  1. That is further exacerbated by the risk of a food crisis, which cannot be ignored, all the more since the recent Hurricane Sandy had a significant impact on the country's agricultural land. Combating the risk of food insecurity is, moreover, a core aspect of the humanitarian plan for 2013, which requires $144 million in funding. Another key aspect of that plan is the fight against cholera and better sanitary conditions. Despite a decrease in the number of infected persons, there is a real risk of a new outbreak since the departure of many humanitarian groups and the lack of financial resources prevent the existing infrastructure from functioning. In order to optimize MINUSTAH's presence in line with the country's needs, while keeping in mind the transition phase of the Mission, a consolidation plan for its withdrawal must be drawn up.

  2. Moreover, the rate of recruitment could be significantly sped up in order to achieve the objectives of the 2012-2016 plan, namely, incraeasing the force to 15,000 police officers. With regard to the humanitarian situation, despite the fact that the number of people living in the camps continues to fall, partly thanks to the programmes launched by the Government with United Nations support, the Secretary-General's report notes with concern the worsening humanitarian situation in the country. With the withdrawal of more than half of the non-governmental organizations present in 2010 and many partners following the fall in available funding, the provision of basic services in the camps has considerably lessened.

At the same time, as the Secretary-General notes, complications linked to establishing the temporary body of the Permanent Electoral Council continue to push back the date for the legislative, local and municipal elections - a phase that remains crucial. On the security front, the situation remains stable despite an increase in demonstrations and some civil disputes. In the light of the consolidation plan and the gradual drawdown of United Nations Stabilization Mission in Haiti (MINUSTAH) troops, we must continue to underscore in parallel the strengthening of the police force. In that connection, we commend the increased effectiveness of the Haitian National Police, which continues to build its capacities with the support of MINUSTAH.

Moreover, three years after the 2010 earthquake, it is clearly noticeable that the international community's humanitarian support in Haiti is diminishing despite the fact that the stabilization process has not yet been finalized. This quarterly debate of the Council on the developing situation in Haiti should enable us to draw attention to the various plans and strategies under way that are not always supported by adequately funding from the international community. We must ensure that the achievements of these past years are sustained. On the political front, Morocco welcomes the many positive developments towards finalizing the necessary institutional reforms to strengthen the rule of law in Haiti.

I express our support to him for the success of his task. I welcome the presence of Mr. Fernando Carrera Castro, Minister for Foreign Affairs of Guatemala, at this debate. As we have seen over the past months, the Republic of Haiti remains vulnerable, in particular with regard to climate. While the country continues to struggle against the devastating effects of the 2010 earthquake, it has suffered in the wake of Hurricane Sandy and tropical storm Isaac, which affected more than 2 million people.

  7. Cooperation between Afghanistan and the international community is equally important, inter alia, to fulfilling the commitments undertaken in the framework of the Tokyo Conference. The commitment of international donors and financial institutions to rebuilding Afghanistan is necessary ifthe country is to implement its national priorities. In conclusion, my country believes it important for the process to continue the process that has been under way for several years to stabilize Afghanistan, which is emerging from a lengthy conflict, and to help it to stand on a more solid footing and to rebuild. That will require the international community's support, but it must be Afghan-led and for the benefit the Afghan people.

In that vein, the participation of political parties and civil society in the electoral process will have a positive impact on the coming elections, endowing them with greater legitimacy and credibility in the eyes of Afghan citizens. Afghanistan has made great strides, although many challenges remain. Cooperation between Afghanistan and neighbouring countries will be critical in particular to resolving such issues as the fight against drug trafficking, counter-terrorism, trade, education, natural disaster management, and investment. Morocco commends the many initiatives launched in that respect, including the high-level meeting on the Istanbul Process on Regional Security and Cooperation for a Secure and Stable Afghanistan, held in Baku.

In that context, the High Peace Council continues to strive to establish conditions conducive to reconciliation by launching direct dialogue with representatives of civil society, women's groups, religious leaders and political figures. The year 2014 will be a watershed year for Afghanistan. Two major electoral dates have been set that are of particular importance because they will open a new chapter of Afghan history. In that regard, we must ensure that the elections are organized successfully by insisting that they be inclusive, reliable and transparent. In that context, we welcome the efforts of the Independent Election Commission to prepare the elections.

  10. During the reporting period, the security situation in Afghanistan improved significantly. For the first time in six years, there has been a fall in the number of civilian casualties, at a time when the Afghan security forces have begun the fourth phase of the transition, taking control of territory that is home to the majority of the country's population. The falling number of casualties can be attributed in part to the Afghan Peace and Reintegration Programme, which continues its roll-out, and to the significant role of the High Peace Council. By late December 2012, more than 6,000 combatants had joined the programme with the aim of laying down their arms and joining the Afghan National Army.

Finally, I also wish to thank Australia, represented today by its Minister for Foreign Affairs, for its leadership within the Security Council on this matter. The report before us today (S/2013/133) comes at a critical moment in the history of Afghanistan, one year before the presidential and provincial elections set for April 2014 and only a few months before the withdrawal of the International Security Assistance Force from Afghanistan.

  13. These incidents are not likely to bring the communities together, much less reconcile them. They serve only to promote the agenda of those opposed to peace and stability in the region. On another question entirely, that of investigations into war crimes, forced disappearances, murders and money laundering, we would encourage the investigations led by the European Union Rule of Law Mission in Kosovo. We would also encourage UNMIK to continue to carry out its mandate. The region has suffered too long from the ravages of war and fratricidal conflicts. It is now up to Serbia and Kosovo to work fervently to resolve their differences.

However, positive signs are on the rise following the formation of a new Serb Government, and there is reason for hope, as seen in the willingness of the two parties' leaders to step up their commitment to resolving their differences. Indeed, the discussions between the two parties, under the auspices of the European Union, have reached a new phase in terms of technical issues. However, substantial issues have not seen much progress. Thus, negotiations on the question of regional cooperation, civil registration, land registry and joint border crossing management have seen progress, but such issues as the freedom of movement and the certification of degrees have not. The progress achieved must not overshadow incidents affecting minorities, be they acts of vandalism, religious intolerance or the destruction of religious sites.

I would like to take this opportunity to wish a warm welcome to Mr. Ivan Mrkic', Minister for Foreign Affairs of Serbia, and to Mr. Enver Hoxhaj. During the reporting period covered by the Secretary-General's report, the security situation remained calm and stable overall, despite certain persistent and sporadic incidents, which particularly affected the Serb minorities in the north of Kosovo and could undermine the momentum of recent months.

  16. Afghanistan is a country that has pulled back from the brink and come a long way towards extricating itself from fratricidal and deadly conflict. It still has a long way to go to stabilize, to rebuild itself and to build State institutions in order to finally ensure the rule of law. To that end, the role of UNAMA, neighbouring States and the entire international community is vital in assisting a country that continues to endure the agony of war. In conclusion, allow me to thank the Special Representative of the Secretary-General and UNAMA for their efforts as they fulfil their mandate.

We welcome the fact that the Special Representative of the Secretary-General has undertaken a number of visits to the region in order to increase cooperation with the United Nations Assistance Mission in Afghanistan (UNAMA) and between those States and Afghanistan. In a different vein, the humanitarian situation, particularly that of women and children, calls for the collective commitment of the Afghan authorities and the United Nations to providing the necessary assistance to vulnerable populations. The issue of refugees is also a problem, both for Afghanistan and for neighbouring States. As such, additional efforts must be undertaken in order to repatriate refugees and ensure that they are reintegrated into their countries of origin.

  18. This will clearly have a positive impact on security in Afghanistan. Regional cooperation during this period was significant, as shown by the Heart of Asia Ministerial Conference held on 14 June in Kabul, which involved 14 countries and seven regional and international organizations, and identified priority confidence- building measures linked to such areas as counter- terrorism, the fight against drug trafficking, trade opportunities and regional infrastructure. Beyond the Conference, Afghan authorities have purused their efforts to strengthen cooperation in areas of common interest with neighbouring States.

Karzai's Government for the two years ahead, in particular the fight against corruption, the renewal of State institutions and the establishment of a mechanism providing for better management of State institutions. On the security front, we note that the number of incidents has declined considerably since last year. Still, it is higher than it was in 2010. This slight improvement took place at a time when the third transition phase allowed for a transfer of responsibilities to the Afghan security forces, who new control an area in which 75 per cent of Afghanistan's population lives. In addition, we have seen an increase in the number of Afghan fighters who have joined the Afghan peace and reintegration programme, which by mid-August included more than 5,000 new ex-combatants.

In this context, Morocco welcomes the fact that the international community has undertaken to earmark, in the years ahead, more than $16 billion for assistance to Afghanistan, which attests to the importance that the international community attaches to that country and to the need to stand with it in its efforts to bring about stabilization and reconstruction. The Conference also saw the adoption of the Tokyo Mutual Accountability Framework, which reiterated the commitment of the Afghan Government with respect to presidential and legislative elections in 2014 and 2015.   22. We remain convinced that the IAEA, the only institution with jurisdiction in this sphere, must receive the necessary cooperation, including with respect to the required information and access. We reiterate that the non-proliferation regime should not be weakened and that all States must scrupulously abide by their obligations with respect to safeguards. The goal of nuclear disarmament, which my country holds dear, will remain elusive if the commitments freely entered into under the Treaty for the Non-Proliferation of Nuclear Weapons are not upheld. At the same time, we wish to underscore that this regime is based on a clear balance between the rights and obligations of States, a balance that every State must uphold.

  23. We hope that the Agency will be enjoy all the cooperation necessary to clarifying all pending matters. We welcome the resumption of negotiations between the five plus one group and Iran in order to move towards a negotiated and diplomatic solution to this question. We remain convinced that dialogue and diplomacy are the only way to find a solution to this question. The successful outcome of such a dialogue will require clear, sustained commitment in good faith, as well as the absence of any actions that could further complicate the situation. We also believe that the resolution of this question will require respect for the Security Council's resolutions and a reponse to the requests ofthe IAEA in the context of Iran's compliance with its international obligations.

The Committee has continued its inspection of the cases brought to its attention, and we hope that it will continue to benefit from the cooperation of Member States and to draw on the professionalism and impartiality of the Panel of Experts. In the same spirit, my delegation welcomes the holding of an informational meeting for all delegations. Such initiatives help contribute to enhancing the transparency of the Council's work and its subsidiary organs. The most recent report submitted by the International Atomic Energy Agency (IAEA), dated 30 August, has shown that the pending matters regarding the Iranian nuclear programme have yet to be resolved. The report also notes the intensification of dialogue between Iran and the IAEA since January 2012.

In spite of the fact that incidents continue to occur, there are grounds for hope with respect to the continuation of dialogue between the parties and their commitment to respect previous agreements and in particular to refrain from any actions that could heighten inter-communal tensions. Indeed, a great deal of progress has been made in improving relations between the parties. That progress must continue. It is important to continue, with the support of the international community, to deploy the efforts required to ensure a better future for the peoples of the region and to reach compromise solutions, through negotiation and dialogue, concerning the various issues under consideration, in keeping with the provisions of resolution 1244 (1999).

The reaffirmation by the new Serbian President of his country's commitment to honouring the obligations undertaken with Pristina, and his statements in favour of continued dialogue with the authorities of the latter, are encouraging developments. On another note, we welcome the progress made in the investigation of allegations of illicit trafficking in human organs, and we look forward in particular to the start, on 3 September, of the trial of persons accused of being involved in organized crime, human trafficking and the illegal exercise ofmedical activities. It is important that every effort be made to investigate those allegations and that the perpetrators be brought to justice. We thank UNMIK for its support for the parties, which made it possible for progress to be achieved, in particular concerning the issue of missing persons.

We are pleased that several agreements were signed between parties on a number of important issues, including regional cooperation, freedom of movement, the certification of diplomas, civil registry books, cadastre records, the integrated management of crossing points and the free movement of goods. It is clear that the effective implementation of those agreements, which will require a commitment by both parties to rise above their differences of opinion, will have a positive impact on the daily lives of the people and will contribute to the easing of tensions and to the strengthening of conditions conducive to dialogue, in particular with respect to the most difficult issues. We note also that during the reporting period, as highlighted by the Secretary-General, dialogue between the parties was suspended owing to electoral calendar.

It is crucial that an increased commitment be demonstrated with respect to the management of the security sector, in particular with respect to the protection of minorities, their property and their cultural and religious heritage. The period was most notably marked by the holding, on 6 and 20 May last, of parliamentary and presidential elections in Serbia, including the voting in Kosovo, which took place in an orderly fashion thanks to the responsible approach adopted by both parties, with the support of the Organization for Security and Cooperation in Europe, the European Union Rule of Law Mission in Kosovo and the Kosovo Force.

  31. Morocco respects the rule of law and has institutions to promote and protect human rights, the credibility and effectiveness of which are internationally recognized. Each situation has its own unique characteristics and thus requires tailored responses. To draw parallels of this type is to simply display great ignorance of Morocco's history. It is thus wrong and careless to seek, in spite of everything, to compare the question of the Sahara to other situations while denying with astonishingly bad faith the historical, legal and political realities that distinguish them.

Morocco regrets that a State member of the Council mentioned the question of the Sahara this morning, drawing a dubious parallel between it and other situations around the world. That same member State had drawn a similar parallel in an equally inappropriate manner during a previous debate. I would reiterate that drawing a parallel between the question of the Sahara and other situations is completely unwarranted and politically motivated and does not in any way take into account the disparate realities of these situations. It is dishonest in both form and substance to compare questions of a fundamentally different nature.

We are convinced of the impartiality and integrity of the IAEA, the only institution competent in this area, which should therefore benefit from all the necessary cooperation, including on all requested information and access. We take this opportunity to reiterate that the non-proliferation regime must not be weakened, and that every State must scrupulously respect its obligations in that regard. The goal of nuclear disarmament will continue to be severely tested if commitments made are not respected. We would also like to emphasize that this regime is founded on a fundamental balance between the rights and obligations of States, which no State should neglect.

  34. We welcome the resumption of talks between Iran and the five permanent members of the Security Council and Germany aimed at making progress towards a diplomatic solution to this issue. We remain convinced that dialogue and the diplomatic route are the only way to arrive at a solution to the problem. The success of such a dialogue demands a clear, sustained and good-faith commitment, with no hint of any action that might complicate the situation. We also believe that settling this issue can be achieved through strict respect for the Council's resolutions and by fully satisfying the demands of the International Atomic Energy Agency in the framework of Iran's complying with its international obligations.

  35. We are also confident that it will be able to benefit from full cooperation on the part of Member States. In that spirit, my delegation supports the Chairman's intention to organize, with the support of the experts, an open briefing for all Member States. The most recent report of the International Atomic Energy Agency (IAEA), published on 25 May, demonstrates that the outstanding issues around the Iranian nuclear programme have not yet been resolved. The report also gives an update on the dialogue between the IAEA and Iran, indicating some progress in the definition of "a structured approach to the clarification of all outstanding issues". We hope that the Agency will receive all the cooperation it requires for that purpose.

In that regard, we are pleased to recall the Panel's visit to Morocco, which allowed its members to review with Moroccan authorities the measures taken to implement the relevant Security Council resolutions. The Committee has considered the final report of the Panel of Experts (S/2012/395). I would like to reiterate my congratulations to the Panel on the quality of the report and its efforts to take into account the Committee's comments following its consideration of the previous report. We hope that the Committee will continue to consider the final report in a constructive spirit that will enable it to reach a speedy consensus. The transfer to national jurisdictions of cases involving intermediate or lower-rank accused by the ICTY and the transfer of five cases by the ICTR to Rwandan courts will contribute to the consolidation of the principle of complementarity and to the strengthening of the national judicial institutions of the relevant countries. The activities undertaken to raise the awareness of younger generations with respect to the lessons to be learned from the crimes prosecuted by both Tribunals should continue. The contribution of the International Criminal Tribunals to international criminal justice must be recognized and preserved. The protection of the legacy of the Tribunals has both a legal and a moral value.

In that context, we deem it necessary to underscore the importance of cooperation on the part of Member States and regional and subregional organizations with both Tribunals, in accordance with their respective statutes and, subsequently, with the Residual Mechanism. Such cooperation should involve not only greater efforts to arrest those fugitives still sought by the ICTR but also an acceleration in communications and requests for judiciary assistance from both Tribunals, as well as support for efforts to relocate persons who have been acquitted or served their sentences. The referral of cases to national courts has considerably facilitated the completion of the work of both Tribunals and a smooth transition towards the Residual Mechanism.

That should induce us to maintain the same level of mobilization in order to explore together ways and means of dealing with the various difficulties related to the retention of skilled personnel. We hope that the relevant United Nations bodies will give favourable consideration to additional measures aimed at overcoming the difficulties related to the downsizing process and at the completion of the deliberations of both courts. The ongoing dialogue between the two Tribunals, the Office of Legal Affairs and the Council's Informal Working Group on International Tribunals, which is chaired with skill and competence by Guatemala, will, of course, remain the best response to the potential practical or institutional difficulties relating to the upcoming launch of the Residual Mechanism.

  42. That will allow us to resolutely continue consideration of the conditions necessary to enable it to effectively carry out its mandate. We welcome the measures adopted by both Tribunals, which, while ensuring due process, have made it possible to streamline procedures and introduce reforms aimed at accelerating the pace of their work. The Kingdom of Morocco also welcomes the fact that those measures have enabled the ICTY to begin certain trials earlier than had been anticipated and to limit the impact of challenges related to translation and lack of staffing on the trial schedule. As concerns the ICTR, the efforts undertaken have led to the announcement of the completion of trial proceedings prior to the end of 2012 and to encouraging predictions indicating that all of the rulings will be handed down during 2014.

Mr. Bouchaara (Morocco) (spoke in French): Allow me at the outset to thank the Presidents and Prosecutors of the International Tribunal for the Former Yugoslavia (ICTY) and the International Criminal Tribunal for Rwanda (ICTR) for their thorough briefings. We were pleased to take note of the efforts undertaken and the progress made by both Tribunals with regard to the implementation of their respective completion strategies, which are aimed at finalizing their work and preparing for a smooth and harmonious transition towards the International Residual Mechanism, which is to take over the residual functions of the criminal Tribunals. We were also very pleased to learn that despite the challenges encountered, the Mechanism will begin operations on the date set out in resolution 1966 (2010).

We believe that the long process that will enable a return to peace and stability in Darfur cannot be achieved without effective and coordinated cooperation on the part of all those involved, regional organizations and the mediation mechanisms involved.

  45. The history of the Sudan did not begin with the conflict that has ravaged the country; its history goes back centuries and is intimately linked to the history of the continent. The Sudan has made important sacrifices for the Comprehensive Peace Agreement and the Doha Document for Peace in Darfur. The decision of the ICC to indict President Al-Bashir is not based on international consensus. The Organization of Islamic Cooperation and the Non-Aligned Movement have called into question such an approach. The cooperation of States not parties to the Rome Statute is also a complex issue in many respects. The League of Arab States clearly expressed its position with regard to the indictment of President Al-Bashir only a few days after the decision ofthe ICC, at its twenty-first Summit, held in Doha in March 2009.

That ambitious agreement tackles all of the issues that gave rise to the conflict, such as measures for an equitable redistribution of power and resources, compensation, the return of displaced persons, reconciliation and the maintenance of dialogue. The failure of several rebel movements to subscribe to the agreement and the resulting instability make its implementation difficult. In addition, the main structure arising from the agreement, namely, the Darfur Regional Authority, has been established. However, the lack of funds available to it currently prevents it from becoming operational. The Sudan is an ancient African nation that, with the richness of its history, culture and civilization, has contributed to the history of the entire African continent.

  47. We also reiterate our commitment to respecting the sovereignty and territorial integrity of the Sudan. Since the adoption of resolution 1593 (2005), the ICC has regularly provided the Council with reports on the implementation of that resolution. The fifteenth report submitted by the ICC enumerates the main actions undertaken by the Court since resolution 1593 (2005) was adopted, on 31 March 2005, and evaluates its actions. Today we can affirm that the situation in Darfur is developing and that significant efforts have been made to resolve the conflict. That progress must be encouraged and supported. Morocco welcomed the signing of the Doha Document for Peace in Darfur and the launching of the implementation of the provisions contained therein.

We wish you every success in carrying out your duties. I would also like to welcome Mr. Moreno-Ocampo and to congratulate Ms. Fatou Bensouda. Her election to the post of Prosecutor of the International Criminal Court (ICC) was welcomed with great pride across our continent. Morocco supports a political solution among all the parties involved in order to reduce the suffering of civilians. We reiterate our commitment to respecting the principles of international humanitarian law and human rights.

  49. In that connection, we would like to emphasize how important it is to bolster activities involving assistance and international cooperation to meet the needs of Member States. The guidelines laid out by the Committee should provide a basis for dialogue with Member States in order to identify shortcomings and difficulties in implementing the resolutions. Lastly, if it is to be able to fulfil its role of supporting national implementation efforts, the Committee must have the expertise of a highly qualified panel of experts at its disposal. In that respect, it is urgent for the Committee to complete the appointment of the new members of the group of experts, taking into account the type of expertise needed and the principle of geographical representation.

  50. Here, we would like to pay tribute to the Ombudsperson, Ms. Kimberley Prost, for her commitment and the remarkable job she has done. Regarding the Committee established pursuant to resolution 1540 (2004), Morocco, which has presented an initial report and additional information, welcomes the work of the Committee and its role and that of its Chair in combating the proliferation of weapons of mass destruction and preventing their being acquired by non-State actors. The first report (S/2012/79) prepared pursuant to resolution 1977 (2011) and submitted to the Council in February 2012, reflects the efforts of the Committee in that regard and contains the Committee's proposals to make its work more effective in the future and to improve its interaction with Member States.
