  1. It is not enough to denounce and condemn Israel for its violations of international law, since that path has not led to any positive results and, to some degree, has resulted in complicity. To conclude, Ecuador calls upon the international community to support the request of Mr. Mahmoud Abbas, President of the Palestinian Authority, to accept Palestine as a State Member of the United Nations with full rigths, within its 1967 borders and with East Jerusalem as its capital. While the issue is being studied, we call for the support of the General Assembly to consider Palestine as an Observer State of the Organization. Only in that manner will we achieve peace and security in the Middle East, and thereby the security of all States Members of the United Nations.

My country believes it is timely to implement the Declaration of the High-level Meeting of the General Assembly on the Rule of Law at the National and International Levels (resolution 67/1), adopted at the opening of the current session of the Assembly (see A/67/PV.3), which states that, "the rule of law applies to all States equally, and to international organizations, including the United Nations and its principal organs, and that respect for and promotion of the rule of law and justice should guide all of their activities". (resolution 67/1, para. 2) In that context, my delegation calls for the Security Council to drop its passive attitude when considering Israeli abuses.

Since 1992, it has built a true wall of shame based on the pretext of security concerns, althouth its purpose is actuallly to militarily control the West Bank and impede the lives of the Palestinians by controlling agriculture and 82 per cent of the water. Many efforts and initiatives at the United Nations, including creating new principles, have all met with failure in the face of this conflict. But it is important to emphasize that that also applies to the Quartet grouping, which prepared a road map that has had no effective results to date.

  4. It is time to seek mechanisms to actively support progress in the peace efforts and strengthen the capacity of the Palestinian Authority so that it can meet the security needs of its people. The Charter of the United Nations was created to emphasize the rights of the people, not those of States. The Security Council therefore has responsibility for Israel's violations of international law, which have allowed it to operate in a state of immunity and impunity. Israel has flouted resolution 242 (1967), which rejects the acquisition of territory by war, while its settlements on Palestinian territory are in full view of the international community.

  5. In that context, the case of Palestine has awakened the conscious of the international community about what the United Nations should be. Member countries are more interested than ever in complying with current international legislation and resolutions, and call for an end to Zionism in Palestine in all its forms. Proof of that is the recognition of 133 States Members of the Organization that support the request of the President of the Palestinian Authority, on 23 September 2011, for Palestine to be considered a full Member of the United Nations. However, due to the anti-democratic right of veto enjoyed by the permanent members of the Security Council, the rise in status of Palestine in the United Nations has not taken place.

Ms. Lalama (Ecuador) (spoke in Spanish): My delegation wishes to express its viewpoints on the situation in the Middle East and the question of Palestine, all the more so at this important stage, which the Security Council must address. I would like to begin by thanking the President for convening this debate. My country appreciates the detailed briefing of the Under- Secretary-General for Political Affairs, Mr. Jeffrey Feltman, on the situation in the Middle East, including the question of Palestine. The Government of Ecuador expresses its concern once again, pursuant to the standards and principles of international law, over the Security Council's protracted handling of the Israeli-Palestinian conflict. At this time of political and economic turmoil, it is important to fight for an international system ofjustice.

  7. In conclusion, Ecuador supports the recommendation made by the Secretary-General in his latest report (S/2012/678) to extend the MINUSTAH mandate for a further year. Haiti undeniably continues to be threatened by food insecurity, growing poverty and a fragile humanitarian situation. My Government hopes that measures can be devised to optimize coordination and joint efforts by the Group of Friends of Haiti, donor countries, and the authorities and the Government of Haiti in order to achieve the badly needed social, political and economic stability that the people of Haiti demand and deserve.

In this regard, my country hopes that all stakeholders will participate in a constructive dialogue with a view to holding credible elections without further delay and thereby contribute to revitalizing Haitian institutions and minimizing the institutional vacuum created by the expiration on 8 May of the mandate of 10 senators. Ecuador commends the progress made in extending State authority, including over border control and in strengthened security. However, we note that violence continues to be concentrated in major urban areas, signalling that the National Police continues to face challenges when it comes to fully assuming its responsibility for safety in the country. In this context, MINUSTAH's social and military components play an essential role in maintaining security and stability in general.

Likewise, the establishment of the Superior Council of the Judiciary is another step forward in the work of the Haitian Government in strengthening institutions essential to the rule of law and thereby human rights. However, Ecuador is concerned to see that the process of the establishment of Haiti's first Permanent Electoral Commission is plagued by controversy between political parties in Parliament and civil society, who have questioned the integrity of the Council and its ability to organize credible elections, which has led a number of lawmakers to favour the establishment of a provisional electoral council.

I take this opportunity to recall that following the earthquake of January 2010, my country, under the auspices of the Union of South American Nations, cooperated directly with the Government of Haiti in rebuilding roads, bridges and access routes in the Artibonite area, which allowed farmers to bring their produce to cities, thus contributing to the development of food security in the most important producing area of Haiti and thereby to the country's sustainable development. Ecuador welcomes the progress made, which has improved conditions in Haiti. These include the ratification by the Senate of the new Prime Minister and the publication of the corrected constitutional amendments which had been awaited since June 2011.

Therefore, since the beginning ofthe Haitian crisis in 2004, we have been participating actively in MINUSTAH, in keeping with the central principle of our foreign relations to provide unwavering support in humanitarian crisis situations and seek to resolve conflicts. It is worth underscoring that my country does not merely contribute troops to peacekeeping operations; we have implemented a series of measures and actions which together form a comprehensive policy, including, for example, Ecuador's peacekeeping school, where soldiers are trained to tackle problems faced by internally displaced persons and refugees, and to respond to humanitarian disasters, as well as prepared to resolve conflicts with civilians.

I thank your country, Sir, for having organized this meeting to consider the report of the Secretary-General on the United Nations Stabilization Mission in Haiti (MINUSTAH), a matter of great importance in our region of Latin America and the Caribbean. My delegation welcomes the presence of Ambassador Mariano Fernandez Amunategui and would like to take this opportunity to congratulate the Secretary-General for his wise choice in appointing him his Special Representative for Haiti and for the efforts he has made to build a better future for this sister nation. Ecuador's commitment to the stabilization process in Haiti is well known.

There is no norm of international law that would allow Israel to imprison a Palestinian suspect for an indefinite period without informing the detainee of the charges against him or her or providing any evidence. The protest by 1,600 Palestinian prisoners who have united on an indefinite hunger strike is part of their broader struggle to attain an independent State. The international community must continue to pressure Israel to end its occupation and its violations of human rights. It is Israel's responsibility to promote negotiations that will lead to a two-State solution in accordance with all relevant United Nations resolutions.

In that regard, my delegation calls on the Council to demand that Israel halt its demolition of homes and structures that were built without permits, some 4,800 of which have been destroyed since 2000, and instead to support Palestine with a programme to construct schools and hospitals and provide water, sanitation and other infrastructure projects. The possibility of finding a solution to the establishment of two States has diminished as a result of Israeli settlement expansion, in addition to the military separation wall, obstacles to free movement, the denial of access to vital natural resources, and the erosion of Palestinian ownership in the West Bank, upon which the hopes of a Palestinian State are based.

Despite the reports of the Quartet and its call for dialogue and cooperation between the parties in order to facilitate social and economic development in Area C, the latter has been undermined by 124 illegal Israeli settlements that prevent the establishment of a viable Palestinian State within pre-1967 borders. Area C comprises 62 per cent of the West Bank and includes the most fertile, resource-rich land, which the future Palestinian State and its people could make use of in living a life of dignity. Palestinian construction is permitted on only 1 per cent of Area C, most of which has already been developed.

Over the past months, relevant events, such as the historic speech of President Mahmoud Abbas before the General Assembly on 23 September 2011 (see A/66/PV.19), as well as the support of 132 States Members of the United Nations in recognizing Palestine as a State, have strengthened the conviction that the Palestinian Authority is able to govern a State. It is therefore time to seek mechanisms to actively support progress in the efforts for peace and to strengthen the capacity of the Palestinian Authority to meet the current and future security needs of the Palestinian people.

The Government of Ecuador respects the norms and principles of international law, in particular in the context of the pacific settlement of disputes, and expresses its concern over the Council's prolonged management of the Israeli-Palestinian conflict. In our desire to support stability in the region, my delegation has recognized Palestine as a State.

  19. The region cries out for a solution. We urge the parties to come to a settlement of the conflict that is peaceful, just, lasting and comprehensive, and to make efforts to re-establish the dialogue that will lead - via the effective fulfilment of the Madrid commitments, the Israeli initiative and implementation of the Road Map - to achieving stability and peace in a region in which two States, Israel and Palestine, must coexist side by side within secure and recognized borders.

  20. The settlements are illegal and unjustifiable. They exacerbate tensions, run counter to the principle of land for peace, which has been supported by the international community since 1979, and hamper the peace process between the parties. If Israel rejects the efforts, appeals and calls of the international community in such a way as to prevent the peace negotiations, then the Security Council should take concrete action - as should all the relevant organs of the United Nations - so as to ensure that Israel suffers the consequences of the violations and crimes it has perpetrated, especially in Gaza and East Jerusalem. 28 My delegation renews its condemnation of the acts being provoked in the region, not only because they violate international law but also and most importantly because they block understanding between the parties.

  21. In that vein, we support all the resolutions of the Security Council. True to that commitment, my delegation condemns the acts of violence that continue in the region, because not only do they violate international law, but they also make it difficult to reach understanding between the parties. The crisis in which we find ourselves forces us to seek actions and decisions to achieve peace. That requires that Israel respect the law and the resolutions of the United Nations. The people need the international community, in accordance with humanitarian law and United Nations resolutions, to demand, once and for all call in a clear and firm way, that Israel cease all harassment activities in the region and stop the settlement activity that it conducts by force in the area, including in East Jerusalem.

I am pleased to confirm once again Ecuador's position on the conflict in the Middle East, and that is total respect for the norms and principles of international law, especially in matters of the peaceful resolution of conflicts; condemnation of the use and threat of use of force; and compliance with the resolutions of the United Nations and its subsidiary bodies.
