We therefore call upon the Somalis to engage in the peace process and faithfully to implement the Djibouti agreement and the agreement on the cessation of armed confrontation. We urge the international community to continue its efforts to develop a common approach to addressing the challenges facing Somalia. In that connection, we commend the African Union Mission in Somalia, the International Contact Group on Somalia, the Intergovernmental Authority on Development and other regional organizations on their active role in the reconciliation process and their readiness to support the implementation of the Djibouti agreement.

  2. On land, serious fighting among insurgent groups and against both the Ethiopian forces and African Union peacekeepers in the south-central regions and Mogadishu has resulted in the heavy loss of civilian lives. At sea, the surge in piracy and armed robbery against ships along the coast is truly alarming. Two recent cases of greatest concern to us were the capture by the pirates of the Ukrainian vessel MV Faina, carrying a large quantity of heavy weapons and small arms, and of an oil tanker belonging to Saudi Arabia. We share the Secretary-General's assessment in his report that the deterioration of security and stability in Somalia poses an immense challenge not only to the ongoing peace process, but also to the delivery of humanitarian aid that is highly critical to the TFG's efforts to address the humanitarian crisis in Somalia.

My delegation notes with appreciation the significant progress made by the Transitional Federal Government (TFG) and the Alliance for the Re-liberation of Somalia in the implementation of the Somali peace process, notably the signing on 26 October in Djibouti of two important documents: the modalities for the implementation of a cessation of armed confrontation and the joint declaration on common political aims. It is our sincere hope that they will pave the way towards a good-faith dialogue and mobilize the needed international assistance to help form a Somali unity Government, as outlined in article 9 of the Djibouti agreement. We are confident that this is a crucial step towards securing peace and stability in Somalia. However, we remain concerned by the increasing insecurity in and off the coast of Somalia.

  6. We are keen to learn more about its enhanced role in facilitating requests for assistance from Member States. Cooperation and coordination among the three Committees and their expert bodies are very important. We follow with interest the preparation of the third subregional common strategy workshop for the Northern and Eastern African States, to be held in Kenya from 11 to 13 November 2008, and look forward to reports on its outcomes. We hope the participation by representatives of CTED, the Monitoring Team and the 1540 Expert Group in the 1540-specific workshops next year will further improve coordination in the work of the three expert bodies.

The 1267 Committee has focused its efforts on implementing the new measures introduced in resolution 1822 (2008), which are intended to further improve the transparency and effectiveness of the 1267 sanctions regime. Those efforts should continue to get the guidance and support of the Council. The 1267 Committee should also find ways to improve Member States' understanding of those new measures, such as by providing interested States with opportunities to seek clarification or exchange views with the Committee in informal settings. The 1540 Committee also made important achievements, including the adoption in July 2008 of the second report on the status of implementation of resolution 1540 (2004) (S/2008/493, annex). We take note of the Committee's outreach activities.

While noting the Committee's intention to further improve the survey, my delegation wishes to reaffirm that any regional or subregional approach taken by the CTC should pay attention to the particular conditions of each country and encourage the participation of all countries in the region or subregion. We continue to support the CTC in carrying out its programme of work and in its participation in promoting the implementation of the United Nations Global Counter-Terrorism Strategy. We encourage the Committee's efforts to improve its dialogues with Member States, such as providing Member States with opportunities to present their views to the Committee with regard to visits to their countries or the contents of their preliminary implementation assessments (PIAs).

At the outset, my delegation wishes to thank Ambassador Jan Grauls, Ambassador Neven Jurica and you, Mr. President, in the capacity of Chairmen of the 1267 Committee, the Counter-Terrorism Committee and the 1 540 Committee, respectively, for the briefings on the work of the three Committees during the past six months. We would like to commend the three Committees, under the leadership of their Chairmen and with the assistance of their expert bodies - namely, the Monitoring Team, the Counter-Terrorism Executive Directorate (CTED) and the 1540 Expert Group - for having accomplished a good volume of activities. We take note of the survey of the implementation of Security Council resolution 1373 (2001) by Member States (see S/2008/379) adopted by Counter-Terrorism Committee (CTC) and submitted to the Council in June 2008.

While reaffirming that peace, reconciliation and stability in Guinea-Bissau are critical for peace and security in the West African subregion, we recognize the role being played by the Peacebuilding Commission, the United Nations agencies, regional organizations and the international community in facilitating the peacebuilding process in Guinea- Bissau. It is our expectation that the Government of that country will effectively galvanize bilateral and multilateral assistance and achieve further concrete progress in the course of achieving durable peace and sustainable development. Finally, we thank the delegation of Burkina Faso for the draft presidential statement, which we are prepared to support. We hope the Council will be able to adopt it promptly.

While recognizing the vital importance of poverty reduction, fiscal management, food security, health care and education promotion, disarmament and humanitarian assistance, we share the Secretary-General's appeal for enhanced support and training for Guinea-Bissau's law enforcement and criminal justice system within the wider framework of security sector reform and the fight against organized crime, drug trafficking and terrorism. We call on all national stakeholders to exercise restraint, renounce violence and strengthen political dialogue and reconciliation, thus contributing to the steady consolidation of peace and creating an environment conducive to socio-economic reconstruction and ensuring the peaceful and timely organization of the polls.

We commend the efforts of the United Nations Peacebuilding Support Office and the United Nations country team under challenging circumstances. My delegation notes with satisfaction that preparations for the legislative elections scheduled for 16 November 2008 in Guinea-Bissau have been on track and that the voter registration exercise has been successful.

In that connection, we welcome the decision made by the Peace and Security Council of the African Union at its 136th meeting, held on 12 June 2008, on the situation on the border between Djibouti and Eritrea, as well as on the development in relations between the two countries. My delegation also wishes to encourage the Secretary-General, in coordination with regional efforts, to use his good offices and to reach out to both parties to promote dialogue on arrangements for the immediate return to the situation prevailing at the common border between the two countries before the incidents leading to the current tension, including the withdrawal from the border of all forces that have been positioned there since February 2008, and for the development of confidence-building measures to resolve their bilateral dispute in a peaceful manner.

We wish to underline the fundamental principle to be applied to such situations, namely that the sovereignty and territorial integrity of States must be fully respected and that every dispute and conflict should be resolved through peaceful negotiations in a manner consistent with international law and with the United Nations Charter. We therefore call upon the two parties to show utmost restraint, to refrain from any threat or use of force, to strengthen the current ceasefire and to intensify dialogue to de-escalate the tension. It goes without saying that the primary responsibility to resolve the conflict rests with the two parties themselves. Viet Nam, however, commends the efforts undertaken by the African Union, the Arab League and the Organization of the Islamic Conference to facilitate the settlement of the dispute.

  18. Member States should fulfil their committed contributions to UNAMID promptly so that the force can fulfil its mandate. My country highly values the roles played by the United Nations and the African Union, and strongly supports the efforts made by the Secretary-General and the United Nations and African Union Special Envoys, Mr. Jan Eliasson and Mr. Salim Salim, in promoting the peace process in Darfur. We also support the appointment of a United Nations-AU joint chief mediator, who will assist the work of the Special Envoys and promote the peace process. Finally, we note with profound regret the recent events taking place in the border area between Chad and the Sudan, which have strained bilateral relations and complicated the regional situation.

We urge the rebel groups, in particular those that have not signed the peace agreement, to renounce the use of force and to engage in the peace process, with a view to reaching a comprehensive solution ensuring the legitimate interests of all parties concerned. My delegation highly commends the activities of the African Union-United Nations Hybrid Operation in Darfur (UNAMID), especially under such difficult circumstances on the ground, where the force has not been enhanced in terms of either manpower or equipment. The deployment of UNAMID on time and in full capacity in accordance with resolution 1769 (2007) is extremely important to promote the political process and to improve the humanitarian and security situation in the region.

First of all, like others, I wish to thank Mr. Jan Eliasson, the United Nations Special Envoy, and Mr. Salim Salim, the African Union (AU) Special Envoy on Darfur, for their respective presentations to the Council this morning. Viet Nam shares the Secretary-General's concerns about the deteriorating humanitarian conditions in Darfur, where tens of thousands of people continue to be homeless, to live in dire conditions and to fall victim to various violent acts. We condemn all acts of violence against civilians and humanitarian aid workers. My delegation is also deeply concerned over the worsening security and humanitarian situation in Darfur. Military actions have further complicated the situation and the political process. We call on the parties concerned to exercise the utmost restraint and to cease military and violent activities.

For this judicial process to be successful, the international community should try to find appropriate ways to help promote further cooperation and participation by the Sudan, as a sovereign State, with the ICC, as an independent international judicial body which, in accordance with its Statute, has a jurisdiction which is complementary to national jurisdictions. Confrontational attitudes and mistrust are not helpful and should be avoided. Viet Nam encourages the Government of the Sudan to step up the efforts of judicial bodies in the Sudan in exercising national criminal jurisdiction relating to violations of international humanitarian law and human rights law in Darfur, including through cooperation with the ICC and with other countries.

  23. We agree that justice for the victims of such violations is a component of a long-term and sustainable peace in the Sudan. At the same time, we believe that the application of justice must respect legal principles and should be sensitive to the complex and volatile situation in the country. By resolution 1593 (2005), the Security Council referred the situation in Darfur since 1 July 2002 to the ICC Prosecutor and requested the Government of the Sudan and all other parties to the conflict in Darfur to cooperate with the Court. The Council also encouraged the Court, as appropriate and in accordance with the Rome Statute, to support international cooperation with domestic efforts to promote the rule of law, protect human rights and combat impunity in Darfur.

  24. My delegation shares the assessments in the Secretary- General's reports and expresses its grave concern over the reported attacks against civilians and humanitarian forces in Darfur. We also fully acknowledge that continued efforts are needed to create conditions favourable to the peace process, including promoting the trust and cooperation of all concerned parties in the Sudan. We strongly support the United Nations activities, including the missions mandated by the Security Council to help bring about peace, security and stability in the Sudan. Fighting impunity for violations of international humanitarian law and human rights law in Darfur is part of the comprehensive endeavour for peace and national reconciliation in the Sudan.

  25. First, please allow me to join others in conveying our warmest welcome to the Foreign Minister of Costa Rica and to the new Permanent Representative of Belgium. My delegation wishes also to thank Mr. Luis Moreno-Ocampo, Prosecutor of the International Criminal Court (ICC), for presenting his seventh report to the Council pursuant to resolution 1593 (2005). Together with the latest reports of the Secretary- General on the Sudan, in document S/2008/267, and on the deployment of the African Union-United Nations Hybrid Operation in Darfur, in document 2/2008/304, the information brought to the attention of the Security Council by Mr. Moreno-Ocampo today further underlines the fact that the situation in Darfur, as well as the implementation of the Comprehensive Peace Agreement in the Sudan, remain highly complicated.

  26. Assistance should also be given in capacity-building, aimed at enhancing the capacity of national jurisdictions to handle referred cases and legacy issues. The Security Council, with the assistance of its informal working group on the International Criminal Tribunals and in close consultation with the Tribunals, should make timely decisions on the residual arrangements and mechanism. Finally, let me reiterate our firm commitment to working constructively with other members of the Council to ensure a smooth and effective completion of the work of the Tribunals.

We encourage the Tribunals to continue vigorously with their efforts to decide, within the time frame of the completion period, on any possible referral of cases of fugitives to national jurisdictions. That would also help the Council to decide on an appropriate residual mechanism to ensure international trials in non-referable cases. In the next two and a half years, we, as members of the international community, need to step up our efforts to ensure that the two Tribunals receive all the support necessary to complete their work and their mandates, including through continued provision of sufficient resources for retaining qualified staff members and working out good solutions in relation to their legacy.

While we fully share the assessments of the Tribunals that those estimates are subject to unforeseen circumstances, we are also mindful of the fact that the Council, in the aforementioned resolutions, asked the two Tribunals to take every step in their power to stay within their deadlines and urged all States, in particular those of the regions concerned, to cooperate fully with the Tribunals towards the timely completion of their work. In that connection, my delegation welcomes all cooperative efforts rendered by States to the Tribunals, as shown in the reports. Viet Nam notes with concern the number of fugitives, including the most senior ones whose names have been mentioned in the Council's resolutions. We believe, however, that the international community will not stop short of bringing those persons to justice.

Bearing in mind the time frame for the completion strategies of the two Tribunals, as set out by the Council in resolutions 1503 (2003) and 1534 (2004), we are very encouraged by the conclusion of the ICTR that the Tribunal remains on track with the majority of the projections announced in December 2007 to the Council. We take note of the ICTY's report that all efforts are being made to complete all trials as quickly and efficiently as possible, and that all appeals are estimated to be concluded in 2011.

My delegation would like to express its most profound appreciation to the Presidents and Prosecutors of the International Criminal Tribunals for the former Yugoslavia (ICTY) and Rwanda (ICTR) for their presentations today before the Council. We wish to take this opportunity to reaffirm our country's strong support for the work of the Tribunals to bring to justice the perpetrators of the most serious international crimes committed in Rwanda and the former Yugoslavia. Over the past 15 years, the two Tribunals have achieved a lot, and both are drawing towards a successful completion of their mandates.

Thirdly, it is also essential to enhance the effective cooperation and partnerships between the United Nations and regional organizations in the areas of conflict prevention, management and resolution, peacekeeping and peacebuilding and to strengthen the capacity of those organizations in these areas. While the primary responsibility for the maintenance of international peace and security falls within the purview of the Security Council, the mix of complementary resources and comparative advantages that regional and subregional organizations possess, including targeted expertise, local knowledge and geographical proximity, can be further exploited, in conformity with Chapter VIII of the Charter and, where appropriate, can contribute to helping countries recover from conflicts in all related fields.

It is equally important that coordination among the United Nations principal organs, as well as between United Nations Headquarters and field missions, be enhanced and better focused, thereby helping to maximize the use of available resources and capabilities and avoiding possible overlap and duplication. Secondly, given its unique experience and advantages in human resources and institutional mechanisms, the United Nations should play the leading role in coordination and collaboration among local governments, specialized agencies, international financial institutions, troop contributors and the international donor community in order to ensure the optimal impact of international assistance in post- conflict situations, especially in addressing the root causes of conflicts, such as hunger, poverty, disease and the inequitable distribution of social welfare.

At this juncture, my delegation believes that, in view of the specific characteristics of each post- conflict environment and with due respect for the fundamental principles of independence, sovereignty and territorial integrity, the international community should establish a more comprehensive and effective peacebuilding strategy that addresses the period extending from immediately after the cessation of conflict to the conduct of an exit strategy and that responds to the specific needs of the country concerned in each particular phase of development. Experience in many other countries also reflects the fact that, even when agreements are signed and ceasefires are in place, countries may relapse into conflict or civil violence if post-conflict peacebuilding lags behind. The growing complexity of contemporary conflicts, which often have serious regional spillover and carry unpredictable socio-economic consequences, has led to tremendous constraints on post-conflict peacebuilding and has exposed its limitations in maximizing its efficiency, resources and impact on the ground. It also requires a multidimensional and multisectoral approach to peacebuilding in close correlation with other areas of equal importance, such as early warning, conflict prevention and resolution, pacific settlement of disputes, preventive diplomacy and peacekeeping operations.

In an interdependent world, where the durable peace and sustainable development of a country and a region cannot be isolated from those of others, peacebuilding continues to emerge as an essential part of the collective efforts of the United Nations and the international community to ensure the transition from conflict to peace, development and reconstruction, and to prevent the recurrence of conflicts. Past experiences in Angola, Mozambique, Sierra Leone, Burundi and Timor-Leste remain vivid examples of how the long- term process of peacebuilding can help to address various political, security, socio-economic, humanitarian and development challenges in the post- conflict environment.

  43. First, the quality of the Committees' work depends very much on the cooperation of Member States in providing updated information on their implementation of the related obligations. The Council should continue to encourage the three Committees to work out further innovative ways to improve meaningful dialogues with Member States and enhance their support for the work of the Committees. Secondly, the principal mandate of the Committees is to monitor the implementation of the relevant Council resolutions. The Committees should continue their efforts in trying to get as detailed and correct a picture as possible of the efforts made by Member States, understanding the difficulties and challenges they face and engaging them in finding appropriate measures to improve implementation.

In that regard, we wish to reiterate that the Committee's work should be in accordance with its mandate, international law and the Charter of the United Nations, thus actively contributing to the cooperation of the international community in counter-terrorism and non-proliferation. With regard to the cooperation between the three Committees through their expert groups, my delegation takes note of the activities as presented in the joint statement. We look forward to seeing concrete cooperative actions undertaken by the three expert groups within the Counter-Terrorism Implementation Task Force, in the context of the implementation of the United Nations Global Counter-Terrorism Strategy. My delegation wishes to promote the Committees' work in the coming months and takes this opportunity to highlight the following points.

We will continue to participate in the discussion of the survey on the implementation of resolution 1373 (2001) by Member States, considering that document as providing a global picture of counter- terrorism efforts and identifying areas for further international cooperation to improve existing efforts. My delegation appreciates the efforts made by the 1540 Committee during the past six months, including those to encourage States to meet the reporting requirements, its various outreach activities to promote full implementation of resolution 1540 (2004) and its work to coordinate the assistance to implement the resolution. We welcome the adoption of resolution 1810 (2008), which extended the mandate of the Committee until April 2011.

  46. For its part, the CTC has adjusted the organization and methods of work of CTED to improve the quality and consistency of its technical judgments and dialogue with Member States. We support the CTC efforts in considering the preliminary implementation assessments, which serve as a tool to intensify dialogue with every Member State on the implementation of resolution 1373 (2001). In that regard, my delegation wishes to express its special thanks to members of the Committee, especially those of sub-Committee C, CTED experts and the Committee's secretariat, for their cooperation.

  47. Since Viet Nam became a member of the Council, it has made constructive contributions to the work of those Committees, including through its assumption of the vice-chairmanship of the CTC. My delegation shares the assessment of the three Committees Chairmen on the achievements made in the past six months. We would like to underline the activities of the 1267 Committee aimed at improving the effectiveness and the full and fair implementation of the sanctions regime under resolution 1267 (1999), in particular through improving the quality of the consolidated list, holding discussions to reach a consensus understanding among the members of the Committee on the three sanctions measures, and exploring ways to further improve the Committee's procedures.

We take this opportunity to thank the three Committees, under the able leadership of their Chairmen, and the expert bodies - the Counter-Terrorism Executive Directorate (CTED), the Analytical Support and Sanctions Monitoring Team and the expert group of the 1540 Committee - for their great efforts in discharging their respective mandates. Allow me to begin by reiterating my country's unwavering position that international terrorism and the proliferation of weapons of mass destruction constitute serious threats to international peace and security. Viet Nam has always been committed to the implementation of its obligations under the international treaties to which it is a party and Security Council resolutions in those areas.

  49. First and foremost, I wish to congratulate you, Mr. President, and the United Kingdom for assuming the presidency of the Security Council for this month. I would also like to congratulate South Africa for having accomplished its presidency in an excellent manner. My delegation welcomes this open debate of the Council, which provides an opportunity for the Chairs of the Security Council Committee established pursuant to resolution 1267 (1999), the Counter- Terrorism Committee (CTC) and the Security Council Committee established pursuant to resolution 1540 (2004) to brief the Council and the larger United Nations membership on their work since their last joint briefing in November 2007.

  50. Salim Ahmed Salim, especially during their visit to the Sudan last January to help organize the talks between the Sudanese Government and the rebel movements. We fully agree that their efforts should enjoy strong support from the Security Council and the United Nations. Furthermore, I would like to join all of my colleagues in extending our best wishes to the Permanent Representative of Croatia as she takes on her future responsibilities. Finally, I would like to conclude by reaffirming the Vietnamese Government's unwavering support for the efforts made by the United Nations and African countries for the full and effective deployment of UNAMID in particular and in bringing about peaceful resolutions to conflicts in Africa in general.
