China knows that during the reporting period, the Mechanism continued to make progress in its traditional activities. An appeal judgements has been rendered on the Seselj case. The Stanisic' and Simatovie case, the Karadeie case and the Mladie case continue to move forward. Eight convicted persons have been transferred to Senegal and Benin to serve their sentences. In that regard, China knows that President Meron is committed to completing the Karadeic case by the end of the year. China welcomes the efforts and progress made by the Office of the Prosecutor in tracking fugitives of the International Criminal Tribunal for Rwanda.”

The Sudanese Government has been actively dedicated to promoting the political process in Darfur and established a Government of National Reconciliation. It also enhanced the capacity-building of security and governance, as well as achieved some progress in the maintenance of stability and the advancement of reconstruction in Darfur. China welcomes such developments. Meanwhile, Darfur is still facing various challenges in its quest for long-term security and stability, including those posed by armed groups.”

“We hope that the Mechanism will assume the remaining functions of the ICTY in a smooth manner and expect that it will learn from the Tribunal's past experiences and lessons learned, and continue to increase efficiency and cut costs in order to meet the request of the Security Council that the Mechanism be small, temporary and efficient. Since its establishment by the Security Council in 1993, the ICTY has carried out judicial activities and upheldjustice by punishing over 160 criminals for serious international crimes, although it has not been able to implement its completion strategy on time. “The Tribunal has begun to plan closure-related events. China will consider sending people to attend these events. Over the same period, the International Residual Mechanism for Criminal Tribunals, under the leadership of President Meron, has made continued progress with the beginning ofthe Stanisie and Simatovic' trial case in June and the ongoing Karadeie and Seselj appeal cases. The Residual Mechanism has issued 152 decisions and orders and conducted its judicial activities in an orderly fashion. It has adopted measures such as remotejudging, double hatting and single judge adjudication to meet the requirement of being small, temporary and efficient. It has also successfully reintegrated one person who was acquitted and one person who was released. China commends the Residual Mechanism for its progress over the past six months.”

“China is pleased to learn that the Residual Mechanism has taken over all the remaining work of the International Criminal Tribunal for the Prosecution of Persons Responsible for Genocide and Other Serious Violations of International Humanitarian Law Committed in the Territory of Rwanda and Rwandan Citizens Responsible for Genocide and Other Such Violations Committed in the Territory of Neighbouring States between 1 January 1994 and 31 December 1994 (ICTR) and continues to carry out its judicial activities. The International Residual Mechanism has also opened the retrial of the Stanisie & Simatovie case, formulated new rules and procedures, issued a large number ofjudicial decisions and orders and cooperated with other countries with regard to their own domestic prosecutions. China appreciates those activities.”

Particular attention should be given to strengthening communication and coordination with the Residual Mechanism in order to ensure a smooth transition to the Mechanism.”

“However, according to the most recent reports of the two Tribunals (S/2014/350, annex, and S/2014/343, annex), the time frame set out by the Security Council cannot be achieved. The work of the ICTY will continue until 2017 and that of the ICTR until 2015. We express our concern in that regard. We understand that there are multiple reasons for the delay. There are some additional issues to those foreseen by the two Tribunals. We hope that both Tribunals will continue to increase their efficiency while ensuring judicial fairness, overcome the difficulties in retaining staff, expedite their work and conclude their task as soon as possible. At the same time, we believe that the Security Council should conduct consultations as soon as possible on the programme of work of the two Tribunals beyond 2014 so as to find an appropriate solution.”

“Mr. Li Yongsheng (China) (spoke in Chinese): I would first like to thank Presidents Meron and Joensen and Prosecutors Brammertz and Jallow for their respective briefings on the work of the International Criminal Tribunal for the Former Yugoslavia (ICTY), the International Criminal Tribunal for Rwanda (ICTR) and the International Residual Mechanism for Criminal Tribunals. I would like to make the following four points. First, with regard to the progress in the work on the completion strategy of both Tribunals, we note that, during the reporting period, the two Tribunals continued to make further progress, and we express our appreciation in that regard. Resolution 1966 (2010) establishes the time frame for the completion strategy ofboth Tribunals and calls on them to complete all their work by the end of 2014.”
