  3. “We hope that they will continue to give the relevant regional countries greater confidence and more opportunities, step up cooperation with their judicial organs and try their best to expand cooperation in that area. They should encourage and support new approaches to referrals and to the transfer of fugitives. We appeal to all countries concerned make efforts to facilitate the maximum number possible of referrals of cases from the Tribunals in a systematic and expeditious manner. Thirdly, a study of the Tribunal's legacy and residual responsibilities is becoming an increasingly pressing issue. First, since the introduction of the completion strategies, the Tribunals have been working hard to improve their methods of work and corresponding working procedures in order to speed up progress. We are already fully cognizant of that, and we hope that they will build on that foundation and continue to explore the possibility and feasibility of improving their working methods and making full use of the available time, space and human resources with a view to conducting highly efficient trials and avoiding, as best they can, any kind of delay, so as to bring the cases to closure on schedule.   5. “Ms. Chen Peijie (China) (spoke in Chinese): Allow me to begin by thanking President Pocar, Prosecutor Brammertz, President Byron and Prosecutor Jallow for their respective briefings on the work of the International Criminal Tribunal for the Former Yugoslavia (ICTY) and the International Criminal Tribunal for Rwanda (ICTR). We welcome them to New York. In particular, we welcome Mr. Brammertz, who is participating in a Council meeting for the first time in his capacity as Prosecutor of the ICTY. We have taken note of the continuing progress in the work of the two Tribunals, and we recognize their efforts towards implementing the completion strategies. As the completion strategy deadlines are drawing near, we expect the Tribunals to make a greater effort to intensify their work all areas.”

We appeal to Members in a position to do so to provide further financial and technical support so as to allow the countries concerned to gain the required capacities as soon as possible so that they may assist the Tribunals in making referrals in as systematic and timely a manner as possible. In that respect, the assessment prepared by President Pocar notes that "[t]he international community must not underestimate the importance of the courts in the States of the former Yugoslavia having the capacity to carry on the legacy of this International Tribunal long after it has completed its mission" (S/2007/663, para. 39).”

The Tribunals attach great importance to cooperation with national judicial organs and have made the referral of cases to national jurisdictions a core element of the completion strategy. All such achievements should be fully acknowledged. The progress has also led to confident optimism about the Tribunals" implementation of the completion strategy.”

  10. “All of that is to be commended. We hope that the Special Court will continue to work actively to achieve its various working goals as it continues to implement its completion strategy. Fourthly, we heard from the President and the Prosecutor of the Special Court that the Court continues to face a number of difficulties. In particular, they referred to the issue of cooperation. I believe that that is a very important issue indeed. Therefore, I should like to call on those countries in a position to do so to continue to provide support to the Special Court and to take a more cooperative approach so as to help it resolve issues such as the enforcement of potential sentences and the relocation of witnesses.”

  11. “Some trials have been completed and some are still under way, including the trial of Charles Taylor, which is being carried out by the Special Court in The Hague, using the facilities of the International Criminal Court. We believe that independent and fair trials help to promote national reconciliation, peace and stability in the region concerned. Therefore, we look forward to the smooth progress and early completion of the relevant trials. Thirdly, we are pleased to learn that the Special Court has also made steady progress in its completion strategy. It has amended its rules of procedure and evidence in order to enhance the efficiency of trials, and it has set very specific goals for its work. We have also noted that the Special Court has begun to address outstanding issues, including capacity-building in local judicial institutions.”

  12. “Ms. Chen Peijie (China) (spoke in Chinese): I too wish to thank the President, Justice King, and Prosecutor Rapp of the Special Court for Sierra Leone for their briefings. At the same time, I wish to thank Deputy Secretary-General Migiro for her presence at our meeting today. I wish to note that after hearing the briefings, we see that since the Special Court started briefing the Council two years ago, it has made real progress in its work, and that is commendable. Here, I wish to make the following points. First, China has always supported the work of the Special Court for Sierra Leone and will continue to do so in the future. Secondly, the Special Court has made progress in its trials, as we have heard.”
