One of the two requests in question concerned releasing a huge amount of data and involved protecting the identity of individuals, and I remind Mr Ross that the other involved the Government, very unusually, releasing legal advice that it had received. That in itself is evidence of the Government’s willingness to comply with FOI requests. [Interruption.] The Presiding Officer: I would be grateful if we could hear each other. One relates to a delay in compliance due to the need to adhere to court orders and the scale and complexity of the material involved. The other is about the interpretation of the scope of a request. As the permanent secretary has set out in response to the commissioner, all FOI request cases are handled with the highest standards of impartiality and integrity. Douglas Ross: The Scottish Information Commissioner has lost trust in the Government. He has called its excuses “preposterous and unacceptable”.”

Section 3A(3) of the Representation of the People Act 1983 includes a blanket ban, similar to the one that used to be in place for prisoners, to prohibit some people detained on mental health grounds relating to criminal justice from voting in elections in the UK. The order makes minor changes to legislation to maintain consistency with exceptions made to prisoner voting in the Scottish Elections (Franchise and Representation) Act 2020, which extended the right to vote in Scottish Parliament and Scottish local elections to prisoners serving sentences of 12 months or less.”

“Members will be aware that the position regarding the Baird family hospital and ANCHOR centre continues to evolve. Commercial discussions between NHS Grampian and the contractor are still active, and those negotiations require space to conclude before any further Government update can appropriately be given. As we have heard, NHS Grampian has very recently provided a detailed public update, including revised target dates for the project’s delivery. That statement reflects the current factual position and remains the most accurate information that is available at this time.”
“However, we are now saying that, actually, it is not open to them all and we will not even consult them. I think that there is a problem there. Graeme Dey: On that point, Jeremy Balfour says that we should consult people who are affected, but there will be people affected by any decision that is taken. I gently point out that, at the conclusion of business last night, the Presiding Officer pointed out that we were way behind where we needed to be at that stage. She indicated that the bureau would have to consider how that would be addressed. The bureau has been anxious to make members aware of the challenge that we face and the solution that will be required. I want to pick up on how we got here.”
“Secondly—I say this with respect to all members of the bureau, because I understand that they have a difficult job—there was no consultation with those who might be affected. The decision was taken by four or five individuals with no consultation. I should say that I will be here on Friday at 9 o’clock, so I am not speaking on my behalf—I am speaking on behalf of others who have these issues. However, I gently say to the minister that there was no consultation with those who might face the greatest issues. In relation to Ruth Maguire’s point about the Parliament being inclusive on paper, three Saturdays ago, every seat in here was filled by disabled people, and the Parliament—from the Presiding Officer down to the minister—gave the message that the Parliament is open to them all.”
“That is why the proceedings have been separated in that way. Even if we sit on Friday, there will already be challenges regarding creating that critique and giving members time to consider the bill in time for the debate next week. Douglas Ross made the point that we have known for a long time that the bill was coming and that there would be a great deal of interest in it. I accept that point but, until the bureau knew the number of stage 3 amendments that had been lodged, it was difficult to determine the exact nature of the time that would be required. Jeremy Balfour: I have two questions that I would like the minister to address. The first follows on from Nicola Sturgeon’s remark about the Thursday of the final week still being available to us.”
“An hour later, we were criticised by another colleague for making that change, because it had impacted their childcare. I relay that story not to give a “woe are we” message from those on the bureau but to show the kind of issues that we try to balance. Two broader issues were raised. Mr Balfour made valid points about his situation. Some colleagues would prefer that we sit on Monday, not on Friday—I absolutely get that—but sitting on Monday would be a problem for other colleagues. In relation to Ross Greer’s point, which Christine Grahame echoed, the bureau took the view that, given the importance of the Assisted Dying for Terminally Ill Adults (Scotland) Bill, we would pause after the amending stage so that members could have time to critique the bill before making a considered decision.”
“We have explored the option of holding the amending stages of three bills next week and holding the stage 3 debates the following week. We are conscious, among many other things, that stakeholders who have an interest in those bills would be deeply concerned if we were to push back the stage 3 proceedings in their entirety to the final week, because there would be a fear that the bills would fall. Therefore, business managers have to take a lot of things into account. I will share with colleagues that— Jeremy Balfour: Will the minister take an intervention? Graeme Dey: I will make some progress and then come back to Mr Balfour. A few weeks ago, the bureau was approached by a colleague who asked that we reorder business to accommodate a childcare issue. We took that on board.”

“In addition to that, the Lord Advocate absolutely fulfilled the undertaking that she gave the Parliament to provide more written information, to such an extent that we have a Conservative MSP, who is not with us tonight, for some reason, claiming that he had been the victim of a document dump. Last week’s urgent question resulted in 14 members having the chance to quiz the Lord Advocate. Tonight’s question resulted in seven members having an opportunity to do so, and on a theme that emanates from the Lord Advocate fulfilling her commitment to provide the examples that she did. I therefore struggle to see where there is a lack of accountability at play here, let alone the cover-up that Murdo Fraser claims.”
“In considering this request from the Conservatives, it is important that we reflect on the extent to which these matters have already been interrogated, including directly with the Lord Advocate. Any reasonable member—even on the Tory benches such creatures still exist—would surely conclude that that has been substantial. We had two urgent questions answered by the Lord Advocate, one of which was answered only a few minutes ago. There has been a topical question on the subject, which I answered, and Russell Findlay and Anas Sarwar raised the topic in detail at First Minister’s questions.”

“Graeme Dey: I absolutely agree with that sentiment. Oddly enough, as I was sitting here earlier today thinking about the debate, the thought that was going through my mind was that this is unfolding in Ukraine right now, so we really have not learned the lessons of the terrible tragedy of 85 years ago. As I prepare to step down from my role as minister for veterans, I find myself reflecting on what a privilege it has been to represent our armed forces and the veterans community. Commemorating the Clydebank blitz reminds me, as I think it should for all of us, that sacrifice during conflict is not solely the preserve of combatants and their families. Remarkable courage was shown in Clydebank in the face of profound loss and unimaginable hardship, and it is absolutely right and proper that we recognise that tonight.”
“We have a monument commemorating the civilians killed during the Clydebank blitz that was unveiled in West Dunbartonshire in 2009, with the names of the people inscribed on a bronze plaque. The memorial sits over the remains of Clydebank’s unclaimed dead, to ensure that we never forget those who lost their lives and that current and future generations learn of these historic events and the strength that emerged from them. Stephen Kerr: The minister is making an excellent speech. Does he think that it is highly appropriate that we are debating this subject on the fourth anniversary of the Russian invasion of Ukraine, in which at least 15,000 Ukrainian civilians have died? The lessons of Clydebank and this country’s experience in the second world war are not lost on us now, as we support the Ukrainians. Does he agree with that sentiment?”
“From the courageous Polish soldiers of world war two to the young families who have settled here in more recent years, and the many Polish nationals who now contribute their talent and dedication within the Scottish Government, we thank them for their service and the vital role that they play in shaping the Scotland of today. The redevelopment of the former John Brown shipyard, which is now called Queens Quay, where the ORP Piorun was built and docked on the night of the blitz, marked a major milestone in the regeneration of the historic shipyard site. The first phase of the development has delivered 146 high- quality affordable homes, which is a significant investment in the future of Clydebank’s community.”
“By the time of the blitz, the vessel and its commander had already played a key role in the sinking of the German battleship Bismarck. The story of the ship and her crew are symbolic of the enduring ties between Scotland and Poland, which span centuries and reach across culture, economy and society. The very depth of our ties is demonstrated by the fact that, by the 17th century, there were more than 30,000 Scots in Poland. We are extremely grateful to our large Polish community today for making the opposite journey and calling Scotland home.”
“Those nights left an indelible mark on Clydebank, but they also forged a legacy of unity and resolve that continues to define the community today. In the face of devastation, people pulled together and worked tirelessly for three days to rescue trapped victims and minimise loss of life. Their actions serve as a lasting reminder of the strength that can arise from even the darkest of circumstances. Of course, it was not only the people of Clydebank who pulled together but the brave crew of the Polish navy destroyer ORP Piorun. As we heard, the destroyer came to the defence of the town, where it was docked for a refit at the John Brown & Company shipyard. Coincidentally, the vessel was, when she was acquired by the Polish navy in 1940, constructed in the same John Brown dockyard at Clydebank that she later defended during the blitz.”
“To be serious, what is clear from the debate— we have had some excellent contributions from members, who have vividly brought back to life the events of 85 years ago—is that we are united in recognising the formidable spirit of the people of Clydebank and that their courage, their determination and their efforts to rebuild their community amid such devastation deserve lasting remembrance. As we have heard, in just two nights, Luftwaffe bombers transformed a once vibrant industrial community into a landscape of ruin. The scale of destruction was immense, with only seven of about 12,000 homes undamaged by the blitz and 35,000 people left homeless. Many families were devastated by loss and injury. It is almost impossible to comprehend the scale of what unfolded.”
“Five years ago, I found myself filling exactly the same role when Ms McNair’s predecessor, Gil Paterson, brought a members’ business debate to mark the 80th anniversary of the blitz. Just to spare mischievous colleagues from indulging in research, let me assure them that my speech is not a copy‑and‑paste job from 2021. However, I must say that I seem to have heard before the tangential tale that Bill Kidd regaled us with, and there is a nagging doubt at the back of my mind that it may have featured five years ago.”
“I thank Marie McNair for securing this members’ business debate to mark the 85th anniversary of the tragic events that took place in Clydebank on 13 and 14 March 1941. It is entirely fitting that we come together today to reflect on what was the worst destruction and civilian loss of life in Scotland during the second world war. It is something that should never be forgotten, especially as we move further away from the events themselves. I am sad to say that the lessons of the past are becoming increasingly relevant as world events grow more turbulent in ways that we might not have expected a few years ago. Standing here responding to the debate, I have a sense of déjà vu.”
