“The annual report to the General Assembly (A/76/13) on the work of the United Nations Relief and Works Agency for Palestine refugees in the Near East (UNRWA), presented to the Fourth Committee by its Commissioner-General Philippe Lazzarini on 5 October, highlighted the Agency’s financial situation, which remains dire and uncertain, lacking the funds to operate in November and December due to funding reductions by some donors and despite the return of the United States of America this year as a partner and donor to the Agency. A disruption in UNRWA services will deny millions of Palestine refugees, among them many young people, across the region the essential rights of a dignified life: education, health, food and housing.”

“In addition, the Committee appreciates Qatar’s contribution of $40 million to the United Nations to support cash assistance to 100,000 vulnerable families in Gaza and an additional $10 million per month for the Gaza power plant. The Committee also commends donors’ response to the United Nations Humanitarian Flash Appeal, which raised $45 million of the requested $95 million to support humanitarian aid and recovery for the Gaza Strip. The Committee appreciates, inter alia, the 22 September decision by the Government of the United States of America to release the remaining $20 million of a total humanitarian aid package of $75 million for Palestinians earmarked in March of this year.”

“The Committee echoes concerns expressed by many about the Palestinian Authority’s financial position, which, according to the Special Coordinator, has deteriorated in 2021, partly due to Israel’s withholding of additional clearance revenues since July and the ongoing impact of the coronavirus disease pandemic. While the Committee calls on donors to support the Palestinian people, it also urges the Palestinian Authority to implement commensurate reform priorities to improve the fiscal outlook. “In particular, the Committee notes the limited easing of access restrictions by the Israeli authorities; the expansion of the fishing zone on 29 July; the easing of import and export restrictions on 13 and 26 August; the issuance of permits to Palestinian traders and businesspeople to cross from Gaza into Israel; and, more critically, permission for construction materials, food and non-food items and fuel to enter Gaza. However, let me reiterate that Gaza requires political solutions that will see a complete lifting of the illegal Israeli blockade, in line with resolution 1860 (2009), and the return of the legitimate Palestinian Government to Gaza, and further recall that Gaza remains an integral part of the occupied Palestinian territory and must be part of an independent, sovereign Palestinian State.”

“In occupied East Jerusalem, a recent Israeli judicial decision to allow “silent Jewish prayers” in Al-Aqsa Mosque/Al-Haram Al-Sharif under Israeli police escort risks inflaming an already precarious situation because it constitutes an alteration of the historic and legal status quo at the holy site, which must be respected, as repeatedly demanded by the General Assembly, the Security Council, the Human Rights Council and the United Nations Educational, Scientific and Cultural Organization. United Nations human rights experts on 13 August called on the Government of Israel to immediately return confidential documents and office equipment that its military seized from the offices of Defense for Children International Palestine in Al-Bireh, in the occupied West Bank.”

“Mary Lawlor, the United Nations Special Rapporteur on the situation of human rights defenders, noted that arrests and raids on the homes of Palestinian human rights defenders form part of a wider crackdown against those defending the human rights of Palestinians in the occupied Palestinian territory. We also continue to witness the limitation of access for Palestinian worshippers to sacred sites. For example, the Office of the United Nations Special Coordinator for the Middle East Peace Process reported that tensions rose at the Ibrahimi Mosque site, in Hebron’s Old City, following a decision by Israeli authorities to temporarily restrict access for Palestinian worshippers between 21 and 24 September, during the Jewish holiday of Sukkot.”

“During September, Palestinians continued to demonstrate in the occupied West Bank to protest the situation of Palestinian prisoners in Israeli detention, including six Palestinians on hunger strike. On 6 September, the reported escape of six Palestinians from Israel’s Gilboa prison, who were later rearrested, ignited protests that escalated into clashes throughout the West Bank and Gaza. The Committee warns that punitive measures by Israel against the Palestinian prisoners and detainees it is holding in its jails risk provoking an open confrontation and escalation of this volatile situation. Palestinian civil-society organizations continued to face restrictions on their freedoms of expression, assembly and association. On 11 August, Ms.”

“Israeli demolitions and confiscations of Palestinian homes and structures have also continued across the occupied West Bank, including East Jerusalem, since the Committee’s last statement to the Council (see S/2021/91). According to the Special Coordinator’s September 2021 statement to the Council (see S/PV.8869), those actions displaced 433 people, including 102 women and 251 children, during the 2 June to 27 September period. The Committee calls on Israel to cease the demolition and seizure of Palestinian property throughout the occupied West Bank, including East Jerusalem, in line with its obligations under international humanitarian law and equally in respect of international human rights law.”

“The Committee remains concerned by the continued loss of life and serious injuries, especially to children, in the occupied Palestinian territory. According to the Special Coordinator, from 12 June to 27 September alone, 27 Palestinians, including two women and five children, were killed by Israeli security forces during demonstrations, clashes, security operations and other incidents. During the same period, thousands of Palestinians were injured, including 10 women and 530 children. The Committee urges further measures to ensure that Israel fulfils its obligations as the occupying Power, in accordance with international humanitarian law, to protect Palestinian civilians from violence, including by Israeli settlers, and to investigate and hold accountable all those responsible for such attacks.”

As we engage once more in this quarterly debate, the situation in the occupied Palestinian territory remains tense. “As we heard today from the Deputy Special Coordinator and Humanitarian Coordinator, Lynn Hastings, the violent escalation has had severe humanitarian consequences for the civilian population, in particular in Gaza, which remains under a 14-year blockade by Israel, the occupying Power. The Committee reiterates its long- standing call for the lifting of the blockade and for the freedom of movement of persons and goods to be respected in accordance with international law. The Committee also calls on donors to support the reconstruction needs of the Gaza Strip as outlined in the rapid damage and needs assessment by the World Bank Group, the United Nations and the European Union, in close cooperation with the Palestinian Authority, which estimated recovery needs of up to $485 million during the first 24 months.”

“They represent a crucial step to broadening the political space for Palestinians, as well as civil society organizations, allowing them to participate fully in the democratic life of the State of Palestine. The Committee is encouraged by the ongoing preparatory work of the Central Elections Commission, including the publishing of the list of 36 parties and independent candidates set to participate in the legislative elections on 22 May. It is estimated that between 800,000 to 1 million new young eligible voters will take part in an election for the first time, together with a growing number of female voters and candidates. Out of a total of 2.55 million voters, 1,247 million are women, corresponding to 48.95 per cent of the electorate, and out of 1,389 candidates, 405 are women, corresponding to 29.15 per cent.”

“On this topic, the Committee welcomes the UNESCO Executive Board resolution of 14 April that calls on Israel to halt its illegal and unilateral procedures against the Al-Aqsa Mosque and the Old City of Jerusalem and its walls. On 9 February, the International Criminal Court (ICC) ruled that it has jurisdiction over grave crimes committed in the occupied Palestinian territory, including potential war crimes, as a major move towards ending impunity and ensuring justice and accountability. The Committee calls on Israel to cooperate fully with the ICC investigation, while respecting its obligations under international law as well as the Court’s independence. The Committee welcomes the holding of the upcoming Palestinian legislative and presidential elections, scheduled on 22 May and 31 July.”

“The Committee calls on Israel to immediately halt all settlement construction and expansion and all measures of de facto annexation. The Committee further highlights paragraph 5 of resolution 2334 (2016), calling on Member States to distinguish in their dealings between Israel and the occupied Palestinian territory, including East Jerusalem, and urges concrete measures in line with international law to hold Israel accountable for its violations in this regard. The Committee also condemns settler violence against Palestinians, such as the 13 March incident in southern Hebron when a Palestinian family was attacked by 10 Israeli settlers, some of them armed. Special Rapporteur Michael Lynk has reported more than 210 incidents of settler violence in the West Bank and one Palestinian fatality since the beginning of 2021.”

“Let me now highlight some negative developments and trends on the ground that continue to undermine the prospect of a two-State solution. The occupying Power has continued to expand its illegal settlement network in the occupied Palestinian territory, including in and around East Jerusalem and deep in the West Bank, reaching the highest number of over 9,000 settlement units built over the last few years and leading to the transfer of thousands more Israeli settlers to the occupied territory, in grave breach of the Fourth Geneva Convention. Let me reiterate in the strongest terms that Israeli settlements in the occupied territory are illegal under international law, as reaffirmed, inter alia, in resolution 2334 (2016). They constitute an obstacle to peace and are destroying the viability of the two- State solution.”

“In the meantime, United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA) continues to struggle with severe financial problems, as witnessed in recent months by its inability to pay staff salaries and deliver urgently needed humanitarian and livelihood support to Palestine refugees in need and the great anxiety that has caused within the refugee community. The Committee reiterates its call on Member States to maintain their strong support to UNRWA and commits to continuing its support for the Agency to attract international solidarity with Palestinian refugees in a way that is sustainable, predictable and long-term.”

“The Committee stresses the centrality of the Arab Peace Initiative, the plans for the convening of an international peace conference, the recent meeting of the Middle East Quartet, as well as the efforts of Egypt and others in advancing the reconciliation process among the Palestinians. The Committee joins the Secretary-General in welcoming the decree issued recently by Palestinian President Mahmoud Abbas to hold legislative and presidential elections starting in May 2021, as a way to renew democratic pillars in a way that would embody and implement the hope of generations of Palestinians for a just, peaceful and prosperous future.”

“The Committee also reiterates the importance of the roles of the General Assembly and the Security Council in promoting a peaceful solution of the question of Palestine and urges serious mobilization in that regard. The Committee calls on all parties to refrain from unliteral acts that would jeopardize the possibility of restarting the peace process. Israeli and Palestinian leaders should seize the opportunity to re-engage in meaningful negotiations to realize the two-State solution on the basis of the pre-1967 borders, in line with international law and the relevant United Nations resolutions.”

“The Committee calls on Israel and the international community to ensure that the rights of the Palestinian People are respected and upheld, including the inalienable right to live in freedom and dignity in an independent and sovereign State. The Committee supports the call made by the President of the State of Palestine, Mahmoud Abbas, for an international peace conference under the auspices of an expanded Middle East Quartet that would allow regional players to contribute to the advancement of the peace process. “The Committee calls on Israel, the occupying Power, to immediately comply with its duties under international humanitarian law by ensuring the provision of vaccines to the Palestinian population under its control in Gaza and the West Bank, including East Jerusalem, as well as to Palestinian prisoners and detainees being held in Israeli jails. In the absence of accountability, Israel’s measures to acquire more Palestinian territory, demolitions of Palestinian homes and structures, as well as forced displacement of Palestinian civilians, settlers’ violence and other violations of human rights and international law, continue unchecked.”

“The Committee calls on Israel to immediately halt all settlement construction and expansion and all measures of de facto annexation. The Committee further highlights paragraph 5 of the resolution, which calls on Member States to distinguish, in their dealings, between Israel and the occupied Palestinian territory, including East Jerusalem, and that must include their dealings with regard to settlement activities. That would also apply to the labelling of products originating in Israeli settlements. With the COVID-19 pandemic affecting the Palestinian civilian population, the Committee echoes the concern expressed by many about the way in which Israeli authorities are rolling-out the COVID-19 vaccine, disregarding their obligations to ensure public health in the occupied territory.”

“This is the first announcement of the year of furthering illegal settlements, following a record for Israel’s settlement campaign in 2020, as attested to by the reports of various organizations, including the Israeli organization Peace Now. Moreover, a newly open road in the Jerusalem area separating Palestinians and Jewish settlers along its entire track, and which has been called “the apartheid road” even by Israeli media and human rights groups, offers yet more evidence that annexation remains very much on the table for the Government of Israel and is being continually pursued. Allow me to reiterate in the strongest terms that Israeli settlements in occupied areas are illegal under international law, as reaffirmed, inter alia, in resolution 2334 (2016), and constitute an obstacle to peace.”

“The coronavirus disease (COVID-19) pandemic has further undermined the already fragile social, economic, humanitarian and political situation in the occupied Palestinian territory, complicated by the crippling restrictions on movement and access imposed for decades by Israel, the occupying Power. Notwithstanding the pandemic, Israel has continued to expand its illegal settlement network in the occupied Palestinian territory, including in and around East Jerusalem and Bethlehem. The most recent announcement concerns the construction of nearly 800 new housing units in the West Bank and the retroactive so-called “regularization” under Israeli law of two additional illegal outposts, decisions that have been broadly denounced by the international community.”
