“Alexander Stewart is also well aware—because we met, I think, just last week—of the importance of the work that I undertake on behalf of the Government on child poverty as well as on the third sector. I discussed with him the importance of the process that we are about to embark on for our next Scottish Government budget. He makes a number of requests for the Scottish Government to deliver higher funding for the third sector. I look forward to working with him when he brings forward costed proposals for, I presume, not just my portfolio but other portfolios, given that the third sector covers every part of Government and, therefore, every portfolio. When I receive a costed proposal, which I am sure will arrive on my desk during the budgetary discussions, I look forward to getting into that detail with him.”
“Alexander Stewart: A joint letter from 240 charities, including the Scottish Huntington’s Association, not only highlights why there are so many alarming closures but sets out some solutions—an immediate cash injection, a medium-term recovery plan and a commitment for multiyear funding, with uplifts that reflect inflation. Will the cabinet secretary commit to implementing those measures? Does she accept that those organisations will otherwise face an uncertain future? Shirley-Anne Somerville: The exact reason why I have had the many discussions that I have had—most recently the round-table discussion that I mentioned—is so that we can talk about what the Government could do.”
“I held a round-table meeting with third sector representatives during the summer so that we could talk about the challenges that they face—in the short, medium and long term—and work together to devise solutions. Some of those solutions will be in the gift of the Scottish Government and others will lie elsewhere, but, as I said at that round table, I am committed to working with the SCVO and others from the third sector to find a way through their challenges. Alexander Stewart is quite right to point out that, for many in the third sector, demand for their services is increasing. That points to the important role that they play, and that is exactly why the Scottish Government is determined to work with them to ensure that we can support the third sector in everything that it does.”
“Alexander Stewart: State funding has gone down by 5 per cent since 2021, at a cost of about £177 million. The rise in employer national insurance contributions has cost the sector £78 million. At a time when demand for support from the voluntary sector is rising, it is unsustainable to expect the voluntary sector to fund the shortfall. Taking this essential sector for granted will be devastating for families and communities across Scotland. Will the Government commit to providing the funding that is necessary to support those charities, which are lifelines for families and communities across the whole of Scotland? Shirley-Anne Somerville: I agree with some of Alexander Stewart’s points about the important work that the third sector does across Scotland, and in all our communities, on a variety of issues.”
“The third sector plays a vital role in supporting communities across Scotland, and we recognise the pressures that it is facing. We are committed to fairer funding and we have launched a multiyear funding pilot that is worth £130 million over 2025-27, which builds on areas where multiyear funding was already established. All arms of Government have a responsibility to ensure the sustainability of the sector. We continue to work constructively within the Scottish Government with the Scottish Council for Voluntary Organisations, and we will carefully consider its proposals. We also continue to press the United Kingdom Government to reconsider its decision to increase employer national insurance contributions for the third sector and for recompense following those changes.”

“Will the minister be finding out whether any of those organisations are based here in Scotland? Will she and the Government issue a directive to public bodies to follow the law by the end of the year at the latest? Shirley-Anne Somerville: As I have made clear to the chamber on a number of occasions, the Scottish Government accepts the Supreme Court judgment, and action is being taken. As well as accepting that judgment, we are moving forward with the detailed work that is necessary as a consequence. I have spoken in detail previously on the working group that is considering that work right across Government. We are not aware of how many of the 19 bodies are in Scotland—that is a matter for the EHRC. We have been clear to public bodies in Scotland that we expect all bodies to follow lawful practice.”
“The EHRC has not published the details of, or otherwise informed the Scottish Government about, the 19 organisations that it has written to following its review of evidence from the United Kingdom Government on single-sex-space policies. The review process is a matter for the EHRC in fulfilling its statutory- function role to monitor and enforce compliance with the 2010 act. Tess White: The Scottish National Party Government has let public bodies break the law, betray women and burn public money. It is defending the indefensible, and that is absolutely shameful. The EHRC has reprimanded 19 organisations for misrepresenting the 2010 act, yet the SNP Government is still peddling guidance that promotes self-identification to schools and prisons. Public bodies are completely at sea because the SNP puts ideology before women’s rights.”
“I appreciate that, when the member and the Scottish Conservatives are preparing a press release, they want to go for the percentage figure, but if we genuinely want to talk about how to get the right decision first time round, it is important that we have a sensible conversation about the fact that, strangely enough, as a benefit goes from being rolled out in three council areas to 32, the number of applications—and, therefore, the number of redeterminations—will go up. That is why it is important that we look at the proportion of redeterminations overall, which is still exceptionally small. As I said in my earlier answer, the absolute figure remains small. That is the important aspect in getting perspective on and context around the matter, rather than going for a cheap headline.”
“Since April 2025, the benefit has been extended to 14 more councils, including Edinburgh, North Lanarkshire, South Lanarkshire, Glasgow, Renfrewshire and West Lothian, which are some of our largest council areas. Given the rapid expansion in eligibility, does the cabinet secretary anticipate further increases in self-determinations? How does she expect that to affect the time that it takes to process applications across the system? Could we see significant delays as a result? Shirley-Anne Somerville: No, we will not see significant delays, because processing times are being kept under close review. That is very different from what happens with a redetermination, which is, I think, what Jamie Halcro Johnston meant in his question.”
“Social Security Scotland’s priority is to make the right decision on applications first time and to do so as quickly as possible. As it is a new benefit, pension age disability payment application volumes are still increasing, but the number of redeterminations has remained low since the launch of the benefit in October 2024. Out of 2,575 processed applications for pension age disability payment, only 45 redeterminations had been requested up to 30 April 2025. Jamie Halcro Johnston: The figure that the cabinet secretary was looking for was a 221 per cent increase. Although that represents a small number of actual cases, it also largely covers the short trial period before the wider roll-out of pension age disability payments.”
“And when we allow fear to shape our response, we do not become safer. We become smaller.” I move amendment S6M-18780.3, to leave out from “acknowledges” to end and insert: “reaffirms individuals’ rights to asylum under international law, including the 1951 Refugee Convention and 1967 Protocol; upholds the European Convention on Human Rights, and highlights Scotland’s place in the world as a welcoming nation to those fleeing persecution, conflict or danger.” 16:15”
“If an independent Scotland had a similar problem of illegal immigration, how would she tackle it? Shirley-Anne Somerville: Of course, every country needs an asylum policy, but we would not allow a backlog of claims to build up, and we would not have a system that did not allow migration into our country at times when we wanted people to come into our country. We would be responsible, morally and economically. I ask the chamber to join me in rejecting divisive, dehumanising rhetoric in favour of delivering our moral and legal duties of protection and building a strong and resilient community. I leave the chamber with the words of Sabir Zazai from the Scottish Refugee Council, who is himself a refugee. Talking about refugees, he says: “To live in fear is not a choice. It is a condition forced upon them.”
“We were disappointed that UK Government ministers did not join us at that meeting, at which we collectively discussed what could be done to tackle the pressures, within our own responsibilities. In the face of Russian aggression, we stood with the people of Ukraine, helping more than 28,000 people to flee war. That approach was supported across the chamber. I wonder what the difference is that makes some people think that we should not support people who flee war, persecution and abuse when they come from other countries. Craig Hoy: Will the cabinet secretary take an intervention? Shirley-Anne Somerville: I am quite happy to take an intervention from Craig Hoy on that point. Craig Hoy: In the previous debate, many of the cabinet secretary’s colleagues talked about what an independent Scotland would look like.”
“Newly recognised refugees are entitled to housing support and other benefits, but we have long argued that 28 days is not sufficient time to enable them to make those arrangements. Indeed, that is a position that is also held by the British Red Cross. Of course, the UK Government’s policy of restricting people seeking asylum from working can also make finding a job extremely difficult once a decision has been made. The Scottish Government recognises that Glasgow City Council in particular has come under significant pressure as a result of UK Government decision making, and I have repeatedly called on Home Office ministers to meet me alongside Glasgow City Council. Indeed, in April, the Scottish Refugee Council invited me to attend a round-table meeting, along with the council and the UK Government.”
“Over the past year, attempts by the current UK Government to speed up decision making and clear that backlog have resulted in a larger-than-expected number of newly recognised refugees seeking support from local authorities. The wording is important: we speak of newly recognised refugees who have gone through the process, not illegal immigrants or migrants. That is where the danger is in the policies that we are seeing. I am disappointed that the UK Government has not been able to work with the Scottish Government and councils on the pressures in the current system. The situation has been further exacerbated by the recent reduction in the time that people seeking asylum are given to move on from asylum accommodation after receiving a positive decision on their asylum claim—again, that means that they are not an illegal asylum seeker.”
“Successive generations of refugee communities have contributed to Scotland’s economy and society. We should not now turn our backs on those who need our protection in response to those who seek to cause division and fuel tensions. Asylum is a reserved issue. The UK Government is responsible for asylum decision making and the provision of asylum accommodation. The Scottish Government has repeatedly raised concerns about the impact of UK asylum policy on Scottish local authorities, devolved public services and people living in our communities. As Kaukab Stewart pointed out, it was the previous Conservative UK Government that introduced asylum hotels and caused a processing backlog in the UK asylum system.”
“Our words matter in this debate. They matter to the communities that we serve and those who seek our protection. Therefore, my message is clear: we must ensure that Scotland continues to be a welcoming nation to those fleeing persecution, conflict or danger. The UK has a moral and international legal obligation to uphold the 1951 United Nations Convention relating to the Status of Refugees and the supporting 1967 protocol. Indeed, the UK was a founding signatory to the convention, which defines the term refugee and outlines the legal protection, rights and assistance that a refugee is entitled to receive. According to international law, everyone who satisfies that definition in the convention is a refugee. Scotland has a long history of being a welcoming nation where refugees have been able to rebuild their lives.”
“I move, That the Parliament acknowledges that the current number of asylum seekers accommodated in Scotland’s local authority areas is becoming financially “unsustainable” for them, as confirmed by the Scottish National Party leader of Glasgow City Council; believes that asylum seekers should never have originally been accommodated in taxpayer-funded hotels; calls for the closure of all asylum hotels across Scotland as soon as possible, and rejects the Scottish Government’s position outlined in its response to the UK Government’s immigration white paper, which would see a further increase in the number of asylum seekers coming to Scotland. 16:10”
“The Deputy Presiding Officer: You need to conclude, Mr Hoy. Craig Hoy: It is not a debate that any of us relish, but it is one that our constituents, regardless of the party that we represent, want us to have.”
“In August 2020, 188 asylum seekers were housed in hotels and bed and breakfasts in Scotland. Today, that figure stands at more than 1,500. The previous Conservative Administration committed to end the use of hotels but, sadly, the Labour Government has comprehensively failed to do so. Stuart McMillan: Will the member take an intervention? Craig Hoy: No, I do not have time. It is unfair and wrong that we are still spending millions of pounds every day providing hotels to asylum seekers and illegal immigrants. The Deputy Presiding Officer: You need to conclude. Craig Hoy: The communities that I speak to want action from their Governments. They understand that Britain should be a place to live, work, flourish, and put down roots, but it should not be a hotel for those who have entered the country illegally.”
“Scots are seeing their services undermined and their life chances blighted. In 2023-24, there were 40,685 applications for homelessness and 33,619 households were assessed as homeless or threatened with homelessness in Scotland. Across the country, people will be concerned, understandably, when they see priority being given to those who are coming from overseas. Housing asylum seekers in hotels is not the solution to the problem. Tackling the causes of illegal immigration and processing those who are seeking to come to the UK at source is, in effect, the only way to fix it. As I said last week, the use of asylum hotels has changed our communities and, in their view, not for the better. Five years after the emergency use of hotels during the pandemic, the numbers have soared.”

Now, we have to admit that it was the wrong policy, even if it was well intentioned. We also have to recognise that things are now much worse as a result of Labour’s failure to tackle the mounting immigration crisis. Rather than stopping the boats, Keir Starmer and Labour have allowed their numbers to swell. They systematically took apart the deterrent schemes that were put in place by the previous Conservative Administration. In the year to June, Labour presided over a 17 per cent increase in asylum applications compared with the previous year. Beyond those numbers, the picture is even more alarming because of the SNP’s open door rhetoric, which is adding to the pressures.”
“It is important that we look at how we can best make use of existing stock through our work on voids in the social rented sector and on empty properties in the private sector, which is exactly why additional funding has been going in. The work that the Cabinet Secretary for Housing announced last week clearly builds on the work that has already been undertaken on acquisitions, empty homes and voids to ensure that we are delivering for local authorities and registered social landlords to support them in providing good affordable homes.”
“The use of B and Bs and hostels for homeless children should end immediately. Will the cabinet secretary commit to ending the scandal of children in B and B and hostel accommodation entirely, as a priority of the Government? Shirley-Anne Somerville: We are working hard with our local authority partners to ensure that families with children, in particular, although not solely families with children, are accommodated correctly. For example, 2,700 households with children have been assisted into affordable housing since December 2024. That is part of the work that the Government has been doing in our delivery of 139,000 homes, including 99,000 for social rent, since 2007.”
“Although this is an issue throughout Scotland, we are seeing progress in many local authorities. Mark Griffin: I thank the cabinet secretary for her response and acknowledge the action that has been outlined today and was outlined in the chamber last week by the Cabinet Secretary for Housing. However, the housing crisis has not appeared overnight; it has been nearly 18 months since the Government declared a housing emergency, and yet since then, record numbers of children have been placed in temporary accommodation, often in the most appalling and unsafe conditions. Council workers report that they have seen very little change in the Government’s approach since the declaration. On last week’s statement, it is not enough to say that we can help a few hundred children.”
“It has been good to see that positive progress has been made in a number of local authorities, including Aberdeenshire, East Ayrshire, East Lothian and South Ayrshire councils, all of which have consistently seen decreases in the number of homelessness applications and in the use of temporary accommodation. Funding is provided by the Scottish Government to local authorities, including through the general grant, and it is important to recognise the work that is undertaken through that funding, which looks in particular at preventative methods. I have mentioned some of the additional funding that we will be providing this year, but there is also the work that we do to provide support to councils, particularly—but not solely—Glasgow and Edinburgh councils, which have been considerably affected by the increased pressures.”

Given that almost 4,000 homelessness applications were made in Edinburgh alone last year, does the cabinet secretary agree that councils should be able to spend their limited funds on preventing homelessness, instead of on firefighting the effects of a housing emergency? How does the Scottish Government plan to support local authorities to cover the increased cost, which is up 128 per cent since 2020-21? Shirley-Anne Somerville: I thank Mark Griffin for his question, because it is important that we focus on what can be done at Scottish Government, local government and United Kingdom Government levels to tackle the unacceptable numbers of people—children, in particular—who are in temporary accommodation.”
“The Scottish Government’s ambition is to prevent homelessness as part of our Housing (Scotland) Bill, and for every homeless household to have a settled home that meets their needs. The solution is to deliver more homes and to make better use of the homes that we have. Last week, the Cabinet Secretary for Housing set out plans to invest up to £4.9 billion in affordable homes over the next four years. We are doubling the funding that is available for acquisitions to £80 million this year so that councils and housing associations can purchase properties for those households who are spending too long in temporary accommodation. We will also invest an additional £4 million this year to expand the delivery of housing first tenancies.”

“The Scottish Government did not see the full provisions of the bill until it was introduced on 22 January 2025, which meant that normal timeframes for lodging this legislative consent memorandum could not be met. As a result, and due to the on-going engagement that is still required to understand where the bill and its numerous amendments will impact on Scotland, I confirm that there will be a requirement to lodge a supplementary LCM for the bill in due course. I will, at that time, be happy to provide a fuller update on the overpayment recovery provisions as part of that supplementary LCM.”
“I fully recognise the duty of Governments to ensure that overpayments are recovered, wherever it is reasonable to do so, but that cannot be at the expense of our values and ethos. As I confirmed to the Social Justice and Social Security Committee, I have concluded that it would not be appropriate to recommend consent for the overpayment recovery provisions. Those provisions allow for the direct recovery from bank accounts with no need for a court order and for the potential suspension of driving licences. No such provisions exist within the devolved system, and I do not consider them compatible with the ethos of fairness, dignity and respect. I have confirmed that position in writing to UK ministers, who have confirmed that they will seek to amend the bill such that devolved benefits are removed from the scope of those provisions.”
“It will be of reassurance to the Parliament today, I hope, to know that the UK Government has confirmed in writing that there is no intention to include devolved benefits within the scope of that measure, now or in the future. On changes to administrative penalties, there is no equivalent to administrative penalties within the devolved system, so I am therefore content to recommend consent. Overpayment recovery is an important aspect of the bill. Although the provisions on that were referred to in the memorandum accompanying the motion, the Scottish Government did not take a position on consent. That was to allow for due consideration of the impact of those provisions on Scottish clients and for on-going discussions with the UK Government.”
