“I hope as well that the minister today will address the question of supporting the trade union campaign against cuts to British Transport Police in Scotland, and that he will make a statement against the outsourcing of ScotRail customer experience services to the anti-trade-union company Teleperformance. Of course, I also hope that the Government will address and reverse the big cuts in ticket office opening hours in railway stations right across Scotland, which have been forced through as a political choice. They are not operational decisions; they have been signed off by the Scottish Government. Let me conclude by saying this: the removal of staff from railway station ticket offices will not only deter passengers; it will deny many passengers access to public transport altogether.”
“He also concluded that, when it came to getting people out of cars and on to public transport, the Scottish Government had carried out no consultation, had no clear costed plan, had no measurable milestones and had done no equality impact assessments, and he said that monitoring and scrutinising arrangements were insufficient. “In my view, it is a victory for the RMT and the other rail unions, which have campaigned for it with tenacity and with banners bright, in the face of which the Scottish Government has maintained for the past year that it was only existing, undeserving and—worse yet—middle-class ScotRail passengers on above- average earnings who gained from the scrapping of peak fares, when in fact it was a benefit to all workers travelling to and from their work, which, by my definition, is the working class. We know that this is about leading a long-term change in behaviour. As the Auditor General told Parliament earlier this year, “it can take time to sustain positive behavioural changes, such as encouraging modal shift from car to rail use”.”

The Scottish Government is now the sole shareholder in Scottish Rail Holdings Ltd, so it must use that ownership—that power— for the common good. Let me be clear: I, for one, welcome the Government’s conversion to the scrapping of peak fares once and for all.”
“I begin by declaring my interest as the convener of the RMT Scottish parliamentary group. I thank Bob Doris for lodging the motion. I know that, like me, he is a regular passenger on the Glasgow to Edinburgh train, so maybe he should declare his interest, too. I also thank the Scottish Government, because Abellio is gone, Serco is gone and ScotRail is in public ownership, the Caledonian Sleeper is in public ownership. I am not sure that the Government is building socialism, but it is taking steps in the right direction. Bob Doris: I thank Mr Leonard for his kind words. I did not declare my interest as a regular Glasgow to Edinburgh rail user because I am privileged that the taxpayer steps in and funds my rail travel. It is my constituents who do not have that privilege who will benefit, rather than me.”

“Standing orders rule 9.8.6 discusses the opportunity that the member in charge of the bill has to take part of the bill, amounting to no more than half of the total number of sections of the bill, back to the committee that dealt with it at stage 2 to take a look at, inter alia, changes that were unexpected by that committee. In the submissions that we heard yesterday, two members of the committee pointed out that, particularly with regard to group 2, on accreditation and quality assurance of qualifications, there had been challenges at committee level to understand the meaning of it. In the circumstances, where there was a potential misunderstanding by the committee, are you aware of any approach that has been made by the sponsoring member to refer the matter back to the committee?”

“As members of the Education, Children and Young People Committee will recall, my concerns at stage 2 were primarily around accidentally restricting appointees to those with Scottish experience only. I note that amendment 91 addresses that suitability, as it is not tied to teaching or leadership in educational establishments in Scotland. I am therefore happy to support Mr Kerr’s amendment 91 tonight. However, for reasons that I set out at stage 2, I cannot support amendment 92. I suggest to members that that amendment is unnecessarily prescriptive. The terms of chief executives and, as in this case, other HM chief inspectors for other inspectorates in Scotland are generally governed by appointment contracts and governance frameworks rather than explicit term limits in legislation.”
“These two amendments are not symbolic or tokenistic; they are structural, substantive and strategic. The chief inspector should have the necessary experience, insight and credibility to carry out the role. I urge all members to support these two amendments. Let us get this right not just for the architecture of the bill or any bill, but for the integrity of the system that we are here to improve. “This is all about creating a structure that enables and protects high-quality public service, that insulates those in high office from pressure and expectation and that signals clearly to the system that challenge is not a threat but a vital condition for improvement. Taken together, amendments 91 and 92 professionalise and de-politicise the role of chief inspector. They give structure to the appointment process, they give clarity to the expectations of the role and they give confidence to the Parliament, the profession and the public that we are serious about quality, independence and the culture of challenge that real improvement requires. The chief inspector of education should be one of the most trusted voices in Scottish public life— trusted to tell the truth, trusted to challenge poor practice and trusted to lead by example.”
“It is simple: to secure the independence of the office and protect it from political influence, favour seeking or strategic careerism. If the chief inspector is to provide fearless, evidence-based reporting, especially when the evidence is inconvenient for Government, agencies or powerful stakeholders, the office-holder must be protected from any perceived pressure relating to reappointment or tenure. A fixed, non-renewable term would ensure precisely that. It would give the post holder a clear mandate and a secure tenure during which they could lead with independence, clarity and accountability. Seven years is long enough to make a strategic impact, but it is not so long as to risk complacency, inertia or the entrenchment of power.”
“The OECD review, too, underscored the importance of rebuilding trust and credibility between national agencies and front-line practitioners. That report noted that professional trust and systemic reform are interdependent. Practitioners must feel ownership of reforms, which depends on transparency and professional legitimacy within the institutions that lead them. What we propose in amendment 91 is entirely consistent with best practice across developed education systems. It should be unthinkable to appoint a chief inspector who does not know schools from the inside. Amendment 92 would complement amendment 91 by establishing a fixed, non-renewable term of seven years for the chief inspector. I have already explained my rationale behind the idea of having a non-renewable fixed term.”
“Amendment 91 proposes that the person who is appointed to the role of chief inspector should have suitable teaching experience and should have held a leadership role in an educational establishment. This is not a bureaucratic tick-box exercise but a statement of principle rooted in evidence and experience. I remind the Parliament that the Muir review, which was commissioned by the Scottish Government itself, made that point absolutely crystal clear. The report said that it is essential that those who hold leadership positions in national education bodies have experience of the sectors that they oversee and can demonstrate credibility and understanding when engaging with practitioners. That is from “Putting Learners at the Centre”, and it should not be controversial.”
“If we are simply seeing a transfer of the SQA to qualifications Scotland, the nature, character and independence of the person who will serve as the chief inspector of education in Scotland become the prime focus of the bill. As it stands, the bill establishes the post but says almost nothing about the qualities, experience or term of office for this critical role. That omission is not simply an oversight but a fundamental weakness in the framework that we are constructing, and it is one that the Parliament must put right. Therefore, I was very grateful to have the positive experience of working with the cabinet secretary and her office to produce amendment 91.”

It is not all entirely within the Scottish Government’s gift, but we recognise our convening power and ability to bring people together. “I whole-heartedly agree with Richard Leonard’s point that this comes after the impact of Grangemouth, which is why we are focusing all our efforts on finding a solution, and it is why we have been engaging with Unite, GMB, the company, the UK Government and procuring authorities to do that. The Deputy First Minister’s statement is more a defence of the Government’s position than it is a plan of action to save these facilities and to save these workers’ jobs. The fact is that the last two factories building buses in Scotland are facing closure at a time when there is no shortage of orders for new buses. That comes in the shadow of the closure of the Grangemouth refinery, and here we are again facing a close-and-import strategy. When is the Government going to recognise that these are strategic national assets? When will we see a proper Scottish Government industrial strategy? When will the Government understand that manufacturing matters, rescue these jobs, prevent these closures and save this industry? Kate Forbes: Manufacturing does matter.”

“It was a test case in which the insurance industry was finally forced to recognise that a civil award for pleural plaques could be pursued, and to do so did not close the door on a later damages claim for mesothelioma. Sadly, that is exactly what happened in the life—and then in the tragic death—of Alex Falconer. For many of us, action mesothelioma day is not abstract. It is very real, and whether inside Parliament or outside of it, in that battle for justice, alongside the grass-roots campaigners in Action on Asbestos and the Clydebank Asbestos Group, we will carry on. It remains painful, poignant and personal, but it is political as well, and so we will carry on—striving, struggling, yielding to none, facing setbacks but unflinching in our determination. In the name of all those we have lost, we will carry on. We will never give up.”
“One of the greatest influences on my politics and in my life was my old friend and comrade Alex Falconer, who was a member of the European Parliament, a community campaigner, a socialist, a peace activist, a dockyard worker and a trade unionist to his core. He won a test case in the late 1980s when he was diagnosed with pleural plaques after working with asbestos as a lagger in Rosyth dockyard. I remember the two of us going to meet the Transport and General Workers Union’s lawyers in Glasgow, going to meet Hugh Campbell QC in the splendour of Edinburgh’s new town, and then meeting him again on the steps of the High Court in Edinburgh just days later, to be told that the Ministry of Defence had decided at the last minute not to defend the action.”

That is why I call on the minister today in Parliament not to meet me but to give them an unequivocal guarantee that the Government will amend the Prescription and Limitation (Scotland) Act 1973, in line with the Scottish Law Commission’s recommendation, before the end of this parliamentary session.”
“The evidence from practitioners advising the Scottish Law Commission is that more than 700 people are diagnosed with pleural plaques in Scotland every year, and that this number might not yet have peaked. That is why the Scottish Law Commission’s recommendation in its “Report on Damages for Personal Injury”, published last December, which at last resolves the time-bar problem, must now be enacted. By its own admission, the Law Commission draws heavily on the case that was made by Unite the Union and articulated by its solicitors, Thompsons. Their submission argued this: “Individuals should not be disproportionately penalised for failure to raise court proceedings for a relatively minor injury when they ...”
