The Security Council's continued failure to advance such demands is a direct result of both Israel's intransigence and disrespect and the paralysis caused in the Council by the use of the veto by one permanent member. However, that cannot be accepted as the norm. The Security Council must uphold the primacy of international law and implement its resolutions. Only within the law and through multilateralism can a just and lasting solution for the Palestinian-Israeli conflict be found. We condemn all unilateral measures, whether colonial or otherwise, rejecting schemes to illegally impose facts on the ground and forcibly impose unjust solutions. Moreover, there is no military solution to our conflict or any of the region's conflicts.

In that connection, we recall the most recent resolution on that issue, resolution 2334 (2016), and the Council's clear call for collective action as it, inter alia, urged "the intensification and acceleration of international and regional diplomatic efforts and support aimed at achieving, without delay, a comprehensive, just and lasting peace in the Middle East on the basis of the relevant United Nations resolutions, the Madrid terms of reference, including the principle of land for peace, the Arab Peace Initiative and the Quartet road map and an end to the Israeli occupation that began in 1967 " (resolution 2334 (2016), para. 9).

  3. Those who deny or dismiss those facts further fuel those phenomena and impede the efforts to stabilize our region and find lasting solutions that can ensure peace and security for all. The Security Council has the duty and the capacity to remedy this situation and launch a new reality in the Middle East, benefiting all countries of the region, neighbouring countries and the goal of global peace. That must begin with action to address the crises before us, including in the besieged Gaza Strip, and justly resolve the Palestine question as a whole. The parameters of that solution are well known and are enshrined in Security Council and General Assembly resolutions. On that basis, there remains a solid international consensus and responsibility to act.

The conflict's protraction, chiefly due to a systemic lack of accountability for Israel's violations across decades, has entrenched a destructive culture of impunity in the region, which has weakened international norms and fuelled cyclical crises, ensuring an environment ripe for further proliferation ofconflict, with far-reaching political, social, economic and security impacts. The human cost has been immense, with profound insecurity, suffering and humanitarian disasters affecting the region and beyond, including as a result of the forced displacement of millions of civilians, among them over 5.5 million Palestine refugees. Increased poverty and the mutation of conflicts has allowed for the spread of extremism and terror, incited religious conflict and undermined the potential of religion as a force for social good.

Seventy years since Al-Nakba and 51 years since the Israeli occupation began, in 1967, the sense of injustice has only intensified, deepening with every veto that absolves Israel, the occupying Power, of its crimes, as again happened on 1 June (see S/PV.8274). That has been matched by an equivalent decrease in confidence in the Security Council's authority, as attempts to de-escalate violent eruptions and uphold human rights and humanitarian principles, including to protect civilians and advance peace efforts, are repeatedly obstructed.

We thank the Russian presidency for convening this timely debate to address the root causes of the conflicts and serious challenges facing us in the Middle East and North Africa region, where the Palestine question remains at the core of our instability and is the crux of the Arab-Israeli conflict. Multilateral efforts are urgently needed in the region to promote the realization of a just, comprehensive and lasting solution, firmly rooted in international law and the relevant United Nations resolutions. The tragedy inflicted on the Palestinian people remains a source ofintense anger, despair, mistrust and fear, particularly across the Arab and Muslim world; it impairs perceptions about the international system's fairness and fuels toxic narratives of double standards, constituting a formidable force to be reckoned with.

We urge donors to respond to UNRWA emergency appeals as swiftly and generously as possible, while fully recognizing the long-standing support of the international community and host Governments over the decades. Today, we also reaffirm the official position of the Palestine Liberation Organization to maintain the neutrality of the Palestine refugee camps in Syria and the refusal to be drawn into the conflict. The Palestinian leadership also fully shares the international community's hopes for a political solution to end the horrific conflict in Syria.   9. We urge full compliance with their provisions. The obligation to protect civilians in situations of armed conflict must be respected by all parties. We reiterate the call for unimpeded and sustained humanitarian access and assistance to the camp's residents and those displaced from Yarmouk, and for the safe temporary relocation of any civilians seeking refuge from the violence. We recognize the efforts of UNRWA Commissioner-General Pierre Krahenbiihl during this crisis, including his important Council briefings and visits to Yarmouk, and are grateful for the valiant efforts of UNRWA staff, along with partners in the field, in providing support to the Palestine refugees in Syria and in the neighboring countries of Lebanon and Jordan, despite extremely difficult and unstable circumstances.

That is the primary reason for our accession to the Geneva Conventions, core human rights instruments and other international treaties, including the Rome Statute of the International Criminal Court. We will not cease calling, and working, for the protection of our people, accountability for all the Israeli war crimes perpetrated against them, and justice for the victims. Before concluding, I must add a few words about the crisis of Palestine refugees in Syria, particularly in the Yarmouk refugee camp. The conflict in Syria has rendered their situation precarious, and their needs for assistance and protection are immense. We welcome the press statement issued yesterday by the Council, as well as the press elements of 6 April focusing on Yarmouk. We recall resolutions 2139 (2014), 2165 (2014) and 2191 (2014).

We also appeal for continued support to the Palestinian Government of National Consensus, under the leadership of President Mahmoud Abbas and Prime Minister Rami Hamdallah, to empower it to assume full responsibility in Gaza and play its role in addressing the many challenges. All of that is essential for rebuilding Gaza, reviving its destroyed economy and giving hope to our people. The alternative is allowing desperation, anger and radicalization to increase, especially among our large youth population, making inevitable another implosion, which must be averted at all costs. We also reiterate our call for protection for the Palestinian people. They are a defenceless civilian population entitled to protection under international humanitarian law and to avail themselves of all the protections of international law.

Recent reports, including by the Office for the Coordination of Humanitarian Affairs, the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA), UNICEF, and the Association of International Development Agencies, attest to the dangers of this festering crisis, and we must heed the warnings. The illegal Israeli blockade must end, and Gaza's crossings must be opened for unimpeded humanitarian access, the sustained movement of persons and goods into and out of Gaza and a link with the West Bank. Reconstruction is imperative, as more than 110,000 people remain internally displaced. The fuel and water crises must also be addressed. We appeal to donors to honour reconstruction pledges, and we recognize the generosity of donors who have done so.

  13. It must cease the confiscation of Palestinian land, the construction of settlements and the wall, the demolition of homes and the forced displacement of civilians. It must bring a halt to the terror, violence, provocations and incitement by its settlers, including in occupied East Jerusalem and towards the Al-Aqsa Mosque - a toxic situation that could erupt at any moment, including in a religious conflict. Israel must end the arrest and detention of Palestinians, including children, and stop its abuse of prisoners and detainees and act forthwith to release them. It must cease its constant attempts to undermine the Palestinian Government and institutions. In the Gaza Strip, the scars of war must be healed. Emergency efforts are needed to alleviate the humanitarian disaster wrought by the Israeli war.

The international community must act urgently to compel Israel to cease its illegal policies and practices in the occupied Palestinian territory, including East Jerusalem, which, in 2014, witnessed the highest civilian death toll since the occupation began in 1967. Hollow words and promises will not suffice. The international community must demand that the new Israeli Government demonstrate its intentions and commitment to peace and respect for international law. Israel must cease its settlement activities in the West Bank, including East Jerusalem. We cannot have a two-State solution while Israel continues to actively and illegally alter the demographic and physical situation, and entrench the occupation.

We we reaffirm our commitment to pursuing a peaceful, political, diplomatic and legal path to the realization of the inalienable rights of the Palestinian people, a just, comprehensive peace that fulfills that people's legitimate national aspirations to live in freedom and dignity in their State of Palestine, with East Jerusalem as its capital, as well as a just solution for the Palestine refugees. A meaningful draft resolution must be adopted and, more important, the determination must be found to implement the international will for the achievement of a just, lasting and comprehensive peace, whereby the State of Palestine and the State of Israel can live in peace and security within internationally recognized borders. We commend France's initiative in that regard, in close coordination with the Arab Ministerial Follow- up Committee, and the widespread calls by Member States for the Council to uphold its duties and its clear, principled expressions of support and readiness to contribute to creating a credible political horizon. Based on that consensus, in which 135 countries recognize the State of Palestine and European Parliaments call on their Governments to accord official recognition as an investment in saving and actualizing the two-State solution, we believe it is high time for the international community to exert the political will necessary to make the two-State solution a reality, to achieve the independence of the State of Palestine, to rectify the historic injustice inflicted on the Palestinian people and to establish genuine Palestinian-Israeli peace and coexistence.   19. There is also broad agreement that creating a credible political horizon requires setting a time frame to end to the Israeli occupation. The Palestinian people need to believe - and be given hope - that the occupation will end. And, admitting the failure of more than 20 years of negotiations, it is widely agreed that the political process should not be reincarnated and that an international conference and framework of support for negotiations would be a more rational, viable path towards a solution.   20. We believe it is time for leadership by the Council. The fundamental parameters of the two-State solution have long been clear and globally endorsed. It must be based on the relevant Security Council resolutions, the Madrid principles and the Arab Peace Initiative. It must be based on the 4 June 1967 borders. Israel must fully withdraw from the Palestinian territory occupied in 1967, including East Jerusalem, and end its occupation in all manifestations, including the illegal settlement enterprise. A just solution must be found for the status of Jerusalem as the capital of two States. And a just solution must be achieved to the Palestine refugee question based on resolution 194 (III) and the Arab Peace Initiative.

The exception is Israel, which remains intransigent, continuing to believe it is a State above the law that can perpetrate crimes and obstruct peace with zero accountability, while falsely believing that the conflict can be managed and that the occupation can continue indefinitely. This was starkly reaffirmed last month when the two-State solution, enshrined in Council resolutions from 242 (1967) onward, was openly ridiculed and tossed aside by the Israeli Prime Minister during the elections, further proving Israel's deceit throughout years of negotiations. How far must the situation deteriorate before the Security Council upholds its Charter duties and its own resolutions to contribute to a just and lasting solution to the Palestinian-Israeli conflict and to peace and security in our region? How long will Israel, the occupying Power, be permitted to deny the Palestinian people their rights and freedom without consequence? How long will Israel ignore the bold Arab Peace Initiative, insisting instead to impose endless conflict? When a refugee camp in Syria, where Palestine refugees have peaceably resided for more than 60 years awaiting a solution to their plight, is ravaged by war and siege, comes under barbaric assault of terrorists of the Islamic State in Iraq and the Sham, and is described by the Secretary-General as "the deepest circle of hell", with children, women and men forced to flee for their lives, dispersed and traumatized once again; when Palestinians, whose resilience is legendary, are drowning in the waters of the Mediterranean Sea, along with others attempting to escape war and poverty - the crisis is existential. When the State of Israel legislates more than 50 discriminatory and racist laws against its Palestinian Arab citizens, and constantly attempts to negate their identity and history; when that State's political, religious and military leaders voice threatening diatribes against them, including calls to "chop off heads with axes" of those who oppose their extremist policies, and calls for the transfer of Palestinian Arabs - the crisis is existential.

  27. As we mark next month 67 years since the Al-Nakba of 1948, and mark in June 48 years since the 1967 Israeli occupation began, the tragic irony of those dates should not go unnoticed. The Palestinian people are enduring the longest occupation in modern history, and over 5 million Palestine refugees have been enduring nearly seven decades of exile. They are a people struggling to preserve their national identity and existence in the face of overwhelming challenges in their ongoing quest for liberation. Their crisis has become untenable; it has become existential.

We recognize his efforts in support of the Palestinian people and Government through many critical periods during his tenure, including three brutal Israeli wars against Gaza, as well as his constant efforts to advance solutions to emerging problems and to promote peace, including his impassioned entreaties to the Council to act to bring an end to this devastating conflict, which remains a threat to international peace and security. Regrettably, our collective appeals to the Security Council have been unanswered, with all initiatives for serious action thwarted, the latest on 30 December 2014.   32. To continue doing nothing in the face of such crimes is unacceptable and will only allow for the cycle of impunity to persist. I would be remiss ifI did not convey, yet again, the grave concerns of the State of Palestine about the critical humanitarian situation of Palestine refugees in Syria, who also continue to suffer death and injury, the destruction of their homes and shelters, dispossession and massive displacement. The plight of the thousands of refugees trapped the Yarmouk camp in particular is inhumane. Urgent international attention is required to alleviate their plight and that of all civilians suffering in the conflict. The siege and starvation of innocent civilians as a combat method is a grave breach of international humanitarian law and cannot be permitted orjustified under any circumstance.

As the Secretary- General states in his report, "The prevalence of impunity in many States experiencing, or that have experienced, conflict allows war crimes and serious human rights violations to thrive, undermines the fabric of societies and prevents the development of lasting solutions, which contributes to instability." (ibia', para. 60) Israel's impunity in the context of its foreign occupation of another people and their land has prevailed for nearly five decades due to the inaction and selectivity of the international community, including the Security Council. It is high time for that to be rectified.   34. The Palestinians living in Gaza not only need protection for their lives, but also protection from such deliberately destructive policies, which are disfiguring an entire society. The international community's failure to hold Israel accountable for its violations and crimes has, regrettably, reinforced that lawlessness, permitting it to continue using military force and collective punishment against the defenceless Palestinian people under its occupation and, in essence, absolving it from its legal obligations as an occupying Power.

  35. International law clearly forbids such brutality against civilians, and such actions, wilfully perpetrated, constitute war crimes. The Palestinian civilian population also remains vulnerable to rampant settler terror and violence, which has intensified in the recent period. Moreover, in the Gaza Strip, the devastating impact of the illegal Israeli blockade and the repercussions of the destruction and displacement inflicted by sequential acts Israeli military aggression have continued to impact every human right and to disrupt every aspect of civilian life, deepening the humanitarian crisis. The blockade constitutes collective punishment of the entire Palestinian civilian population in Gaza, in grave breach of the Fourth Geneva Convention.

  36. That includes the period covered by the Secretary-General's report, which witnessed a significant increase in Palestinian civilian causalities, including among women, children and the elderly. Besides the complete absence of protection for those Palestinians who have been killed, including by air strikes and explosive weapons in densely populated areas, as in the Israeli military aggressions against Gaza in 2008, in 2009 and in November 2012, Palestinians also continue to be victims of appalling human rights violations and crimes, suffering physical and psychological harm, dispossession, forced displacement, imprisonment and detention, torture, exploitation, hunger, poverty, disease and the destruction of their communities. Even the right to peaceful protest has been lethally violated by the occupying forces.

One clear and persistent example of the failure to respect, and to ensure respect for, the law is the case of the Palestinian civilian population living under Israel's occupation in the occupied Palestinian territory, including East Jerusalem. For more than four decades, any and all of the legal safeguards for the protection to which civilians are entitled under international humanitarian law have been deliberately ignored by Israel, the occupying Power, leaving Palestinian civilians devoid of protection of not only their physical bodies and lives, but also their well-being and human dignity. It is a situation that has inflicted upon them massive suffering, trauma and hardship, for generation after generation.

While significant efforts have been made to prevent and respond to Violations of international humanitarian and human rights law in conflict situations, the Secretary-General noted in his latest report that "[t] he current state of the protection of civilians leaves little room for optimism" (S/2013/689, para.8) which was compellingly confirmed by the briefers in today's debate. The failure of States and parties to respect and ensure respect of their legal obligations remains widespread, and civilians continue to bear the burden of war and violence and to suffer its brutal consequences in a tragic manner.

  42. Unlawful actions should be confronted and not tolerated or excused. If the latter options are chosen, justice and peace, and their associated benefits of security, stability, prosperity and development, can never be truly realized, and the rule of law and the foundations of our international system will continue to be gravely weakened. Such an outcome must be avoided at all costs. Accordingly, despite our deep disappointment and frustration, we have not lost hope and will continue to call on the international community, including the Council, to uphold international law towards the promotion of a peaceful resolution of the Israeli-Palestinian conflict and the Arab-Israeli conflict as a whole.

The Council should not be exempt from its responsibilities in that regard, and here we emphasize the importance of the role of the caucus of the Movement of Non-Aligned Countries as a voice for the 118 countries members of the Non-Aligned Movement, including Palestine, in the Council. If the Council remains unable to bear its responsibilities vis-a-vis the question of Palestine in the face of flagrant breaches, its credibility will be undermined. Moreover, it will continue negatively to affect the image of the United Nations and feed the perception of double standards held by those in the Middle East and the developing world, a conclusion borne out by several assessments, including the latest investigation by an independent panel. In our international community, alliances should be made in favour of international law and not against it.

That is a matter of international peace and security, for the continuation of that illegal situation is not only obstructing the peace process but is seriously harming it, endangering the achievement of a peaceful settlement of the Israeli- Palestinian conflict, the core of the Arab-Israeli conflict, and consequently the future prospects for peace and stability in the Middle East region and beyond. The United Nations has a permanent responsibility towards the question of Palestine until it is resolved in all its aspects, including a just resolution for the plight of the Palestine refugees in accordance with General Assembly resolution 194 (III).

  45. All attempts to rectify that unjust situation have been impeded by Israel's continuing illegal practices, and real progress has been elusive. The situation continues to decline and the opportunities for peace continue to be undermined. That is why we have continued to appeal to the international community to address the critical issues before us, and why we specifically returned to the Council, imploring it to uphold its responsibilities under the Charter and international law, particularly with regard to the illegal Israeli settlement activities in the occupied Palestinian territory.

In that regard, we reiterate the Palestinian Authority's readiness to assume responsibility for the Palestinian side of Gaza's border crossings and call upon Israel to allow for the opening of the crossings in line with the 2005 Agreement on Movement and Access. In 2008, despite the investment of so much hope, energy and effort in the peace process, we are still witness to the perpetuation of the longest military occupation in contemporary history, the active colonization of occupied land in violation of international law and United Nations resolutions, and the continued denial and Violation of the inalienable human rights of the Palestinian people, including the right to self-determination and the right of the Palestine refugees to return.

  47. The West Bank and the Gaza Strip constitute one geopolitical unit - the occupied Palestinian territory - and, accordingly, Israeli military attacks in either area affect the other negatively. As we have witnessed repeatedly, reckless and violent Israeli actions similar to the raids and killings in Nablus shortly after the truce began in June have in the past undercut attempts to bring about a cessation of violence, sabotaged Palestinian Authority efforts to promote law and order, harmed peace negotiations and fuelled the deadly cycle of violence. Nevertheless, we reaffirm our hope that the truce will hold, that calm will prevail and that the occupying Power will completely lift the siege of Gaza and allow for the movement of persons and goods to ease the isolation and humanitarian suffering of the Palestinian civilian population.

  48. As a result, Palestinian civilians, including children, continue to be killed, injured, detained and arrested, and Palestinian homes, property and infrastructure continue to be destroyed. We call for an immediate end to such illegal, deplorable actions and call on Israel instead to abide by its legal obligations and its commitments in order to create an environment actually conducive to the pursuit of peace. In this connection, I wish to refer to the truce agreement reached as a result of the intensive, commendable efforts undertaken by the Government of Egypt. The truce took effect in the Gaza Strip on 19 June and continues to be upheld despite several infractions. President Abbas continues to appeal for respect of the truce on both sides and continues to call as well for extension of the truce to the West Bank.

  49. Poverty and hardships continue to rise as a result of declining socio-economic conditions. Health conditions continue to deteriorate owing to inadequate medical and food supplies as well as the breakdown of sewage and sanitation systems because of lack of spare parts and fuel. And, the continuing fuel crisis has disrupted all sectors of life and has even disrupted United Nations operations in Gaza. Moreover, this deliberately imposed humanitarian crisis is only worsening with the globally rising food and fuel prices affecting the whole international community. At the same time, the Israeli occupying forces continue to carry out violent military raids and attacks in the occupied Palestinian Territory.

The entrenchment and continuation of this illegitimate situation will make physically impossible the establishment of a sovereign, contiguous, viable and independent Palestinian State, with East Jerusalem as its capital, and the ultimate realization of the two-State solution for peace in accordance with relevant Security Council resolutions, including resolutions 242 (1967), 338 (1973), 1397 (2002) and 1515 (2003), by which the Council endorsed the Quartet Road Map. The situation in the rest of the occupied Palestinian Territory, namely the Gaza Strip, also remains critical. Israel's siege of Gaza has surpassed one year, and the occupying Power continues to impose a suffocating closure of border crossings, obstructing the movement of persons and goods, in collective punishment of the entire Palestinian civilian population there.
