“The review should also aspire to create a system that is easier to access. The new entrants will be the life-blood of crofting’s future, and we need to pave the way for new faces by levelling out the market in croft tenancies and simplifying the legislation so that it is clearer and more coherent for those who are not yet part of the crofting community. There was an opportunity to create rapid positive change in part 2 of the bill. We pushed the Government to consider giving the Scottish Land Court further environmental jurisdiction, with a view to using it as a foundation for an environmental court. For too long, Scotland has been in breach of its Aarhus convention obligations, with little meaningful movement by successive Governments to rectify the situation.”

I look forward to working with the Government to create something that will allow crofting to flourish and expand. There are a multitude of challenges ahead that crofters will need support with so that they can adapt and thrive. For example, the 2045 net zero target is edging ever closer, and we also have the good food nation commitments to consider. The job of the Scottish Government in both instances is to prepare the ground for crofters and enable them to make the most of the opportunities that these present. We are moving in the right direction, but more haste is needed, given the severity of the challenges that are on the horizon.”

Scotland wants and expects us to make things happen. By all means campaign for more powers—I accept that—but, when it comes to delivery, we should remember the old French proverb that it is bad workmen who blame their tools. I would like to give three pieces of advice to those who will come here in the next session of Parliament. The first is to be kind. Members should remember that, when they come to work in this building, their job is important and they are less so.”
“We need to put party politics to one side, because we must remember that we all came here for one reason, which is to make Scotland a better place. Therefore, we have no differences except in the way that we deliver a better Scotland. I wish that we could work more across the Parliament to make that happen. I have found convening committees in the Parliament for nearly 10 years to be interesting. I absolutely respect the committee system, but it is truly broken. All but a few of the committees have Government majorities that can be whipped to get legislation through. That is not suitable, and it is the root cause of framework and bad legislation. I wish that we could find a way to make committees work more as a revising chamber than they do at the moment.”
“I have found the formulaic nature of the Parliament to be quite difficult and stifling. Everything that we do follows procedures and timings. For me, four-minute speeches kill debate and prove only that the person who is giving the speech can read. Pre- supplied questions to the Government demonstrate the power of good briefings as well as good reading skills. The never-ending creep of partisan party control is also deeply unhelpful. We should all resent parties choosing who gets supplementary questions and who gets to speak in debates. I wish that the Presiding Officer could make those decisions and call on the person who has the knowledge and the experience. I strongly believe that we need less party dominance and more individuality.”
“As this will be my last speech in the Parliament, I hope that the minister will excuse me if I touch only briefly on the Crofting and Scottish Land Court Bill. It is nothing like what we were promised in 2016. I agree with the minister that crofting needs a simpler future to secure our heritage, our rural population and our national language. Like him, I hope that the bill is just an appetiser and a step towards a future bill. I am sure that he and many other members of the Parliament will be pleased that I will not be here to lodge one or two amendments—if I were here, he could guarantee that I would do so. I will take some time to offer some comments on my experiences, having had the privilege of being a member of the Highlands and Islands MSP group for the past 10 years.”
“With respect, I find that answer to my question to be troubling, because it is clear that the NZET Committee called for drop-in fuels— not just biofuels but a combination of fuels to allow diesel vehicles to continue to work. I find it difficult to understand why the cabinet secretary does not understand that, given that it was a recommendation in our report. Is there a way in which I can get an answer to my question? At the moment, I have not had one. The Presiding Officer: Thank you, Mr Mountain. That was not a point of order, but the cabinet secretary has heard your comments and has offered to be in touch with you on that issue.”

We have boosted the monitoring and evaluation approach in the final plan and have set out greater detail on the methodology. The committee of which Edward Mountain is convener asked for more information on the co- benefits in the plan, and we have given an awful lot more detail on what can be delivered. However, on his substantive question on fuels—it might have been about biofuels—I will have to pick that up with him later, because I did not quite hear what he was asking. Edward Mountain: On a point of order, Presiding Officer.”
“Finally, we have the climate change plan, on the penultimate sitting day of the parliamentary session. In the 40 minutes that we have had to look at it—let me be clear that I have always called for that period to be much longer—I have found no clear synopsis of the changes from the draft plan to the final plan. I expected that to be in a few pages in annex 4. The Net Zero, Energy and Transport Committee said that the targets for changing heavy goods vehicles to electric HGVs were unachievable. The committee called for drop-in fuels. Is that in the plan? Gillian Martin: I do not understand. I have to be honest and say that I did not catch the end of Edward Mountain’s question about drop-in fuels. I will need to consult him afterwards about what he meant.”
“The reason that I was pushing for such a review is that 1,078 common grazings in Scotland, which cover more than 500,000 hectares, are recorded in the register of crofts. Of those, only 461—fewer than half—have common grazing committees in place. Considering the amount of land involved, and the significance of crofting in reaching net zero, which will be a high priority for the next Parliament, it is important that we utilise common grazings and that crofters benefit from them, to the extent that they can, and that the country benefits from them, too. I will say no more, except that I will not move amendment 48 or amendment 49, and that I would appreciate the support of the Government on amendment 50.”
“I thank the minister for taking the time to meet me and trying to find compromise. Sometimes that is not possible, but he tried very hard on this, and for that I am grateful. In relation to common grazings, I am sad that we have not resolved the issue of what are often called slipper crofters. There are real issues where crofters have moved away and sold their shares in the common grazings to people who are no longer part of the crofting community. I lodged my amendments 48 to 50 to encourage ministers to commit to a review of the operation of common grazings. I wanted such a consultation to be undertaken within three years; the minister wanted the time period to be much longer, although no figure was put on that; and he has compromised by making it five years, which is fair.”
“Until we do, I am afraid that I cannot support the offering of assisted death; to me, that is morally wrong if we cannot allow for an assisted life. 18:48”
“I will turn to the area of the bill that gives me the greatest concern: coercion, including self- coercion. I find that a really difficult area to discuss. When one’s grip on life is fragile, the mind does somersaults. However, once someone gets past thinking that it might be easier and kinder to their family to die, the overriding consideration will turn to living. Treatment options and pathways for care are, rightly, the top priorities. However, the bill would give doctors the right, in terminal cases, to say, “Death is available.” I believe that the last thing that we should do is suggest that ending life is a form of treatment. Presiding Officer, when we despair we need hope. Death offers no hope. Treatment and care offer hope. Let us provide and fund that care before we legislate to end life.”
“It is just not good enough to say, “Pass this bill, and then we’ll work out how we’re going to pay for it.” We need clarity now. On clarity, if the bill is passed, what will happen to those who want to opt out of providing an assisted death—from doctors to nurses to care homes to palliative care homes? Many of those, like me, will have no religious drivers but will know in their hearts that they do not want to be part of the process. The part of the bill that would have protected conscientious objectors has been removed, in order to make the bill competent. That worries me. Civil servants and ministers at Westminster will be able to decide on how to protect Scots in what is specifically a Scottish bill. Here, in our Parliament, there will be no choice on the exact detail. That not only seems wrong but is wrong.”
“Thus, to some, it may be easier to opt for death, knowing that palliative care close to their home and family is unavailable. That is not a choice. Before we consider helping those people to die, we must know that their end of life is fully provided for and funded—which, at the moment, it is not. Funding is a key issue when it comes to the bill. We know that funding for it would come from the existing national health service budget. The Government has been clear that it has no idea of the costs, but it admits that they would be high, and it says that a level of reprioritisation would be required. That means that existing services would face funding cuts. Which treatments would be cut? Would they include cancer care, palliative care, elective surgery, or perhaps even screening for breast or bowel cancers?”
“We have finally reached the last stage of the Assisted Dying for Terminally Ill Adults (Scotland) Bill. I am sure that, for many, it has been a long and uncomfortable journey. We have all had to consider our own mortality and that of our constituents. Looking death in the eye has never been easy, and we must always consider the fragility of life. However, let us be clear: in my mind, life is always about living. I have heard much in the debate about why people should have the choice. In principle, I agree. However, choice can be made only if there are genuine options. Those options must include palliative care, for which my colleague Miles Briggs has fought hard. However, the sad fact is that more than 14,000 Scots a year die without proper palliative care, and a lot of money would be needed to provide that.”
“Something has to give, because that is not how palliative care funding works. Liam McArthur: That is a helpful intervention from Bob Doris. However, for the reasons that the cabinet secretary set out about the way in which amendment 256 interferes with the responsibilities of integration joint boards, I do not believe that it represents the correct approach. That is not to say that I do not accept that steps need to be taken, but other amendments in the group address the issue more effectively. Jackie Dunbar: Does Liam McArthur agree that this parliamentary session has seen the biggest uplift for palliative care funding since the time of the Assisted Suicide (Scotland) Bill in 2015 and that your bill has put palliative care back on the agenda in a way that has not been the case in more than a decade?”
“The bill says that the code of practice must make provision about “how existing and future statutory funding streams intended to support the delivery of palliative and end of life care services can be differentiated to ensure assistance provided in accordance with this Act is not funded at the expense of existing palliative and end of life care services” —I am sorry for speedreading that, Presiding Officer. The point that I want to make to Mr McArthur is that, although the money that flows through integration joint boards might be statutory funding, it is not ring fenced for palliative care. Decisions on prioritisation are made daily, weekly and monthly, so we need something in the bill that recognises that—I acknowledge that Jackie Baillie’s amendment might bring in as yet unknown provisions.”
“As the Health and Social Care Committee of the House of Commons concluded after an extensive inquiry over 14 months, in those other jurisdictions that brought in assisted dying, there was not only additional investment in palliative care—of course, that is a decision for Parliaments, and each political party going into the election will have options regarding the prospectus that it puts before the electorate—but also improved engagement with palliative care services, which was driven by the fact that the conversations that are required through that process open up a better understanding of what the palliative care choices might be in relation to each individual case. Bob Doris: I appreciate the concerns of colleagues about this section.”
“I wonder whether the member sees the problems that many of us have with regard to money for palliative care being moved aside if this bill is passed. That is deeply difficult for many of us to understand. Not having proper palliative care would, I feel, be a form of coercion with regard to assisted dying. Liam McArthur: I say to Mr Mountain that, as I have been clear throughout this process, it is not a question of either/or. We need to invest in good palliative care to improve access to it where it does not exist and to improve the palliative care itself where that might be needed. However, we also need the choice of assisted dying for those who are dying horrendous deaths, often beyond the reach of good palliative care.”

“She wanted to live. She would not have wanted a doctor to have raised with her the option of assisted dying at any stage during those six months. However, on her final day, when she knew that she was not going to go any further, she asked the doctor what the prognosis was. It was right that the doctor told her, and it would have been right, if the bill had been passed, for the doctor to have given her options. However, that is such a difficult thing to do. I do not envy members making this decision, but we should be very careful to ensure that, when we decide when the right time is for a doctor to tell a patient about their options, it is the right time for the patient, not the right time for the bill, for the doctor or for anyone else. We cannot remove hope from the patient when we do that.”
“At that stage, you look for treatment options, and it is those treatment options that give you the confidence to go forward. Therefore, that is not the time—it never will be the time—to raise the issue of assisted dying. The question is how we can legislate for that. Every time you go into hospital—I have been in a few recently—you are told about all the risks that you will face. You are told, “You could get a blood clot,” “You could get this,” or, “You could get that.” You are given options. I did not want, at that stage, to be given assisted dying as one of my options. Actually, it would not have been relevant to me, but if it had been relevant, I would not have wanted to have been given that option. I think back to my mother, who died with breast cancer. It took six months for her to die. She did not want to approach death.”
“This is only the second time that I have spoken in the debate, and I have lodged no stage 3 amendments, which is unusual for me. This part of the bill troubles me more than most parts of it do. When is it appropriate to raise the issue of assisted dying? I do not support the bill, but, if it passes, we must ensure that the issue is raised at the right moment. Let me be clear. I know that, when you get an adverse diagnosis, you are at your lowest ebb. Invariably, you have not listened to what you have been told, so you are reliant on members of your family to have listened with you. You do not have access to doctors and nurses afterwards. It might take you three or four weeks to get used to the diagnosis and to understand what it means.”
“All that I am asking for is that the bureau looks at this again and is flexible, in the interests of not only members but good legislation. 21:36”
“This is a difficult problem for the Parliamentary Bureau to wrestle with. I will not be clever and try to suggest all sorts of answers. However, one thing that is clear to me from my short time—10 years—in the Parliament is that, when we sit late towards midnight, we tend not to give legislation the due care and attention that we should be giving it. Does Jackie Baillie agree that, although Friday might not be the perfect solution, nor is sitting until 12 o’clock at night? Jackie Baillie: I agree, but I have not suggested that we do that. There are some evenings when we are not sitting until 10 o’clock that are part of the normal parliamentary timetable. There are also mornings when committees are not meeting, and there is perhaps an opportunity to use those slots.”
