“<BR /> <BR />A huge amount of work has gone into the Bill. It is a very large piece of legislation, and, as we know, it is the first of its kind, in bringing together legislation on mental health and mental capacity.”
“While the BPS is disappointed that it did not get that in the Bill, nevertheless it will be working on the development of the code of practice and the regulations. “That was before he went on a rant against Sinn Féin, calling us liars. I resent that and think that he should take back those remarks. Adrian Cochrane-Watson talked about a hokey-cokey Minister. Kieran McCarthy paid tribute to hospital and ambulance staff for their commitment at a time when the DUP is playing games. Jim Allister called what the DUP is doing a "stunt" to buy time and save face. <BR /> <BR />I think that all Members are in agreement that the Minister should come back to work. Well, maybe not all, but most Members. With that in mind, glaoim ar an Aire an ceannaireacht a sholáthar atá de dhíth le haghaidh a thabhairt ar na fadhbanna seo agus le gabháil ar ais ar obair gan mhoill. I call on the Minister to provide the leadership that is required to address these issues and get back to work immediately.”
“<BR /> <BR />To drive the agreed policy forward, we need a cast-iron assurance that the development of service models and workforce planning will reflect the requirement to be joined at the hip with the implementation of TYC. What we do not need is an absent Minister. An rud nach bhfuil de dhíth orainn is é Aire atá ar strae. We need a working Minister, who will deal with the health service problems such as residential homes, domiciliary care, the staff pay review, the shortage of GPs and nursing staff, cancer drugs and many more. <BR /> <BR />Many of the Members who spoke referred to a lot of those issues, and I will mention some of the specific things that people referred to. Fearghal McKinney mentioned the need for a Minister to take the big strategic decisions that I mentioned.”
“I thank the Member for his comments. I agree that it would be a very good thing if someone could take the decisions that are necessary on the pay review and, indeed, on all the other major health issues that are keeping people in distress. That should happen as soon as possible. <BR /> <BR />In 2011, TYC was introduced as the new way forward for the delivery of health services. The shift left was broadly welcomed, with agreement that a move towards more community provision and less dependence on hospitalisation was a good thing. Successive Health Ministers received support from all parties for that policy shift. Four years on, there is little confidence in or evidence of what has been achieved; only a fraction of the promised £83 million has been transferred to TYC initiatives.”
“He must accept that, as Minister, he is the one in ultimate control. All the major decisions are his, and it neither helps nor serves anyone when he decides to resign his post when there are so many stresses in the system.”
“In fact, 40·5% of people were still waiting at the 18-week point. At a time that patients are waiting in pain and trauma, we have no Health Minister. Níl Aire Sláinte againn. Added to that is the impact of delays in receiving treatment for diseases and medical conditions. It is well known that early diagnosis is key when it comes to all forms of cancer and other illnesses, so any delay in seeing a specialist could have devastating effects for some people. It is unacceptable that avoidable premature deaths could be happening as a result of the delays in the health system. <BR /> <BR />Níl mé á rá go bhfuil sé ar chumas an Aire gach rud a athrú. I am not saying that the Minister can change everything, and I know that health is an extremely challenging environment, but it must be tackled.”
“He thinks that it is a good idea to adopt a form of in-and-out political chicanery, which serves only his party political interests and does nothing to alleviate the illness and stresses that are affecting our ailing public. <BR /> <BR />Only last week, Members reported on the shameful record of our Health Department and how it is failing miserably to deal with waiting times. Agus is fiú dúinn cuimhniú air siúd inniu. It is worth reminding ourselves of the figures today. The Minister's target for 2015-16 was that at least 60% of patients would have a first appointment within nine weeks and that no patient would wait longer than 18 weeks, yet, at the end of June this year, we saw that neither the nine-week target nor the 18-week target was achieved. Today, we are debating the absence of a Health Minister, and there are huge concerns around the issue. <BR /> <BR />Our health service is in real crisis. Day and daily, we hear about problems relating to TYC, waiting times, emergency departments, workforce planning, the review of health-sector pay and other areas. At a time when those and, indeed, many other elements of the health service are impacting negatively on our population, the Minister prefers to ignore the pain and anguish of people in our community who suffer daily and who sit at home hoping and praying that the appointment that they so badly need will come their way. What does the Minister think?”

“"Social well-being" is a vague phrase, which could be interpreted very widely or very differently from one person to another, so we must have clarity as to what that will mean in order to take a properly informed view on it. <BR /> <BR />The Bill proposes that a committee may be established as a safeguard to decide how confidential information is processed. I question the use of the word "may" in this case. If a committee is intended to be put in place as a safeguard, why does it appear to be optional rather than obligatory? In conclusion, these questions, and many others that other Members have raised, will need to be addressed as we proceed with the scrutiny of the Bill.”
“There are some concerns around sharing identifiable information without consent, particularly as it would be regarded as permissible to do so if it is believed to be in the public interest. I have difficulty with that and I know that there are difficulties in defining what the public interest actually means. If a person's views are being overridden because of some undefined public interest, I feel that we should have a clear definition of what is meant by that. <BR /> <BR />"Social well-being" is another undefined concept. Again, the Bill uses this phrase without giving a definition. If an individual's personal information is to be used with or without their consent, I believe that it is only reasonable that we have some idea of how it will be used. The Bill states:”

The Bill aims to provide a statutory framework and safeguards so that information relating to the health and social care of individuals may be used for medical or social care purposes without the consent of the people concerned. While there are, no doubt, very good reasons for collating valuable patient information in order to feed into research and where all that can take us for very positive reasons, I would like, nevertheless, to draw attention to a couple of areas of concern that I feel are vague and require more stringent definition. <BR /> <BR />First, I want to refer to the use of the expression "in the public interest".”

“It will reflect on all the relevant questions and on concepts such as safeguards; formal capacity assessments; nominated persons; deprivation of liberty; powers of attorney; appointment of deputies; public guardian; the power of the police to remove a person to a place of safety; and criminal justice issues, like remand to hospital and all the added complex issues that surround all those subjects. <BR /> <BR />I recognise the difficult work that we will face as a Committee, and I look forward to hearing the presentations and listening to all the expert opinions so that we can arrive at the best and most comprehensive legislation for the protection of people in the North. “It has been said that the Mental Health Order 1986 will be amended to cater for under-16s, pending a review of the Children Order 1995. That could take a very long time, and, meanwhile, children may be subject to less favourable regulations, including being formally detained. <BR /> <BR />Bamford also recognised that the Mental Health Order was not fully ECHR compliant. Is gnéithe dáiríre iad seo den Bhille ar chóir scrúdú grinn a dhéanamh orthu lena chinntiú go mbeidh na socruithe is fearr in áit do gach duine — do pháistí agus do dhaoine fásta araon. Those are very serious aspects of the Bill that must be fully scrutinised to ensure that the best possible arrangements are put in place for all people, children and adults alike. <BR /> <BR />As I said, the Ad Hoc Committee has a hugely complex piece of legislation to consider.”
“As I said, those are very weighty decisions, and they are always made simpler when the correct legalities have been put in place. Where no prior arrangement is in place, such matters will fall to the courts to decide on property and financial matters. <BR /> <BR />Where a person's care, treatment or personal welfare are concerned, where no such arrangement is in place, the Bill seeks to place the common law doctrine of necessity on to a statutory footing and, further to that, to provide new safeguards to allow for different types of interventions. <BR /> <BR />There have also been concerns raised about another aspect of the Bill, which is that children under the age of 16 will be excluded from its scope. The worrying aspect of that is that the new safeguards and protections being created will not apply to children.”
“Those are the pertinent questions and matters to which we should be giving serious consideration at a time when we are capable of making such decisions. We should think about people who may be lying in a vegetative state or in a coma and are now unable to communicate, let alone convey their deepest wishes. Those are the circumstances that we need to prepare for in advance. It is very similar to a situation where someone might die without leaving a will and the complications that can arise from that. <BR /> <BR />In some circumstances, there can be the risk of fraud as well. There can also be cases where someone who may not have been the person's choice may be able to step in and apply for power of attorney. So, again, it is about people putting in place arrangements that will lay out how they want their wishes to be carried out.”
“It was shown how life can become extremely complicated when certain circumstances arise, as in the case of a sudden debilitating illness or a serious accident that could result in a person no longer having the capacity to make decisions and where there are no legal provisions in place to cover that. In a very accessible way, the examples flagged the need for all of us to consider our own arrangements and how we would like our wishes to be fulfilled in such circumstances.”
“The main difference is that an EPA covers property and financial affairs, whereas the LPA will be more wide-ranging so as to include matters relating to health treatment and care. <BR /> <BR />In the event of the new legislation taking effect, an EPA will no longer be available, although people who have an existing EPA arrangement can continue with that. It has also been flagged at this stage that the LPA will be more costly and complex than an EPA, so that will be taken into account as well in the consideration. <BR /> <BR />Last week, we had a very interesting presentation from the Law Society, which explained these arrangements by providing human examples of what that can mean.”
“If not, how will it be interpreted legally? Those are the questions that the Committee will seek clarity on as it moves through Committee Stage. <BR /> <BR />In a general sense, the Bill will facilitate people making plans for their future in case a time should arise when they no longer have the capacity to make decisions for themselves. That would include decisions relating to healthcare and treatment, property and finance. Currently, people can avail themselves of making such arrangements through an enduring power of attorney (EPA), which allows for the appointment of a person chosen by an individual to make decisions relating to property and affairs — an arrangement that would continue in the event of loss of mental capacity. The new legislation will seek to replace the existing EPA with lasting powers of attorney (LPA).”
“that they may have. The Committee is exploring the use and implications of the word "merely" in that context: for example, does that word appear in the 2005 Act in England? How is the term "rights" being used here? Does it refer to a person's rights in reference to any particular existing legislation?”
“Initially, the Department thought about dealing with this via separate legislation, but it became clear from the consultation responses that the desire was overwhelmingly in support of having one comprehensive framework, as envisaged by Bamford. <BR /> <BR />This is complex legislation, as we have all said. Throughout Committee Stage, there will be an opportunity for close scrutiny of the clauses to ensure that it fulfils the needs for which it is being created. Even at an early stage, some issues are coming to light. Cause 1, for example, states that whether a person is able to make a decision is not:”
“<BR /> <BR />The Mental Health Order 1986 currently governs decisions relating to mental health issues, and it gives statutory powers to remove and detain people in certain circumstances where assessment and treatment of a mental health disorder is required, whether or not a person has capacity. It is now recognised that this runs contrary to the right to personal autonomy, and so it is clear that reform of the legislation is a positive move forward. The Bill spells out an approach that will join mental capacity and mental health law in one piece of legislation — something that has never been attempted before in any jurisdiction and has been described as groundbreaking.”
“Even at the early outset, the sorts of complexities that will arise out of the Bill are clear. How, for example, do you determine what is reasonable? How do you define that? That is one of the challenges that will arise. What dictates how you come to a decision on another person's best interests? The Bill will throw up various legal questions that will, no doubt, be very interesting to explore. However, they place a very onerous task on those carrying out the scrutiny as these minutiae are all connected to a person, and these decisions will have implications for the health, treatment or personal affairs of that person. We, as a Committee, have an obligation to ensure that we consider all the foreseeable eventualities that could come from this.”
“It would also give protection to those who are within the criminal justice system. <BR /> <BR />Bheadh cosaint ann fosta do na daoine úd atá sa chóras choiriúil. It will seek to improve the current legal framework, which does not have stand-alone mental capacity legislation. Mental capacity issues come under common law here in the North, which provides for an acceptance generally that anyone aged 16 or over has capacity. I welcome the introduction of the Bill. <BR /> <BR />The Ad Hoc Committee has recently begun the task of scrutinising the Mental Capacity Bill, which has arisen out of the Bamford review of 2007, the main recommendation of which called for a single comprehensive legislative framework for the reform of mental health legislation and for the introduction of capacity legislation in the North. The report concluded that that would help reduce the stigma attached to mental health being dealt with in separate legislation. It would also allow for improving the protections for people who lack capacity and find themselves in a situation where they cannot make their own decisions in regard to their health and/or personal circumstances.”

“When the Minister is seeking further funding for marching bands, and I support here in that search, I urge her to consider other musicians, ones who do not belong to that tradition but who nonetheless must be encouraged and supported in their endeavours.”
“The outcomes from the activity of Comhaltas, including the great success of the Fleadh Cheoil 2013 in Derry, are hugely positive and should be afforded a similarly high level of consideration as that given to the marching bands for the positivity that it brings to its own community. <BR /> <BR />While I am here, I would like to mention the Andersonstown school of music in west Belfast, which recently lost its entire funding. That is a great shame, because it provides tuition and support to many disadvantaged young musicians in my local area. I hope to see that funding reinstated also. <BR /> <BR />Mar sin de, tá mé ag moladh gur chóir comhionannas a bheith ann do gach sórt ceoil. Today, I am calling for equality for all musical forms.”
“I imagine that he would not support the view that engaging in offensive behaviour is something that bands should be involved in. <BR /> <BR />Let us look at funding. Since 1995, marching bands have received £4·75 million. In comparison, Comhaltas Ceoltóirí Éireann has received well under £500,000 for the same period. As I said earlier, we need to support all musicians, wherever possible. When Comhaltas Ceoltóirí Éireann gave evidence to the Committee earlier this year, it told us that it supports 6,000 musicians and that its membership of 60,000 ranges in age from eight to 88. It also has a very positive impact on the community.”
“I am not aware of the incident that the Member is speaking about, so I cannot comment on it. <BR /> <BR />I feel that it is important to note that most bands do not involve themselves in that sort of behaviour. Indeed, we have seen examples of very good behaviour by the Bands Forum in Derry, whose members have engaged very positively with other communities and, indeed, participated in the Sinn Féin ard-fheis earlier this year. That type of engagement is extremely positive and respectful, and we should all be seeking to see that replicated across the North, particularly in contentious areas such as north Belfast. <BR /> <BR />The report also references the contribution to the marching band tradition of the world-renowned flautist Sir James Galway. I listened to Sir James's comments in recent days.”
“That must be seriously addressed. <BR /> <BR />It is also important that public money not be used to support any type of activity that is sectarian in nature or that disrespects other communities. A couple of years ago, we witnessed from a band a display of very offensive behaviour outside St Patrick's Church in Belfast. That was a precise example of what should not be happening or be supported by the fund.”
“One of the reports that the Member who has just spoken referred to was the 2011 report published by DCAL. It sought to provide information on the marching band sector and to aid its future development. The report was very wide ranging and informative and acknowledged the very positive impacts that marching bands have on their communities. I acknowledge that. However, it also drew attention to the negativity that is often associated with the sector. In one part, the report specifically states”
“The Minister's statement, I believe, is positive. She reiterates her commitment to providing support for musical instruments for bands. Nonetheless, I support the general thrust of the motion. It is important to note the cultural, artistic and community importance of bands in the North. However, funding for instruments should include all musical forms. We should be encouraging the gamut of musical expression by initiating funding for as many musicians as possible so that the talents of all are nurtured and developed.”

I do not believe that that is valid. <BR /> <BR />When I look at the Minister's words, I see that she said that she intends to bid for additional funds for this valuable scheme in June monitoring and that she understands that the uncertainty will not be welcome for those in marching bands. We can see that over half a million pounds has been awarded under the scheme in the past three years. That shows a real commitment from the Minister.”

“In the North, you cannot get information on their location, which highlights the need for an interactive website so that everybody can access the information at the touch of a button and we can become like Japan and New Zealand in having the most up-to-date and important information to save lives.”
“She paid tribute to the work being pioneered by families and highlighted her responsibility to ensure safety for people in the sporting world. She felt that access was critical in all public places. She highlighted the importance of the community resuscitation strategy and of learning lessons from places like Japan that lead the way. She gave an account of the current situation with defibrillators in her Department and arm's-length bodies, and she stressed the importance of not duplicating any of that work when we create a map-based register. <BR /> <BR />Fearghal McKinney wound on the amendment and talked about New Zealand, where 4,300 defibrillators are publicly available as well as full mapping information and a mobile app.”
“He also highlighted the fact that the GAA, the IFA and rugby all play their part in promoting the use and availability of defibrillators. David Hilditch commended the community resuscitation strategy and the good developmental work that has arisen from that. He also highlighted the need for training in the use of defibrillators. Dominic Bradley talked about the tragic death of another local person, Mary Mooney. He found it inspiring that the family has been involved in very positive work. It is often the case that, out of these tragic circumstances, there are inspirational examples of leadership in our communities and issues such as this being highlighted. <BR /> <BR />The Minister fully supported the motion and the amendment. She was delighted that there was cross-party support.”
“He also said that no Department had yet taken the lead but he looked forward to hearing the Minister's comments. <BR /> <BR />Leslie Cree highlighted an initiative to create a generation of lifesavers. Anna Lo highlighted the number of people suffering cardiac arrest, the Defibs4kids campaign and the high number of schools that have installed defibrillators as a result. Gordon Dunne commended the many local organisations and charities that have taken initiatives in this regard and highlighted the need to ensure that defibrillators not only were available but were regularly maintained. Barry McElduff talked about the Cormac Trust, which was started by the family of Cormac McAnallen after his tragic death in 2004.”
“<BR /> <BR />Oliver McMullan talked about the first responders scheme in the glens, where he comes from, and the importance of the Ambulance Service knowing where defibrillators are located. That highlights the need for mapping. It is as vital as having fire extinguishers available. Karen McKevitt talked about this being a good opportunity for businesses and the work that she does in her constituency with local people and local councils. She mentioned the Páirc Esler case, where the life of a local referee was saved by the use of a defibrillator — sorry, I cannot say that very well. Nelson McCausland, speaking as Chair of the Committee, mentioned a recent presentation that Defibs4kids gave to the Committee and pointed out that schools can access defibrillators at a reduced cost.”
“<BR /> <BR />I pay tribute to the Ambulance Service and its excellent work. It is important that we support that. The first responder scheme is an excellent part of the support that the Ambulance Service needs, and we should all support it. It is also worth highlighting the case of Lynda Donaldson, who took a heart attack on the street.
