Those achievements and progress are attributable to the people and Government of Afghanistan, who want to freely take their destiny into their own capable hands and bring to an end the past sombre years under the presence of foreign forces in their homeland. Nine years have passed since American and NATO forces entered Afghanistan with the aim of establishing peace and security and reconstructing the country. The main justification for the military excursion was, of course, eliminating the threat of terrorism. However, it is very hard to assess the achievements attained so far or the prospects for the future. Even the newly unveiled military strategy review issued a few days ago by the United States Government casts some doubt on the possibility of attaining the desired goals, as originally set forth, for the so-called Afghan war.

  4. Attaining a peaceful and just settlement of the question of Palestine is imperative to the realization of a comprehensive and lasting peace and stability in the Middle East and beyond. In our view, a lasting peace in Palestine and the region will be possible only through justice and an end to discrimination and to the illegal occupation of Palestinian and other Arab occupied territories. Today, we need to act collectively to demonstrate our all-out support for the cause of Palestine and to rally to the assistance of those who have been deprived of their rights. Let us hope that oppression and occupation will end and that justice and freedom prevail in the occupied Palestinian territories. Before concluding, I would like to react to the reference made to my country by the representative of the Israeli regime.

Now, it is widely recognized that the Israeli regime's clandestine development and unlawful possession of large stock of nuclear warheads and its constant threats to use them against certain countries pose a uniquely grave threat to regional and international peace and security. The Israeli regime has persisted in its aggressive and expansionist policies towards Lebanon by constantly violating the latter's land, sea and air space and refusing to withdraw from Lebanese occupied land in the Shaba'a, the Kfar Shuba Hills and the northern part of Al-Ghajar village. It also continues its occupation of the occupied Syrian Golan. That regime should immediately and fully withdraw from these occupied territories in compliance with the most basic principles of international law and the United Nation Charter.

  6. Furthermore, the Israeli regime, since its unblessed inception, has attempted to cite external elements as factors in its failure to move to advance the so-called peace processes. These failed attempts have been manifestly aimed at diverting attention from the principled causes of the crisis and at evading responsibility for the crimes committed in Palestine. In line with this policy, Israeli officials, instead of answering to world public opinion for their unparalleled record of non-compliance with all humanitarian and human rights principles and their long and dark history of crimes and atrocities, including occupation, aggression, militarism, State terrorism and crimes against humanity, have always made inflammatory remarks and baseless allegations against other countries.

  7. The resumption of demolition work came as the international community strongly called for an end to the Israeli demolitions, describing them as illegal under international law. We believe that the fundamental problem of this long-standing crisis is not in the lack of peace plans, which have arisen from time to time, one after the other, but is rooted in the continuation of the illegitimate occupation of Palestinian and other Arab territories and in the Israeli regime's intransigence to any single principle of international law. All these plans were doomed to failure because they all failed in one way or another to tackle the Palestinian problem at its root causes, including the occupation itself.

Despite strong international condemnation, illegal settlements are being expanded much faster than in the past, and one tangible consequence is that the land of the Palestinians is shrinking and more and more Palestinian houses are being demolished, to be replaced by illegal settlements. This Monday alone, the Israel regime, in defiance of global calls for halting the destruction of Palestinian shelters, levelled tents used by Palestinians as their homes in the northern West Bank. Israeli soldiers entered Al-Farisiya village and ordered the residents away before knocking structures down. The occupying forces also knocked down nine agricultural structures on the pretext that they had been put up without permits.

It is regrettable to witness that the inaction or weak reaction of relevant responsible United Nations organs in dealing with the Israeli regime's illegal policies and practices have emboldened that dangerous regime to continue with its crimes and cruelty against the defenceless Palestinian people, especially innocent women and children. The blatant support of certain Powers for the Israeli regime is one of the bitterest realities of our world today. By blocking any single action against the inhumane policies and acts of the Israeli regime in this Council and using various tactics to undermine efforts in other United Nations bodies to hold it accountable, these criminals enjoy a merciless impunity in violating the internationally recognized human rights and humanitarian law.

  10. The report of the United Nations Fact-Finding Mission on the Gaza Conflict (A/HRC/12/48) was an important step forward towards remedying the violations of the Israeli regime in Gaza. The report, when issued, brought hope of swift action by the relevant bodies of the United Nations, including this Council, to put an end to the culture of impunity for Israeli war crimes. So far, this hope has not been realized. If criminals were brought to justice, perhaps the barbaric attack on the humanitarian convoy would not have happened. Impunity for perpetrators of grave crimes, including war crime, occupation and crimes against humanity, is in itself a cause of and incentive for further atrocities.

The flotilla attack happened at a time when our memories were still fresh of the crimes and atrocities committed by the Israeli regime in its all-out attack against the people of Gaza in Operation Cast Lead, during which thousands of besieged innocent Palestinians, including women and children, lost their lives or were injured, and civilian infrastructure and facilities were willfully and systematically targeted. According to various reliable sources, in the course of that operation the Israeli army did not hesitate to use internationally prohibited and restricted weapons against civilian targets. Since then, the Israeli regime has continued to defy the will of the international community, while its inhuman policy of continued blockade against the Palestinians has caused an unprecedented humanitarian crisis in Gaza.

Delegations have been informed of the arrest of Abdulmalik Rigi, a terrorist and gang leader of the so- called Jundallah, which has operated over the past few years along Iran's south-east borders and conducted armed robberies and terrorist acts in which more than 140 innocent Iranians, including women and children, have been killed in the most horrific manner and over 260 wounded. There is irrefutable evidence, including the terrorist's own confession, that he enjoyed extensive support from certain States that have a military presence in countries neighbouring ours.

With regard to the Committee established pursuant to resolution 1540 (2004), we believe that the work of the Committee should not have operative impact on the rights enshrined in internationally negotiated instruments such as the Treaty on the Non- Proliferation of Nuclear Weapons (NPT), the Chemical Weapons Convention and the Biological and Toxin Weapons Convention, as well as the Statute of the International Atomic Energy Agency. The Islamic Republic of Iran also believes that any emphasis on the concept of prohibiting access of non-State actors to weapons of mass destruction and nuclear materials should be balanced by the commitment of Member States to nuclear disarmament, as this issue is also currently gaining momentum in the current Review Conference of the Parties to the NPT taking place here in New York.

In those reports, we have elaborated the concrete steps that the Islamic Republic of Iran has taken to implement the provisions of that and other relevant resolutions, including the intensification of border controls and security and surveillance measures at the points of entry and exit at border checkpoints. Moreover, we continue to counter drug trafficking assiduously, given the fact that drug trafficking has proved to provide important financial resources for certain terrorist groups in the region. The application of double standards in dealing with terrorism and terrorist groups is a matter of grave concern and seriously undermines the international community's collective fight against terrorism. The Islamic Republic of Iran condemns all acts of terrorism, including those committed by States against innocent people and those under occupation. As a victim of terrorism, the Islamic Republic of Iran has spared no effort to fight this threat and continues to do so. My country has taken far-reaching measures in implementing Security Council resolutions on terrorism, including resolution 1373 (2001). We have presented six national reports on the measures taken to implement that resolution.

Addressing the global threat posed by terrorism requires an integrated and comprehensive approach, taking into account the variety of underlying causes that may lead to terrorist acts and violence, as well as other contributing factors which provide a breeding ground in which terrorist groups can take hold and operate. Eliminating terrorism requires that all States manifest their political will by avoiding double standards and organizing themselves under the auspices of the United Nations and in full conformity with the United Nations Charter, international law, international human rights and humanitarian law. Fighting terrorism should not be carried out at the expense of the principles of the United Nations Charter, in particular the sanctity of the sovereignty, territorial integrity and political independence of States.

There is an urgent need to put an end to these acts. There should be no room for criminals who are motivated to commit atrocities. This Council should live up to its responsibilities in supporting the Palestinians and relieving them of their long suffering under occupation.

Although more than a year has passed since the end of the brutal attack on Gaza, reconstruction of the destroyed and damaged areas, buildings and infrastructure remains nearly impossible due to the Israeli regime's continuing blockade. Relief agencies in Gaza continue to work in a very harsh environment to help those in desperate need, in particular the children, women and other vulnerable people in the region. The problem of the Middle East is not a lack of peace plans, but rather the lack of a correct understanding and reading of the root cause of the crisis. As we have mentioned repeatedly, the fundamental problem of this long-standing crisis is the illegitimate occupation of Palestinian and other Arab territories and the Israeli regime's intransigence with respect to every single principle of international law.

  35. If criminals were brought to justice, room for criminal acts by those who possess the motives and the madness to commit them would be restricted. Impunity for perpetrators of crimes of a grave nature is, in itself, a cause of and an incentive for further atrocities. Unfortunately, it seems that, for certain members of this Council, the lives of the Palestinians and their long suffering under the occupation and suppression do not count, as the massacre of hundreds of Palestinians, including dozens of women and children, is not worthy of the least consideration, let alone meaningful firm action. That is true with regard to the illegal detention of more than 11,000 Palestinians, including hundreds of women and children.

Even the United Nations was not spared the Israeli atrocities, as the compound of the United Nations Relief and Works Agency for Palestine Refugees in the Near East was deliberately shelled by the Israeli army. There is no doubt that the Israeli acts in Gaza amounted to war crimes and crimes against humanity. Almost one year has passed since then but, despite all efforts on the part of the United Nations, there is still no prospect of justice for the victims. The Israeli regime continues to defy the will of the international community and persists in the Palestinian blockade, causing an unprecedented humanitarian crisis in Gaza. These violations of international norms and principles are not limited only to Gaza.

I also take this opportunity to extend my delegation's sincere congratulations to the new members of the Council - Bosnia and Herzegovina, Brazil, Gabon, Lebanon and Nigeria - and to wish them every success in upholding their responsibility to fulfil their duties over the next two years. Likewise, my warm appreciation goes to the outgoing members of the Council: Burkina Faso, Costa Rica, Croatia, Libya and Viet Nam. One year ago, Gaza faced an all-out attack, the so-called Operation Cast Lead. During that barbaric operation, the Israeli regime killed or maimed thousands of besieged innocent Palestinians, including women and children, and wilfully and systematically targeted civilian infrastructure and facilities.

On 18 October, that group attacked participants in a conference of tribal and local leaders in the border city of Pishin in the eastern province of Sistan-Baluchistan, killing at least 57 and injuring 150. This group also enjoys the support of some foreign countries. We expect all countries to uphold their international obligations in this respect. I would like to conclude by reiterating that we should all strengthen our cooperation in the fight against terrorism.   41. The European Union decision has put on display the selective approach and double standard with which the European Union deals with the vicious menace of terrorism. It is obvious that this kind of attitude towards terrorist groups weakens the international consensus against terrorism and encourages terrorists to continue their inhuman activities. Such support is indeed in clear violation of the provisions of Security Council resolutions, particularly resolutions 1373 (2001) and 1624 (2005). There are certain other terrorist groups that have committed acts of terrorism against the Iranian people. In the past several years, the Jundullah terrorist group has attacked and killed dozens of people in the eastern and south-eastern parts of the country in an attempt to create an environment of intimidation and insecurity.

Despite its heinous and appalling record of terrorist acts and incitement to terrorism, and although it was officially designated a terrorist group by the United States and others, elements and members of that group continue to enjoy support and receive safe haven in the United States and some European countries, including some States members of the European Union. The irony is that the European Union Council of Foreign Ministers, despite its own belief in and emphasis on the terrorist nature of the Mujaheddin e Khalq, decided, on 26 January 2009, to remove the name of this notorious terrorist cult from the European Union list of terrorist groups by invoking the judgment of the Court of First Instance of the European Court of Justice.

In that regard, particular reference should be made of the Mujaheddin e Khalq terrorist group, which has thus far perpetrated more than 612 terrorist operations in Iran, resulting in the killing and wounding of many civilians and officials and damage to private and government properties. That terrorist group has also devised many atrocious ploys to incite acts of terrorism inside and outside the country. This terrorist group was long supported and sheltered by the former regime in Iraq and was engaged in Saddam's bloody campaigns against the Iraqi people, too.

  44. Given the fact that that menace serves as a feeding ground for terrorism, Iran's efforts in that regard have undoubtedly made a fundamental contribution to the global fight against terrorism. Iran has thus far shouldered that burden almost single- handedly. As one of the first victims of terrorism in the region, Iran made unwavering efforts to fight it and has always strongly condemned that vicious menace in all its forms and manifestations. As I stated earlier, the application of double standards in dealing with terrorism and terrorist groups is a matter of grave concern that seriously undermines the international community's collective fight against terrorism. The Islamic Republic of Iran has been subject to various acts of terrorism by certain terrorist groups over the past three decades.

  45. In line with the points I have just made, the Islamic Republic of Iran has submitted two reports to the 1540 Committee on the measures Iran has taken to implement the resolution. The Islamic Republic of Iran has taken serious steps in implementing the Security Council's resolutions on terrorism, including resolution 1373 (2001). We have submitted six national reports on our implementation of that resolution, in which we have set out the concrete steps that our country has taken to implement the provisions of that and other relevant resolutions. Those steps include stepping up border control security and surveillance measures at border entry and exit checkpoints. Moreover, we have intensified our fight against drug trafficking originating from Afghanistan.

The Islamic Republic of Iran believes that the work of the Committee should not have operative impact on the rights enshrined in internationally negotiated instruments such as the Treaty on the Non-Proliferation of Nuclear Weapons, the Chemical Weapons Convention and the Biological and Toxin Weapons Convention, as well as the statute of the International Atomic Energy Agency. The Islamic Republic of Iran also believes that any emphasis on the concept of prohibiting access by non-State actors to weapons of mass destruction and nuclear materials should not divert the attention of Member States from nuclear disarmament as the highest priority of the international community.

  47. On the one hand, they appear to confront some terrorist groups while, on the other, they overlook others. Perhaps one reason for the rise in terrorist activities in recent years, in terms of frequency and the advanced tactics used by terrorists, is the wrong and selective approach by certain States in dealing with terrorism. On the work of the Committee established pursuant to resolution 1540 (2004), we welcome the initiative to convene the open meeting of the comprehensive review on the status of the implementation of resolution 1540 (2004), which was held in October. The meeting was an opportunity to address a number of serious and valid concerns of Member States in connection with the work of 1540 Committee.

  48. Terrorism is one of the gravest threats to international peace and security. Addressing this problem requires an integrated and comprehensive approach. Clearly, the United Nations has made considerable progress, both in the areas of standard-setting and in implementing counter-terrorism measures. But despite all those efforts and activities, we have unfortunately witnessed an escalation in terrorist attacks in various parts of the world. Genuinely combating terrorism very much depends upon how we identify its root causes. Foreign occupation, exclusion, selectivity and expansionist economic and political policies are among the factors that create conditions conductive to the spread of violent acts and terrorism. Furthermore, the double standard exercised by certain States in dealing with terrorism has aggravated the situation.

  49. I wish to conclude by putting on record that my delegation rejects the baseless and absurd allegations made against my country by the representative of the Israeli regime in the Council today. This is another tired attempt by the Zionist regime to divert attention from that regime's war crimes and crimes against humanity. This wicked ploy has not worked in the past; nor will it work in the future. It is preposterous that a criminal regime that possesses nuclear weapons, is not a party to the international treaties on weapons of mass destruction and feeds on terrorism and bloodshed can accuse others groundlessly. Nothing could be more dangerous for the world and the region than nuclear weapons in the hands of the terrorist Israeli regime, which has proved to have no respect for any human right or any international regulation.

  50. There should be no doubt that occupation lies at the centre of the Palestinian conflict and overall tension and instability in the Middle East. Unless this principal cause of conflict is effectively addressed, the crisis will never subside. We expect the Security Council, in particular, to shoulder its primary responsibility for the maintenance of international peace and security by putting an end to the Israeli regime's inhumane and aggressive acts. It should force the Israeli regime to completely and permanently cease settlement activities, lift the blockade against the Gaza Strip, cease and desist from its inhumane violation of Palestinian rights and end its occupation of all Palestinian, Lebanese and Syrian territories.
