In this respect, we call on the Transitional Federal Government to strengthen its efforts to address these considerable political, economic and security challenges. As the transitional period will end in less than a year, we call on the United Nations and the TFG to immediately start working on a road map for the most urgently needed measures to be taken before August 2011 in order to avoid a prolongation of the transitional period.

The European Union commends the work done so far by the Contact Group on Piracy off the Coast of Somalia and calls for an increased coordination by the United Nations on the issue of the fight against piracy on land. The European Union will continue to support the region's own leadership and efforts in finding solutions to counter piracy by helping the regional countries to develop their judicial capabilities, as envisaged in the Djibouti Code of Conduct. We invite the States of the region to make use of this offer.

  4. Specifically, there is a need for stronger United Nations leadership of the international efforts, as well as closer cooperation with the African Union. The European Union calls for more effective use of the current mechanisms of coordination between the international community and the TFG, such as the High-Level Committee and the Joint Security Committee. As for the fight against piracy, we have recently dedicated a specific session to that instance. Therefore, let me simply take this opportunity to reiterate the need for the international community to devote more attention to reversing the socio-economic drivers that feed the scourge of piracy.

  5. The European Union reiterates its call on the broader international 10-5364] community to follow its lead and do more to support both the Somali security apparatus and AMISOM. We recognize that security support is essential, but we understand well that there can be no purely military solution in Somalia. Whilst we support the imperative to get AMISOM. to its mandated strength, such a capacity needs to be matched by corresponding and parallel political efforts by both the international community and, above all, by the TFG itself. The European Union fully supports the current peace process led by the United Nations in Somalia. However, the international coordination urgently needs further improvement.

  6. The main responsibility for Somalia's future lies with the Somalis themselves, and the role and initiatives of the TFG will be decisive for Somalia's future. Without a credible and inclusive Somali-owned political process, gains will be short-lived. The European Union, in line with the United Nations and the main international partners, considers AMISOM. to be a crucial element in supporting and protecting the Transitional Federal Institutions and to help them carry out their responsibilities. AMISOM contributes to the provision of the much-needed security to allow the TFG to undertake dialogue, reconciliation and political outreach. Since 2007, the European Union contribution to AMISOM. has amounted to €95 million, to which we have recently added a further €47 million.

  7. Together with international partners, the European Union has long been engaged in supporting a peaceful and sustainable solution to the Somali crisis. The European Union assists in stabilizing Somalia by providing support to such priority areas as the security sector - including support to the Somali police force - as well as the training of military personnel, humanitarian and development assistance to the population and capacity-building support. In addition the European Union is largely involved in the ongoing naval operations against piracy through deployment of its Operation Atalanta forces. The European Union and its member States continue to constitute the largest donor to Somalia. It is, however, important to underline that the role of the European Union is only to assist.

The consultative process that should take place to win broad-based popular support for a new constitution will provide an opportunity to reach out on substantive issues of concern for the future prospects of Somalia. The most recent Al-Shabaab terrorist attacks on Mogadishu Airport, aiming at a high-level meeting of United Nations, African Union and Somali officials taking place there, and previous attacks in Kampala in July and in Mogadishu in August pose a serious threat not only to the security situation in Somalia, but also to the wider region and all international actors. The peace process in Somalia must continue despite all the attempts to derail it by an increasingly well-organized and violent minority.

  9. Despite all the efforts of the African Union Mission in Somalia (AMISOM) and the international community, the security situation in Somalia remains fragile. The transitional federal institutions are continuously facing serious challenges to their efforts to improve security, to strengthen the political process and to intensify institution-building, as well as to deliver minimum basic services to the Somali people. Somalia is now entering a critical phase, with the transitional period culminating in less than a year in August 2011, while the Djibouti Agreement has yet to be fully implemented. It is imperative that the Transitional Federal Government (TFG) urgently take the necessary steps in order to address the outstanding priority transitional tasks and intensify its outreach efforts.

The European Union commends all initiatives that contribute to improve the well-being of the Palestinian population, especially in Gaza, such as the recent summer games held by the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA) in Gaza. High Representative Ashton visited a summer camp on her recent visit to Gaza. This initiative can count on the continued political and financial support of the European Union and its member States. It serves as a much needed counterbalance to the backdrop of violence and poverty, and it provides Gazan children with recreational and educational opportunities. The European Union strongly condemns the recent attacks on UNRWA's summer camps.

  13. It is the view of the European Union that substantive discussion of all final status issues should commence as soon as possible. The implementation in the coming weeks of confidence-building measures on the ground would help in reaching this goal. The European Union calls on all parties to refrain from all provocative actions. The European Union remains deeply concerned about the situation in East Jerusalem. Recent settlement activity, house demolitions, evictions and deportations underline the need to resolve through negotiations the status of Jerusalem as the future capital of two States. We particularly deplore the recent house demolitions in East Jerusalem, which do not contribute to the establishment of an atmosphere of confidence, which is crucial at this stage of the negotiation process.

  14. These talks are a significant step towards the resumption of direct bilateral negotiations. The European Union supports the continued efforts of Senator Mitchell in this regard. The overall aim of negotiations between the Parties is - within 24 months, as set out by the Quartet in March - a settlement that results in the emergence of an independent, democratic and viable Palestinian State living side by side in peace and security with Israel and its other neighbours. A comprehensive peace, which is a fundamental interest of the parties in the region and the whole international community, must be achieved on the basis of the relevant Security Council resolutions, the Madrid principles, including land for peace, the Road Map, the agreements previously reached by the parties and the Arab Peace Initiative.

  15. The European Union is ready to help in the opening of the crossings, but has expectations linked to volumes, exports, the movement of persons and security. These expectations are, of course, applicable to all existing crossings. The objective remains the full implementation of Security Council resolution 1860 (2009), as well as the 2005 Agreement on Movement and Access, leading to the immediate, sustained and unconditional opening of Gaza crossings for the flow of humanitarian aid, commercial goods and persons. Israel's legitimate security concerns should also be addressed and Gilad Shalit must be released without delay and without conditions. The launch of proximity talks between Israelis and Palestinians was welcomed by the European Union and its Quartet partners. We called on the parties to pursue them in good faith.

  16. The European Union called for an immediate, full and impartial inquiry into these events, which should include credible international participation. Furthermore, the European Union declared its readiness to contribute to the implementation of a mechanism that would allow for full and regular access to Gaza based on a list of prohibited goods. The European Union High Representative discussed this matter with the Israeli and Palestinian leadership during her visit to the region last weekend and will present options to the European Union Foreign Affairs Council next Monday. The European Union has welcomed the Israeli Government's recent announcement, which is a significant step forward in the review of Israel's policy on Gaza. The implementation of commitments undertaken will be key.

Since our last open debate in April on this issue (see S/PV.6298), two major developments have occurred: the Gaza flotilla events of 31 May and the beginning of proximity talks in early May. The Israeli military operation in the morning hours of 31 May in international waters against a flotilla sailing to Gaza resulted in the loss of nine lives and directed international attention to the unsustainable situation in Gaza.

  18. The United Nations Inter-agency Framework Team plays a helpful role in that regard. Looking ahead to the coming months, in particular the tenth anniversary of Security Council resolution 1325 (2000) in the autumn, we should never underestimate the key role that women can play in conflict prevention. Women are often powerful and capable actors in their communities, and the information provided by women's groups can be valuable in the early detection of tensions. Women should be encouraged and enabled to participate equally and actively in formal and informal mediation processes and peace negotiations. Africa has led the way in operationalizing resolution 1325 (2000). In this anniversary year, much more remains to be done to fully implement that landmark document. The European Union will strongly support such efforts.

  19. The experience in Africa shows how accountability for the most serious crimes must be part of any lasting solution, not least for its deterrent effect on ongoing conflicts. Accountability for past violations of human rights, as well as the overall reform of the justice sector, should thus be integrated in security sector reform and other institution-building efforts. The Peacebuilding Commission also plays an important preventive role regarding the countries on its agenda. In our view, the Peacebuilding Support Office should deepen its interaction with other actors within 10-45510 the United Nations system, such as the United Nations Development Programme and the Department of Political Affairs, in particular the Mediation Support Unit, in order to exchange experiences and build on best practices.

In implementing the African Union-European Union Action Plan on the Peace and Security Partnership, we put particular emphasis on cooperation in the field of mediation as a tool of first response to emerging or ongoing crises. The United Nations is certainly the most important and experienced actor in the area of mediation. At the same time, regional and subregional actors are increasingly the first to respond, given their knowledge of local and regional dynamics and their credibility in the regional context. Our cooperation therefore aims at developing a common understanding and broad guidelines, through regular African Union-European Union-United Nations exchanges. As other speakers before me have stressed, justice contributes to the consolidation of peace and to conflict prevention.

The European Union provides funding for African-led peace support operations, and we are often invited to assist in many crisis situations in Africa through other tools at our disposal, such as EU special representatives and European Union crisis management operations. We commend the growing role of the African Union and African regional and subregional organizations in conflict prevention and mediation efforts in Africa. International contact groups are also useful tools for coordinating efforts to tackle crisis situations. Some of these bring together the African Union regional organizations, the United Nations, the European Union and other relevant partners. We could do more to strengthen relations among these organizations by developing a common methodology for identifying and addressing emerging conflicts and the capacities needed.

To that end, the European Union has strengthened its crisis- management capabilities in recent years and pursues a wide range of policies and actions from development cooperation and external assistance to efforts aimed at strengthening human rights, the rule of law and accountability, along with cooperation with international partners and non-governmental organizations. The Joint Africa-European Union Strategy, in particular the Partnership on Peace and Security, embraces a wide set of objectives and activities addressing short- and long-term security challenges. We hold regular joint consultations on crises or 2 emerging threats, and our close cooperation is facilitated by a designated Special Adviser on African capabilities.

We look forward to the next report of the Secretary-General on the protection of civilians and to the first progress report on New Horizons, and trust that the issue of improving the protection of civilians will be addressed therein. All these measures will contribute to the development of a culture of protection.   27. The European Union recognizes and welcomes important implementation steps taken since the adoption of resolution 1894 (2009). These include the independent study commissioned by the Department of Peacekeeping Operations (DPKO) and the Office for the Coordination of Humanitarian Affairs; the operational concept and the lessons learned note circulated by DPKO; and the regular inclusion of protection of civilians tasks in the mandates of United Nations peacekeeping operations; the more consistent and systemic consideration of protection of civilians issues in the Secretary-General's reports; the significant inclusion of several paragraphs on the protection of civilians in the 2010 recommendations of the Special Committee on Peacekeeping Operations (see A/64/ 19), including the development of a strategic framework for mission-wide protection strategies; the elaboration of protection of civilians training modules; and an assessment of the resource requirements for implementing protection mandates.

Over the course of the past year alone, the United Nations and the European Union have worked together in more than 60 countries that were either in emergency or protracted crises to provide assistance and offer protection to vulnerable groups. While the protection of civilians and the responsibility to protect are two different concepts that must not be confused with one another, there is a clear linkage between them because, when populations are properly protected, they will not fall victim to genocide, war crimes, crime against humanity and ethnic cleansing. As many speakers have stressed today, the implementation and operationalization of the protection mandates of United Nations peacekeeping and other missions are key to protecting civilians.

Moreover, as Under-Secretary-General Holmes underlined in his briefing today, it is essential to ensure safe access to the civilian population - particularly to vulnerable groups, such as detainees, IDPs, women and children - for humanitarian assistance. We look forward to more comprehensive reporting by the Secretary-General on challenges to humanitarian access in situations on the agenda of the Council. As the world's largest provider of humanitarian aid and through its contributions to crisis management, the European Union is an important partner in United Nations engagements in conflict and post-conflict situations.

  30. The PBC has been indeed active in this field. We are grateful to Under-Secretary-General Holmes for underlining the need for better compliance with international humanitarian law, including by non-State actors, and we concur with the need for greater accountability for violations of international humanitarian law. The European Union encourages the Council to adopt appropriate measures in cases of widespread violations of international humanitarian and human rights law in situations of armed conflict. In this regard, we welcome the recently adopted presidential statement on children and armed conflict (S/PRST/2010/10), which provides for increased exchange between the Security Council Working Group on children and armed conflict and sanctions committees.

Moreover, it is crucial to highlight the importance of developing synergies between the protection of civilians and other fields such as transitional justice, gender policies and development, and of ensuring good cooperation among all actors concerned. In the same vein, enhanced cooperation between the Security Council and the Peacebuilding Commission (PBC) will allow the sharing of experience and expertise with regard to protection issues, especially relating to the four countries currently on the PBC agenda, as the EU has repeatedly underlined in the consultations for the 2010 review of the PBC. In particular, the return, resettlement and protection of internally displaced persons and refugees and the specific protection needs of women and children need to be addressed in still- volatile post-conflict environments.

  32. The adoption of resolution 1894 (2009), last November, is a landmark development. It reflects the increased attention paid by the Security Council to protection issues. Security Council resolutions on women, peace and security and on children and armed conflict also contribute to enhancing the protection agenda. Furthermore, stronger interaction between the Council, troop and police contributors, Special Representatives of the Secretary-General, missions and other relevant actors in the field adds to greater coherence and helps mainstream the issue of protection. The European Union commends the work of the expert group on the protection of civilians as a valuable forum for addressing protection concerns in the run-up to mandate renewals.

I also welcome the participation of the United Nations High Commissioner for Human Rights, Ms. Pillay, in this debate, and thank her for the proposals aimed at strengthening human rights protection for civilians in the most difficult situations. Thanks to the work conducted within the United Nations, there is an increasing understanding of the important concept of the protection of civilians in situations of armed conflict. As it is a cross-cutting issue, our strategy needs to be comprehensive. It should encompass activities that range from ensuring the safety and physical integrity of civilian populations to preventing war crimes and other deliberate acts of violence, securing humanitarian access and ensuring full respect for human rights and international humanitarian law by all parties to conflict.

  36. Ensuring adequate security will be crucial to the whole electoral process, particularly for female candidates. As the Secretary-General indicates in his report, we would also like to underline the need for more comprehensive and long-term electoral reform. In the European Union's View, UNAMA is well on track with the implementation of its refocused mandate. Yet we note that recruitment continues to be a matter of concern, mainly for security reasons. Against this background, we commend the commitment of UNAMA's staff and would like to express our condolences for the recent loss of one of its members. As stated in the European Union action plan for Afghanistan, the EU will continue its support for UNAMA and the role of the United Nations in the region.

  37. We note with concern reports that the space for human rights defenders has become increasingly limited, and not only because of the deteriorating security situation. Turning to the upcoming elections on 18 September, we commend the work done by the Independent Electoral Commission and the Electoral Complaints Commission, with support from UNAMA, to prepare for elections, building on lessons learned from 2009. Holding credible, fair, inclusive and secure elections, reflecting the will of the Afghan people, is in the interests of the Afghan Government. In View of that, we note with satisfaction that the registration of candidates has concluded without incident and that the number of female candidates, compared with the 2005 parliamentary elections, has significantly increased.

Since governance, the rule of law, respect for human rights and Afghan institution-building are also the bases for progress in other areas, including security and development, we strongly believe that the Kabul Conference should give explicit political support to achieving progress in all of these areas, including the fight against corruption under the governance cluster. In particular, there is a need to advance the development of the formal justice sector and police reform, which the European Union supports through the European Union Police Mission in Afghanistan and its contribution to the Law and Order Trust Fund. The Kabul Conference will also provide an opportunity to give a much higher profile to issues such as human rights, gender equality, freedom of expression and transitional justice.

The EU agrees that the Kabul Conference on 20 July should not be a pledging conference but an occasion for the international community to lend support to the Government's renewed commitments to its people. We also welcome the co-chairing of the Conference buy the United Nations. We look forward to the presentation of a peace and reintegration programme and national priority programmes on security, governance and the three development clusters, as well as the joint Afghan-International Security Assistance Force way forward for the transition to Afghan security. The EU welcomes Afghanistan's determination to set priorities at the Conference and supports increasing the proportion of aid delivered through the Afghan Government.

The European Union agrees that the Peace Jirga held in Kabul was successful and notes in particular that participation was high and from a wide spectrum of Afghan society, with 20 per cent of the delegates being female. As the steps towards reconciliation and reintegration take shape, the EU wishes to stress that those processes should remain Afghan-led, based on renunciation of any form of violence and in conformity with the Constitution, as well as on Afghanistan's international commitments, including to human rights. Strengthened regional cooperation also remains essential. In that context, we welcome the renewed diplomatic engagement between Afghanistan and countries in the region, and look forward to the next session of the Regional Economic Cooperation Conference on Afghanistan.

The EU Special Representative, Mr. Usackas, has taken up his duties and is working closely with the Special Representative of the Secretary-General. The European Union commends the efforts by the Afghan Government since the last debate of the Security Council, on 18 March, to further advance the agenda agreed at the London Conference, particularly since they were pursued against the background of an increasingly deteriorating security situation that particularly affected the civilian population.

  43. We welcome in particular the recent appointment of the Ombudsperson by the Secretary-General and express our hope that she will be able to take up her functions in the very near future. For its part, following a number of recent judgements by the European Union General Court and the Court of Justice, the European Union has conducted a thorough review and consolidation of its implementation procedures. Those procedures will be kept under constant review and further adapted where necessary.

  44. The Security Council can play an important role in ensuring that justice for the most serious crimes is brought to victims. Impunity should no longer be an option. As regards sanction regimes, the European Union supports the principle of restrictive measures with clear objectives that are targeted at those persons or entities identified as responsible for the policies or actions that have prompted the decision to impose sanctions. The introduction and implementation of restrictive measures must always be in accordance with international law and respect for human rights, and the European Union attaches great importance to the application of fair and clear procedures when designating persons and entities to be targeted. In this regard, the European Union welcomes the improvements introduced by resolution 1904 (2009).

Resolutions 1325 (2000) and 1820 (2008) constitute an important framework for conflict settlement activities, which need to incorporate the principles contained therein at all stages of the process. The European Union strongly supports the role of the International Court of Justice and calls on all States that have not yet done so to consider accepting the jurisdiction of the Court in accordance with its Statute. The European Union is also a staunch supporter of the International Criminal Court. The Court has already proven its value in preventing and deterring those crimes that undermine the very essence of humanity. With the winding down of the ad hoc and special tribunals, the International Criminal Court will be at the centre of the international criminal justice system.

The European Union supports the use of mediation as a peaceful, efficient and cost-effective instrument of conflict prevention and resolution in line with the Secretary- General's report of April 2009 (S/2009/189). The European Union is in the process of strengthening and professionalizing its own mediation and mediation support capacity so as to use these tools more effectively. We appreciate the continuing cooperation with the Mediation Support Unit in that endeavour. Women's underrepresentation in peace processes and the lack of gender expertise in negotiation and mediation teams seriously limit the extent to which women's experiences of conflict and consequent needs for justice and recovery are addressed in these processes.

  47. Finally, the accession process, in the framework of the European Union enlargement policy, is also a powerful tool to drive reforms in these areas. The rule of law is part of the so-called Copenhagen political criteria for EU membership, and issues such as an independent and impartial judiciary and the effective fight against corruption and organized crime largely condition progress towards accession. Non-violent conflict resolution, be it through negotiation, mediation, arbitration or judicial settlement, is, at the same time, the result of adhering to the principle of the rule of law and an important contribution to further consolidating it.

Cooperation between the United Nations and other international actors such as the Organization for Security and Cooperation in Europe or the Council of Europe is essential for the effective promotion of the rule of law, particularly in post-conflict situations. The European Union has also gradually focused on the re-establishment of the rule of law in post-conflict situations. More than 4,000 civilian experts are currently deployed in nine European Union missions, of which 1,700 alone are in Kosovo, and they are working together with their United Nations counterparts. Support to governance in its different aspects is also at the core of EU development cooperation, including with African, Caribbean and Pacific States.

The European Union also supports the idea of an update report by the Secretary-General taking stock of the implementation of the recommendations contained in his 2004 report (S/2004/616) and making proposals for further actions. Reforming the security sector in post-conflict environments is crucial to the consolidation of peace and to promoting poverty reduction. Only where legitimate State authority is expanded through the rule of law and good governance can countries be prevented from relapsing into conflict and losing development achievements. The rule of law should not be seen as a principle exclusive to the justice or security sectors, but as crucial in all areas where public authority is being exercised, in particular in public administration.

  50. The European Union reaffirms its deep commitment to an international order based on international law, including human rights law, with the United Nations at its core. In our view, it is imperative that we all join our efforts to strengthen the rule of law at the national, international and institutional levels. The rule of law should be mainstreamed throughout all peacebuilding and State-building activities, in particular as regards transitional justice and the integration of justice into the external support to security sector reform. In this regard, the European Union welcomes the establishment of the Rule of Law Coordination and Resource Group and calls for greater efforts by the Group and the Rule of Law Unit to ensure a coordinated and coherent response by the United Nations system in the field of the rule of law.
