Only three weeks ago, on 25 April, the Prosecutor requested that the habeas corpus petition made by one of them, Gerardo Hernandez Nordelo, be rejected, and did the same shortly thereafter with respect to those made by Antonio Guerrero and Rene' Gonzalez. These three, together with Ramon Labariino and Fernando Gonzalez, are irrefutable proof of the terrorism perpetrated by the United States against the Cuban people. I reiterate here once again our willingness to make a more detailed presentation on these issues before the Counter-Terrorism Committee and to provide any additional information or clarification deemed necessary. Cuba will continue to strictly comply with the provisions of resolutions 1267 (1999), 1373 (2001) and 1540 (2004) and to cooperate with the subsidiary bodies created pursuant to those resolutions.

All of these actions against Cuba enjoy the blessing of the United States Government. Incontrovertible proof of that can be seen in the result of the recent legal farce in El Paso against the well- known and self-confessed terrorist Luis Posada Carriles, who was tried not for terrorism but for perjury, despite all the evidence against him in the possession of the United States Government. He was acquitted of all charges and moves freely about this country, enjoying official protection and announcing further terrorist acts with total impunity. On the other hand, five Cuban patriots - heroes in my country - were unjustly sentenced and cruelly imprisoned for trying to prevent terrorist acts against Cuba from the United States.

I have here a book entitled Voices from the Other Side: An Oral History of Terrorism Against Cuba, by Keith Bolender, which I make available to the relevant Committee and the Security Council, together with the other materials with which we keep the Committee informed. This book, which was launched here at the United Nations on 26 April, contains a detailed explanation of the many terrorist acts perpetrated against the Cuban people, organized and funded from the United States, with the participation of a mafia that enjoys impunity in this country. I also have here, available to the Committee, a DVD entitled "Cuba's Reasons: Path of Terror", with information and testimony from the Salvadorian terrorist Francisco Chavez Abarca, who was recruited by Posada Carriles to carry out criminal acts against Cuba.

For all of these reasons, I reiterate Cuba's rejection of the unilateral development by the Government of the United States of America of a list of States that supposedly support terrorism, and the inclusion of Cuba on that list. This practice is in violation of international law and the Charter of the United Nations. It is spurious and politically motivated. No Government can arrogate the right to categorize the actions of other nations with regard to terrorism, especially not a Government of double standards that refuses to prosecute confessed perpetrators of horrendous terrorist acts against Cuba and other countries of this hemisphere, such as Luis Posada Carriles, allowing them instead to roam free and participate in political activities.

Cuba has subscribed to the 13 international conventions on this topic and strictly complies with its commitments and obligations arising from the resolutions of the General Assembly and Security Council. My country does not possess weapons of mass destruction of any type and has no intention to acquire them. It respects its obligations under relevant international instruments on nuclear, chemical and biological weapons. We believe the adoption by the General Assembly of the United Nations Global Counter-Terrorism Strategy (resolution 60/288) to be of the utmost importance. My country has implemented various legislative measures in this area, including long before the adoption of the Strategy, with a view to preventing and suppressing all acts and activities directly or indirectly relating to terrorism.

This is precisely why we strongly condemn all acts and manifestations of terrorism, wherever and by whomsoever committed.   8. As indicated by President Raul Castro, "as early as March 1960, President Eisenhower approved a covert action programme against the island that was declassified a few years ago. The United States Central Intelligence Agency played a leading role in planning, providing logistical support, recruiting and training mercenaries to carry out terrorist acts under the aegis of the Government of that country - arson, bombings, sabotage of every type, the seizing of aircraft, ships and Cuban citizens, attacks against our Government offices and killings of diplomats, machine gunning of dozens of facilities, many attempts to put an end to the lives of the principal leaders of the Revolution, and particularly hundreds of plans and actions targeting the Commander-in-chief". The Cuban people have lost some 3,478 of their number as victims of terrorism.

The three Committees have carried out commendable work that Cuba values and closely follows. My country, as all know, complies strictly with its obligations under resolutions 1267 (1999), 1373 (2001) and 1540 (2004). Cuba reiterates its firmest rejection of all terrorist acts, methods and practices in all their forms and manifestations, regardless of who commits them, against whom they are perpetrated and where they are carried out. All terrorist acts, for whatever purposes they are carried out, must be condemned. The Cuban people has suffered first hand a broad spectrum of terrorist attacks since the triumph of its Revolution.

It is up to the United States Government to stop using the issue of terrorism to political ends and to bring an end to the unfair and groundless inclusion of Cuba on the list of countries that supposedly sponsor terrorism. For years now, our country has submitted detailed information on terrorist acts committed against Cuba to the Security Council. Our denunciations have still not received an appropriate response. We reiterate our willingness to make a more detailed presentation on this matter before the Counter-Terrorism Committee or to submit to it any additional information or clarification it deems necessary. If the new American Administration really wants to illustrate its commitment to the fight against terrorism, it now has the opportunity to act firmly and without double standards against the terrorist organizations that have attacked Cuba from United States territory throughout the years.   12. The sham of the proceedings is also evidenced in the continuous delays and postponements, which prove the lack of interest in prosecuting and sentencing that individual. Cuba reiterates that the way that the United States Government has handled this case is a clear and flagrant violation of resolution 1373 (2001) and other relevant resolutions of the Security Council and General Assembly, as well as of several international legal instruments in the fight against terrorism. Cuba demands once again that the authorities of the United States prosecute Posada Carriles as a terrorist or return him to the Bolivarian Republic of Venezuela, a country that requested his extradition on 15 June 2005, nearly five years ago.

During the past 51 years, the Government of the United States of America has been involved in numerous terrorist acts that have caused the Cuban people 3,478 deaths, produced 2,099 disabled persons and generated material losses that exceed $54 billion. While the Government of the United States of America claims for itself the right to label the behaviour of other nations with regard to terrorism, it employs a double standard by not prosecuting, and allowing the continued freedom of, those who have confessed to horrendous acts of terrorism against Cuba. Despite having all the evidence to charge as a terrorist Luis Posada Carriles - who has been justly designated as the most notorious terrorist in the Western hemisphere - the United States Government has only carried out legal proceedings against him for petty offences.

Cuba demands its immediate exclusion from that spurious list, as it constitutes an unjust, arbitrary and politically motivated designation that contradicts the exemplary conduct of our country in facing terrorism and puts into question the seriousness of the United States in the fight against this scourge. By keeping Cuba on that list, the new United States Government is denying the political rationality it publicly proclaims and following the erroneous path of its predecessors, as it resorts to political manipulation and flagrant lies against Cuba in order to justify its discredited, isolated and untenable policy against our country. It is not in Cuba, but in the United States, where a terrorist mafia that acts with impunity has organized, financed and carried out hundreds of terrorist acts against the Cuban nation.

  15. Since 1982, the United States Government has included Cuba on the Department of State's annual list of State sponsors of international terrorism. With the purpose of keeping Cuba on that list, various pretexts - all of them untenable - have been used throughout the years without putting forward a shred of evidence of our country's participation in any terrorist act. The inclusion of Cuba on that list has entailed the application of economic sanctions by the United States Government, including a freeze on financial transactions, a prohibition on technology transfers and restrictive and isolating measures against our country and its citizens. Those sanctions are in addition to the already draconian measures imposed by the economic, commercial and financial blockade decreed by the United States Government against Cuba more than 50 years ago.

Cuba condemns all acts, methods and practices of terrorism in all their forms and manifestations wherever, by whomever and against whoever they are committed and whatever their motivations may be. The Cuban territory has never been used, nor will it be used, to organize, finance or carry out terrorist acts against any country. Our country supports the position of the 118 member States of the Non-Aligned Movement against the unilateral drafting of lists accusing States of allegedly supporting terrorism, which are incompatible with international law and United Nations resolutions.

  18. Once again, the Middle East peace process is in jeopardy, along with the fate of the occupied Arab territories. Once again, the United Nations must without delay take a firm stand against this challenge. The Security Council must act without delay and with unmistakable clarity to demand that Israel put an end to the construction of settlements in the occupied Arab territories in general and in Jerusalem in particular. The policy of modifying the legal status, demographic composition and geographical character of Jerusalem is unacceptable.

Today the Council is meeting once again, and we note that resolution 1073 (1996) has yet to be implemented; to the contrary, the international community is witnessing a fresh escalation by the occupying Power, which is again jeopardizing the entire peace process in the region. The decision of the Israeli authorities to establish new settlements in the southern part of East Jerusalem is yet another example of the obstacles being placed in the path of the peace process. These settlements, moreover, constitute a flagrant violation of the most basic rules of international law and run counter to the letter and the spirit of United Nations resolutions, including those of the Security Council itself, on the Arab-Israeli conflict and the Palestinian question; these resolutions continue to be completely ignored.

Mr. Nunez Mosquera (Cuba) (interpretation from Spanish): I wish on behalf of my delegation to congratulate you, Sir, on your assumption of the presidency of the Security Council for the month of March. We also convey our appreciation to the Permanent Representative of Kenya for the manner in which he presided over the work of the Council last month. Barely five months ago, on 27 and 28 September 1996, the Security Council met to discuss the situation in the occupied Arab territories. At a meeting with the participation of the Ministers of Foreign Affairs of a number of Member States, the Council adopted resolution 1073 (1996), in which it called for the immediate cessation by Israel of all acts which had resulted in the aggravation of the situation in the area and which had negative implications for the Middle East peace process.
