The decision taken on 1 March by the Council of the Russian Federation to authorize the use of the Russian armed forces on Ukrainian territory, and the subsequent actions undertaken, constitute a flagrant violation of international law. Those actions violate the commitments Russia entered into with regard to Ukraine within the framework of the Budapest Memorandum of 1994 and the Treaty of Friendship, Cooperation and Partnership Agreement between Russia and Ukraine, signed in 1997. Had it been adopted, the draft resolution would have helped to put an end to that vicious cycle and the nationalist escalation that accompanies it. Today's vote is a failure - a failure for the Security Council and the United Nations, but also, and above all, a failure for Russia.

  2. Pursuant to the Charter of the United Nations, Member States have conferred upon the Security Council the primary responsibility for maintaining international peace and security. Today, the Russian veto prevented the Security Council from assuming that responsibility in the interest of peace and security in Ukraine and Europe. The referendum organized for tomorrow in Crimea runs contrary to Ukraine's Constitution, which stipulates that the territory of Ukraine is indivisible and inviolable. The referendum is also contrary to the Constitution of the Autonomous Republic of Crimea. The international community can in no way recognize its outcome. The referendum of 16 March is part of a vicious cycle.

With regard to dialogue, in accordance with Chapter VI of the Charter of the United Nations, the draft resolution under consideration by the Council this morning was intended to urge all parties to seek a peaceful settlement immediately through direct political dialogue, to exercise restraint, to refrain from any unilateral action and any inflammatory rhetoric that might increase tension and to engage fully in international mediation efforts. However, the referendum organized for tomorrow in Crimea is intended to change the status of the Ukrainian territory against the will of Ukraine. If the referendum were to take place, it would constitute a unilateral act that could very seriously destabilize Ukraine and the entire the region.

The draft resolution was intended to reaffirm the Security Council's support for the sovereignty, independence, unity and the territorial integrity of Ukraine within its internationally recognized borders. The Security Council should be unanimous in upholding those principles. The Charter ofthe United Nations states that in discharging its duties the Security Council "shall act in accordance with the purposes and principles of the United Nations".   5. I shall now make a statement in my capacity as the representative of Luxembourg. Luxembourg deeply regrets that the draft resolution (S/2104/189). proposed by the United States ofAmerica, on the situation in Ukraine was not adopted because of the vote against it by Russia, a permanent member of the Council. Luxembourg voted in favour of the draft resolution and is also a sponsor of the text, as did many United Nations States Members. Why? Because the draft resolution was based on principles and dialogue. First, with regard to the principles, the draft resolution was intended to recall the purposes and principles of the United Nations, as set out in particular in Article 2 of the Charter.

  27. We encourage the Ukrainian authorities to appeal to the expertise of the Council of Europe and the OSCE, in particular with regard to the protection of the rights of minorities. In conclusion, we welcome the restraint shown by the Ukrainian authorities in the face of the crisis, in particular in Crimea. It is vital for all parties to respect the unity, territorial integrity, independence and sovereignty of Ukraine. I now resume my functions as President of the Council. We call on the entire international community to support the efforts of the United Nations, together with those of the Organization for Security and Cooperation in Europe (OSCE), the Council of Europe and the European Union, to reach a political settlement of the crisis with the parties concerned. We welcome the preparations under way with a view to establishing an OSCE observer mission to impartially assess the situation on the ground. A lasting political solution to the Ukrainian crisis also requires an inclusive political dialogue, taking into account the diversity of Ukrainian society, the aspirations of all Ukrainians and the need to respect the rights of all Ukrainians. Luxembourg supports the new Government and Parliament of Ukraine, which have taken steps to promote that inclusive political dialogue.

  29. We would like to believe that it is still pssible to avoid the worst. Owing to its history, unfortunately, Luxembourg is well placed to understand the threats that a military escalation poses to the peace and security of Ukraine and the region. We must therefore do our utmost to start a de-escalation of the situation through specific actions. We resolutely support the ongoing efforts within the United Nations, in particular the good offices role of Secretary-General Ban Ki-moon, who took the decision to dispatch the Deputy Secretary- General to Ukraine. The principles of the United Nations and the very raison d'etre of the United Nations are at stake.

I would like to echo the appeal of the European Union to Russia to withdraw its armed forces without delay in order to meet its obligations under the 28 May 1997 Agreement between Russia and Ukraine on the Status and Conditions of the Presence of the Russian Black Sea Fleet on the Territory of Ukraine. The crisis must be resolved peacefully. A first critical step would be for Russia to accept Ukraine's offer to hold consultations without delay, as provided for in the Memorandum on Security Assurances in Connection with the Republic of Ukraine's Accession to the Treaty on the Non-Proliferation of Nuclear Weapons, signed 5 December 1994 by Ukraine, Russia, the United Kingdom and the United States, and under the Treaty of Friendship, Cooperation and Partnership, signed on 31 May 1997 between Russia and Ukraine.

  31. I shall now make a statement in my capacity as representative of Luxembourg. Luxembourg is deeply concerned about the recent developments in Ukraine, in particular in Crimea. Our position is reflected in the conclusion that the Foreign Affairs Council of the European Union has just adopted today during an urgently convened meeting. We strongly condemn the violation of Ukraine's sovereignty and territorial integrity by Russian armed forces and the decision taken last Saturday by Russia's Federation Council to authorize the deployment of Russian armed forces on the territory of Ukraine. Those actions are a flagrant violation ofthe Charter of the United Nations and the Helsinki Final Act.

During our chairmanship of the Forum for Security Cooperation in the past four months of 2013, Luxembourg worked to help the OSCE better respond to the challenges posed by small arms and weapons, and stocks of ammunition. We also encouraged cooperation between the OSCE and the United Nations in Afghanistan, in the light of the major challenges that country must face in 2014. I wish to assure the Chairperson-in-Office of the OSCE and his team that Luxembourg will spare no effort to support their efforts. In order to adhere to the goal of making this briefing more interactive, I will conclude my remarks by asking a question to the Chairperson-in-Office. He referred to the phenomenon of foreign fighters, which is of particular concern in Syria at present.

  38. In that regard, we welcome the successful holding yesterday of the initial elections towards the selection of the mayor of Mitrovica-North. The Swiss chairmanship has rightly focused its chairmanship under the leitmotif of creating a security community for the benefit of everyone. Luxembourg shares the importance that gives to the human dimension of security. The OSCE was founded on the idea that lasting security is possible only if human rights and fundamental freedoms are respected. In that context, I would like to highlight the continuous support my country provides to the activities of the Office for Democratic Institutions and Human Rights, the OSCE Representative on Freedom of the Media and the OSCE High Commissioner on National Minorities. Their independence and impartiality are at the heart of the organization.

  39. The recent appointment of eight coordinators to conduct discussions is a further step towards advancing the "Helsinki-l-40" process. We welcome the intention of the Swiss chairmanship to enhance cooperation between the OSCE and its partners on the ground. The OSCE plays an essential role in mediation and in dealing with and resolving conflicts, working in harmony with the United Nations and other regional organizations. That is the case in Central Asia and the Southern Caucasus, through the Minsk Group and the process of Geneva talks. That is also the case in Moldova with regard to the Transnistrian conflict. In Kosovo, the OSCE has provided indispensable support in facilitating elections in the four northern municipalities, pursuant to the First Agreement on Principles Governing Normalization of Relations between Belgrade and Pristina.

  40. We believe that in Ukraine, the OSCE will once again be able to play its role as a bridge between the East and the West in order to promote peace, democracy and stability. As a member of the OSCE, Luxembourg fully supports the priorities of the Swiss chairmanship. We appreciate the close coordination of its priorities with those of Serbia, which will assume the OSCE chairmanship in 2015, and its strengthening of the continuity of its activities, and thereby the effectiveness of the organization. We also welcome the close cooperation that has been consolidated between successive chairmanships since the Dublin Ministerial Council of 2012 with a view to deepening the approach taken to envisioning a Euro-Atlantic-Eurasian security community that is free, democratic, united and indivisible.

  41. Those responsible for violence must be held accountable for their actions. We welcome the efforts made by the international community to stop the violence and find a peaceful and negotiated end to the crisis. We call on all political forces to show restraint and pursue dialogue. The unity, sovereignty, independence and territorial integrity of Ukraine must be preserved. A lasting political solution to the crisis requires the formation of a new inclusive Government, constitutional reform and the holding of democratic, free and impartial elections. The OSCE's contribution will be important in supporting that political solution. The Chairperson-in- Office has given us a glimpse of the shape that that contribution could take, in close cooperation with the European Union, the Council of Europe and other partners.

Ms. Lucas (Luxembourg) (spoke in French): I, too, would like to wish a warm welcome to the Security Council to His Excellency Mr. Didier Burkhalter, President of the Swiss Confederation and Head of the Federal Department of Foreign Affairs. I thank him for his very clear briefing on his priorities as Chairperson-in-Office of the Organization for Security and Cooperation in Europe (OSCE) for 2014. I will begin my remarks with a subject that the Chairperson-in-Office mentioned and that concerns us all, namely, Ukraine. We were shocked last week by the escalation of violence in several Ukrainian cities, which caused dozens of deaths and numerous injuries. In Ukraine, as in other participating States, it is essential that the commitments under the OSCE framework be fully respected and implemented.

  43. The Syrian authorities must endorse without further delay the Geneva communique of 30 June 2012 (S/2012/522, annex). The parties must work towards a genuine political transition that meets the legitimate aspirations of the Syrian people. The resolution includes provisions that will enable the Security Council to verify in a precise manner whether its demands have been implemented on the ground. The Council expresses its intent, in the case of non-compliance with the resolution, to take further steps to support the vital humanitarian efforts in Syria. Today, to the Council's credit, international humanitarian law and the needs of the Syrian people have prevailed over the interests of those who cling to power in Syria. Luxembourg is proud to have contributed actively to this result.

  44. The humanitarian situation has continued to deteriorate at an unacceptable pace. Today approximately 10 million Syrians, half of whom are children, are in need of urgent humanitarian assistance. More than 3 million of them are living in areas that are difficult to access. More than 2.4 million Syrians, more than half of whom are children, have had to take refuge in neighbouring countries, primarily Lebanon and Jordan. Given that tragic deterioration of the situation, the Security Council had to act. With today's unanimous vote, the Security Council is shouldering its responsibilities. Henceforth it is up to the parties to the conflict in Syria, primarily the Syrian authorities, to fully and swiftly implement the provisions of the resolution that we have just adopted and the provisions of the presidential statement of 2 October 2013.

  45. In recent weeks, along with our colleagues from Australia and Jordan, we worked to build a consensus around a strong resolution that would enable us to change the situation on the ground. By adopting resolution 2139 (2014), the Security Council is sending a clear and unified message to all parties to the conflict in Syria with a view to ensuring that humanitarian access to all Syrians in need is guaranteed, that the siege of cities where civilians are trapped is lifted, and that an end be put to the senseless atrocities and indiscriminate bombings and to the use of barrels bombs, whose only goal is to the civilian population. The requests that the Security Council made in the presidential statement adopted on 2 October 2013 (S/PRST/2013/ 15) unfortunately were not followed up on.

  46. Ms. Lucas (Luxembourg) (spoke in French): Luxembourg welcomes the unanimous adoption of resolution 2139 (2014) on the Syrian humanitarian cr1s1s. The aim ofthe resolution is simple: it seeks to protect civilians affected by the conflict in Syria. It demands that rapid, safe and unhindered humanitarian access be authorized across conflict lines and across borders, so that humanitarian assistance can be conveyed along the most direct routes to the people who need it. It recalls that starvation of civilians as a method of combat is prohibited under international humanitarian law. It reaffirms that those who have committed violations of international humanitarian law and human rights in Syria must be brought to justice. Finally, it underscores the importance of finding a political solution to the Syrian conflict.

  47. Allow me to conclude by stating the importance of taking into account the protection of children in the promotion and strengthening of the rule of law. Children are very often the first victims of conflicts, and sometimes they are even forced to become combatants. They therefore have very specific needs that must be taken into account in conflict and post- conflict situations, including in the framework of programmes relating to disarmament, demobilization and reintegration; security-sector reform; and transitional justice.

The report of the Secretary-General quite rightly stresses that the strengthening of national capacities in the area of collecting, verifying and analysing data should be an integral part of the design of projects and programmes, in order to strengthen cooperation in the area of analysing the results. I welcome the elaboration by the Department of Peacekeeping Operations and the High Commissioner for Human Rights of a number of benchmarks for the rule of law that make it possible to assess progress in conflict and post-conflict situations. We are particularly pleased to hear that this project, which Luxembourg actively supports, has already proved worthwhile in Haiti, Liberia and South Sudan. In order to best promote the rule of law, the effectiveness of institutions must be judged according to empirical criteria.

Resolution 2100 (2013), on Mali, therefore mandates the United Nations Multidimensional Integrated Stabilization Mission in Mali to contribute to the work of the Malian authorities to bring to justice the perpetrators of war crimes and crimes against humanity committed in Mali, taking into account the fact that they have referred the situation in their country to the ICC. That example clearly illustrates the support that United Nations missions can provide national and international justice. I should like to stress in this context the importance of the Secretariat's fully applying, including for current operations on the ground, the guidelines that exist with regard to relations between United Nations officials and those subject to an arrest warrant or called upon to appear before the International Criminal Court.

  50. The belief that crime will not go unpunished is an integral part of the very notion of justice. Therefore, there can be no amnesty for perpetrators of the most serious crimes, namely, genocide, crimes against humanity, war crimes and crimes of aggression. The establishment of the International Criminal Court (ICC) is a result of such thinking, and it has strengthened the fight against impunity for those crimes as well as the credibility of the rule of law. As we have noted many times before in the Council, the roles of the Security Council and the International Criminal Court are also complementary, insofar as the two institutions are working for peace and justice.
