“We hope that the five- month period of calm in Gaza and southern Israel will persist for the benefit of both sides, leading to the improvement of living conditions for the civilian population of Gaza and the opening of the crossings for the movement of persons and goods. Regrettably, the renewed rocket attacks into Israel from Gaza are calling into question the commitment of Palestinian groups to prolonging the calm. Such acts, which give rise to Israel's exercise of its undeniable right to self-defence, are irresponsible and unacceptable and have to be brought to an end. Croatia believes that only a political settlement that is a two-State solution can fundamentally alter the socio-economic situation for the Palestinian population and guarantee security for Israel.”

“We note, for example, that the ministers for foreign affairs of the League of Arab States, meeting in Cairo, pledged in their statement that their Governments would send food and medicine to Gaza and said that they would coordinate with Egypt and Jordan to ensure that their supplies enter Gaza. Israel's legitimate security concerns should not be casually disregarded, as it has been confronted with hostile shipments in the past. Furthermore, the humanitarian situation in the Gaza Strip cannot be seen in isolation from its wider background and its underlying causes, at the heart of which is Hamas' usurpation of the legitimate institutions of the Palestinian Authority in Gaza.”

“I shall now make a statement in my capacity as the representative of Croatia. Croatia shares the concerns expressed over the serious humanitarian situation in the Gaza Strip. We understand that resuming humanitarian activities and the provision of basic supplies to the civilian population of Gaza is a matter of urgency. Croatia welcomes the humanitarian effort to alleviate the situation of the Palestinian people, but it should not lead to instrumentalizing the suffering of the civilian population for other purposes. There exist established channels and procedures for delivering aid. We believe that those should be followed in the interest of all of the parties and beneficiaries of such actions.”

“We understand that the Government of Chad is under a great deal of pressure, but we believe that it should further increase its investment in creating a viable political dialogue that will bring an end to the conflict and restore the normality that is so needed in order to be able to address humanitarian and development issues. We are encouraged by Mr. Holmes' optimistic assessment of the situation in Chad over the past 12 months and we hope this trend will continue. We hope that the recent rapprochement between Chad and the Sudan will also help bring positive change to the humanitarian situation.”

“If anything, this briefing has assured us that the international community needs to invest more efforts into bringing a political solution to this conflict, and ending impunity for all war crimes will certainly help in this process. As has been proven time and again, there is no lasting peace without justice, and any suggestion to the contrary is hollow and without merit. Croatia joins other delegations in thanking Mr. Holmes for all the work he has done and for his briefing today about his most recent trip to Chad and the Sudan. I would also like to welcome the Ambassador of Chad and thank him for his statement. It was only this morning that we were briefed on the Sudan from another angle, that is, its lack of cooperation with the International Criminal Court. Now, we have heard in graphic detail what the situation is in this country and about the ongoing suffering of the population, especially that of refugees and the internally displaced persons (IDPs), many of whom are women and children. What we have heard is very disturbing and I echo other delegations who have expressed their serious concerns and indignation.”

“We reiterate the clear message that this Council reaffirmed in its presidential statement last June (S/PRST/2008/21) and call upon the Government of the Sudan, all parties to the conflict in Darfur, as well as United Nations Member States, to extend their full cooperation to the Court. Croatia takes seriously and supports the Prosecutor's recommendations on bilateral and multilateral actions that need to be taken in order to ensure enforcement of the Court's decisions in the future, in the hope that these can be endorsed by all members of the international community. “As regards the lack of cooperation of the Government of Sudan with the International Criminal Court, this, in our View, represents the Sudan's disregard of its international obligations as specified in Security Council resolution 1593 (2005). As such, it also represents the disregard of the Security Council itself. The constant defiance of the Sudan towards the Court shows contempt for the multitude of victims in Darfur, as well as for international order and the United Nations Charter. The crimes committed in Darfur, and the impunity associated with these acts, as demonstrated by the Government of the Sudan, is intolerable and must be brought to an end.”

“It is regrettable that the Government of the Sudan continues to refuse to cooperate with the Court despite its prosecutions, many of which engage the Government in the judicial process. The principle of complementarity is the cornerstone of the ICC. It is disappointing to note that, despite its rhetoric, the Government of the Sudan has not made any genuine effort to comply with the complementarity test and allow the Court to examine the admissibility of the applications. While we appreciate the ongoing efforts aimed at securing a peaceful solution to the conflict in Darfur, and the sensitivities of that process, Croatia believes that it would be tragic if this should lead to accommodating permanent impunity by interfering with the ongoing independent judicial activities.”

I join others in thanking Mr. Moreno-Ocampo for his briefing and offer both him and the International Criminal Court (ICC) Croatia's full support. This morning we heard yet another very disturbing report which not only conveys a lack of substantive progress in bringing to justice those responsible for atrocities in Darfur but also the threat of ongoing violence. Shocking and abhorrent crimes continue to be committed against innocent civilians, mostly women and children. Equally deplorable is a string of attacks against peacekeepers and humanitarian workers. We take note of the latest application presented by the Prosecutor against three rebel commanders in connection with the Haskanita attack and the application against Omar Al-Bashir.”

“We also expect that the European Union Rule of Law Mission in Kosovo (EULEX) will ensure and aid in further solidifying Kosovo's independence and sovereignty, as well as offer its assistance in the development of democracy and the rule of law as the most visible and symbolic proof of its engagement. We welcome the decision of the Secretary-General to proceed with the further reconfiguration of UNMIK and thus facilitate the deployment of EULEX throughout Kosovo. Croatia signed an agreement with the European Union on 24 November 2008 enabling my country to participate in EULEX. “My delegation shares the great concerns expressed by Council members about the effect that the continuing deterioration in security is having on the already dire humanitarian situation and the civilian population. The reports from the field about civilians being at the mercy of all parties involved in the conflict are extremely disturbing. All parties to the conflict should be held equally accountable for violations of international humanitarian law, including guarantees for the unimpeded delivery of humanitarian aid. In a situation in which more than 3 million Somalis are in dire need of assistance, humanitarian access should continue to be a priority for the international community as a whole.”

“We welcome the consolidated description of a feasible international stabilization force, as presented in the Secretary-General's report, and the subsequent efforts of the Secretary-General to raise the issue with potential lead countries and troop-contributing countries. “In that regard, we welcome the progress made with respect to the Djibouti peace process, in particular the technical signing of the Djibouti agreement on 19 August and the signing of a cessation of armed confrontation agreement on 26 October. We commend the parties - the Transitional Federal Government and the Alliance for the Re-liberation of Somalia - on the commitment to the peace process they have demonstrated thus far. We hope that determination will be further translated into concrete measures, in particular with respect to the implementation of the cessation of the armed confrontation agreement and the establishment of a Government of national unity. We also echo the Secretary-General's call for all Somalis to join the peace process. That being said, we hope that the aforementioned developments will have a real impact.”

“I would like to join others in thanking Assistant Secretary-General Menkerios, the Secretary-General of the International Maritime Organization (IOM), the Director of the Africa II Division of the Department of Peacekeeping Operations (DPKO), the Permanent Representative of Somalia and the Permanent Observer of the African Union to the United Nations for their briefings and interventions. We take note of the report (S/2008/709) of the Secretary-General and the observations contained therein. I must admit that they provide us with a rather bleak picture. Bearing that in mind, allow me to make a number of short observations. We believe that true progress on the political track is the essence of a sustainable, long-term solution.”

“In addition, we would also like to stress our support for the process that was recently launched aimed at the adoption of an arms trade treaty, as well as our support for the opening for signature of the Convention on Cluster Munitions later this year in Oslo. Let me conclude by expressing once again Croatia's support for this debate and any further efforts aimed at strengthening the existing international system of collective security. Our discussions here today are a step in right direction.”

“We would also like to stress the importance of compliance with agreements already in place, which greatly contributes to collective security and has beneficial effects on confidence between nations in their international relations. In this regard, Croatia would like to stress the utmost importance of upholding the relevant provisions of the Charter as they relate to the legal effect of decisions adopted by the Security Council. We would also like to reiterate our support for existing international agreements and instruments in the field of non-proliferation, disarmament and arms control, which contribute positively to collective international and regional security and stability.”

“As regards the promotion of development through the reduction and prevention of armed violence, we would like to take particular note of the importance of the Geneva Declaration on Armed Violence and Development, which was endorsed by more than 100 countries, including Croatia. In this framework, I would like to draw the Council's attention to a regional meeting that was held in Sarajevo, Bosnia and Herzegovina, only a few days ago, at which the countries of South-Eastern Europe adopted the Sarajevo Declaration on Armed Violence and Development. Croatia supports international efforts for more effective arms control.”

“My delegation concurs with the notion that a reduction in military spending and expenditures can, where appropriate, contribute to committing more resources to development and can be important in achieving the Millennium Development Goals, although we believe that this idea should be coupled with the principle of responsible governance and should not negatively affect national or regional security and stability. In the context of development, we would like to recognize once again that development, peace, security and human rights are interlinked and mutually reinforcing.”
