Now, on the error rate: the Commission remains committed to proactively discussing with the Court of Auditors how we can best reconcile our respective assessments of the level of error in EU expenditure and reach a common ground while preserving each other's role and prerogatives. The Commission has intensified such discussions in 2025 through targeted workshops. We very much appreciate those workshops, and I would like to thank you for your openness and readiness to organise them. And I do hope also that that's the sentiment that you also share in the European Court of Auditors. To conclude, I would like to emphasise that the Commission is determined to uphold the highest standards of transparency and accountability, and we are looking forward to this debate and I will be back at the end.

The Commission is fully committed to ensuring that the legal and policy framework, as well as obligations on transparency and ethics, are properly implemented and respected at all times, and we take corrective actions if there is a legal basis to do so. The Commission will consider the recommendations from the European Court of Auditors' recent special report on the funding of NGOs to the fullest possible extent to further enhance transparency and accountability. And I believe that this report is a real opportunity to address the concerns that have been raised in this House, to improve the way in which our system works, and to close this debate for the future.

  3. And that's why I would like to thank the European Parliament for support in the negotiations on the recast. We also have the Conditionality Regulation in place, and it is being applied, and it will continue to be applied also in the future MFF. We have started, and we are determined to improve the way in which the anti-fraud architecture is organised. Now, when it comes to the NGOs – because I know this is the issue that is very much present, both in the report but also in the debate – I want to state it clearly: the Commission remains committed to supporting organisations that contribute to a vibrant civil society, and that is not going to change. As discussed in the plenary in January, we have taken steps to mitigate the identified risks, reputational risks – not of fraud, as I have heard on a number of occasions in this in this House.

  4. First of all, we did manage, I believe, to strengthen the protection of the EU budget in several years, starting with the recast of the financial regulation. We have right now grounds for excluding unreliable entities from EU funding under the Early Detection and Exclusion System (EDES). The recast also lays the ground for an expanded use of a modernised single data mining and risk-scoring tool, the current ARACHNE system to identify the project beneficiaries, contracts and contractors which might be susceptible to risk of fraud, conflict of interest and irregularities. The recast has extended the scope of the early detection of ARACHNE to funds disbursed in shared management and direct management with Member States as of 2028. Yes, it should have been faster, but nevertheless it is progress.

  5. But it is also extremely important from the perspective of the European Commission. We take this process with the utmost importance, and I would like to thank the discharge rapporteur, Nicholas Herbst, for our cooperation up until now – as you know, I have jumped into this process in December last year. We are discussing about the budget for the 2023. But I want to say that I really appreciate both the opportunity to work with you, but also with the whole of the Budgetary Control Committee. Now, I also know that by the very nature of this process, the attention today will be focused not on achievements and not on successes, but on the weaknesses that have to be addressed. And of course, I will respect the nature of this process, but let me start by stressing a few things that we did manage to collectively achieve.

  6. I'm confident we all agree that our recommendations should be followed and implemented by all actors without delay. Finally, I want to emphasise that the Council invites the Court to provide representative error rates for all headings of the EU budget.   7. My second point relates to the chapter dedicated to the Recovery and Resilience Facility in the Court's report, which was thoroughly examined in the Council. The Council took good note of the findings of the Court, which need to be put into the appropriate context. More specifically, the Court is conferred a limited mandate by the Treaties which frames the scope of the audit to the grants part of the RRF. Also, the limited number of milestones and targets examined do not constitute a representative sample, and therefore an error rate for this chapter is not concluded on. The Council underlines the importance of the performance of the EU budget in general, since it represents a measure of the true value delivered by the EU to its citizens.

At the same time, given the degree of differences between the Court and the European Commission in interpretation of the same standards, legislation, facts and rules, we invite both institutions to continue the dialogue to address this issue. I would like to highlight two elements of the Council's recommendation more specifically. Firstly, the Court of Auditors' opinion on expenditure is again unfavourable. The Council regrets that the overall error rate has increased and goes even further above the materiality threshold. Nevertheless, the Council still considers that it would be appropriate to grant discharge to the Commission in respect of the implementation of the budget of the European Union for the financial year 2023, thus recognising the efforts of the management and control authorities both at Commission and Member State level.

  9. 2-0272-0000 Adam Szłapka, President-in-Office of the Council. – Mr President, Commissioner, honourable Members, it's an honour for me to represent the Council of the European Union in this debate today and present our recommendation on the discharge to be given to the Commission for the implementation of the budget for the year 2023. Just like the European Parliament, the Council attaches great importance to the discharge exercise. It is key to accountability by providing the assurance that EU funds are used in accordance with the rules and that expenditure respects the principles of sound financial management. As you know, on 18 February, the Council adopted its recommendation to grant discharge to the Commission while expressing concerns similar to those expressed in the European Parliament's report.

  10. Nevertheless, we saw allegations which were dismissed by the Commission and timely clarified by the recent ECA special report. Such unfounded claims have no place in this exact procedure. In Budgetary Control, we are proceeding on the basis of financial regulations and the established financial rules, the principle of legality being the core element. NGOs, as part of civil society, are an integral part of EU decision-making, and it remains fundamental that civil society organisations, through EU funding, can engage in an open, transparent and structured dialogue with EU institutions as enshrined in Article 11 of the Treaty, through activities such as advocacy, demonstrations and judicial actions. This is nothing more than we have agreed on, and I call on all of us to abide by it in this very House.

Nevertheless, we endorse the Court's recommendations and conclude that the risks to the reliability of annual accounts was deemed to be low for all joint undertakings and medium for the smart networks and services joint undertaking and the global joint undertaking, due to the complexities brought about by the transfer of budget appropriations. We also conclude that the risk to the legality and regularity of revenue was deemed to be low for all joint undertakings. As a member of the CONT Committee, I would also like to express my personal dissatisfaction over the recent politicising of the discharge procedure. Let me remind my colleagues that it is ensuring compliance with the relevant legal and regulatory framework requirements that is the main aim of the procedure. There should be no space for political targeting.

I would like to highlight that there are some recurrent problematic areas that could be still brought about in the next financial years, particularly the need for improvement in programme implementations, human resources, and the management and control systems. Likewise, we also emphasise the continuation of aftermath of the important events that enrolled over the last years and that eventually had an impact on the performance of the joint undertakings. Particularly, these were the Russia's war of aggression against Ukraine and its impact on some specific supply chains. These were also the COVID-19 pandemic impacts and the high level of inflation caused by the two aforementioned events, which, again, had an impact on the supplies and delivery time for the joint undertakings.

  13. – Mr President, ladies and gentlemen, dear colleagues, let me first also thank to the European Court of Auditors for their thorough audits, as well as for the clarifications and open cooperation with joint undertakings. Joint undertakings as public-private partnerships play a crucial role in ground-breaking European research, development and demonstration programmes in sustainable transport, revolutionary fusion energy, health, circular bio-based industries, key electronic components, supercomputing and network systems. On 13 November 2024, the Court of Auditors published its annual report on joint undertakings in the form of a consolidated report, similarly to the previous year.

  14. Und deswegen glaube ich, dass es gut ist, hier noch einmal eine Extrarunde zu drehen. Es gab ja schon ein internes Verfahren in der Europäischen Asylagentur. Aber Vertrauen in diese Verfahren ist gut, Kontrolle ist besser – und deswegen sind wir der Haushaltskontrollausschuss und werden uns damit beschäftigen. Zum Abschluss vielleicht noch ganz kurz: Ich glaube, dass wir bei den OLAF-Berichten insgesamt noch einmal gucken müssen: Wie können wir schneller und besseren Zugang zu den OLAF-Berichten bekommen, nicht nur im Falle von Agenturen, sondern auch bei anderen Berichten? Wir müssen aber insgesamt, finde ich, zum Schluss so einer Rede dann auch noch einmal sagen: Vielen Dank an die europäischen Agenturen und vielen Dank an die Leute, die für diese Agenturen arbeiten und einen guten Job leisten. 2-0271-0000 Michal Wiezik, rapporteur.

Unter dem Strich freue ich mich – die Redezeit ist ja bald vorbei, so viel Redezeit hatte ich übrigens noch nie, das freut mich sehr –, in dem Bericht die Entlastung von 32 der 33 Agenturen vorschlagen zu können. Wir haben ja im CONT-Ausschuss bereits beschlossen, die Entlastung der Europäischen Asylagentur jetzt nicht durchzuführen. Und das schlagen wir auch für das Plenum vor. Es gibt einfach einen aktuellen Bericht der Antibetrugsbehörde, über den ich hier nicht inhaltlich reden möchte, aber den wir ernst nehmen müssen, wo es Probleme gibt. Und wir als Parlament haben besonders in den aktuellen Zeiten, glaube ich, die Verantwortung, im Bereich der Asylagentur, im Bereich von Asyl und Migration auch dafür zu sorgen, dass die zuständigen Agenturen das Vertrauen genießen, das sie dann auch verdient haben.

Da haben zum Beispiel die Untersuchungen des Europäischen Bürgerbeauftragten gezeigt, dass es bei Bereichen von Frontex, zum Beispiel beim Zugang der Öffentlichkeit zu Dokumenten, sicherlich noch viel zu tun gibt. Bei der Grenzschutzagentur Frontex – das sagen wir auch im Bericht – gibt es ohne Zweifel Fortschritte in den letzten Jahren, auch seit es einen neuen Exekutivdirektor gibt. Aber wir sagen auch, dass im Bereich der Grundrechte noch einiges zu tun ist. Um bei den Grundrechten zu bleiben: Es ist auch bei der Agentur für die Grundrechte, der FRA, so, dass diese Agentur angesichts ihrer wachsenden Aufgaben personell und natürlich auch finanziell mitwachsen und angemessen finanziert werden muss.

  17. Schwächen im öffentlichen Beschaffungswesen sind nach wie vor eine große Quelle für vorschriftswidrige Zahlungen, besonders bei ENISA, eu-LISA und ELA. Die Agenturen erhielten aufgrund von Problemen bei der Auftragsvergabe eingeschränkte Prüfungsurteile vom Europäischen Rechnungshof – da muss man sicherlich noch einiges tun. Ich möchte aber auch festhalten, dass die Agenturen seit dem Berichtszeitraum 2023 schon einiges getan haben, sodass wir dann hoffentlich auch bei den nächsten Entlastungen da die Fortschritte in den Berichten abbilden können. Ich möchte auch die Notwendigkeit von verstärkter Transparenz der EU‑Agenturen hervorheben. Besonders bei Agenturen mit kritischen Aufgaben im Bereich von Sicherheit oder auch Migration ist das sehr wichtig.

  18. Und natürlich geht es darum, damit dann die Transparenz, die Leistungsfähigkeit zu steigern, aber auch das angesprochene Vertrauen. Unter diesen Kriterien haben die allermeisten EU‑Agenturen die Finanzvorschriften weitgehend eingehalten und auch positive Bewertungen vom Europäischen Rechnungshof erhalten. Einige Agenturen hatten mit Verzögerungen bei der Ausführung des Haushaltsplans zu kämpfen und mit Minderausgaben ihres Haushalts. Ich glaube, da geht es schon ein bisschen darum, dass wir noch einmal genauer schauen, wie man die Ressourcenplanung besonders bei den Agenturen, die in den letzten Jahren sehr stark gewachsen sind, besser macht. Einige Finanztransaktionen haben Anlass zu Bedenken gegeben, und da wurde jetzt eine verstärkte Aufsicht gefordert.

Und wenn man den Trend der letzten Jahre betrachtet, dann ist es so, dass wir sowohl bei der Anzahl der EU-Agenturen als auch bei bestimmten Agenturen beim Aufwuchs der Mittel wirklich eine erhebliche Steigerung beobachten. Und da – das sagen wir auch im Bericht – ist es sehr wichtig, noch einmal festzuhalten, dass die Schaffung neuer Agenturen, aber auch die Erweiterung bestehender Agenturen auf Grundlage von Belegen und realem Bedarf entschieden werden sollten, nicht aufgrund von Wahlkampagnen. Wir kümmern uns in dem Bericht natürlich auch um die Einhaltung der Finanzvorschriften, um die Grundsätze einer soliden Haushaltsführung, die Prüfung der Finanzberichterstattung, die Feststellungen des Rechnungshofes – auch vielen Dank an den Rechnungshof für die Arbeit, die da reingeflossen ist.

  20. Insofern – Frau Hohlmeier hat es angesprochen – ist es sehr wichtig, dass man auch in diesem Prozess breite Mehrheiten findet, dass man aufeinander zugeht. Ich glaube, am einfachsten, Frau Hohlmeier, geht das wahrscheinlich, wenn man nicht den Eindruck erweckt, vor den anderen wegzulaufen. Dann nähert man sich auch an, wenn man einen Schritt aufeinander zugeht. Aber darum soll es heute nicht gehen in meiner Rede. Meine Rede bezieht sich auf den Bericht, in dem es um die Entlastung der 33 Agenturen geht. In dem Jahr 2023, um das es geht, hat sich der Gesamtetat, den wir zu entlasten haben, auf 3,7 Milliarden EUR belaufen.

  21. Je mi to neskutečně líto, ale výbor CONT řekl zcela jasně: „Budeme chtít, aby v této agentuře proběhly změny“. Absolutorium není způsob kritiky. Absolutorium je způsob, jak udělat Evropskou unii lepší. Prosím, pamatujme na to všichni, kdo jsme tady v tomto sále shromážděni. 2-0270-0000 Erik Marquardt, Berichterstatter. – Herr Präsident, Herr Kommissar, Vertreter vom Rat! Die Haushaltskontrolle ist ja vielleicht nicht die emotionalste Aufgabe des Parlaments, und manchmal wirkt das auch alles etwas trocken. Aber ich glaube, wir – zumindest die, die hier sind – wissen, dass das ein ganz entscheidender Mechanismus in unserer Demokratie ist – auch um Vertrauen in die Demokratie, in die demokratischen Institutionen zu wecken.

  22. Působí to na mě přinejmenším zvláštně. My máme nároky na všechny ostatní, ale sami k sobě nejsme schopni být kritičtí? To není správně. A já musím říct, že mě to neskutečně mrzí. A bohužel, jak bývá pravidlem, absolutorium neobdrží ani Rada a Evropská rada. Dokud oni nezačnou akceptovat zakládající Smlouvy a nepodrobí se nezávislému rozpočtovému absolutoriu, nelze jednat jinak. My to ale vyřešit nemůžeme. Musí přijít konec zlomu. A proto, pane komisaři, je váš klíčový historický úkol pro budoucnost prostě „bouchnout do stolu“, sejít se se šéfkou Evropské rady a Rady a navázat s ní dialog. A já pevně věřím, že za tu dobu, jak jsem vás poznal, jste člověk na pravém místě a můžete to vyřešit. Závěrem mi dovolte říct, že bez zásadních reforem nelze udělit absolutorium Agentuře pro azyl.

  23. V posledních měsících ale jedno téma ovládlo diskuzi více než jiná – neziskové organizace a jejich vliv na evropské rozhodování. Šíří se kolem toho velké množství různých spekulací, polopravd a záměrných manipulací, ale já bych vám to chtěl říct tady jasně. Evropská lidová strana nikdy nepožadovala omezení práv neziskových organizací, nikdy jsme to nechtěli a nikdy to chtít nebudeme. Na čem ale trváme a co je pro nás důležité, je transparentnost. Pokud neziskové organizace berou peníze z evropského rozpočtu, tak je naší povinností vědět, jak byly použity, a to napříč celou Evropskou unií. A to je celé. Proč z toho Levice nebo Zelení dělají konec světa, to opravdu nechápu a docela mě to i mrzí. Poprvé v historii dostane jedna instituce absolutorium, ale bez doprovodné rezoluce. A tou je Evropský parlament.

  24. Bez vás by nebylo možné dokončit discharge. Tohle je neskutečný výsledek spolupráce napříč výbory, frakcemi, ale hlavně lidmi. Jsem rád, že se ve výboru CONT podařilo nastavit kulturu spolupráce, která je věcná, efektivní a konstruktivní. Věřím, že si tento přístup udržíme i po zbytek mandátu. Hlavně doufám, že se přenese i do pléna, kde občas spíše než argumenty slyšíme ideologické výkřiky. Letos jsme doporučili absolutoria pro téměř všechny instituce a agentury. Je to výsledek poctivé práce, jasné metodiky a faktického posouzení. Nehráli jsme na politiku a „nehonili jsme si ego“, jako to někdy bývá v této plenární místnosti zvykem. A o to více je důležité říct, že kontrola rozpočtů není a nikdy nebude ideologie, ale bude to odpovědnost.

  25. Das ist nicht unbedingt der klügste und der beste Weg, Wenn wir in der Vorbereitung des mehrjährigen Finanzrahmens sind, sind daraus die Konsequenzen zu ziehen. Bei NGOs in allen Bereichen, übrigens nicht nur bei LIFE, müssen die entsprechenden Konsequenzen gezogen werden. Ich danke der Kommission dafür, dass sie auf dem Weg dazu ist und dass wir einen sinnvollen Weg finden, die Transparenz entsprechend auszubauen und das Ganze sinnvoll zu steuern, ohne dass man gegen NGOs ist. Wir können nicht den Fall Kaili hinter uns gebracht haben und dann anschließend sagen: Bestimmte brauchen sich nicht transparent zeigen und Bestimmte müssen nicht ihre Gelder entsprechend rechtfertigen und ausgeben oder im Transparenzregister angeben, dass sie ja gar kein wirtschaftliches Interesse haben in Wirklichkeit bei einer Masse von Gesetzgebungen in Bereichen, die die Wirtschaft intensiv tangieren, oder sogar wirtschaftliche Interessen vorantreiben, entsprechend agieren und sogar in Wortlauten formulieren, wie sie möglichst intransparent hier parlamentarische Entscheidungsflüsse oder die im Rat oder auch die in der Kommission zu beeinflussen gedenken. Es geht auch nicht, dass die Kommission die Kommission lobbyiert über Nichtregierungsorganisationen.

Als Zweites: Wir haben auch eine notwendige und wichtige Diskussion über sogenannte Nichtregierungsorganisationen und über die Transparenz, mit der sie hier in der Öffentlichkeit auftreten bzw. auch Legislativverfahren beeinflussen. Wir haben doch eine ganze Menge von Arbeitsprogrammen gefunden, in denen ein Teil von Netzwerken glaubt, intransparent Lobbyismus betreiben zu dürfen, und der Sonderbericht des Europäischen Rechnungshofes entdeckt – im Gegensatz zu dem, was die Pressemeldung auch von Grün und von Rot gewesen ist – sehr deutliche Defizite und auch Kriterien, in denen ausdrücklich darauf hingewiesen wird, dass intransparentes Lobbyieren ausdrücklich nicht erwähnt worden ist.

Ich sehe aber die Entlastung insofern vor einem Hintergrund, der außerordentlich wichtig ist, und möchte ausdrücklich betonen, dass das Mitentscheidungsrecht des Europäischen Parlaments in Fragen des Haushalts nicht infrage gestellt werden darf. Es darf nicht infrage gestellt werden, dass wir überhaupt ein Haushaltsentlastungsrecht bekommen, dass wir überhaupt noch die Möglichkeit haben, zu überprüfen, welche Ausgaben getätigt werden, was beim ARF sichtlich nicht der Fall ist. Mot bakgrund av det ökade behovet av granskning efter att volymen av resurser kraftigt ökat genom coronafonden kan ECA:s kostnadsökningar kanske ses som alltför små för att göra en effektiv granskning. Coronafonden var svar på en kris, men kriser får aldrig bli en ursäkt för slappa kontroller. Vi måste därför vara vaksamma, så att externa faktorer inte skymmer sikten för potentiella interna brister i kontrollen. Revisionsrätten larmade redan för flera år sedan om att felnivån i EU:s budgetar ökar markant. Under 2023 ökade felprocenten enligt revisorerna till 5,6 %. Det rör sig nu om enorma belopp. Särskilt vad gäller coronafondens utbetalningar kan omfattande fusk observeras. Enligt revisionsrätten går det helt enkelt inte att följa pengarna för att se var de tagit vägen.

  34. Jag vill i egenskap av föredragande för detta förslag först understryka vikten av Europeiska revisionsrättens arbete. ECA spelar en unik roll inom unionen. Revisionsrätten utför oberoende granskningar av unionens omfattande utgifter och stärker genom sitt arbete den bristfälliga demokratiska legitimitet som EU lider av, genom att ge ökad transparens och ökat ansvarsutkrävande. För 2023 uppgick revisionsrättens budget till ca 175 miljoner euro, vilket motsvarar en ökning på knappt 8 %. Din păcate, în câteva decizii recente, inclusiv care privesc România, Curtea încearcă o federalizare de facto pe cale jurisprudențială a Uniunii Europene, atribuindu-și competențe pe care tratatele nu i le dau. O astfel de abordare nu doar că este ilegală, dar contravine direct voinței exprimate de cetățenii europeni care au respins explicit, prin referendum, proiectul de constituție europeană. Până una-alta, statele au creat Uniunea Europeană, nu Uniunea a creat statele membre ale ei. UE trebuie să rămână ceea ce a fost gândită să fie: o uniune de state care cooperează pentru binele comun al cetățenilor, nu un suprastat birocratic care își extinde autoritatea peste voința democratică a cetățenilor. Solicităm prin acest raport CJUE să continue acest demers prin transmiterea în direct a tuturor ședințelor și arhivarea lor online, astfel încât persoanele interesate să le poată accesa. Totodată, raportul salută decizia CJUE de a publica, cu unele excepții, documentele depuse în procedurile preliminare după închiderea acestora. Este un demers care va îmbunătăți semnificativ actul de justiție. Un aspect pe care raportul îl abordează doar tangențial, dar care merită o reflecție profundă, este tensiunea tot mai evidentă între supremația Constituției și prioritatea dreptului european.   42. Od tego czasu sytuacja nie uległa poprawie, Rada unika odpowiedzi na fundamentalne pytania związane z wydatkami budżetowymi. W 2024 r., pomimo dostarczenia przez Parlament kwestionariusza zawierającego aż 90 pytań dotyczących wykonania budżetu Rady, Rada ponownie odmówiła udzielenia odpowiedzi.   43. Niestety, od ponad dekady, podkreślam od ponad dekady jesteśmy świadkami sytuacji, w której Rada Europejska oraz Rada systematycznie odmawiają współpracy z Parlamentem w tej procedurze. Let me be very clear: the RRF is not a blueprint for the next MFF. Let me also stress that subsidiarity is not an outdated idea. We also have to talk about the reste à liquider, record high unpaid commitments and mounting EU debt sparks warnings over long-term effects, slow absorption of cohesion and RRF funds keep pushing the reste à liquider up.
