On 9 August 2005, the three judges of the Court of Appeals for the Eleventh Judicial Circuit, in Atlanta, who were presiding over the case of five Cuban citizen anti-terrorist fighters - Gerardo Hernandez, Ramon Labaflino, Fernando Gonzalez, Rene Gonzalez and Antonio Guerrero - being held in United States prisons, announced their unanimous decision to revoke the sentences and to order a new trial. The court recognized their right to be tried fairly and impartially in a non-hostile atmosphere, as provided for in the Constitution of the United States. Despite the fact that there is now no conviction against those Cuban citizens, the Government of the United States holds them hostage in its prisons.

Abbott not to deport the terrorist Luis Posada Carriles to either Venezuela or Cuba, using the cynical and false argument that there was a danger of torture if he were to be detained in either country and resorting in a manipulative manner to the exemptions provided for in the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment. Are not resolutions 1373 (2001) and 1566 (2004), adopted by the Council under Chapter VII of the Charter of the United Nations, applicable to the Government of the United States? However, as at similar public Security Council meetings held in April and July 2005, my delegation feels obliged to focus its statement on an issue of deep concern. While we are meeting here today to discuss effective measures to prevent and eliminate terrorism, the notorious international terrorist Luis Posada Carriles remains on United States territory without the Government of that country complying with its obligation to prosecute or extradite him for the horrendous crimes he has committed.

Either they definitely align themselves with terrorism by protecting this person, or they strike a powerful blow, in compliance with their legal obligations, by arresting Luis Posada Carriles and extraditing him to Venezuela, where he escaped from prison in 1985. My Government reaffirms its willingness to cooperate with the administration of justice by handing over all the information it has on this terrorist and urges the international community to remain alert to the possibility that Posada Carriles might quit United States territory with impunity or that he might be eliminated by internal forces in the United States to "solve" the dilemma in which he has dragged the Government of that country by his presence. We do not wish this man's death.

We would consider it very serious, both for the actions being carried out by the United Nations against terrorism, and for the credibility of the United States Government in its self-proclaimed "war on terror", if Washington were to decide to harbour Posada Carriles or were to resort to cunning legal arguments to permit him to remain in the United States. Allowing this avowed terrorist to move freely, enjoying total impunity, while imposing long and unjust sentences on five Cuban youths fighting terrorism, is immoral and greatly irresponsible. It is an insult to all victims of terrorism the world over and their relatives. United States authorities are facing a serious dilemma.

He caused the in-flight sabotage of a Cubana de Aviacien civil aircraft, in which 73 persons were killed, and a string of Havana hotel bombings in 1997, causing the death of the Italian tourist, Fabio Di Celmo. He has also planned many assassination attempts on President Fidel Castro; he was tried for one of them in Panama, but was fraudulently pardoned by then President Mireya Moscoso on 26 August 2004. My delegation calls upon the United States Government, particularly its President, as President Fidel Castro has repeatedly been doing since last 11 April, to say whether or not it is aware of the presence of the terrorist Posada Carriles on United States territory, and to state the measures it is taking to locate his whereabouts in Miami.

Resolution 1373 (2001), adopted by the Council on the proposal of the United States, is also clear in invoking Chapter VII of the Charter, categorically establishing the obligation of all States to take effective measures to prevent the transit of terrorists, to deny refuge not only to terrorists, but also to those who protect them, and to exchange information leading to their detention. Moreover, on 26 August 2003, the President of the United States of America said: "If you harbour a terrorist, if you support a terrorist, if you feed a terrorist, you are just as guilty as the terrorists". Posada Carriles is not unknown to Washington. He was trained and used by the Central Intelligence Agency (CIA) to carry out terrorist actions against Cuba for more than 40 years.

Therefore, my Government cannot understand why the United States Government has not taken action and has failed to conduct an in-depth investigation of the most recent voyage of the Santrina, and why it did not immediately detain and interrogate those who, like the well-known terrorist Santiago Alvarez Fernandez Magrifia, known as a Miami resident, know Posada Carriles's whereabouts and who helped him in his illegal entry into the United States. United States law is clear: to provide entry into the United States of an avowed terrorist, particularly someone as notorious as Luis Posada Carriles, is one of the most serious crimes that can now be committed in the country that was victim of the atrocities of 11 September 2001.

  16. Despite the critical situation in that country, Cuban volunteers, resolutely adhering to the principle of non-interference in Haitian internal affairs, have remained at their posts. Our medical brigade in particular, composed of 492 health-care workers and posted throughout the country's 10 departments, has been an example of disinterested cooperation, saving lives in the most difficult conditions. Cuban cooperation with Haiti goes beyond direct medical assistance. It includes continuous training aimed at capacity-building in the short and medium term. More than 3,000 persons have participated in those programmes, and today there 889 Haitian students in Cuba, 606 of whom are attending our Latin American School of Medicine.

  17. It is only through solidarity that the international community's duty and commitment to the sovereignty, independence, unity and territorial integrity of Haiti will fully materialize. The uninterrupted cooperation that Cuba has maintained with Haiti for years shows how much can be achieved for that country through cooperation and development assistance. Cuba is cooperating with Haiti in various sectors, placing top priority on the health care sector. In more than five years of medical cooperation, 1,909 Cuban health care specialists have worked in Haiti. Their work has made it possible to hold nearly 6 million consultations. They have administered 756,000 vaccinations, assisted with 52,000 births and performed 75,000 surgical interventions. All those actions have enabled us to save more than 120,000 human lives.

  18. It is essential that the international community and international institutions increase their contributions and their permanent commitment to this Caribbean country. We hope that the United Nations and the international community as a whole will unite their efforts to attain that objective and that the pledges made at the international donor conference will materialize. Haiti is undoubtedly one of the clearest examples of the disastrous consequences of the current international order for underdeveloped countries, particularly in the case of a country that has had to endure more than 200 years of the most flagrant colonialism, exploitation and intervention. My country supports all the efforts of the Haitian people to overcome existing tensions and to move forward a process of dialogue and national reconciliation, as well as the efforts of the Caribbean Community to find a peaceful and just solution to the Haitian situation. Such a solution will be possible only with the promotion of the economic and social development of the country and the development of its human resources and infrastructure.

The year 2004 was particularly tragic for the brotherly Haitian people. Cuba, which feels united in its history and culture with the destiny of the Haitian people, continues to observe the developments in Haiti attentively and with concern. Our country, which has made supportive and unconditional cooperation a pillar of its relations with the Haitian people, believes that a massive contribution of financial and human resources to the economic and social rehabilitation and national reconciliation of that brotherly people is an inescapable duty of the international community.

If we are sincerely to move forward towards a fair solution of the Palestinian problem, the United States should avoid exercising its paralyzing and complicit vetoes when the Security Council addresses this matter. It should also immediately withdraw its military financial support to Israel, including its provision of weapons - the tanks, missiles, helicopters and airplanes currently being used against the civilian population today.   24. At the same time, Cuba condemns suicide bomb attacks and other acts against Israeli civilians, who are innocent victims of the spiral of violence provoked by their Government's policy. We also object to the manipulation of such isolated acts in order to question the Palestinian people's legitimate exercise of self-defence and to justify activities, whether large-scale or selective, against the Palestinian population. We hope that, faced with this clear threat to international peace and security, the Security Council will act without employing the double standard that has characterized its past action on this matter, in order to urgently and decisively adopt the draft resolution that is being put forth by Algeria on behalf of the members of the Arab Group.

Those acts of aggression and violations include illegal settlements, house demolitions, arbitrary arrests, extra-judicial executions, acts of torture, the building of a wall of separation on Palestinian land and the asphyxiation of the Palestinian economy. The crisis in Palestinian territories continues to worsen, while the number of dead and wounded grows apace, the great majority of those being innocent civilians. In that regard, we reiterate the need for Israel to respect international humanitarian law, including the Fourth Geneva Convention. Cuba reiterates its full support for the cause of Arab peoples. We especially support the cause of the Palestinian people against Israel's occupation and aggression, and we have a deep sense of solidarity with its resistance and rebellion.

The Cuban delegation energetically condemns the carrying out of attacks against Palestinian civilians, as well as the general destruction being caused by Israeli occupation forces in the northern Gaza Strip. We also call for an immediate end to those attacks and for the urgent withdrawal of the occupation forces. The State terrorism being practised by Israel, which knows no limits, must cease. This new hostile act joins the extensive and growing list of Israeli acts of aggression and violations of the most basic human rights and of the moral and physical damage inflicted on the Palestinian people.

Mr. Requeijo Gual (Cuba) (spoke in Spanish): The Security Council is once again meeting on an urgent basis to discuss yet another violent act by Israel, a Member State of the United Nations, against citizens of the territory it is occupying illegally and in violation of a considerable number of resolutions of this very body. The recent escalation in attacks and military operations by Israel, the occupying Power, against the civilian population in occupied Palestinian territory have resulted in a significant number of fatalities, including children, and in a considerable number of injured persons and a great deal of destruction of infrastructure.

Lastly, it would be useful to recall that the main author and promoter of this draft resolution is precisely the State that has the largest military expenditures in the world, that has doctrines of security that contemplate preventive attacks and the use of nuclear weapons against States that do not posses such weapons, and that not only has many nuclear weapons but is also in the process of developing new types of such lethal weapons. This double standard represents a real threat to all that must not be left without due denunciation.

Likewise, we must not discard the possibility of some of the participants in the Proliferation Security Initiative considering that they have been given some kind of authorization to intercept any type of cargo on the basis of arbitrary criteria. This would lead to attempts to board ships and aircraft, even violating rights established by the 1982 United Nations Convention on the Law of the Sea, the provisions on the right of innocent passage of ships through States' territorial waters and the jurisdictional regime of the high seas contained in the above-mentioned Convention.

Several elements of this initiative do not correspond to the basic principles contained in the United Nations Charter and recognized in international law that prohibit interference in the internal affairs of States and the use or the threat of the use of force against the territorial integrity or political independence of any State. There is absolutely no guarantee that the prerogatives, which were self- assumed by the participants in the Proliferation Security Initiative and which could be given legitimacy by this draft resolution, might not be manipulated by some, particularly by the States that have the greatest military might, to commit abuses against the ships and aircraft of other States for a range of reasons.

The text of the draft resolution is ambiguous enough for some States to proclaim that, in it, the Security Council legitimizes the interception of ships and of aircraft in the framework of the so-called Proliferation Security Initiative. This initiative is already operational, although the great majority of States were not given an opportunity to participate in its development, in spite of its important implications. The Initiative, instead of contributing to international unity on this subject and contributing to the strengthening of the role of the United Nations and of international treaties, weakens these. Cuba believes that a multilateral and non-discriminatory approach is the only effective way of countering the use of WMD by terrorists.

Furthermore, it cannot be ruled out that some Power might interpret the adoption of this text under Chapter VII of the United Nations Charter to be a pre- authorization or a justification for the unilateral use of force against given States because of alleged suspicions of proliferation of weapons of mass destruction (WMD) or their components. In our own case, this is of particular concern, bearing in mind that high officials of the United States Government have repeatedly and dangerously levelled completely false and unfounded accusations against Cuba, alleging, without presenting the slightest evidence, that our country possesses a limited capacity for the research and development of biological weapons, an accusation which we will continue to vigorously reject.

The only guarantee that WMD will not fall into the hands of terrorists is the prohibition and the total elimination of this type of weapon, especially nuclear weapons, whose very existence constitutes, in itself, a threat to international peace and security. For reasons of time, I will not explore in depth other concerns that we have with regard to other elements of the draft resolution, such as, for example, the issue of the definitions used, the true scope and implications of this text for Member States and the negative impact that it might have on the existing non- proliferation treaty regime.

In this connection, we believe that international legal obligations, including those that relate to the field of disarmament, weapons control and non- proliferation, must not be imposed upon Member States without their participation and their sovereign acceptance, through the signing and ratification of the corresponding treaties and agreements that have been negotiated multilaterally. Nonetheless, the Cuban delegation is also concerned that the Security Council, recognized to be of limited composition, and in which some members have the right of veto, has taken the initiative to prepare a draft resolution on a subject which should continue to be considered in the framework of the traditional multilateral disarmament machinery, where the appropriate space exists to negotiate a legally binding instrument.

The Cuban delegation repeats that a just and lasting peace in the Middle East cannot be achieved without an end to the Israeli occupation, and until the Palestinian people exercise their legitimate right to establish an independent State with its capital in East Jerusalem, and until all of the occupied Arab territories are returned and Israel withdraws from the Gaza Strip, the West Bank and the Syrian Golan to the border of 4 June 1967. That also requires an end to Israeli provocation in southern Lebanon and a guarantee of the return of the Palestinian refugees, while eliminating the unlawful Israeli settlements in all of the occupied territories.

  37. Of those times, 28 have been directly linked to the situation in the Palestinian territories illegally occupied by Israel. That is not to mention the constant threats of the use of the veto, which have impeded the adoption of a number of draft resolutions that did not even come to a vote or were significantly watered down. If it really desires to make progress towards a just solution to the Palestinian problem, the United States should immediately suspend financial support for the purposes of war and its military supplies to Israel, which include tanks, helicopters, missiles and aircraft that are used against civilians. Those deliberate extrajudicial executions not only cost lives, but also destroy any hope of progress towards peace.

At the same time, Cuba expresses its condemnation of suicide bombings and other acts aimed at Israeli civilians, innocent victims of the spiral of violence caused by their Government's policies, while we oppose the manipulation of those isolated acts in order to question the exercise of self-defence by the Palestinian people and to justify both selective and large-scale actions directed at the Palestinian population. Violence and the use of force cannot lead to a solution to a conflict that should have been resolved many years ago had the Security Council acted resolutely and without the dual standards that it applies to this issue. Mr. Requeijo Gual (Cuba) (spoke in Spanish): The Security Council has been compelled to meet on an urgent basis to discuss a further extrajudicial execution committed by a Member State against citizens of the territory that it occupies unlawfully and in breach of a large number of resolutions of this very body. Once again, the Cuban delegation strongly condemns the most recent selective assassination committed by Israel, the occupying Power, in which Abdel Aziz Al-Rantisi and others accompanying him in the Gaza Strip lost their life. The State terrorism exercised by Israel continues unchecked. This new extrajudicial execution is one more addition to Israel's extensive and still increasing record of aggression and violations of the most fundamental human rights and of physical and psychological damage to the Palestinian people.

There can be no just and lasting peace in the Middle East until the Israeli occupation ends; until the Palestinian people exercise their legitimate right to establish an independent State, with its capital in East Jerusalem; until all the occupied Arab territories are returned and Israel withdraws from Gaza, the West Bank and the Syrian Golan to the line of 4 June 1967; until Israeli provocations in southern Lebanon end; until the guaranteed return of Palestinian refugees; and until the elimination of the illegal Israeli settlements, in accordance with Security Council resolution 465 (1980).

  42. Practically half the number of times that the United States has exercised its veto in the Security Council - 39 times - it has done so in relation to the Middle East question. Twenty-seven such vetoes were directly linked to the situation in the Palestinian territories under illegal Israeli occupation. This does not even include the constant threats of veto that have prevented the adoption of a considerable number of draft resolutions which were either not brought to the vote or had been significantly watered down. In order to move towards a just solution to the Palestinian problem, the United States must immediately suspend its financial support for aggression and its provision of military supplies to Israel, which include tanks, helicopters, missiles and aircraft used against civilians.

At the same time, Cuba expresses its condemnation of the suicide bomb attacks and other acts directed against Israeli civilians - innocent victims of the spiral of violence brought about by their Government's policy - while we oppose the manipulation of such isolated acts to call into question the exercise of legitimate self-defence by the Palestinian people and to justify both targeted and large-scale actions against the Palestinian population. Violence and the use of force cannot lead to the solution that the world awaits to a conflict that could have been resolved many years ago if the Security Council had acted decisively. In the case of the Palestinian question, there is clearly a double standard at work in the Council.

  45. In addition, the Palestinian economy has been suffocated, while Yasser Arafat - legitimate President of the Palestinian Authority - is kept in confinement. Despite the appeals of the international community, the crisis in the Palestinian territories continues to worsen, while the number of dead and injured - the vast majority of them innocent civilians - rises. According to information provided recently by the Secretariat on the loss of human life caused by this conflict, approximately 4,200 people have died since September 2000. Of those, nearly 3,300 are Palestinians, which constitutes one of the most massive, flagrant and systematic violations of human rights in the world today.

Mr. Requeijo Gual (Cuba) (spoke in Spanish): The delegation of Cuba vigorously condemns the most recent targeted assassination committed by Israel, the occupying Power, which claimed the lives of Sheikh Ahmed Yassin and other Palestinians as they were leaving a mosque in Gaza. The State terrorism employed by Israel with modern, lethal weapons of war knows no boundaries; it must be condemned and must cease. This new extrajudicial execution adds to Israel's long history of aggression, violations of the most basic human rights and physical and psychological harm to the Palestinian people. Included among those reprehensible practices are illegal settlements, house demolitions, arbitrary arrests, torture, premeditated extrajudicial executions and the building of a separation wall on Palestinian lands.

A spurious court in Miami sentenced them to imprisonment for life or for many years, prohibiting them, upon their release, from visiting places where certain terrorist groups are based - groups that they had been observing in order to prevent such acts from being committed in Cuba or on United States territory. Cuba has provided sufficient information to the Counter-Terrorism Committee on this case and has repeatedly denounced the double standard being applied in the alleged fight against terrorism by the Government of the United States. The Cuban delegation hopes that all efforts aimed at revitalizing the Counter-Terrorism Committee will lead to its more efficient functioning and will enable it to respond more effectively to the concerns expressed by Member States.

In Miami, with complete impunity and with the complicity of the United States authorities, funds are provided and collected to carry out terrorist acts; bank accounts that finance terrorism operate openly and normally; terrorists are recruited; supplies of weapons are provided; safe refuge is offered; and those who finance, plan and commit acts of terrorism are allowed to use the territory. While that has been taking place, five young Cubans have been incarcerated in the United States for more than five years, having been subjected to excessive confinement and isolation for long periods of time. In some cases, they have been unable to contact their wives and families since their imprisonment.

  50. Cuba will comply with the laws it has adopted as a sovereign Power and expresses its readiness to cooperate with all countries, with full respect for the Charter and international law. In that spirit, Cuba has proposed on three occasions to the Government of the United States - without conditions and in accordance with the provisions of Security Council resolution 1373 (2001) - three draft bilateral agreements, concerning cooperation in the fight against terrorism, illicit drug trafficking and trafficking in persons. Although the United States has refused - under mere pretexts - even to consider them, Cuba still hopes that that policy will change. It is impossible to eliminate terrorism if we condemn some terrorist acts while we keep silent about others or tolerate or justify them. The terrorism against Cuba must stop.
