It should also be noted that France, Germany and the United Kingdom (E3) continue to fully support and enforce such United States sanctions and policies. They, like the United States, are failing to meet their obligations under the JCPOA. Nevertheless, today the delegation of the United States played the victim and acted as if it was Iran that withdrew from the JCPOA and was responsible for the current status of the JCPOA. It needs to stop fooling the international community and stop the deception. Moreover, it has pursued its so-called maximum pressure policy against the Iranian people, the aim of which was to starve the Iranian people, as stated openly and shamelessly by the former United States Secretary of State. In reality, the United States has weaponized economic sanctions in its long-standing hostile policy against the Iranian people. Furthermore, as a permanent member of the Council, the United States has brazenly forced all other United Nations Member States to either violate resolution 2231 (2015) or face punishment.   3. I thank India for convening today’s meeting. I also thank the briefers for their briefings. Today, as expected, the members of the Security Council once again expressed their support for the restoration of the Joint Comprehensive Plan of Action (JCPOA) and called for its full implementation as the only viable course of action. Obviously, the JCPOA can be restored only by addressing the root causes of the current situation, namely, the United States’ withdrawal therefrom on 8 May 2018. Since then, the United States has reimposed all of its harsh and inhumane sanctions against Iran, in flagrant violation of its explicit legal obligations under resolution 2231 (2015).

  4. We hope that the high-level meeting between the OPCW Director-General and the Foreign Minister of Syria will take place and pave the way for the parties to settle their unresolved concerns. We once again agree that the recurring meetings on this file are costly in terms both of United Nations resources and Security Council members’ time. Furthermore, considering that the Syrian Arab Republic has complied with the Convention’s requirements and cooperated with the OPCW, addressing the issue in a political or unfair way will serve only to detract from the technical nature of the discussions.

Syria has also consented to an additional six-month extension of the tripartite agreement among Syria, the OPCW and the United Nations Office for Project Services, using written correspondence to reach an understanding. While promoting dialogue and engagement between the parties, we consider it essential to address the Syrian Government’s legitimate concerns in that regard, such as its position on the illegal establishment of the so-called Investigation and Identification Team. According to Syria, the CWC does not mandate the OPCW Technical Secretariat to conduct investigations into the use of chemical weapons, which makes its mandate unlawful. That implies a flaw in the implementation of the CWC and a disregard for its provisions that can only infuriate Syria, as a State party to the Convention.

  6. It is equally important to ensure that the Convention is implemented fully, effectively and without discrimination. Politicizing its application and exploiting the OPCW for political reasons therefore only endanger the credibility of the organization and the Convention. We commend the Syrian Arab Republic for its positive engagement with the OPCW and believe it merits recognition. Syria regularly submits its monthly reports to the OPCW Director-General. The most recent report was submitted on 15 November and included a thorough account of the country’s efforts to destroy chemical weapons and their manufacturing facilities. Syria made it possible for the OPCW Fact- Finding Mission to visit between 6 and 12 November and fully supported the completion of its mission.

  7. I congratulate India on its assumption of the presidency of the Council in December and Ghana on its successful presidency in November. Iran’s position on chemical weapons is clear. Their use is a flagrant violation of international law, and as a main victim of such weapons of mass destruction, Iran strongly condemns their use by anyone, anywhere, under any circumstances. On the Syrian file, Iran supports the resolution of outstanding issues on their own technical track within the Organization for the Prohibition of Chemical Weapons (OPCW), through dialogue and constructive cooperation between Syria and the OPCW. To that end, any investigation must be impartial, professional, credible and objective and must fully comply with the requirements and procedures of the Chemical Weapons Convention (CWC).

  8. We acknowledge that the Charter and international law provide the Syrian Arab Republic with a legitimate right to self-defence. We support Syria’s standing in the region and its improved bilateral relations. The international community must support the Syrian Government’s ability to achieve economic and social stability and to improve the living conditions of the Syrian people. A secure, stable, and prosperous Syria benefits the Syrian people and is in the interests of the region and of the international community. It can also facilitate the safe, dignified and voluntary return of refugees and internally displaced persons to their places of origin in Syria, upholding their right to return.   9. We once again condemn the theft of the Syrian people’s natural resources, particularly oil products, in areas occupied by foreign forces. This criminal act is an obvious violation of Syrian territorial sovereignty, relevant Security Council resolutions and the United Nations Charter. The Security Council must strongly condemn ongoing aggressions and terrorist attacks by the Israeli regime against Syria. The Israeli regime’s repeated violations of Syria’s sovereignty and territorial integrity, as well as its systematic and intentional targeting of civilians and civilian infrastructure, particularly the attacks on commercial airports and humanitarian shipments, are a flagrant violation of international law, international humanitarian law and the United Nations Charter.

In support of these efforts, during the two-day meeting that was held in Astana on 22 and 23 November, the senior representatives of the Astana-format guarantors emphasized the Constitutional Committee’s critical role and reaffirmed their willingness to support ongoing interactions between their members and the Special Envoy as a facilitator, in order to ensure the long- term stability and effective work of the next sessions of the Committee. They also expressed deep concern about the humanitarian situation emphasizing the need to remove impediments and increase humanitarian assistance to all Syrians across the country without discrimination or preconditions.   11. We believe that for the subsequent time of extension, the mechanism’s shortcomings and the Syrian Arab Republic’s associated legitimate concerns must be addressed. On the political process, Iran supports convening the next meeting of the Constitutional Committee, as the Committee’s ongoing work is critical to reaching a political solution. The cessation of the occupation and the full restoration of respect for the national sovereignty and territorial integrity of the Syrian Arab Republic are prerequisites to any political solution. In the meantime, the Astana format will continue its efforts aimed at bringing the crisis to an end and alleviating the sufferings of the Syrian people.

  12. The United Nations and its humanitarian organizations’ work in Syria is also affected by these illegal actions. Meanwhile, donor countries remain hesitant to contribute the necessary funding for Syria’s humanitarian response plan, which, according to the United Nations report, has not exceeded 42 per cent of the total funding required. We support the eighth cross-line delivery of humanitarian aid. However, a lack of visible progress in the cross-line delivery, as well as inequitable and discriminatory distribution of early-recovery projects, remain challenging and must be improved based on resolution 2642 (2022). We further emphasize the importance of the cross-border mechanism.

  13. I thank Special Envoy Pedersen and Under-Secretary- General Griffiths for their briefings. Syria’s humanitarian situation is dire, and the country’s continued economic difficulties have had a widespread impact. The frightening spike in suspected cholera cases reported across the country has aggravated the already precarious humanitarian situation. We commend the efforts of the United Nations and its agencies to provide humanitarian relief to those in need, as well as their cooperation in implementing resolution 2642 (2022). The ongoing unilateral coercive measures imposed by Western countries have exacerbated the humanitarian situation despite the efforts of the United Nations. In particular, they present substantial difficulties to public health and food security.

  14. We agree with the view that convening monthly meetings on this subject is costly, not only in terms of United Nations resources but also in terms of the Security Council’s time. Moreover, while the Syrian Arab Republic has met the requirements of the Convention and continues to cooperate constructively with the OPCW, handling this file in a political and double-standards manner will only divert discussion away from its technical substance. We support the discussion of this matter on its own technical track within the OPCW in order to foster positive dialogue between Syria and the OPCW and resolve the outstanding issues. A high-level meeting between Syria’s Foreign Minister and the Director-General of the OPCW, which we hope will be held, has the potential to pave the way for the parties to resolve the outstanding issues. The Syrian National Authority requested the Technical Secretariat to convene a coordination meeting of the two parties in Beirut to agree on the agenda for the high-level meeting, which the Technical Secretariat responded to on 3 October. The previous Council meeting on the Syrian chemical file was held on 25 October (see S/PV.9164) and today we meet on the same topic for the second time in less than two weeks, during which time there have been no new developments. Therefore, it is clear that there is no point for today’s discussion other than to repeat claims against the Syrian Arab Republic.

  16. We reiterate our call for the Chemical Weapons Convention to be implemented fully, effectively and without discrimination. We believe that politicizing the Convention’s implementation and exploiting the OPCW for political reasons endangers both the organization and the Convention’s credibility. Syria voluntarily joined the Convention in 2013 and dismantled its weapons arsenal, as well as the facilities used to manufacture such weapons. While encouraging dialogue and consultations between the parties, we believe that the collaboration of the Syrian Arab Republic with the OPCW should be recognized. We further commend the Syrian Arab Republic for providing monthly reports to the OPCW Director- General, detailing activities on its territory related to the destruction of chemical weapons and their production facilities.

  17. I would like to congratulate Ghana on assuming the presidency of the Security Council for November. I also congratulate Gabon for successfully completing its presidency for the month of October. Iran once again strongly condemns the use of chemical weapons, by anyone, anywhere and under any circumstances, as a flagrant violation of international law. We underscore once again that any investigation into the use of chemical weapons must be impartial, professional, credible and objective, and must fully comply with the requirements and procedures of the Chemical Weapons Convention. Equally crucial, the Organization for the Prohibition of Chemical Weapons (OPCW) must be able to perform its duties in an impartial, professional and objective manner in order to establish the facts and develop evidence-based conclusions.

At today’s meeting, the representative of that rogue regime went beyond that, blatantly threatening a Member of the United Nations with the use of force in the Chamber, in a flagrant violation of the Charter of the United Nations and international law. The Security Council must strongly condemn such reckless and belligerent statements, which can pose a threat to regional and international peace and security. We also totally reject the unjustified and unfounded claims levelled against my country by the representative of Albania, who deviated from the Council’s agenda issue. Iran has already rejected those unfounded assertions and detailed its position in its letters to the Security Council dated 10 September (S/2022/685), 19 October (S/2022/776),and 24 October 2022 (S/2022/794).

The representative of the Israeli regime attempted to abuse the Chamber once again, resorting to fabrications and lies and making repeated allegations by accusing Iran of hostile actions and malicious activities that the terrorist regime has conducted and is continuing against regional countries and beyond. Iran categorically rejects all those baseless allegations. It is obvious that the purpose of such unfounded accusations is to deflect attention from the meeting’s agenda item, which is focused on the atrocities committed by that apartheid regime against the Palestinian people, as well as its systematic and deliberate violations of human rights and international humanitarian law in the occupied Palestine territories.

We believe that the conflict in Palestine can be resolved only if the occupation ends and the inalienable right of the Palestinian people to self-determination is fully recognized, restored and protected, resulting in the full restoration of Palestinian sovereignty over all of Palestine. That, however, will not be achieved until the Security Council’s inaction remains an option. The Council’s current position has only encouraged and emboldened the Israeli regime to perpetuate its occupation and atrocities against the oppressed people of Palestine. The Islamic Republic of Iran regards it as its duty to support Palestine’s legitimate right to resistance to the oppression and aggression of the apartheid regime, in line with the right of self-determination, and that will be our principled policy until the occupation ends.

Due to the Security Council’s silence, all United Nations resolutions of the past several decades have remained on paper only, while we continue to witness more atrocities committed against Palestinians by that despicable regime. Members of the Security Council must consider whether any United Nations resolutions, particularly those urging an end to the occupation, settlement expansions or the blockade of Gaza, have been implemented.

  23. That is a crime against humanity, a violation of all international laws and norms, and a serious threat to international peace and security. For 74 years, such brutal crimes and atrocities have been committed against the Palestinian people without ceasing, and neither the occupation has ended nor has the occupier and apartheid regime faced any consequences. Today, the Palestinian people need the Security Council’s effective support and decisive action to stop the aggressor and end the occupation, not its sympathy.   24. I thank you, Madam President, for organizing this important open debate. The situation in the occupied Palestinian territories has deteriorated. United Nations reports indicate that 2022 has been the deadliest year for the Palestinian people since 2006. The Israeli regime has persisted with its oppressive, expansionist and apartheid practices, as well as systematic violations of the human rights of Palestinians by killing innocent people, including women and children, stealing and demolishing the property of the Palestinian people and forcibly evicting them from their homes. Today, Gaza has become the world’s largest prison and the voice of the oppressed people of Gaza is silenced. Civilians, including women and children, face severe deprivation and violations of their basic rights.

  25. Despite a bilateral defence cooperation agreement, Iran has never provided the parties with weapons for use in the Ukraine conflict, either before or after the conflict. Aside from the legal and political position, Iran believes, from a moral point of view, that providing military support could not be intended to end the war but rather to escalate it, increasing damage and destruction and causing more suffering for civilians. That is why Iran has urged the parties to uphold their obligations under international humanitarian law and conduct consultations to protect civilians and critical infrastructure from attacks or becoming military targets. Against that background, my delegation completely rejects all unfounded allegations made against my country at this meeting by a certain State. The meeting rose at 6.20 p.m.

Having said that, I would like to once again emphasize that any misuse of the functions described in note S/2016/44 for conducting the so-called investigation requested would be illegal and in clear violation of the Secretariat’s mandate. Finally, I would like to reiterate Iran’s clear and consistent position on the conflict in Ukraine. Since the beginning of the conflict, Iran has maintained a position of active neutrality and has emphasized that all United Nations Member States must fully respect the purpose and principles enshrined in the Charter of the United Nations and international law, including sovereignty, independence, unity and territorial integrity. Iran consistently advocates for peace and an immediate end to the Ukraine conflict.

The paragraph clearly refers to restrictions on items, materials, equipment, goods and technology that the State determines could contribute to the development of nuclear weapon delivery systems. As was stated in our letters of 19 October addressed to the Secretary-General (S/2022/776) and 24 October addressed to the Secretary-General and the President of the Security Council (S/2022/794), Iran has never produced or supplied, neither does it intend to produce or supply, items, materials, equipment, goods or technology that could contribute to the development of nuclear weapon delivery systems. With regard to the request to the Secretariat to conduct what is referred to as an investigation, the resolution itself provides no legal basis for such an investigation.

  29. Without a doubt, continuing such unlawful acts violates international law, the Charter of the United Nations and resolution 2231 (2015). In yet another desperate effort, those States have now attempted to establish an entirely artificial linkage between resolution 2231 (2015) and the use of unmanned aerial vehicles in the ongoing conflict in Ukraine by disseminating unsubstantiated and erroneous information, raising inaccurate assumptions and resorting to totally flawed, arbitrary and misleading interpretations of that resolution. Let us be clear, and let us elaborate on Iran’s position on resolution 2231 (2015). The claim regarding the violation of paragraph 4 of annex B to resolution 2231 (2015) is an erroneous, arbitrary and misleading interpretation that contradicts the letter and spirit of that paragraph.

First and foremost, I would like to clarify and emphasize that Iran’s participation at this meeting is confined to the matter raised in relation to resolution 2231 (2015), which is directly related to and affects Iran. As a result, I feel compelled to attend this meeting in order to elaborate on Iran’s position on the claims made against my country in the context of resolution 2231 (2015). Certain Security Council members, including the United States, accuse Iran of violating resolution 2231 (2015) despite the fact that those States continue to violate all their explicit legal obligations under that same resolution. The main example is the illegal withdrawal of the United States from the Joint Comprehensive Plan of Action, which is still openly used as bargaining leverage today.

  31. I thank you, Mr. President, for convening this meeting. Before I begin, I would like to express my sorrow and sadness that our people and my country were targeted today by a terrorist attack whereby, according to the initial reports, a couple of armed gunmen attacked a holy religious site, the Shah-e-Cheragh Shrine, in Shiraz, resulting in at least 15 people martyred and another 21 injured. That is a heinous terrorist attack on civilians, including children and women. Iran once again condemns terrorism in all its forms and manifestations as a real and grave threat to international peace and security, and it is expected that the Security Council explicitly and strongly condemn such a heinous crime.

  38. In that regard, we welcomed the Special Envoy’s recent visit to Damascus, particularly his meeting with Syria’s Foreign Minister on 17 October. We are maintaining our contact with the Syrian Government, the Special Envoy and our Astana format partners in order to facilitate the next Committee meeting as soon as possible, and we support Mr. Pedersen’s efforts in that regard. The free movement of terrorist groups within Syria’s territory where foreign forces are illegally present is a danger to Syria’s sovereignty and territorial integrity, as well as regional peace and security. As has been said repeatedly, the fight against terrorism must not be used to violate Syria’s sovereignty and territorial integrity.

We hope that the next meeting will be a real interactive dialogue, contributing to serious discussion about identifying the obstacles and difficulties facing the implementation of the resolution and how to overcome them before the mandate of the resolution expires early next year. The only way to improve the situation in Syria is to achieve a political solution through a Syrian-owned and -led political process facilitated by United Nations efforts. To that end, we support the convening of the next meeting of the Constitutional Committee, as its ongoing work is critical to reaching a political solution. Iran supports the constructive engagement of the parties with the Special Envoy and with the political process in order to effectively settle the differences concerning the Constitutional Committee meetings.

We urge all stakeholders and donors to support the full implementation of the resolution, stop politicizing humanitarian and development efforts and remove obstacles in their way, particularly by refraining from imposing unilateral coercive measures. We regard the first session of the informal interactive dialogue, which was held on 26 September, as an initial and significant step to review and follow up on the implementation of resolution 2642 (2022). However, we believe that politicizing such a meeting will only undermine the resolution’s goal and its implementation.

  41. We support the Syrian Government’s full cooperation with the United Nations and humanitarian organizations involved in delivering aid in Syria. In that context, we applaud the Syrian Government’s efforts to improve the humanitarian situation on the ground, including by providing assistance to the United Nations to enhance the delivery of humanitarian aid to those in need and implement the early-recovery projects mandated by resolution 2642 (2022). Moreover, the ongoing efforts to effectively implement resolution 2642 (2022) must be accelerated and be focused on the early-recovery projects essential to people, such as electricity, water, sanitation, health, education and shelter.

  42. I thank the briefers for their insightful briefings. The Syrian people are still suffering. The humanitarian situation remains difficult, causing a significant impact on the Syrian people. More needs to be done in many areas to alleviate their suffering. Providing humanitarian aid to those in need is critical, and ensuring safe, rapid and unhindered access to aid for those in need throughout Syria must be a priority in this situation. Preserving the sovereignty and territorial integrity of Syria is also crucial. It must be accomplished as soon as possible. That can be done by ending the foreign aggression against Syria, as well as the country’s occupation, dealing with terrorist threats and lifting the cruel and illegal sanctions imposed on the Syrian people.

While the Syrian Arab Republic has met the Convention’s requirements and continues to cooperate constructively with the OPCW, handling this file in a political manner and applying double standards will only divert discussions away from its technical nature and could undermine the Security Council’s credibility and authority. We believe that it is high time for the Council to return discussions on the issue to the technical track within the OPCW in order to foster a constructive dialogue between Syria and the OPCW to resolve outstanding issues. Furthermore, by focusing on the technical rather than the political aspect, the OPCW will be able to carry out its functions in an impartial, professional, credible and objective manner in order to draw conclusions based on factual evidence.

In that context, we commend the Syrian Arab Republic for submitting its 106th monthly report to the OPCW Director-General on 15 September, detailing activities on its territory related to the destruction of chemical weapons and their production facilities. In line with that constructive cooperation, the Syrian Arab Republic also facilitated a visit of the OPCW Technical Secretariat to Syria to conduct the ninth inspection tour of the Syrian Scientific Studies and Research Centre. We hope that a high-level meeting between the Syrian Minister for Foreign Affairs and Expatriates and the Director-General of the OPCW will take place as soon as possible, with an agenda agreed upon by both parties that will contribute to resolving the outstanding issues.

We believe that politicizing the implementation of the Convention and using the Organization for the Prohibition of Chemical Weapons (OPCW) for political ends endangers both the legitimacy of the Convention and the OPCW, which is as equally deadly as a chemical weapon. We emphasize that any investigation into the use of chemical weapons must be impartial, professional, credible and objective in order to establish the facts and reach evidence-based conclusions. In doing so, it must strictly adhere to all provisions and procedures within the framework of the Convention. We acknowledge the critical importance of the Syrian Arab Republic’s efforts to uphold its obligations under the Convention. We encourage continued communication and interaction between the OPCW and the Syrian Arab Republic.

As the main victim of most of the systematic uses of chemical weapons in modern history, the Islamic Republic of Iran once again condemns, in the strongest possible terms, the use of chemical weapons by anyone, anywhere and under any circumstance. We share the view that the use of such inhumane weapons, which pose a serious threat to international peace and security, must not be tolerated. The only way to guarantee that chemical weapons are never used again is to destroy and eliminate all chemical weapons on a global scale and take all necessary measures to prevent the production of such weapons of mass destruction. We reiterate our call for the full, effective and non-discriminatory implementation of the Chemical Weapons Convention.

The Security Council must work diligently to ensure that resolution 2642 (2022) is properly implemented in a balanced and effective manner, particularly in terms of early-recovery projects and enhancing the cross-line delivery of humanitarian assistance. We once again condemn the robbery in areas occupied by foreign forces of Syrians’ natural resources, particularly oil products, which are critical to supporting the Syrian economy and saving lives. That criminal act clearly violates Syria’s territorial sovereignty, the relevant Security Council resolutions and the Charter. We support Syria’s standing in the region and its improved bilateral relations. The Syrian Arab Republic has always played a significant role in regional peace and security.

The continuation of illegal unilateral sanctions on the Syrian people is having disastrous consequences for every aspect of their lives and runs counter to various provisions of resolution 2642 (2022), particularly those related to the implementation of early-recovery projects, which are critical to strengthening Syrian resilience and enabling displaced people to return home. Those unlawful measures have also had a negative impact on the international and national efforts of humanitarian organizations in Syria. We reiterate our call for ending such illegal and disruptive measures. It is self- contradictory to voice concern about the difficult humanitarian situation in Syria while supporting unilateral sanctions against the Syrian people.

We are maintaining contact with the Syrian Government, the Special Envoy and our Astana format partners in order to ensure that the next meeting of the Committee is held, and we support the Special Envoy’s efforts in that regard. We also emphasize once again that the Committee must work in strict accordance with its terms of reference and rules of procedure, free of outside influence or pressure and any imposition of artificial deadlines. This must be a truly Syrian-led and Syrian-owned effort, with the role of the United Nations limited to facilitation. Given the dire situation in Syria, the provision of humanitarian aid is essential, and political circumstances should not prevent humanitarian aid from reaching people in need.

Israel’s ongoing attacks, particularly its systematic and deliberate targeting of civilians and critical infrastructure in Syria, including the recent attack on Aleppo’s international airport on 31 August, are a flagrant violation of international humanitarian law and constitute an act of aggression and a war crime. We call on the Security Council to hold the Israeli regime accountable for such violations and atrocities, which threaten regional and international peace and security. With regard to the political process, we support the convening of the next Constitutional Committee meeting, as the Committee’s ongoing work is critical to reaching a political solution.
