In the previous session of Parliament, the Social Justice and Social Security Committee engaged widely with the third sector, including on the funding arrangements that such organisations require if they are to carry out their vital roles as best as possible. I remember one person mentioning that, particularly during the Covid lockdown period, committee members should watch our language. They said that, rather than calling that body of organisations the “third sector”, we should call it the “essential sector”.

  2. Last year, East Kilbride Citizens Advice Bureau assisted more than 2,500 people in obtaining around £800,000. Healthy and Active East Kilbride is dedicated to enhancing the lives of local people. It runs the shopmobility scheme in the town centre and its meeting place cafe provides a nice space for people to socialise and enjoy food and drink. Using an electric minibus funded by the Scottish Government, Healthy and Active also offers community transport. Just like Loaves and Fishes, the charity works holistically, by providing classes and drop-in sessions to support people in East Kilbride. Third sector organisations work on the ground every day and possess a wealth of expertise. They can identify barriers before they become apparent elsewhere.

Loaves and Fishes was set up more than 30 years ago and initially offered a street meals service. The charity, which is led by Lesley Davidson, has since evolved and now provides more than 250 food parcels a week, including fresh and frozen produce. It also runs a community cafe with computer facilities in Greenhills. In addition, people can use its clothes and dishes section, where they can access clothes and household goods without paying money for them. Citizens Advice Scotland is another organisation that is working hard to support local people.

  4. Before I turn to the substance of the debate, I want to take a moment to say how proud I am to once again represent the wonderful people of East Kilbride in the Scottish Parliament. It is perhaps fitting that one of my first speeches of the new session is on the subject of Scotland’s partnership with the third sector, because East Kilbride is home to countless organisations, volunteers and community groups whose dedication strengthens our town every single day. Scotland’s third sector is essential to the wellbeing of our communities. There are great charities that work at the national level to deliver services and tackle poverty and inequality in alignment with Scottish Government priorities.

I commend three business owners—I had better not name them, because they have not given me permission to do so—who have worked tirelessly with me over the past few months to present practical ways that we can change the bill to help them. One of those suggestions related to the fact that it is quite an administrative burden to collect the levy, fill in acres of paperwork and submit it to the authority. The easiest thing to do, with the technology that we have in this day and age, would be to have the visitor pay the levy directly to the local authority, perhaps through a platform. I am not asking for that to be changed right now, and I do not propose that in amendment 33. All that I am saying is that, as part of a review, the Government could consider whether that might be a feasible option in future.

  13. I thought that I would be reasonable and lodge just three. I have lost on two of my very reasonable amendments, but I hope that I will not lose on amendment 33. For, I think, the second time, the minister has said that we cannot go back and open up the 2024 act. However, as Murdo Fraser pointed out, we are opening it up, because of mistakes that the Government made originally. It is only fair to point out again that we are having this debate only because the Conservatives went to the Scottish National Party and said that we would work with it on the bill to help to fix the problems. Amendment 33 is an easy one for the SNP to get behind. When the 2024 act first went through, there was a lot of concern in the Highlands and Islands from the business community.

  14. Amendment 33, in the name of Tim Eagle, would require a report on a review of the operation of the 2024 act to set out an assessment of whether the levy should be paid to the relevant local authority by visitors rather than by accommodation providers. The act makes accommodation providers liable for payment of the levy and the liability is enforced on that basis. The model that is set out in the act was agreed to by Parliament after extensive consultation and engagement. The bill seeks to enhance the act’s operation and not to reopen its basic principles, which amendment 33 seeks to do. Therefore, I ask Tim Eagle not to move the amendment and, if it is moved, I ask members to reject it. I move amendment 13. Tim Eagle: On Willie Rennie’s advice, I did not lodge hundreds of amendments to the bill, which I was going to do.

  15. Amendment 32 disagreed to. Section 5A—Reporting on impact on tourism in rural areas The Deputy Presiding Officer: Group 6 is on reporting on the operation of the act. Amendment 13, in the name of the minister, is grouped with amendment 33. Ivan McKee: At stage 2, I supported an amendment that was lodged by Tim Eagle that will require ministers, when reviewing the 2024 act, to consider the impact of visitor levy schemes that were introduced under that act on tourism in rural areas of Scotland. Amendment 13, which is in my name, will adjust that requirement to remove a redundant reference and avoid repetition.

Motion, as amended, agreed to, That the Parliament condemns the culture of secrecy and cover-up that has hidden the truth from patients, families and campaigners and denied them justice in many NHS scandals in Scotland in recent years; recognises that, as the Scottish Hospitals Inquiry draws to a close, many serious questions remain regarding the decision-making process and the role of the Scottish Government; considers that political decision making should be considered by the inquiry, and calls for the Scottish Ministers to authorise the immediate full disclosure and preservation of all communications connected to the contaminated water and inadequate ventilation system and the premature opening of the Queen Elizabeth University Hospital, as well as any subsequent communications relating to the handling of the infection and its cover-up; acknowledges that recent revelations surrounding the Queen Elizabeth University Hospital will have been distressing for patients, their families and staff; understands that this could create uncertainty and fear regarding the safety of Scotland’s hospitals and negatively impact staff morale; recognises that patient privacy has to be given the greatest consideration in the publication of any materials, and calls for the Scottish Government to outline how it will urgently restore confidence into the services delivered by NHS Greater Glasgow and Clyde.

  47. During our scrutiny of the bill, we received suggestions for improving the NPF and the national outcomes. Witnesses told us that there needs to be a more effective way for public bodies to demonstrate compliance, so that it is not a tick- box exercise. We asked the Scottish Government to take into consideration, as part of its review, the evidence that we received. I welcome the minister’s confirmation that the review will focus on areas that are identified in our report, such as strengthening accountability and oversight mechanisms, alignment with the United Nations sustainable development goals and consideration of the investment that is required to improve the embedding of wellbeing and sustainable development to achieve policy coherence across public bodies.

For example, I discussed with the Auditor General that overlap and a waste of public money can be avoided by having constructive conversations at the start, just as took place in the case of the Welsh commissioner. Collette Stevenson: On the issue of overlap, I hope that the evidence from the Scottish Parliamentary Corporate Body will feed back into the Scottish Government’s review of the national performance framework, future development and sustainability. The Scottish Government told the committee that its review of the national performance framework and the national outcomes provides an opportunity to achieve the policy objectives of the bill. Given the timing of the review coinciding with the introduction of the bill, it was not possible for the committee to come to a view on that.

The intention is for the commissioner to champion the issues underpinning the bill, ensure its successful implementation and build policy coherence for sustainable development throughout Scotland’s public sector. The committee does not disagree with the need for effective oversight to ensure implementation of the bill’s provisions. However, issues were raised in evidence about the overlap of the commissioner’s remit with the remits of existing commissioners and oversight bodies. Compared to other options, the cost of that approach and that of establishing a commissioner do not meet the criteria agreed by Parliament. Sarah Boyack: Does the member accept that it would be possible to establish memorandums of understanding with existing commissioners so that there is no overlap?

However, a key concern was the potential for the new duty to duplicate rather than complement existing public sector duties—in particular, the duty to have regard to the national outcomes in the Community Empowerment (Scotland) Act 2015. We asked the Scottish Government to be open to amending legislation by exploring what could be achieved by strengthening the duties in the 2015 act. The minister indicated in his response that the focus at the moment is on improving implementation of the duty. However, the Scottish Government is open to considering legislative improvements or changes in future. That is very much welcome. The bill would establish a future generations commissioner for Scotland.
