“The State of Kuwait affirms our constructive engagement with the just Palestinian cause, as it is considered a central and pivotal issue for the Arab and Muslim world. We support General Assembly resolution 77/247, which requested the International Court of Justice to issue an advisory opinion on the Israeli colonial occupation of territories of the State of Palestine and the legal consequences arising from it. When we submitted our written statement to the Court, we also expressed our trust that it would take our written statement and those submitted by many other fraternal and friendly countries into account when issuing its advisory opinion.”

“Although statements of condemnation and denunciation seem to be futile in terms of the occupation Governments, especially when it comes to the current Israeli Government, which is considered to be the most extremist in the country’s history, they nevertheless constitute solid ground for promoting international positions that favour peaceful solutions, provide international protection for the fraternal Palestinian people and support the State of Palestine’s efforts to obtain full membership in the United Nations, in line with the fact that it is an active member in many regional and international organizations, including the League of Arab States, the Organization of Islamic Cooperation, the Non-Aligned Movement and many others.”

I also thank Mr. Khaled Khiari, Assistant Secretary-General for Middle East, Asia and the Pacific, for his briefing. We meet in the Security Council Chamber again amid the escalation of tensions and violations of international law, international humanitarian law and international human rights law by the occupation authorities in the occupied Palestinian territory. Israel continues to disregard international calls to stop its escalation and cease its use of violence against the defenceless Palestinian people. Israel’s use of violence makes no distinction between human beings and rocks, or between men, women and children.”

“We call on the Member States and all countries that adhere to the values of justice and the principles of international law to support the State of Palestine in that endeavour by providing written legal submissions to the International Court of Justice. We also urge the International Criminal Court to finalize the criminal investigation and to hold responsible and accountable all perpetrators of war crimes and crimes against humanity committed by the occupation Power against the unarmed Palestinian people. “We reiterate that just and comprehensive peace, security and stability in the Middle East can be realized only when the free Palestinian people can exercise their inalienable and legitimate rights, including the right to self-determination, thus ending the illegal Israeli colonial occupation and establishing the independence of the State of Palestine, with full sovereignty over occupied Palestinian territories since 1967 and with Jerusalem as its capital. “In a few days, the General Assembly will be commemorating the seventy-fifth anniversary of the Nakba, which attests to the languishing of successive generations under the yoke of continued injustice due to the inability of the international community to find an active mechanism to implement the resolutions of various United Nations organs since 1948. Notwithstanding the multiple international and regional efforts and peace initiatives in that regard, as well as international resolutions, the unprecedented deterioration of the situation of the steadfast Palestinian people, especially refugees, continues, along with the increasing systematic violence and illegal restriction of their rights, illegal settlement activities, the demolition of homes, the confiscation of land and the continued blockade on the Gaza Strip.”

“It is incumbent on the Security Council to shoulder its responsibilities by condemning those serious violations by the occupying Power and compelling it to refrain from any attempt to change the legal and historical status quo of the Al-Aqsa Mosque, including by respecting the sanctity of Al-Quds Al-Sharif. “During that month we witnessed the unprecedented escalation on the part of the occupying Power, with the support of extremist settlers, during which they desecrated the sanctity of the Al-Aqsa Mosque and assaulted unarmed worshippers, including women and children, arresting hundreds of them. This is a renewed vicious circle of bloody violence and a provocation of millions of Muslims all over the world. These actions showed contempt for the appeals of the international community, especially the calls of the Security Council for de-escalation during the month of Ramadan.”

“Migrants continue to face difficult and coercive conditions, in particular because of the security situation in Libya. The continued trafficking of illegal migrants across Libyan territory and off the coast of Libya undermines efforts to achieve peace and stability in that country. We call on all Member States to support the efforts of the United Nations to provide a safe haven for migrants and allow them the time they need to prepare asylum requests or for their repatriation. That would help to ensure the security, stability, and territorial integrity of Libya as well as non-interference in its internal affairs.”

“Mr. Alajmi (Kuwait) (spoke in Arabic): We welcome the unanimous adoption by the Security Council of resolution 2491 (2019). We thank the delegation of the United Kingdom for its considerable efforts as penholder on the issue of Libya. At the same time, we commend its flexibility during the negotiations on the draft resolution. Today, we voted in favour of resolution 2491 (2019), thereby confirming our steadfast position in support of all efforts of the United Nations to address the challenges raised by the smuggling of migrants and human trafficking in the Mediterranean off the coast of Libya. According to the report of the Secretary-General contained in document S/2019/711, on implementing resolution 2437 (2018), there was an increase in the number of migrant deaths at sea this year as compared to previous years.”

“There must be cooperation among States and relevant international organizations to promote the efforts of the Mechanism, enabling access to important information regarding the location and detention of the fugitives. Sixthly, we reiterate the importance of taking the measures necessary to address the concerns of Member States reflected in resolution 2422 (2018) regarding early release. We also stress the need for the Mechanism to take into account the observations of Member States on its functioning in order to achieve the desired goals. “One example is the appeals sentence in the case Prosecutor v. Radovan Karadzie last March. We look forward to the rulings in other cases considered by the Mechanism within the time frame set. Fourthly, we commend the efforts of the Mechanism to transform itself into a small, temporary and efficient structure whose functions and size will become leaner over time, in accordance with its founding resolution, by adopting measures to reduce expenditures without affecting its functioning. Fifthly, we commend the efforts of the Mechanism's Prosecutor. However, we believe that the responsibility to locate and detain the eight fugitives does not lie with the Mechanism alone.”

“Secondly, the General Assembly did not approve the proposed budget of the Mechanism for 2018-2019. Therefore, the Mechanism revised and reduced its budget by laying off several staff members, which may have an adverse effect on its functioning and the implementation of its mandate, not to mention on the morale of its staff. It is therefore important to adopt the new budget without any revision or reduction so that the Mechanism can assume its functions, in particular as it envisages judicial milestones, such as the conclusion of all remaining cases in 2020. Thirdly, we commend the speedy measures implemented by those in charge of the Mechanism, including the Prosecutor and the Registry, in trials reviewed by the Mechanism's judges, which would expedite rulings against indictees.”

“At the outset, we welcome the efforts of the President of the Mechanism, who, since assuming his new role, has adopted priorities that will improve its functioning and ensure the conclusion of the remaining legal proceedings, while taking into account the factors of time and efficiency, the promotion of inter-branch cooperation and the improved professionalism among the staff. Without prejudice to the mandate of resolution 1966 (2010) and notwithstanding the challenges faced by the Mechanism, such priorities include the following. First, there was a surge in judicial activities concerning requests for reviews of rulings, access to confidential information and allegations of contempt of court, as a result of the discontinuation of the support provided by the two Tribunals when they closed.”

“Sixth, it must call upon Israel to unconditionally release all Palestinian prisoners held since the beginning of the current aggression, especially those under administrative detention without charge, which clearly contravenes existing law. Seventh, it must provide the necessary assistance to the Palestinian State to ensure its capacity to meet the urgent needs of the Palestinian people and to rebuild the Gaza Strip. In conclusion, the Arab Group reaffirms its commitment to and solidarity with the Lebanese Republic and its support for its territorial integrity and security. The crowning glory of this activity was the murderous action carried out in the Shujaiya neighbourhood, All these actions are war crimes. We now find ourselves on the very brink of a humanitarian disaster as Israel pursues its nihilistic policy aimed at undermining all of the basic rights of the Palestinian people by rejecting the peace process; shattering the dreams of a people who have been deprived of the right to create a State within the 4 June 1967 borders, with East Jerusalem as its capital; and ignoring all peace proposals, including the Arab Peace Initiative.”

“The Arab Group vigorously condemns the barbaric aggression and extreme violence against civilians in the Gaza Strip. Israel has again topped itself. This is one of the darkest pages in history, replete with violations of human rights law and international humanitarian law concerning civilians in armed conflict. Israel has outdone itself in carrying out ever more horrendous actions and escalating its military operations to a new level, as evidenced by the ground incursion subsequent to the air bombardments and the targeting of Palestinian beaches in the framework of its collective reprisals against the civilians under occupation. The result can be seen in the growing number of civilian victims 4 over 600, most of them women and children .”

“The blood of innocent victims, men, women, children, continues to flow. And the anguished cries persist of mothers who have lost children, the cries of pain of the injured, the despair of those who have been displaced, who have lost their shelters, their homes, all as a result of the Israeli bombardment. Now we are again facing another episode of bloodthirsty and ever more aggressive Israeli collective punishment. Its bombardments resemble a sea of lava that cannot discriminate among an elderly woman baking bread, an elderly man praying or a student studying his lessons. The deadly Israeli machine is always proud to demonstrate its superiority, especially its military superiority, when confronting an unarmed civilian population that is destitute as a result of the ongoing occupation and the asphyxiating blockade on the Gaza Strip.”

We are convinced that your wisdom and professionalism will enable you to manage the Council during this month with success. We would also like to congratulate your predecessor on his on his presidency last month. We find ourselves gathered together again during this now regular meeting on the ageanda item "The situation in the Middle East, including the Palestinian question". However, this time it is taking place in humanitarian circumstances that are far from routine. That reminds us of the tragic Israeli aggression against the Gaza Strip at the end of 2009, which remains quite present in our collective memory.”
