“We very much welcome that and hope to work with the cabinet secretary to make sure that that happens and that it fulfils the desires of all the NGOs, because flexibility is provided in some areas but not in others, so it would be good to have renewed guidance that provides the comfort that everybody needs but also makes restoring nature the priority. Edward Mountain: I welcome the comments that have been made by the cabinet secretary and the work that has been put in by Mark Ruskell and Rhoda Grant. The cabinet secretary has said that she will reconvene a group later in 2026. Amendment 31B includes the wording “Ministers may appoint such persons as they consider to have an interest in the habitats regulations”.”
“Although we realise that that part was not perfect, there was an intention to provide much-needed flexibility in protected site designation to enable nature recovery. When part 2 was removed, because other NGOs were concerned about its being far too broad, the Woodland Trust sought to work with MSPs to develop a much more targeted set of powers to enable nature recovery or habitat restoration. However, we could not reach agreement with the NGOs, so I looked at strengthening Mark Ruskell’s amendment instead. We would want guidance to be comprehensive, detailed and impartial and to be based on the findings of an independent working group of experts. I think that that is what the cabinet secretary has agreed to do.”
“On amendment 31B, I would not be opposed to the creation of an independent working group, but I would be concerned if there was not a more wide-ranging public consultation, which I think is needed. There was not a full consensus on part 2, particularly among environmental non-governmental organisations, and we would want there to be much more unity on what would be appropriate to change the guidance on the habs regs as we go forward. However, I do not intend to move amendment 31, and I am content with the commitments that the cabinet secretary has made with regard to moving the issue on. The Deputy Presiding Officer: Rhoda Grant joins us remotely. Rhoda Grant: I will speak to my amendments 31A and 31B. As we have heard, some NGOs— such as the Woodland Trust Scotland—were concerned at the loss of part 2 of the bill.”
“The intention behind amendment 31 was to require the Government to review the existing regulations guidance with the new environmental goals in mind, to establish what degree of flexibility exists within the guidance without taking the original approach of opening up the entire habitats regulations to broad changes at ministerial discretion. It would be a nutcracker to crack a nut, rather than a sledgehammer. I welcome the comments from the Cabinet Secretary for Climate Action and Energy, particularly on the setting up of a working group to look in detail at that issue specifically. That is very welcome, as is the timeframe that she has just outlined for that work. On that basis, I am content to not move amendment 31. Amendment 31A would extend the timescale for review from one year to two years.”
“The first guidance came into effect in the 1990s. Times have changed and environmental priorities have evolved, and the Government, its agencies and the huge range of land managers increasingly want to take forward broader nature restoration projects. With the existing habs regs being based on the protection of specific species, there have been some instances where those different aims have conflicted. Questions have been raised about how much flexibility exists under the current habitats regulations to allow for restoration, such as tree planting on river banks, to take place on sites that might be protected for species such as the wild salmon.”
“It would have given ministers extensive powers to rewrite environmental protections, including the habitats regulations, and there was a lack of clarity from the Government about why such extensive powers were needed. The committee was given few clear examples of how the new powers would be used or what problems they would solve. Members were asked to put a lot of trust not only in this Government but in all future Governments that the powers would be used wisely. As a result, a majority of members voted to remove part 2 from the bill, and I think that that was the right outcome. However, it is clear from the months of evidence that the committee heard and from discussions with environmental stakeholders before and after stage 2 that there is a lack of clarity on some of the guidance on the implementation of the habitats regulations.”
“If Mark Ruskell and Rhoda Grant are willing to not move their amendments, I will commit to establishing a short-life working group in 2026, which will be formed of independent experts with appropriate ecological expertise. The group will consider where we need new guidance on the habitats regulations and will provide advice to ministers on where that guidance will help us to achieve our biodiversity ambitions. Once that advice is received, I will consult on it to ensure that everyone with an interest has the opportunity to comment. I move amendment 30. Mark Ruskell: A majority of the committee agreed that there were problems with part 2 of the bill as introduced.”
“Although I cannot support amendments 31, 31A and 31B, given their very wide scope, I welcome the suggestion that a working group be established to provide ministers with advice on how we can make our protected sites more effective. I also agree that it would be helpful to consult on any new guidance, to ensure that we obtain the views of a wide range of organisations and individuals who are involved with our protected sites. I am grateful to Mark Ruskell and Rhoda Grant, as well as stakeholders such as Scottish Environment LINK and the Woodland Trust, for their constructive engagement on those issues in advance of today’s stage 3 proceedings and for their willingness to work with the Government on a solution in the light of the concerns that were raised.”
“Amendment 31 would require the Government to produce new guidance on every aspect of the habitats regulations and, in doing so, to review all the existing guidance. My concern is that that significant undertaking would risk diverting resources away from tackling the things that we know will deliver the biggest benefits for nature in order to produce guidance in areas where it was not needed. I am sure that that is not the intention behind the amendments, but I have said many times during the passage of the bill that I want the Government to focus on delivery and not to needlessly divert resources from that. Amendment 31B would require the establishment of an independent working group to provide advice to ministers on guidance.”
“For those reasons, I ask members to support amendments 30 and 44. I understand and appreciate the intentions behind Mark Ruskell’s amendment 31 and Rhoda Grant’s amendments 31A and 31B. I know that they are well meaning and that the intention is simply to seek to ensure that our protected areas are delivering for biodiversity. Regrettably, however, the obligation that the amendments would impose on policy officials in the Scottish Government would be significant and administratively burdensome. Amendment 31 would require guidance to be published on both the interpretation and implementation of the habitats regulations. Those regulations are far reaching as they cover a wide range of subject matters over and above our protected sites, and a large volume of guidance has already been produced by a range of bodies.”
“Amendment 30, in the name of the cabinet secretary, is grouped with amendments 31, 31A, 31B and 44. 15:45 Gillian Martin: I will speak to my amendments 30 and 44, which are minor technical amendments, before turning to the rest of the amendments in the group. Amendment 30 will remove a redundant provision from the bill. Part 1B of the bill was agreed to at stage 2, and the intention was for the provision in that part to apply to part 2. However, as the entirety of part 2 was removed at stage 2, that provision now has no practical effect and is therefore unnecessary. Amendment 44 will update the bill’s long title by omitting the reference to a power to modify environmental impact assessments and habitats regulations, as that power was removed from the bill by amendment at stage 2.”
“My intention is for the level of protection currently afforded to SSSIs to be unchanged by this bill, and my amendments will ensure that that is achieved. Section 34, as amended by the amendments in group 2, simply sets that out explicitly, for the purpose of making the 2004 act easier to read by laypeople and by the bodies and office holders upon whom functions are imposed under the terms of the 2004 act. I move amendment 29. The Deputy Presiding Officer: No other members have pressed their request-to-speak buttons. Gillian Martin: I have nothing further to add. Amendment 29 agreed to. “The purpose of section 34 was to be clear about the extent of the definition, because the definition of a “public body or office holder” in the 2004 act was non-exhaustive and we were concerned that that could lead to possible confusion as to who has duties under that act. My amendments 29, 35 and 39 further refine that definition to provide greater clarity as to what constitutes a “public body or office holder” by clarifying the extent of the functions of such bodies or office-holders under the 2004 act. That has been done in response to feedback about the potential unintended consequences of how the provisions would interact with part 2 of the 2004 act and with the protection of sites of special scientific interest.”
“Amendment 70 agreed to. The Deputy Presiding Officer: We come to group 2, on the meaning of public authority et cetera in the Nature Conservation (Scotland) Act 2004. Amendment 29, in the name of the cabinet secretary, is grouped with amendments 35 to 39. Gillian Martin: The amendments in this group are technical amendments, the purpose of which is to provide additional clarification to a provision in section 34 of the bill as introduced. Section 34 replaced the definition of a “public body or office holder” in section 58 of the Nature Conservation (Scotland) Act 2004 with a provision to the effect that the 2004 act does not apply to the exercise of functions by public bodies and office holders other than in areas of devolved competence and “in or as regards Scotland”.”

“Given the importance of the issue, it is important that we work on it on a cross-party basis, and that is exactly the approach that I will continue to take. At the meeting that we had last week, which included Mr Kerr, I suggested that we have a fuller update for MSPs in March that will allow for a consistent flow of information to members on the Government’s work on the topic. I will be able to share more with members on that in my statement in February, and then again in March, before Parliament dissolves.”
“I am mindful of that, particularly in my own role. Children disclose or report allegations in relation to child sexual abuse in a range of ways. Given my experience as a teacher, I know how that works in a school. However, four different independent inspectorates will be looking in clearer detail at the ways in which that works within their relevant responsibilities. I want to come back to Parliament with a fuller update on the substantive point that the member raises, which is hugely important. I have been clear throughout my time in Government, in responding on the Government’s approach to this issue, that we need to hear from victims of child sexual abuse in order to ensure that we can learn from their experiences, improve our response and eradicate that type of behaviour in our society.”
“Last September’s initial report of a national child sexual abuse and exploitation sub- group “found little evidence that training in Scotland adequately equips professionals with the skills needed to respond ... current practice often relies on children verbally disclosing their abuse before decisive protective action is taken”. What meaningful, substantive action has the Government taken to protect Scotland’s children in the months since its own experts gave it that warning? If something was done, why has it not worked? Jenny Gilruth: I thank Mr Kerr for raising that substantively important matter. I am also mindful that, every time we discuss these topics, victims of child sexual abuse might be listening, and it is important that we discuss the issues in a sympathetic and appropriate manner that is reflective of victims’ trauma.”
“I was very pleased that he attended the cross-party meeting that I held last week with the Cabinet Secretary for Justice and Home Affairs, in which we heard an update from Professor Alexis Jay, Police Scotland and the four independent inspectorates that will be leading the work. I want to be clear again today that the Government is not ruling out further inquiries. I made that substantive point in my statement to Parliament in December. However, there is a need for an evidence base, and that is exactly why the inspectorates are taking the work forward appropriately. To that end, as I intimated in my first answer, I will update Parliament further in February. Liam Kerr: I think that the cabinet secretary’s response will disappoint so many. She listed, and places great reliance on, those in the field.”
“Liam Kerr: The sinister revelation that grooming gangs are putting mobile phones into residential care homes exposes once again how much remains unknown and how sophisticated these vile predators actually are. Whereas a full inquiry would shine a light on all the dark corners of this nefarious, vicious practice, this Government contents itself with an ill-defined review. In the light of the latest revelations, surely the cabinet secretary now concedes that what is needed is not a review but the full inquiry that everyone is demanding. “Sexual abuse and exploitation of children are abhorrent crimes with devastating impacts on victims and their families. The first part of the independent national review that I announced last month will focus on rigorous, detailed scrutiny of local authorities’ assessments of the threat and risk of group-based child sexual abuse and exploitation. The review, which will be undertaken by the four independent inspectorates, will assess local areas’ understanding of and response to known risk factors, including children who regularly go missing from home or care. If any harm or risk is identified during the review, it will be escalated immediately through the appropriate channels, including to Police Scotland as required, and will be acted on. I intend to update Parliament more fully on that work in February.”

We all recognise the growing demand for additional support in recent years, so the report will reflect areas in which on-going work must remain a priority and that will be important to acknowledge as part of our focused ASN review. There was a clear ask from Willie Rennie—who, I note, is not in the chamber—for the Government to hold a national ASN debate. I am pleased to share with the Parliament that that event is scheduled for 12 March.”
“The framework will enable reporting on measures that better reflect the achievements and experiences of children and young people with additional support needs. By embedding ASL data in that platform, we will ensure an equal focus on making progress in reducing the poverty-related and ASN-related attainment gaps. Thirdly, work has been developed and led by Enquire, Scotland’s national advice service for ASL, to improve communication. A dedicated web page has been launched on the Enquire website, which now serves as a central hub for all ASL resources. It hosts a suite of downloadable materials, including general information cards for parents, carers and professionals, as well as a series of frequently asked questions that address common issues about ASL rights and processes.”
“First, we have refreshed the code of practice for supporting children’s learning in order to provide clearer guidance on the implementation of the Education (Additional Support for Learning) (Scotland) Act 2004. The draft document will be published for consultation next month, giving stakeholders a final opportunity to engage and contribute their views. The code seeks to address practicalities and common areas of ambiguity that teachers and families have raised. It explains how the law should work in practice, including in relation to identification, planning, co-ordinated support plans and dispute resolution, and it is central to consistent delivery. Secondly, the first iteration of the ASL national measurement framework was launched last month.”
“Furthermore, starting this month, the General Teaching Council for Scotland will consult on planned changes to initial teacher education accreditation. Alongside that, the GTCS is working with the Scottish Council of Deans of Education to deliver a national evaluation of ITE programmes in Scotland. That work has the potential to evaluate the impact of ITE, including by providing a more robust assessment of ASN content in ITE, which was a key ask of the Parliament’s Education, Children and Young People Committee. Notwithstanding the focused review, it is important that we learn from previous action on additional support needs. The ASL action plan, which arose from the Morgan review of 2020, is now entering its final phase. The plan has resulted in a number of deliverables.”
“Teachers will be able to access the latest research and evidence through briefs from the centre, and they will receive structured support to apply insights to their practice, share findings and learn from colleagues across peer networks. I am pleased that a number of teachers have already been seconded to each hub. Those teachers will act as a point of contact for schools and colleagues, and they will support participation in networks and events. That work builds on the national support from Education Scotland, which we have funded to deliver a national ASN teacher professional learning programme over the past 18 months. That initiative includes deploying ASN associates to support adaptive teaching in classrooms.”
“We also need better support for the teaching profession. In many schools across the country, the ASN cohort in classrooms is more than 50 per cent. The necessary differentiation required in lessons, which has always been a feature of our learning environments, has increased as identification rates have improved and our approach to inclusion has, rightly, broadened. A key priority, which was identified by teachers, for the new centre for teaching excellence is additional support for learning. I can announce today that, this spring, a dedicated research hub on pedagogy for inclusion will open, with a specific focus on additional support needs. The hub will provide accessible resources and professional learning aligned to the priorities that teachers have identified.”
“That is demonstrated by the 2024 statistics, which showed that the overall ASN rate in local authorities ranged from 27 per cent to 52 per cent. It is, therefore, important that we support consistent reporting to ensure that we have an accurate data set from which to drive improvement. That is why, in December, I announced a new national programme to improve additional support for learning data. The work will improve the breakdown of data into meaningful categories and strengthen the quality and completeness of school-level recording. It will also include practical support and targeted guidance on categories in order to create a consistent approach across Scotland to the recording of additional support needs. That matters because it will help us to understand the extent of issues and challenges and to identify localised pockets of need.”
“The work is intentionally designed to focus on the existing evidence and to take forward feedback from previous reviews, particularly about the capacity and complexity in the system. The priority is identifying what needs to happen next to strengthen delivery. Given that the ask for the review came from Opposition parties, I have written to party spokespeople this afternoon to invite them to a briefing with Ms McManus, to ensure that her review takes cognisance of their views on where improvement can be strengthened. In November, we held a national data summit, which highlighted that ASN data collection varies across local authorities. Members know that ASN measurements can encompass a wide range of needs, which can be defined and met in a wide range of ways.”
“Last year, when we discussed the parameters of a further review into additional support needs, I was grateful to MSPs from across the chamber for their cross-party engagement. A number of helpful contributions were made in that discussion, including recognition that we should build on the previous reviews and a request for a national event to share best practice, on which I will say more later. There was also a clear ask from Opposition parties for a short, sharp review that would report before the pre-election period. I can announce today that Janie McManus, our professional adviser for education, will lead that review. The rigorous, evidence-informed review will focus on the national and local system conditions that support ASN delivery, the experiences of delivery in schools and how policy is translating into effective practice.”
“That teacher worked with smaller groups of pupils with additional support needs, giving them the tailored input that their learning required. Other examples of PEF inputs include nurture rooms, outdoor learning, music therapy, sensory gardens and extra classroom assistants, to name but a few. In 2025-26, further funding was provided to bolster the ASN workforce and teacher numbers nationally and locally. I am pleased that that additional funding will continue into 2026-27, subject to the passing of the Scottish Government’s budget. Those investments provide the scaffolding that is necessary to increase capacity in classrooms and help teachers and support staff to deliver what children need.”
