  3. Israel has created an atmosphere of death inside the occupied Palestinian territory. That has led many to equate the value of life and death, given that there are no prospects for the future to give Palestinians hope or an alternative to the peace process that has been aborted by successive Israeli Governments. Those with influence on the peace process have no interest in intervening to put an end to the bloodshed in occupied Palestinian territories. That bloodshed will lead to more violence, because all hope has disappeared from the lives of Palestinians. They have lost their livelihood and human dignity. All of that will only lead to generations filled with hate, desperation and the desire to avenge. Israel will be responsible for that.

  4. Even those few who have justified revenge as an act of deterrence have qualified that position by saying that revenge must be proportionate to the initial crime. The excessive and indiscriminate use of Israeli military power and the inhuman practices of the occupation forces fall under the category of repression and collective punishment against the Palestinian people, whose land is occupied and whose rights are usurped. Israel's barbaric attacks against Palestinian civilians, including the killing of women, children and the elderly, run counter to all international laws and norms and are clear and flagrant violations of international law and the relevant provisions of the 1949 Fourth Geneva Convention relative to the Protection of Civilian Persons in Time of War.

  5. Through the carnage it is wreaking in the Gaza Strip, Israel has again called attention to its bloody nature and inhuman approach. Yesterday, it carried out yet another massacre in Beit Hanoun, killing tens of civilians, most of whom were women and children. Israeli occupation forces fired 11 shells on 6 houses from tanks surrounding the city, from which they had withdrawn the day before yesterday. Those shells struck people while they slept, tearing them apart and mixing their blood with Palestinian soil. That barbaric Israeli attack cannot be justified as self-defence: it was unjustified revenge. Nowhere in the Charter of the United Nations is there a reference to revenge. This is an act of aggression that cannot be justified by international law.

Based on Saudi Arabia's position of principle - solidarity with the legitimate national regimes of brotherly Lebanon and of occupied Palestine - we call upon the international community to shoulder its legal and humanitarian responsibilities, in order to put an end to the condemnable Israeli aggression, to protect the Lebanese people and their infrastructures and to support the efforts of the legitimate Government of Lebanon that are aimed at protecting the independence and sovereignty of Lebanon and its people and at extending its authority throughout the national territory. We issue a warning to the international community of the seriousness of the situation in the region and the fact that it is sliding towards a climate of war and a new circle of violence whose results will be difficult to predict, particularly given the failure of international action and of Israel's aggressive policies. Israel must bear responsibility for its barbaric acts and must undertake to compensate Lebanon for serious material damage caused by its aggression. This barbaric war is an extension of policies of occupation and hegemony as pursued by Israel in the region.

The imbalances and biases with respect to the Israeli State and the failure to implement the road map set by the influential Powers and the Arab peace initiative have killed the peace process in the past and will kill it in future phases. Meetings and conferences, statements and promises are all in vain if they are aimed at just pretending to implement something without addressing the root causes, namely, occupation and repeated aggression by Israel against civilians and the destruction of their property and livelihoods.

History will not pardon the international community for its failure to ensure justice for the Palestinian people and the people of Lebanon, for leaving any solutions to the conditions set by Israel and for erroneous arguments and pretexts put forward, and leaving the task to Israel to create peace as it sees it and according to its positions - not peace that is based on international law. This is not peace; it is surrender. Failure to use the criteria of justice, the passivity of the Council and its failure to assume its duties and responsibilities have allowed for the ongoing Israeli occupation and the expansion of Israeli settlements. Those failures have also allowed for addressing the Middle East question on the basis of Israeli interests.

  12. This runs contrary to the opinions of the International Court of Justice with respect to the basis of the legitimate right to self- defence and the conditions that justify such right. This principle is enshrined in international law, but it has been converted into an instrument to justify the aggression pursued by the Government of Israel. International disputes such as this one can be resolved not by sending in armies or firing rockets or bombing from the air, but instead by a commitment to implement the provisions of international law and the principles of justice and equity. It is urgent to end the illusion and arrogance of military power, of barbarous oppression, targeted killings and collective punishment in violation of international law and humanitarian norms and values.

It is regrettable that, despite what has taken place in Lebanon - planned destruction, premeditated killings and planned sabotage - the Security Council has not yet found enough reasons to intervene, while its responsibility is to maintain international peace and security. Today's international relations are in a very dangerous state because of the primacy of the concept of use of force over law and human values and custom. That has taken us further from the rules of justice and equity and has enshrined a double-standard policy in political positions. It has also undermined the rules of international law in an effort to erroneously justify the legitimate right to self-defence that is set forth in the United Nations Charter.

We agree with the briefing on the need to have the international community assume its role with courage and creativity in order to resolve the Israeli-Palestinian issue and also settle the root causes of the conflict in the region, namely, the lack of comprehensive and just peace. No one would doubt Israel's ability and skills at slapping together a pretext to justify pursuing its aggression and to cover its tracks, create chaos and expose the region to greater disruption and tension. This all-out war pursued by Israel against Lebanon and, earlier, against Gaza cannot be justified by Israel's pretext.

Blood and despair can never serve as the basis for good relations among peoples. Pictures of blood- soaked bodies and mutilated limbs among the rubble and bombed-out cars are testimony to the violence resulting from arrogance and the use of force. It continues to flout the relevant Security Council resolutions and to perpetrate acts of aggression without regard for the repercussions of such violence, taking steps that give the impression that it believes itself above any criticism or condemnation. Israel is also trying to circumvent any party that might try to find a solution to the problem. It rejects all solutions and persists in finding pretexts to continue its occupation of Palestinian territories and to deny the Palestinian people their rights. The occupation by Israel of Palestinian territories as well as the Syrian Golan and the Shaba'a Farms represents a flagrant violation of international law and a clear challenge to the principle of the inadmissibility of the acquisition of territory by force and to the peace process begun in Madrid in 1991. Resort to violence and extremism has resulted in the marginalization of other parties that are attempting to deal with the situation. The bloodshed and violence between the two parties is driven by the Israelis' obsession with security and by Palestinian despair, so that for both parties the cycle of violence has become a fatal, infernal spiral. The continued Israeli occupation and the fact that the Israeli Government is evading its responsibilities and using excessive force is what is compelling Palestinians to commit suicide.

The separation wall has given a new dimension to the problem: it jeopardizes efforts to secure peace in the region; it could undermine the road map; and it is a major obstacle to the establishment of a viable Palestinian State living side by side with Israel in accordance with Security Council resolution 1397 (2002). The international community cannot shut its eyes or turn a deaf ear to the suffering of the Palestinian people. Israel has always defied the decisions of international legitimacy, and one year after the advisory opinion of the International Court of Justice, it has continued that defiance by deciding to accelerate the construction of the separation wall around Jerusalem with the purpose of completing the wall that Israel has been building for the past two years. The wall will annex more than 8 per cent of the West Bank and will isolate cities and villages. In the full view of the Security Council and on the pretext of security and self-defence considerations, Israel is continuing construction of the separation wall in total disregard for the Court's advisory opinion and in contempt of General Assembly resolution ES-10/15 of 20 July 2004. The wall's purpose is to eject the largest possible number of Palestinians.

I would also like to express similar appreciation and thanks to your predecessor, the Ambassador of France, for his efforts in conducting the business of the Council during the past month. Less than a month ago, the Security Council met to discuss the heinous crime committed by the Government of Israel when it assassinated Sheikh Ahmed Yassin and his comrades as they left the mosque in Gaza City. Because the Council did not condemn that terrorist act, Israel continued to kill, destroy and violate international law. It killed Mr. Abdel Aziz Al-Rantisi in an aerial attack against the car he was in.

International efforts to fight terrorism, no matter how effective, will not be able to eradicate that dangerous phenomenon without addressing its root causes and the conditions that lead to its prevalence. Those efforts will not succeed while the situation of people under occupation continues to deteriorate and the international community fails to find a just solution to occupation. The spiral of violence will not end as long as the international community fails to combine international political initiatives with serious work and as long as the Security Council remains unable to condemn Israeli terrorism. All of this has distorted the principle of the self- determination of peoples and their right to resist occupation and to defend their sovereignty and territorial integrity, long consecrated in the United Nations Charter and since confirmed by resolutions and decisions of the General Assembly and by opinions of the International Court of Justice. The assassination of Sheikh Ahmed Yassin and his companions as they left a Gaza City mosque was one link in a chain of terrorist acts doggedly carried out by the Israeli Government, targeting and mercilessly assassinating Palestinian activists. Today, international relations are in a very grave situation because of the precedence being granted to the logic of force over law, and because of the lack of respect for international norms. This has led to total disregard for the norms of justice, to the consecration of the law of the jungle, to the adoption of double standards in political affairs, to the complete distortion of the norms of international law and to utterly strange interpretations of those norms. This gives rise to flawed, baseless explanations regarding the concept of self-defence as set out in the Charter.

We agree with the statement made by the Secretary-General in which he denounced the Israeli aggression and warned against escalation in a region that is already extremely tense and against a rising danger that may be difficult to contain. Israel's violation of Lebanese and Syrian airspaces and its aggression against Syrian territory is a blatant contravention of international law and norms, confirming the aggressive, terrorist nature of the Israeli Government. The Israeli Government is resorting to every pretext to export its internal crises, terrorizing and intimidating the countries of the region and pursuing its continued aggression against the Palestinians and repressive practices in the occupied territories. The Israeli Government is trying to confuse everybody, wrecking havoc on the region and raising tensions in a very volatile situation.

  44. Mr. Shobokshi (Saudi Arabia) (spoke in Arabic): Ijoin with those who have congratulated you, Sir, on your assumption of the presidency of the Council for this month. We are optimistic that your wisdom and experience will help you in conducting the Council's business as we all would wish. I also extend appreciation and thanks to your predecessor, the Ambassador of the United Kingdom, for guiding the Council's work last month. Once again, Israel has affirmed its disregard for international law and norms. Once again, it has affirmed that it does not care about any agreement, convention or international legality. The Israeli air force has committed an unprovoked aggression against a civilian site in Syria that posed no threat or danger to anybody.

History will not look kindly on the international community for not attempting to do justice to the Palestinian people, for leaving the solution to Israel's dictates, for being biased towards Israel and for allowing Israel to attempt to make peace according to its own vision and its own interests in defiance of judicial norms and the international community's demands. Israel has been and continues to be the genuine cause of the failure of the peace process. Bias towards Israel has undermined the peace process in the past and will cause its total collapse in the future if this situation prevails. The influential Powers are not playing the role of honest broker. Conferences and initiatives will lead nowhere if they give the impression that nothing can be done and that the road ahead is clear.

This decision not only is in breach of international law and Security Council resolutions, but also is a new affront to the peace process and to the Quartet's efforts to implement the road map, and it may be the final nail in the coffin of the peace process. The Kingdom of Saudi Arabia, while it joins the international community in condemning this decision, calls upon all members of the international community- as represented by the Quartet - to move swiftly and decisively in the face of the Israeli policy aimed at denying the will of the Palestinian people and confiscating their land and legitimate institutions.

Various Palestinian factions made every effort and complied with a 50-day truce, until the Israeli Government violated that ceasefire by an aggression aimed at dragging the Palestinians into a new series of acts of violence, knowing that such aggression and the actions of the Palestinians would dash all hopes for peace as envisaged by the international community. The whole world condemned the decision of the Israeli Government to remove Yasser Arafat. The Government of Saudi Arabia has condemned this serious Israeli escalation, which could lead to an explosion of the situation in the region and to the total collapse of the peace process.

We also thank you for your response in convening this open meeting of the Security Council to consider the grave situation in the occupied Palestinian territories due to the continued aggression by the Government of Israel, its failure to carry out the commitments it has undertaken and its pursuit of policies inflicting open-ended destruction and forcing large number of Palestinians to leave their homeland because they find themselves living in intolerable conditions in their national territory. The Palestinian leadership has made every effort to implement the road map.

Therefore, we demand that there be serious and effective action in the coming stage to reach an immediate and just solution to the Middle East problem and the occupied Arab territories on the basis of the Arab initiative anchored in the principle of land for peace, Israeli withdrawal from all occupied Arab territories and the establishment of a Palestinian State alongside Israel, with East Jerusalem its capital.
