“Mr. President, I wish to commend you for the efforts made to engage the wider membership on this important issue of improving the working methods of the Security Council, at a time when the Council is perceived to be in a state of paralysis in terms of finding a lasting solution to the pressing events that are currently taking place in the Middle East, in particular in the occupied territories of Palestine and Syria. I wish also to align my statement with the statement delivered earlier by the representative of Iran on behalf of the Non-Aligned Movement. “Malaysia also welcomes capacity-building cooperation, as well as the exchange and sharing of information and intelligence on the issue of piracy. For Malaysia, such regional cooperation takes place in the frameworks of the Malacca Straits Sea Patrol and the Eyes in the Sky air patrols. I would like to assure the Council that Malaysia will continue to support any effort to ensure the safety and security of international maritime waters. “A comprehensive arrangement for maritime security in the Straits of Malacca was achieved through the Malacca Straits Coordinated Patrols in 2004 among Malaysia, Indonesia and Singapore. In that connection, I am happy to inform the Council that the incidents of armed robbery in the Straits of Malacca have dropped drastically, from a high of nine in 2011 to only one so far in 2012. Malaysia will continue to support the call for strengthened international efforts against piracy in the concerned areas. It is our hope to see a more vigilant and forward-looking mechanism in place to address such security threats. Having said that, we believe that regional and international cooperation should not impinge on the sovereignty and territorial integrity of affected States in any aspect.”

“Those six pirates have been dealt with within the framework of the Malaysian legal system. Malaysia has been actively ensuring that our maritime zones, which include the Straits of Malacca, are safe and secure for international navigation. The relevant authorities and enforcement agencies, which include the Royal Malaysian Navy, the Malaysian Maritime Enforcement Agency, the Royal Malaysian Police and the Marine Department, are constantly undertaking enforcement of the relevant regulations, direct protection and surveillance of Malaysia's maritime areas. It is evident that the overall improvement of maritime security in the Straits of Malacca is a reflection of close cooperation among the littoral States.”

“In that connection, we commend the role of the Contact Group on Piracy off the Coast of Somalia in facilitating discussions and the coordination of actions among Member States and organizations to suppress piracy off the coast of Somalia. As a trading nation, Malaysia will continue to follow the work of the Contact Group closely. As members may be aware, two ships belonging to the Malaysian International Shipping Corporation - the MT Bunga Melati Dua and the MT Bunga Melati Lima - one Malaysian-flagged tugboat and one Malaysian-flagged cargo ship, the MVAlbedo, were captured by pirates off the coast of Somalia and in the Gulf of Aden from 2008 to 2010. The MV Albedo is still under the control of the pirates. Malaysia also arrested six Somali pirates who tried to hijack a Malaysian vessel in the Gulf of Aden in January 2011.”

“We must continue to have mechanisms for naval enforcement, an improved implementation of the International Maritime Organization guidance and industry-developed best management practices for Protection against Somali-based Piracy, better application of self-protection measures, the prosecution of suspected pirates and the imprisonment of convicted pirates. For its part, Malaysia has been involved in the global effort to combat piracy off the coast of Somalia. Since 3 September 2008, the Royal Malaysian Navy has sent five warships to the Gulf of Aden, in stages, to provide a precautionary escort to Malaysian ships while traversing the Gulf of Aden. In the course of escorting Malaysian ships, the Royal Malaysian Navy has also assisted foreign flagged ships by providing safe passage for seafarers and those vessels.”

“On the problem of piracy off the coast of Somalia, Malaysia welcomes the report of the Secretary-General (S/2012/783). We are heartened to note that there has been a sharp decline in the number of pirate attacks and hijackings so far this year as compared with 2011. The sharp reduction in the number of attacks and hijackings confirms that the international community is certainly on the right path in our common goal to effectively overcome that threat. Nevertheless, we could not agree more that piracy continues to pose a serious threat not only to seafarers, but also to international trade. In that regard, Malaysia believes that we need to be cautious so as not to be complacent in the success that we have enjoyed in combating piracy.”

“I wish to take this opportunity to congratulate India on its presidency of the Council for the month of November. I wish also to align Malaysia with the statement just delivered by the Permanent Representative of Iran on behalf of the Non-Aligned Movement. Malaysia is of the view that this debate is timely indeed, as it allows all Member States the opportunity to address an issue that has plagued most of them. In that connection, I wish to reiterate Malaysia's support for the Council's efforts in addressing piracy as a global threat. “We urge Israel to fully implement resolution 1701 (2006), which called for a permanent ceasefire and for the complete withdrawal of Israeli troops from Lebanon, with full respect for the Blue Line. The situation in the Middle East needs our collective attention and a solution. Malaysia urges the main players to show political leadership and impartiality in order to improve the deteriorating situation in the region. We also wish to remind the Council that failure to enforce many of its resolutions on the question of Palestine has in some ways encouraged the occupying Power to continue defying world opinion. The time has come for us to make some difficult decisions for the good of the region and the world. It has been a year since Palestine submitted an application to be a State Member of the United Nations.”

“Malaysia joins the international community in urging restraint between Turkey and Syria with regard to the recent shelling incidents along their common borders. We believe that resorting to military action would worsen the situation. Both nations should find the courage to resolve their differences amicably, without the need for any military action. Malaysia strongly supports the restoration of Syrian sovereignty over the occupied Syrian Golan. We urge Israel to withdraw from the occupied Syrian Golan to the line of4 June 1967. Malaysia also reiterates its support for Lebanon in its efforts to complete the liberation of all its territories and condemns the continued violations and aggression launched by Israel.”

“We must continue to uphold the principles for the establishment of a Palestinian State under the two- State solution, based on the pre-I967 borders and with East Jerusalem as its capital. Only then will Israel and Palestinians live side by side in peace and security. We are appalled by the death of thousands of Syrian civilians and the thousands more who have been displaced and have taken refuge in neighbouring countries. The unabated violence and destruction of property must end, the loss of lives must be stopped, and due process of law must resume. We call upon all parties in Syria to cease hostilities immediately and abide by international law, including international humanitarian and human rights laws. We believe that a solution to the conflict in Syria must be a Syrian-led process ifit is to be sustainable in the long run.”

“World leaders also committed themselves to upholding the right to the self-determination of peoples who remain under foreign occupation, and to ending impunity for violations of international humanitarian and human rights law. Malaysia hopes that the Security Council will uphold the agreement adopted in the outcome document. The plight of the people of Palestine cannot be ignored by the international community. It is our moral responsibility to uphold their aspirations to freedom and liberty. Their ambitions for self-determination are legitimate aspirations. “On the same token, Malaysia is also extremely concerned with Israel's intention to divide the Al-Aqsa Mosque, which is also a holy site for Muslims and Christians. Such acts would further undermine international law and aggravate the situation in the occupied Palestinian territory. Just a few weeks ago, world leaders gathered in New York to participate in the High-level Meeting on the Rule of Law at the National and International Levels. Our leaders adopted what is considered to be a landmark Declaration (resolution 67/1). The provisions contained therein should be implemented. These include applying the rule of law to all States equally and resolving disputes by peaceful means, in conformity with the principles of justice and international law.”

“It is without a doubt that the deadlock in the talks on Palestine is diminishing the possibility of a return to the negotiating table for a two-State solution. With more Israeli settlements created, the probability of a resumption of mediation is even more remote. But the world cannot sit idle as the situation in the Gaza Strip and the West Bank continues to deteriorate, with no hope of recourse. We should collectively demand that Israel lift the blockade on Gaza immediately. Israel must cease all its illegal settlement activities. Malaysia has been consistent in its view that the continued occupation by Israel of Palestinian land and territory is unlawful and against international law.”

“We feel that, in the context of the issue of children and armed conflict, accountability consists not only in careful investigations and prosecutions of those responsible, but also in a broader shouldering on the part of individuals and institutions of the political, legal and moral responsibility for violations that have occurred in the past. “Malaysia acknowledges the two verdicts pronounced by the International Criminal Court and the Special Court for Sierra Leone in March and April this year on the former Congolese warlord Thomas Lubanga and the former Liberian President Charles Taylor, respectively, establishing important precedents for international jurisprudence on the war crime of recruiting and using children. They send a clear signal to commanders that child recruitment is a war crime and that perpetrators will be held accountable. In that regard, Malaysia feels that Governments in conflict should strengthen their capacity to investigate and prosecute adult recruiters before national courts.”

We believe there is an urgent need to strengthen collaboration and the protection of children within the United Nations system. In an effort to help accomplish that crucial ongoing task, at the General Assembly's sixty-sixth session Malaysia co-sponsored resolution 66/139, introduced by Thailand, on strengthening collaboration on child protection within the United Nations system, which was designed to bring about important organizational improvements that will further the cause of protecting children worldwide.”

“Malaysia is equally disturbed by the fact that there was a significant increase in 2011 of fatal incidents in the occupied Palestinian territories, where 20 Palestinian children were killed and 448 were injured. We are deeply concerned about the unending cycle of violence in which Palestinian children are detained and subjected to cruel and degrading treatment by Israeli security forces. I reiterate my call, particularly in the Council, for the perpetrators to be brought to justice. The only way forward is to ensure that Palestinians, especially Palestinian children, are granted their basic rights as human beings. Malaysia notes the mention in the Secretary- General's report of attacks on schools and hospitals. We are saddened that such places, which are regarded as safe havens, are being ravaged by such deplorable acts.”

I urge the parties involved to continue consultations with the United Nations and implement the action plans without delay. “The mass imprisonment of Palestinians, the routine demolition of homes and the displacement of Palestinians, the widespread violence by Israeli settlers against Palestinians, and the blockade and resulting reliance upon illegal smuggling to survive are practices that amount to a strategy to either force the Palestinian people off their land or so severely marginalize them as to establish and maintain a system of permanent oppression. Those Israeli practices are systematic. They are aimed at moving Palestinians off their land. Working together, they increasingly discredit Israel's claim of a commitment to two states living side by side in peace and security.”

“While in Gaza, we had the opportunity to observe the actual situation on the ground and to meet directly with witnesses and victims affected by Israel's blockade. The blockade continues to have a devastating impact on the people of Gaza. The principal result of Israel's blockade has been to make 80 per cent of the Palestinians in Gaza dependent upon international humanitarian aid. I have to admire the resilience of Gazans for being able to survive on so little, especially in the face of the inadequate health care, frequent power outages and not infrequent incidents of violence that mark their daily lives. The blockade on Gaza is illegal. It amounts to the collective punishment of 1.6 million Palestinians. The international community must bring pressure to bear on Israel until it is fully lifted.”

“Israel's continued occupation of the occupied Palestinian territory has stood as a sustained violation to international humanitarian and human rights law. The regime has displaced thousands of Palestinian people and killed innocent civilians. In short, Israel has failed in its obligation as an occupying Power to protect civilians, instead committing extrajudicial killings and oppression. The regime has continued along that degrading trajectory with impunity. Its persistent blockade of the Gaza Strip has further translated into misery for more than 1.6 million Palestinian people. I have just returned from Gaza, where I was on a United Nations mission under the auspices of the Special Committee to Investigate Israeli Practices Affecting the Human Rights of the Palestinian People and Other Arabs ofthe Territories Occupied since 1967.”

“In order to achieve peace in the Middle East, the plight of the Palestinian people should be resolved with international determination. The suffering of the Palestinians and the predicament of its people are currently the longest global tragedy of modern times. The solution has always been in sight, but it has been almost 20 years since the Oslo Agreement, which was endorsed by the two sides but never took off. Additionally, the Arab Peace Initiative of 2002 also never materialized. The long-standing two-State solution remains a vision, but nothing more. Peace in the Middle East once seemed so close, and yet today that solution is as far off as when it was first envisaged. The continued occupation by Israel of Palestinian land and territory are as unlawful today as it was in 1967.”

“The violence that we have witnessed over the past months has left thousands of civilians maimed and dead, despite the six-point plan and presence of United Nations observers. Malaysia is appalled by the civilian losses in Syria. Malaysia calls for all parties to the conflict to cease their violent activities immediately. “We continue to witness democratic processes and the participation of people in politics and political institutions is promising. Malaysia would like to highlight these positive developments as the appearance of normalcy and recovery has attracted the interest of many countries across the globe, including in the Council. Malaysia welcomes the recent political developments in Egypt, Libya and Tunisia, which have held elections in recent months. Malaysia believes that the transition to democratic processes in Egypt, Libya and Tunisia has shown that the people are at the forefront of political developments and will undoubtedly contribute to regional peace and stability. “We wish to reiterate that addressing the Palestinian question requires that the international community, particularly the Security Council, act truthfully and sincerely to achieve a just peace in the region. The Council should undertake immediate and substantive actions to address the Palestinian question by upholding its own resolutions. “We hope that, through the six-point proposal of the Joint Special Envoy of the United Nations and the League of Arab States and the Council's resolutions, the loss of life will end and normalcy will return to Syria. Malaysia also seeks a peaceful settlement through an inclusive Syrian-led political process, where the rights of all parties are protected. “I would not be doing justice to the Palestinians if I failed to mention the illegal blockade of Gaza, which is now entering its fifth year. Having witnessed its effects during my visit there last July under the auspices of the Special Committee to Investigate Israeli Practices Affecting the Human Rights of the Palestinian People and Other Arabs of the Occupied Territories, the illegal blockade is a cruel case of the deliberate economic strangulation of Palestine and a form of collective punishment that fully violates international law. Seventy per cent of the population of the narrow Gaza Strip, or 1.1 million inhabitants, have become dependent on United Nations humanitarian assistance. To alleviate the suffering, Malaysia calls on Israel to unconditionally and completely lift the illegal blockade.”

“In that regard, Malaysia calls upon Member States to refocus their attention on Palestine. While most of the world's attention seemed to be drawn to the Arab Spring, with particular regard to the protection of human rights, the rule of law and democratic principles, Malaysia wishes to draw the attention of the international community to Israel's continued violations of international law, including humanitarian and human rights law, even as I speak now. “In support of all of those efforts, Malaysia will continue to urge Switzerland, in its capacity as depositary of the Geneva Conventions, in particular the Fourth Geneva Convention, to convene a conference of the high contracting parties, at the earliest opportunity, to discuss issues related to the Convention in the context of the situation in the occupied Palestinian territory. We have witnessed rapid and substantive developments in the Arab world in the past 15 months, which have become known as the Arab Spring. While there have been positive outcomes, we have indirectly and unintentionally neglected the people of Palestine, who have been forced to live under the longest illegal military occupation in modern history. Palestine has recently been sidelined by other major events in the Middle East.”

“Let me first congratulate you, Madam, on your presidency of the Council for this month and, secondly, align my delegation with the statements delivered by the representatives of Egypt, on behalf of the Non-Aligned Movement, and Kazakhstan, on behalf of the Organization of the Islamic Conference, respectively. I also wish to thank Ambassador Pascoe, Under-Secretary-General for Political Affairs, for his briefing earlier today. Malaysia has been closely watching recent developments regarding the Palestinian question. We welcome all attempts by the international community to find ways and means to resolve that long-standing issue. Those efforts include the Middle East Quartet meeting of 11 April, as well as the efforts by Jordan to revive negotiations between the two States.”

“Commencing in 2008, with third-party funding, mainly through the Japan International Cooperation Agency, Malaysia has also provided technical expertise in the fields of agriculture, procurement, macroeconomics and statistics. Since 2002, a total of 43 officers from the Timor- Leste Armed Forces have attended MRCP programmes. Courses have included instruction for ship divers; language training; a course on law in armed conflicts; instruction on joint warfare and a course on United Nations military observer service. In 2003, Malaysia contributed $2.56 million as part of it efforts to assist Timor-Leste in developing its defense forces. Malaysia has also extended bilateral assistance in capacity-building programmes and training for PNTL personnel Malaysian police training centres since 2001.”

“Malaysia is continuously committed to assisting Timor-Leste in its nation-building efforts. We have provided substantial assistance to Timor-Leste, especially through the Malaysia Technical Cooperation Programme (MTCP) and the Malaysian Defense Cooperation Programme (MRCP). Since 2001, Malaysia has provided assistance to Timor-Leste in the area of human resources development through various training programmes. As of November 2011, a total of 350 officials from Timor- Leste have been trained through the MTCP in the areas of public administration; crisis management and diplomacy; the training of trainers for the Timor-Leste Police Academy; airport management; microfinance; prison administration and management; community nursing; road construction and management; and agriculture.”

“Malaysia has been actively participating in Timor-Leste since 1999. To date, Malaysia has a total of 230 police personnel and two military observers serving in the country. At the request of the United Nations, Malaysia has approved the deployment of an additional 20 police personnel to UNMIT, bringing the total to 250. Currently, Malaysia is the top police- contributing country in Timor-Leste. In November 2011, UNMIT requested Malaysia to consider extending the tour of duty of 20 Malaysian United Nations police officers until December 2012, which we have agreed to do. Those officers are part of the core group that is directly involved in the capacity-building activities of UNMIT. Our active participation in UNMIT is a manifestation of Malaysia's long-term commitment to Timor-Leste's development.”

“Malaysia stands ready to support a post-UNMIT presence in Timor-Leste, as part of our contribution towards the development and rebuilding of the country. We believe that economic and social development is crucial for ensuring long-term peace and stability in Timor-Leste. Malaysia fully supports Timor-Leste's application to become a full member of the Association of Southeast Asian Nations (ASEAN). In the recent ASEAN Coordinating Council meeting held on 17 November 2011, in Bali, Malaysia reiterated its position that Timor-Leste's application should be favourably considered, in line with article 6.2 of the ASEAN Charter and the fact that Timor-Leste meets the geographical criteria stipulated in therein. We look forward to welcoming Timor-Leste as a full member of ASEAN soon.”

“The upcoming elections are important, and we call on all parties to respect the outcome so as to ensure that stability continues to prevail. We are prepared to consider sending election observers to monitor the elections, if there is a formal invitation from the Government of Timor-Leste. Malaysia supports the Secretary-General's recommendations for the extension of UNMIT's mandate until 31 December. As the withdrawal of UNMIT is nearing, Malaysia calls for an early discussion on the long-term United Nations engagement in Timor-Leste. We believe that a post- UNMIT United Nations presence in Timor-Leste is necessary. We are always prepared to assist in promoting law and order in Timor-Leste.”

“Israel's insistence that Palestine assume direct negotiations without any preconditions does not reflect Israel's willingness to be fair and to be more accommodating to its future neighbour. While my delegation speaks today with a sense of pessimism, make no mistake that we remain resolute in our commitment to finding a lasting two-State solution based on the 1967 borders, with East Jerusalem as the capital of Palestine, where both sides could live side by side in peace and taking into account the security concerns of both. It is our earnest desire to see future discussions on the issue take a different tone that is more positive and reflects substantial progress on the ground. The time for peace is now and we must not miss this opportunity. Prolonging the conflict will only create more problems and is not in anyone's interest.”
