“Proceeding from the Agreement on Special Parallel Relations, Serbia has had successful cooperation with the Republika Srpska, but, at the same time, has made every effort to strengthen cooperation with the Federation of Bosnia and Herzegovina, with considerable results. To promote and strengthen that cooperation, important agreements were reached during the Visit to Sarajevo by His Excellency Mr. Ivica Dacic', Prime Minister of the Republic of Serbia, on 13 and 14 September 2012. On that occasion, it was agreed, inter alia, that the Ministries of Foreign Affairs of the two countries would draft a list ofthe outstanding issues to be addressed, identify the most important areas of cooperation and take concrete steps to urgently reactivate the Joint Commission for Economic Cooperation and the Interstate Council for Cooperation.”

Those recommendations are a good basis for the strengthening of the institutions in Bosnia and Herzegovina and finalizing the process ofreconciliation. “Therefore, we consider that all war crimes committed on the territory of the former Yugoslavia must be processed in order to establish lasting stability and reconciliation in the region. In that context, Serbia welcomed the setting up, at the insistence of the Republika Srpska and in agreement with Baroness Ashton, High Representative of the European Union for Foreign Affairs and Security Policy, of a commission to review judiciary and prosecution practices in Bosnia and Herzegovina, which began its work last year. In November 2011, the Commission adopted preliminary recommendations which highlighted the lack of objectivity, transparency and efficiency in the judiciary of Bosnia and Herzegovina, especially with respect to the processing of war crimes.”

“Taking all the above into consideration, it is evident that Serbia, as well as the whole region, has greatly changed since the Secretary-General, in his report to the Security Council of 3 May 1993 (S/25704), stated that he is of the view that the enforcement of sentences should take place outside the territory of the former Yugoslavia. Therefore, the Republic of Serbia is ready to share responsibility with other countries in regard to that issue and will pursue its initiative whereby Serbia and other countries of the former Yugoslavia willing to do the same are allowed to sign agreements with the Tribunal on the enforcement of sentences. Serbia expects that the Security Council will pay attention to that initiative.”

“With the transfer of the last two indictees to the Tribunal and the fact that there are no outstanding ICTY requests for assistance regarding the ongoing proceedings before the Tribunal, Serbia believes that it has now, undoubtedly, fully cooperated with the Tribunal. Serbia is confident that the level of cooperation achieved will continue in the coming period and that it will secure a smooth transition to future cooperation with the International Residual Mechanism for Criminal Tribunals. “Concerning Serbia's cooperation with the ICTY, it is my pleasure to say that Serbia, once again, shares the Prosecutor's assessment on all aspects of cooperation. The last two fugitives before the Tribunal have been arrested and transferred to The Hague by Serbian authorities, and my Government is in accordance with the Prosecutor that "these arrests are milestones to remember" (S/2011/716, annex 11, para. 47). With regard to the other aspects of cooperation pertaining to access to documents, archives and witnesses, I would like to add that such cooperation between Serbia and the Tribunal has been impeccable for a long time and that the high level of cooperation was successfully maintained during the reporting period. New requests for assistance are received on a daily basis and are considered without delay.”

“Accordingly, an honest analysis of the events leading to the conflict and of the deeds and mistakes that caused it is necessary to avoid similar pitfalls in the future. New institutions and their procedures must be designed so as to maximize the chances for avoiding a repetition of past mistakes. Those who do not remember history are condemned to repeat it, as Santayana said. Countries that have gone through conflicts need enlightened leaders and enlightened institutions, and people must stand up for them if they care about their future and the future of their children. Work on promoting sustainable peace, stability and development is the best prevention against the resurgence of conflict. The cost of conflict is so high that it is incumbent upon us to make every possible effort to succeed in our endeavours to build peace.”

“We also support the proposal to strengthen the consultative role of the United Nations Peacebuilding Commission. The Republic of Serbia has been active, and will continue to be so, in support of United Nations activities on building institutions in conflict-affected areas. We shall also continue our support through our participation in United Nations peacekeeping missions. “My country has thus clearly shown its resolve to contribute to peace and stability in the Western Balkan region. The Republic of Serbia is also of the opinion that full reconciliation in the region will be greatly helped if justice is fully served through national and international institutions with regard to all individuals who committed crimes during the conflict. “It gives its unwavering support to the territorial integrity of Bosnia and Herzegovina and is supportive of all decisions based on the agreement of the three constitutive peoples of that State. Last year, the National Assembly of the Republic of Serbia adopted a resolution condemning the crime at Srebrenica. Serbia cooperates actively with the international presences in Kosovo headed by the United Nations Interim Administration Mission in Kosovo deployed in the province pursuant to resolution 1244 (1999) and supports activities aimed at improving the living conditions for all inhabitants of Kosovo. We showed our readiness to quickly start a dialogue with Pristina in accordance with resolution 64/298. President Boris Tadie has met the leaders of the other countries of the region on a number of occasions.”

“Serbia's efforts to comply with its legal and moral obligations - such as witness protection, provision of documents to the ICTY Office of the Prosecutor and all other means of technical assistance, along with the commitment of the Serbian authorities to continue addressing these issues - are recognized, while joint efforts to ensure success in that cooperation are pledged in the reports. “Although I do not belong to the membership of the Security Council, I wish to congratulate you, Sir, and your country Turkey, on your assumption of the presidency of the Council for the month of June. I know that, under your wise guidance, the Council will be able to effectively deal with the problems on its agenda. At the outset, I would like to express the gratitude of Serbia to Judge Patrick Robinson, President of the International Criminal Tribunal for the Former Yugoslavia (ICTY), and to Mr. Serge Brammertz, its Prosecutor, for the efforts they put into their comprehensive reports (see S/2009/252). My country is appreciative of the fact that the substance and thrust of the reports are in agreement with our own assessment of the level of cooperation achieved so far.”
