“Yes, there has been a lot written about critical minerals, including rare earth elements, but the focus is not so much on mining these essential elements or materials, it is actually processing them that is turning them into functional units. And China does about 90 percent of that in the world. I am grateful to the President for recognizing the importance of this issue. Last week, he signed an Executive order on unleashing America's offshore critical minerals and resources, which directs the Secretary of Commerce to expedite the reviewing and permitting process to mine in deep seabeds. In addition, the order directs the Interior Secretary and the Energy Secretary to work together to identify new partnership opportunities with the private sector and allied nations to continue developing these critical mineral capabilities.”

At this time, China is involved in what some might call old-fashioned mercantilism when it comes to these critical minerals. They will do anything to preserve their near-monopoly on processing these rare earth minerals that are vital to everything in modern life. In my tour of the MP Materials factory, I learned that, basically, China will give away their product rather than have to compete on a level playing field, mainly to undermine any effort for us to establish an alternative processing operation here in the United States. But the good news is that this rather grim picture does not have to be where the story ends.”
“As a result of a 40-year strategy that included both domestic investment and trade barriers, China has usurped our place as the global leader in producing rare earth elements. But they didn't stop with domestic manufacturing. China has also been aggressively buying up critical mineral facilities in countries around the world [[Page S2624]] in order to increase their dominance in the market. By 2010, they had become the source of 85 percent of the global rare earth element supply and the source of 95 percent of the processed rare earth elements. This is a storyline that has become all too familiar regarding a plethora of American industries that have been offshored to China and has done nothing to make us safer and more prosperous.”
“Again, COVID woke up a lot of us with regard to the vulnerability of our supply chains, and certainly advanced semiconductors was one of those. The rare earth mineral processing is another. The ability to produce critical minerals and process them here at home is a critical step to safeguarding our supply chains from the Chinese Communist Party. There are risks from relying substantially on our greatest strategic adversary, China, for the production and manufacturing of these resources. America used to have dominance in this area, not unlike semiconductors and quantum computing. In fact, we were, at one point, the largest producer of rare earth elements in the world, from the 1960s until about 1985. That was when China entered the picture and began ramping up their rare earth mining and processing capabilities.”
“From our iPhones to the cars we drive, even our washing machines, without the magnets that these minerals produce, society would come to a screeching halt, as dependent as we are on electricity and everything driven by electricity. Naturally, the work of this company, MP Materials, has implications not only for the Texas economy but for our entire Nation's national security. It reminds me a little bit of the epiphany we had post-COVID that we were almost completely dependent on Asia for advanced semiconductors and the fact that America once held a leading role in manufacturing these advanced semiconductors that basically ran everything with an off and on switch. But we have become almost entirely dependent on Taiwan and South Korea to produce these advanced semiconductors.”

Well, if you think about it, magnets are involved in almost every type of electric motor, whether it is for commercial applications or national security applications. In particular, MP Materials produces these magnets for General Motors as well as essential components for various vehicles, drones, robotics, electronics, aerospace, and defense systems. When we talk about critical minerals, there is a lot of confusion because it sounds pretty technical. But it has real-world impact on everyday Americans, on our economy, and on our national security.”

This impressive plant is the Nation's first fully integrated rare earth metal alloy and magnet manufacturing facility. Not only is this the first of its kind in America, it is the largest producer of rare earth minerals in the Western Hemisphere.”
“I have been working here in the Congress, as have my colleagues both in the Senate and the House, particularly our Texas delegation in the House of Representatives, to get them to live up to their responsibilities, and I think we have come to realize that the current treaty, which was signed back in 1944, has become obsolete; that we need some interim measures and metrics to ensure that there are regular annual water deliveries for Texas and our agricultural industry. But yesterday's announcement was an important step forward doing just that. And, again, I thank the President, the Secretary of Agriculture, the Deputy Secretary of State, and the Secretary of State for their efforts to secure this important and long-overdue payment of water to south Texas.”
“But their habit has been to delay the delivery of that water until the end of the 5-year period of the treaty. Obviously, in the interim, Mexican farmers have the water they need to grow the crops they need to grow and leave Texas agriculture high and dry. But it is important that we get this water flowing again because Mexico has repeatedly refused to comply with the terms of the treaty in a timely manner. We worked with the Biden administration. I remember talking to Secretary Blinken and introducing legislation, talking to my colleagues across the aisle about coming up with some carrots and sticks that we might be able to use to get Mexico to live up to its responsibilities, but the Biden administration really wasn't particularly interested in solving the problem.”

This has been a longstanding problem. I remember years ago being in Mexico City when I was attorney general of Texas talking about getting the Mexican Government to live up to their responsibilities under this treaty, which requires them to deliver water to the United States on a regular basis.”

“Despite these hard facts, our Democratic colleagues continue to peddle the myth that President Trump's tax cuts are just for rich folks. It couldn't be more clear that these claims are nothing more than just that--myths. So I urge my fellow Republican colleagues to never mind the naysayers across the aisle. The American people, on November 5, gave us a job to do. We took the important first step by passing the budget resolution just before the Senate adjourned, and now that we are back in Washington, it is time that we finish the job. I yield the floor. “This is really about lifting up hard-working men and women across the country. The tax cuts are about helping every hard-working American achieve their dreams. If President Trump's tax cuts are not extended, as I say, virtually everybody or at least a significant supermajority of American working families will see a tax increase. Texans specifically will see taxes increase about $3,000 on average. I am sure every single one of my constituents can think about somewhere better to spend that $3,000 than to write a check to the IRS. Small business owners like many of the folks that I met with these last 2 weeks would see tax hikes of nearly 50 percent, and working families could see their child tax credit cut in half, along with the standard deduction, which was dramatically increased in 2017.”
“You know, I have been here working in Washington--or what I like to call the forward operating base in hostile territory--for some time now, and the truth is, you get these prevailing narratives that get repeated over and over and over again and written about by the press that simply have no basis in fact or reality. The truth is, if we fail to extend the expiring provisions of the Tax Cuts and Jobs Act, 62 percent of American taxpayers will see their taxes go up. Obviously--on top of a 40-year high inflation, which has raised input costs across the board by about 20 percent or more as a result of the policies of the previous administration, that obviously would have a tremendously negative impact on our economy and the standard of living, like the folks I mentioned back home.”
“The message I heard from all of these impressive Texas entrepreneurs, job creators, and pillars of the community was simple: The Trump tax cuts helped their businesses grow and flourish, providing benefits not only to themselves and their families but to their employees and their broader communities. Stories I heard from my fellow Texans like Andy, Luis, Sarah, Hortencia, Jessica, and others show how patently false the accusation is of our Democratic colleagues who somehow claim that this is just to benefit rich people. The fact of the matter is, the Tax Cuts and Jobs Act is not about helping the wealthy few at the expense of ordinary Americans, contrary to the Democratic talking points.”
“Then there was Jessica Delgado, who, having worked in the restaurant industry since age 16, now owns multiple restaurants, and she serves on the board of the Texas Restaurant Association and is a former chairwoman of the Texas Restaurant Foundation. Another impressive woman small business owner was Hortencia Camargo, the owner of C4 Transport and Hacienda La Hortencia and a licensed Realtor in McAllen, TX, and she is also the founder of GRASP, which advocates for safe gun storage practices around children. I also had the chance on this same panel to visit with representatives of the agricultural sector, including Dante Galeazzi--I am going to butcher Dante's name--Galeazzi, who is president and CEO of Texas International Produce Association, who emphasized to me how beneficial the Trump tax cuts were for Texas farmers and ranchers.”
“There at 5x5, we had a panel discussion of small business owners, including Luis Espindola, who is one of the coowners of 5x5 and a Marine Corps veteran. I met with other business [[Page S2594]] owners at that panel, like Sarah Hammond, who owns Atlas Electrical Air Conditioning, Refrigeration & Plumbing Services. Sarah is known as a pillar of her community, serving as chair of the Rio Grande Valley Hispanic Chamber of Commerce and helping to oversee the management of Hummingbird Trailer Park. On top of this, she is involved with an organization dedicated to helping develop and empower other women business owners.”
“Andy told me how beneficial the Tax Cuts and Jobs Act was for his family business. He said that over the last 3 years, he has been able to invest $80,000 in improving his business as a result of that legislation. So if the Tax Cuts and Jobs Act is not extended at the end of this year, Andy and his employees in this small business will lose out on these benefits that have helped his business grow and thrive and provide employment for other families. I visited another place in the Rio Grande Valley, this one called 5x5 Brewing Company. This is a veteran-owned, as it sounds, brewery which is dedicated to brotherhood, tradition, and, yes, you guessed it, great beer. This tradition is reflected on their menu as many of their signature beverages have names of military significance.”
“I know most of the time when we think about job creators, we think about Fortune 500 companies, but the fact is, in Texas and across the Nation, it is our small businesses that are the primary engine of job creation. In the Dallas area, I met with Andy Ellard, the owner and general manager of Manda Machine Company, a third-generation, family-owned company in Dallas. It is no secret that Texas is one of the best places in the country to do business, and that was certainly confirmed by my visit back home these last couple of weeks. I had the opportunity to visit with some of our most impressive businesses, from major manufacturing facilities to local, family-owned small businesses. One such visit was to Daikin Texas Technology Park in Waller County, a suburb of Houston. There, I had the opportunity to tour their facility and attend a townhall with many of their employees.”
