For my country, this debate is particularly important, as it reflects the Security Council's clear commitment to the political stability, reconstruction and development of Haiti. That country is a clear example of the vital comprehensive attention that should be given to many of the crisis situations on our agenda, which go beyond the strict notion of maintaining international peace and security.

  8. Thirdly, the indirect contacts between Israel and Syria, in which Turkey has played a key role in the past, must be resumed. In particular, the endeavours of the Special Envoys appointed by the President of the United States will also make it possible to achieve progress on this matter. In conclusion, I reaffirm my delegation's commitment to continue to support action by the Security Council and interested States with a view to attaining those objectives, while always giving precedence to the contribution that the United Nations should make, in the conviction that stability and security in the Middle East will come about as a result of dialogue and negotiation, not the use of force.

  9. Statements to that effect made yesterday by the new Prime Minister seem to be encouraging. Secondly, there must be a continued commitment by Israel and Lebanon to the provisions of resolution 1701 (2006), and the normalization of relations between Lebanon and Syria must continue. We are pleased to note that, to date, as a result of the Doha agreement of May 2008, calm has prevailed in Lebanon in the preparations for the parliamentary elections to take place in June this year. But we deplore the incidents that took place during the commemoration of the assassination of Prime Minister Rafik Hariri and the tragic news of the recent assassination of Kamal Medhat, leader of the Palestine Liberation Organization in Lebanon.

We also call on the Government of Israel to support the ongoing investigation - undertaken at its own initiative - regarding possible violations of international humanitarian law during the military operations in Gaza. We hope also that there will be an investigation of alleged human rights violations by Hamas. Tomorrow will mark 30 years since the signing of the historic peace agreement between Israel and Egypt. For that model to be reproduced in the region, three objectives must be attained. First, negotiations between Israel and the Palestinian Authority should be resumed, with a firm commitment by the parties to constructive dialogue without preconditions. In the present context, meeting that objective depends on progress in the intra- Palestinian dialogue and on the will of the new Government of Israel to support the peace process.

Here, we recall the importance of implementing the provisions of resolution 1502 (2003) regarding the obligation of all parties involved in an armed conflict to comply fully with the rules and principles of international law applicable to them related to the protection of humanitarian personnel and United Nations and its associated personnel, in particular international humanitarian law, human rights law and refugee law. We welcome the Secretary-General's decision to establish a Board of Inquiry to shed light on the attacks on United Nations facilities in Gaza; we await the findings of the Board's investigation and the identification of actions to be taken to prevent further incidents of this kind.

We shall also continue to make an active contribution to the work of the United Nations Relief and Works Agency for Palestine Refugees in the Near East, which acted in an exemplary manner throughout the recent conflict. My delegation is concerned by the fact that humanitarian work continues to be hindered, in particular in terms of access for humanitarian assistance and materials for rebuilding Gaza. In some cases, we see actions that are clear violations of international humanitarian law.

The outcome of the Sharm el- Sheikh conference was encouraging: it is a starting point for adopting a long-term approach to respond to the humanitarian crisis, taking account of fundamental aspects such as the permanent opening of all border crossings; support for the rebuilding of infrastructure; the sustainable economic, social and environmental development of Gaza; and the strengthening of governance. That collective effort made it possible to obtain pledges totalling nearly $4.5 billion. We trust that those pledges will be translated into concrete action to benefit the civilian population and regional stability. Mexico is participating in the effort by making a contribution to the World Food Programme, through its Operation Lifeline Gaza, which provides food to those affected by the conflict and promotes school attendance by children.

We must recall here that it is only through the introduction of a monitoring mechanism that a lasting ceasefire will be possible and that an end will be put to illicit arms trafficking into Gaza Strip, which was one of the central issues that brought about the recent crisis. Here, we commend Egypt for having taken steps to facilitate the intra- Palestinian dialogue and establish the basis for an agreement on Gaza. We also commend the international community for its efforts to resolve the humanitarian crisis and begin reconstruction efforts as soon as possible. We should redouble our efforts to make progress on the basis of agreements achieved at Sharm el- Sheikh in early March.

In addition to these events, we note that the lack of substantial progress in intra-Palestinian dialogue and the delays in the formation of a new Israeli Government have led to the temporary interruption of the peace process. We also believe that the continuation of the policy of demolitions and settlement activities in East Jerusalem and the West Bank does not bode well for the negotiations between Israel and the Palestinian Authority or for the establishment of a lasting peace. We therefore call on the parties to implement as soon as possible the provisions of resolutions 1850 (2008) and 1860 (2009), as they contain the elements necessary for the establishment of a permanent ceasefire and renewed dialogue.

Now more than ever, it is imperative that all of the actors concerned reiterate their commitment to political dialogue, to the peace process and to the establishment of a Palestinian State, living side by side with Israel in peace within secure and recognized borders. The recent crisis in Gaza has shown once again that weapons will not solve the conflict. Only a few weeks after the partial cessation of hostilities, we note with concern that rocket attacks from Gaza into southern Israel, the most recent of which took place yesterday in Ashkelon, have continued, as have air incursions by the Israel Defense Forces into Gaza. My delegation condemns these acts of violence and once again urges all stakeholders to respect the provisions of international humanitarian law at all times.

  17. Mr. Heller (Mexico) (spoke in Spanish): I would like to thank Mr. Lynn Pascoe, Under-Secretary- General for Political Affairs, for his detailed briefing on the situation in the Middle East. We also welcome the statements by the Permanent Representative of Israel and the Permanent Observer of the Palestinian Authority. Despite the adoption of resolution 1860 (2009) and the unilateral cessation of hostilities in the West Bank, a tense calm prevails in the Middle East. The humanitarian crisis brought about by the conflict has not been resolved and continues to pose a threat to the stability of the region.

We express our hope that peace can be safeguarded and stability consolidated so that Kosovo and the Balkans region in general can move towards a more stable, more prosperous future as an integral part of Europe. Although there are positive developments in the area of the rule of law, it should be applied uniformly throughout Kosovo, in particular with regard to access to justice without discrimination based on ethnicity or location. Those principles should be the basis of a fair and inclusive justice system that properly addresses civil and penal issues, as well as police activities.

Security Council resolution 1244 (1999) is the legal framework for the search for a solution to the situation of Kosovo, and the United Nations should be the competent forum in which to achieve a definitive, long-term resolution. Mexico has been a firm and constant promoter of the principles of justice and international law enshrined in the Charter of the United Nations, as well as of the International Court of Justice as the jurisdictional body, par excellence for peacefully settling differences arising from interpretations of international law. In that context, we await the Court's advisory opinion on Kosovo requested by the General Assembly during its sixty-third session.

We believe it important that the reconfiguration of UNMIK and the activation of EULEX - especially the transfer of police, justice and customs functions - have taken place successfully and without major incidents. The cooperation and coordination of both missions is a good example of cooperation between the United Nations and the European Union. Although the security environment in Kosovo has remained stable, tensions, including incidents of violence between communities in the region, remain cause for concern. Therefore it is important that, despite continuing difficulties on the ground, UNMIK should be able to appropriately carry out the mandate conferred upon it by the Security Council. We call on all parties to fully cooperate with the mission.

I also thank the Special Representative of the Secretary- General, Mr. Lamberto Zannier, for introducing the report of the Secretary-General on the United Nations Interim Administration Mission in Kosovo (UNMIK) (S/2009/149). We are also grateful to Mr. Skender Hyseni for his statement. A definitive solution to the issue of Kosovo is essential in order to achieve stability in the Balkan region. My delegation is pleased that the report of the Secretary-General reports on progress made in the deployment of the European Union Rule of Law Mission in Kosovo (EULEX) and the consequent reconfiguration of UNMIK under resolution 1244 (1999).

  24. That jeopardizes the lives of large parts of the population, in particular those of vulnerable groups such as women and children. Mexico is also concerned about the safety and security of humanitarian personnel on the ground, given the repeated incidents of intimidation and threats reported by OCHA. Mexico unreservedly condemns those incidents. 5 In order to address the situation in the Sudan as comprehensively as possible, my delegation urgently calls upon the Government of the Sudan to reverse its decision, allow the return of the non-governmental organizations that have been expelled and facilitate and guarantee adequate access for humanitarian aid and assistance to the civilian population, in line with the norms of international humanitarian law.

Mr. Heller (Mexico) (spoke in Spanish): My delegation would like to thank Mr. Rashid Khalikov of the Office for the Coordination of Humanitarian Affairs (OCHA) for the information he has provided this afternoon, which itself is justification for the holding of this meeting. The decision by the Government of the Sudan to halt the operations of the 13 non-governmental organizations (NGOs) concerned, which provide humanitarian assistance in northern Sudan, including in Darfur, is, to say the least, unfortunate. That decision not only inappropriately links the humanitarian situation with a decision by an international tribunal; it also jeopardizes the lives of a considerable number of people and opens the door to a crisis of major proportions by creating obstacles to access for international assistance.

In that sense, in both resolutions, the Security Council, having determined the situation to be one that threatens international peace and security, decided on the measures necessary to maintain or re-establish that peace and security. It is important also to recall that both resolutions explicitly establish that the authorizations granted are not considered precedents in customary international law. In our View, that is recognition of the exceptional nature of the authorized actions and of the Security Council acting pursuant to Chapter VII of the Charter. With that understanding, Mexico wishes to review its support for the initiatives undertaken by the International Maritime Organization and the Security Council to counter this threat in a coordinated and consistent way.

In that regard, we recognize the importance of Security Council resolutions 1816 (2008) and 1846 (2008), which authorize, subject to certain conditions, entry into Somalia's territorial waters, in accordance with the United Nations Charter. I wish to emphasize that in Mexico's View - as the texts of the aforementioned resolutions explicitly indicate i the powers granted to the Security Council under Chapter VII of the Charter are the legal basis that permits States to enter Somalia's territorial waters for the purpose of suppressing acts of piracy and armed robbery at sea and to employ, in Somalia's territorial waters, in a manner consistent with actions permitted on the high seas with respect to piracy under relevant international law all necessary measures to counter acts of piracy and armed robbery.

  29. With regard to the report of the Secretary-General on piracy in Somalia (S/2009/ 146), we acknowledge that piracy is one of the consequences of the serious instability affecting the country. That is why we agree with the Secretary-General on the importance of following an integrated approach to achieve stability in the region. Mexico condemns acts of piracy, armed robbery and violent acts against the safety of navigation in the Gulf of Aden and believes that their perpetrators must be brought to justice under the applicable legal system. Likewise, Mexico supports the validity, relevance and applicability of existing international law to address the threat represented by acts of piracy off the coast of Somalia.

  30. Measures must also be taken to address the alarming recruitment and use of children in armed conflict. Here, we acknowledge the significant role played by the Human Rights Unit of the United Nations Political Office for Somalia. We reiterate how important it is for that Office to continue its work in coordination with the new Government and AMISOM. With regard to international humanitarian law, Mexico calls upon the parties to the conflict to observe its provisions and principles, to cease attacks immediately and to avoid situations where civilians may be affected. It is also essential that the new Somali Government fulfil the measures of the sanctions Committee, as a complementary measure to the endeavours to bring about peace and security in the region.

Exchange of information and points of View with groups such as the Intergovernmental Authority on Development and the International Contact Group on Somalia can provide valuable contributions to such discussions. Fourthly, with regard to human rights, the enlarged police force must ensure full observance of human rights and adopt measures to protect the civilian population and ensure those responsible for violations be held accountable for the deaths of civilians, whether resulting from crossfire incidents, targeted assassinations or the murder of judges, as such acts foster impunity and undermine the judicial system. Mexico also condemns the attacks against humanitarian workers, which have caused a reduction in humanitarian aid and significantly affected vulnerable groups, in particular women and children.

  32. Concrete progress must also be promoted with regard to the justice system and to programmes to combat national and regional arms trafficking. That must be linked to actions to bring about the disarmament, demobilization and reintegration of ex-combatants as well as demining activities with United Nations support. The responsibility of the African Union here is essential, and close cooperation and coordination with regional bodies will facilitate the creation of strategies to consolidate the rule of law and bring about full compliance with international law as a basis for socio-economic development. Thirdly, the Security Council must bring about the active participation of regional bodies and mechanisms during discussions on the issue.

  33. An example is the agreement reached with some insurgent groups to declare a truce and proclaim Islamic law, sharia. However, it is worrying that the most extremist groups remain on the sidelines of dialogue, which threatens the fragile progress achieved. The President must therefore continue his efforts to bring about the full implementation of the agreement in order to promote inclusive political dialogue to stabilize the country. Secondly, it is essential that the new Government focus its efforts on a complete reform of the security sector - based upon the recommendations of the technical assessment mission which visited Addis Ababa and Nairobi last January - as a useful starting point to achieve progress in strengthening the Somali police force with the support of the Joint Security Committee and the Joint Security Force.

In the light of the success of the presidential elections held on 30 January in Djibouti, it is important for the international community to redouble its efforts to complete the establishment of the Somali State and its institutions, in close coordination with the new Government of Somalia, the United Nations, the African Union Mission in Somalia (AMISOM) and regional organizations. In Mexico's View, concrete action in the following areas is of priority. First, it is fundamentally important that the Djibouti agreement, signed in 2008 between the Transitional Federal Government and the Alliance for the Re-liberation of Somalia, continue to be the operative mechanism to promote the process of national peace and reconciliation. The new President has demonstrated his commitment to international efforts to establish peace.

The establishment of an office of the Office for the Coordination of Humanitarian Affairs is therefore timely, and we trust that the Mission will continue to strengthen its activities in the field of human rights protection. Stability in Afghanistan does not depend solely on the success of military and security actions. In line with national priorities, a comprehensive approach should be maintained, which will strengthen institutional capacity-building and promote socio- economic development. This should take into account the regional dimension of a number of problems affecting the country.

  38. The fight against drug production and trafficking is another priority area for Afghanistan's stability. We are gratified to see that the Government's efforts to bring down production in several provinces are starting to show positive results. In this area, cooperation with the United Nations Office on Drugs and Crime and the regional focus on the problem are of particular importance. We agree with the Secretary-General that UNAMA has the appropriate mandate to play a role in coordinating the various efforts to promote stability and development in Afghanistan. The additional resources approved for the Mission will enable it to strengthen its institutional capacity and extend its presence in several areas of the country.

  39. Specifically, we believe that all measures should be taken to prevent the recruitment of children by armed groups and ensure their return to a safe environment. Moreover, we recognize the efforts of the Government of Afghanistan and the international community to move forward in the removal and destruction of mines, other types of explosives and remnants of war in the country. Nevertheless, these artifacts continue to be a serious threat to the civilian population. For this reason, additional support should be given to demining programmes. We commend the efforts undertaken by the Government to reform various ministries and police forces and to reduce and fight against corruption. These efforts contribute to the institutional normalization of the country and to building the population's confidence in its authorities.

It is unfortunate that there is an upsurge of victims in the civilian population, and we trust that greater cooperation between the Afghan armed forces and the international forces will make itself felt through a reduction of damage to civilians and an improvement of the general security situation in the country. Once again, we emphatically reject terrorism in all its forms and expressions. We condemn the attacks on innocent persons and express our condolences to the families of the victims of the terrorist attacks and to the people and the Government of Afghanistan. For Mexico, the security of humanitarian workers and of the most vulnerable sectors of the population, such as children, calls for priority attention, in accordance with the standards and principles of international humanitarian law.

That is why we support the work of the Independent Electoral Commission and we hope that elections take place in a free, impartial and transparent fashion, in an atmosphere of security that will guarantee the rights of the Afghan people. We call on the United Nations system, and especially the Mission in Afghanistan, to redouble their efforts and work with the Electoral Commission, political parties, civil society and other actors to encourage successful elections this year. Mexico believes that ensuring the security of the population in the framework of the rule of law is one of the main challenges that Afghanistan faces in the short and medium term. The report is very clear in this regard, bearing in mind the deterioration of the situation in this area and the extremist violence that is spreading in various regions.

Mr. Heller (Mexico) (spoke in Spanish): Mr. President, I would first like to thank Mr. Kai Eide, Special Representative of the Secretary-General for Afghanistan, for presenting the latest report of the Secretary-General on the situation in that country (S/2009/135) and for his remarks regarding the work of the United Nations Assistance Mission in Afghanistan (UNAMA). I would also like to thank the Permanent Representative of Afghanistan, Ambassador Tanin, for attending this meeting. Mexico finds that the elections process to take place next August in Afghanistan is both a major challenge and an opportunity to achieve peace and a political solution to a conflict that has been going on for over eight years now. The elections should herald a new chapter for national reconciliation and strengthening sovereignty and democracy in Afghanistan.

Thus, drawing on the experience of United Nations peacekeeping missions in Africa, it is clearly important for us to have a strategic vision, shared by the AU and the United Nations, clear and viable mandates and close coordination between United Nations agencies and programmes in the field and regional and subregional organizations when a peace mission is deployed. The link between the AU and the Security Council could be strengthened through exchanges of information, in particular the presentation of regular reports on the regional and multilateral peacekeeping operations deployed on the continent. We therefore believe that we should explore the issue of mechanisms to develop AU capacities to take timely action.

  45. This cooperation with regional organizations, however, is of particular relevance and clearly fruitful when it occurs within the purview of regional organizations. We must not overlook this point when we consider the role of regional organizations. Neither must we forget that different organizations serve different purposes in each of the regions - hence the advantages of exploring this option in the case of the AU. We firmly believe that in order to achieve peacebuilding and peacekeeping in Africa, we need to work on four main issues: the resolution of conflict - that is, the establishment of peace; the promotion of economic development and of institution-building; respect for human rights; and conflict prevention through a focus on the causes of conflict and the eradication thereof.

The report of the African Union-United Nations panel on modalities for support to African Union peacekeeping operations (S/2008/813) is a useful and important contribution to the task of identifying more effective ways of linking the efforts of the United Nations in the area of peace and security, in particular those of the Security Council, with those of regional and subregional organizations. It is important to remember the inevitable regional dimension of internal conflicts. This requires the identification of appropriate strategies that define actions emphasizing compliance with international law, the peaceful solution of disputes, respect for human rights and the strengthening of the rule of law.

  49. For Mexico, it is important that UNAMI, together with other relevant actors, continue to give priority to supporting the approximately 2.8 million internally displaced persons. We therefore welcome the establishment of the cooperation mechanism of the 2009 consolidated appeal, which the Office for the Coordination of Humanitarian Affairs has promoted with a view to helping the most vulnerable people within the country, to supporting refugees in conditions of security and dignity, and to promoting a regional approach to guarantee the security of Iraqis. Likewise, it is important that UNAMI continue its work in the constitutional review process under way in Iraq. That will help Iraq to consolidate the rule of law and provide guarantees for Iraqis in the sphere of civil and political rights.

As international financing for reconstruction and development diminishes, the work of UNAMI becomes even more relevant, in particular its strategies to support the fight against poverty and initiatives towards the attainment of the Millennium Development Goals, its work to protect ethnic and religious minorities and its efforts to strengthen the education and health sectors. In addition, UNAMI will have an invaluable opportunity to continue to help the people and the Government of Iraq through key initiatives such as the International Compact for Iraq, the holding of local and national elections, the national assistance strategy and the establishment of the Independent High Commission for Human Rights.
