We support President Abbas’s call for the holding of an international peace conference. As the Commander-in-Chief of the Cuban Revolution, Fidel Castro Ruz, said at the Non-Aligned Movement’s sixth summit conference in 1979, “[N]o more brutal dispossession of the right of a people to peace and existence has been committed in this century (...)   2. We reiterate our demand for Israel’s full and unconditional withdrawal from the Syrian Golan and all the occupied Arab territories. We call for an end to external interference in Syria and full respect for its sovereignty and territorial integrity. We also support finding a peaceful and negotiated solution to the situation imposed on that sister Arab nation. We reiterate our support for the Joint Comprehensive Plan of Action (JCPOA) with Iran and for the inalienable right of States to the peaceful uses of nuclear energy. We reiterate our rejection of the unilateral withdrawal of the United States from the JCPOA and its reimposition of unilateral sanctions against the Islamic Republic of Iran, which are contrary to international law and the Charter.

We condemn the unilateral decision of the Government of the United States to recognize Jerusalem as the capital of Israel and establish its diplomatic representation in that city, disrespecting its historical status, as well as its decision to recognize the sovereignty of Israel over the Syrian Golan, both of which constitute serious violations of the Charter, international law and the relevant resolutions of the Security Council. We reiterate our rejection of the so- called deal of the century, which ignores the concept of a two-State solution and threatens the future of the State of Palestine within its pre-1967 borders and with East Jerusalem as its capital. We demand an immediate and unconditional end to the United States’ arbitrary and illegal unilateral coercive measures imposed on sovereign nations in the Middle East.

The United States, which has repeatedly obstructed Council action and prevented it from fulfilling its responsibility under the Charter of the United Nations to ensure the maintenance of international peace and security, continues to obstruct a comprehensive, just and lasting solution to the Israeli-Palestinian conflict, while enabling Israel’s impunity. Other unilateral and unwarranted decisions by the United States Government, which the current Administration has not reversed, further undermine the possibility of a negotiated solution to the Israeli-Palestinian conflict, continue to severely harm the legitimate interests of the Arab nations and maintain the latent danger of an escalation in the region.

Despite long-standing requests from the United Nations, the Non-Aligned Movement, the League of Arab States, the Organization of Islamic Cooperation and other international actors, the Security Council has still failed to act to put an end to Israel’s military aggression and occupation of the Palestinian territory, including East Jerusalem. There can be no justification for continuing to prevent the Palestinian people from exercising their right to self-determination and to an independent and sovereign State within the pre-1967 borders, with East Jerusalem as its capital, and with the right of return of refugees also guaranteed.

  6. The violence against Palestinian civilians continues, and it includes arrests, detentions, imprisonment and killings, including of children. Israel is ramping up its illegal annexation policy and expanding its colonization practices. Homes and properties continue to be destroyed and more Palestinian families are being forcibly displaced as a result of the continued construction and expansion of Israeli settlements. The blockade of the Gaza Strip continues, as do the plans to annex the Palestinian territories in the Jordan Valley and other parts of the West Bank and East Jerusalem.

Mr. Gala López (Cuba) (spoke in Spanish): We support the statements to be delivered by the representatives of Azerbaijan, on behalf of the Movement of Non-Aligned Countries, and Indonesia, in its capacity as Vice-Chair of the Committee on the Exercise of the Inalienable Rights of the Palestinian People. Cuba maintains its long-standing and unwavering position in defence of and solidarity with the just cause of the Palestinian people. The most recent report of the United Nations Special Rapporteur on the situation of human rights in the Palestinian territories occupied since 1967 states that Israel is practicing apartheid in the occupied Palestinian territories. We note with deep concern the increasing tensions and human rights violations in those territories, including East Jerusalem.

We reaffirm that no just and lasting peace can be achieved in the Middle East until the Israeli occupation is ended; the Palestinian people can exercise their legitimate right to establish an independent State, with its capital in East Jerusalem; all the occupied Arab territories are returned; Israel withdraws from the Gaza Strip, the West Bank and the Syrian Golan to the borders of 4 June 1967; the Israeli provocations in the south of Lebanon are halted; the return of Palestinian refugees is guaranteed; and the illegal Israeli settlements are removed from all the occupied territories.

Violence and the use of force cannot lead to the solution that the world seeks for a conflict that would have been settled many years ago if the Security Council had acted with decision and transparency and without double standards. In order to advance in earnest towards a just solution of the Palestinian problem, the United States should refrain from using its paralysing and complicit vetoes when this question is under consideration in the Council. And it should immediately suspend financial support for military purposes and the delivery of military equipment to Israel, including tanks, helicopters, missiles and aircraft, which today are used against civilians. Cuba reaffirms its full support for the cause of the Arab peoples, in particular the Palestinian people, against the occupation and the aggression of Israel.

  11. The illegality of the construction of the wall and its associated regime was clearly confirmed by the International Court of Justice in its advisory opinion of 9 July 2004. Construction of the wall must cease immediately, and what has already been built must be demolished without delay. Cuba continues to condemn the acts of annexation, the excessive use of force that does not discriminate between civilians and combatants, the humanitarian crisis resulting from limitations on the circulation of goods and persons, the inhumane treatment of children, the generalized destruction of property and the territorial expansion through the construction of the separation wall.

Despite the appeals of the international community, the crisis in the Palestinian territories continues to worsen as the number of dead and injured rises, the vast majority of them innocent civilians. In that respect, we reaffirm that Israel must comply with international humanitarian law, including the Fourth Geneva Convention of 1949. Approximately one year has passed since the General Assembly adopted its resolution ES-10/15. However, the occupying Power has continued the dangerous and unacceptable construction of the separation wall in the occupied Palestinian territory, including in and around East Jerusalem, despite the fact that it is illegal and in violation of the norms and principles of international law and the relevant resolutions of the Security Council and the General Assembly.

Mr. Gala Lopez (Cuba) (spoke in Spanish): We consider the convening of this open debate to consider recent events in the occupied Palestinian territory, including East Jerusalem, to be very timely. The situation there has deteriorated even further. The recent hostile actions of Israel, the occupying Power, add to its long record of decades of aggression, violations of the most basic human rights and physical and emotional damage inflicted on the Palestinian people. That includes, inter alia, illegal settlements, house demolitions, arbitrary detentions, State terrorism and targeted extrajudicial executions, torture, the building of a separation wall in Palestinian territories and the suffocation of the Palestinian economy, all of which continues to increase the economic and social hardships of the Palestinians.

My Government reiterates once again its request to the Counter-Terrorism Committee established pursuant to resolution 1373 (2001) to proceed to an assessment of the information submitted by my country, in, among others, documents S/2002/ 15, S/2004/753 and S/2005/341, in the hope that its work will help put an end to the impunity enjoyed on the territory of the United States by those who have carried out, and continue to carry out, terrorist actions against Cuba. Cuba reaffirms its position of principle against all terrorist acts, methods and practices, in all their forms and manifestations, wherever, whenever, by and against whomever they are committed, including those in which States are directly or indirectly involved.

We would consider it to be a very serious matter if Washington were to decide to give asylum to Posada Carriles or if it were to adduce sophistic legal arguments to allow him to stay in the United States. That would constitute an affront to all the victims of terrorism throughout the whole world and to their relatives, including the people of the United States themselves. My Government urges the international community to demand that the United States Government fulfil its obligation to extradite Luis Posada Carriles to Venezuela.

  16. Resolution 1373 (2001), adopted by the Council based on a proposal by the United States, clearly establishes, in invoking Chapter VII of the Charter, the obligation of all States to ensure that any person who participates in the financing, planning, preparation or perpetration of terrorist acts or in supporting terrorist acts is brought to justice, as well as to take effective measures to prevent the movement of terrorists and deny refuge not only to terrorists but also to those who protect them. We hope that the case of the terrorist Luis Posada Carriles does not end up like that of Orlando Bosch Avila and of other self-confessed terrorists of Cuban origin - responsible for plunging dozens of Cuban families into mourning - who live freely in the United States and stroll along the streets of Miami.

If the United States Government wants to lend a sliver of credibility to its proclaimed war on terror, it has no option but to proceed to the extradition of a criminal who, it is worth recalling, was the author of numerous other terrorist acts, including a bombing campaign in Havana hotels in 1997 that caused the death of the Italian tourist Fabio Di Celmo. In addition, he has planned numerous attempts on the life of President Fidel Castro, for one of which he was sentenced in Panama, where he was fraudulently pardoned on 26 August 2004 by former President Mireya Moscoso.

  18. Most appropriately, the Government of the Bolivarian Republic of Venezuela requested the extradition of the terrorist Posada Carriles so that he could be submitted to trial in that South American country in connection with a heinous crime committed against a civilian aircraft belonging to Cubana de Aviacion, which caused the loss of 73 lives and for which he was on trial when, in 1985, he escaped from the Venezuelan prison where he was being held. My country takes this opportunity to reaffirm its belief that the only right action the United States Government could take is to agree to the extradition requested by the Bolivarian Republic of Venezuela that, in addition to being in compliance with the relevant norms of international law, is covered by a treaty in force between the two countries.

Under the increasing international pressure generated by the accusation by Cuba, and following more than a month of complicit silence, on 17 May 2005 the United States immigration authorities were obliged to detain the terrorist of Cuban origin Luis Faustino Clemente Posada Carriles, who had entered the country illegally and had applied for political asylum on the basis of the services rendered to the United States during more than 40 years as a member of the Central Intelligence Agency and the United States armed forces.

Mr. Gala Lopez (Cuba) (spoke in Spanish): My delegation wishes to join the expressions of solidarity with the British people following the bombing attack in London's public transportation system, which caused the death of dozens of individuals and hundreds of casualties. As expressed by the President of my country in a message to Her Majesty Queen Elizabeth II, the people of Cuba, which has been the victim of terrorism for more than four decades, shares the pain of the British people and condemns that unjustifiable attack.
