  1. Only when the cost of occupation outweighs its benefits will Israel ever consider ending it. The Israeli public will then demand it. The resolutions of the Security Council, including resolution 2334 (2016), provide a clear path to a just peace, the only path to peace. It is the responsibility of the Council to pursue the implementation of its own resolutions. It is important to enact the law and to condemn those violating it, but it is as important to pursue enforcement and ensure accountability. Israel wants United Nations resolutions to conform with the illegal reality it has created on the ground, while the Council should ensure that the reality on the ground conforms to its resolutions.

Can anyone seriously argue that we should wait for Israel to be ready to end its occupation on its own, to wake up one day wiser and decide to redeem itself, to respect the rule of international law and to listen to the advice of the world based on its meri?. Is there anyone around this table who believes this is a rational or winning strategy? The fate of the Palestinian people cannot be left hostage to Israeli domestic politics and expansionist desires, and neither can the survival of the Israeli coalition serve as an excuse to deny the rights of an entire nation. Israel displays the same arrogance displayed by colonial Powers blinded by their colonial appetite throughout history. Healing Israel from this disease is not only a service to Palestine, to the rule of international law and to our humanity, but also to Israel itself.

While measures that may partially alleviate the hardships faced by our people are needed, they cannot serve as a substitute to addressing the root cause of our suffering and the conflict, which is the Israeli occupation. One cannot entrench the occupation and pretend to shrink the conflict. One cannot reject the two- State solution and the one-State solution, unlawfully annex our geography and besiege our demography, attack our people and holy sites, including in the holy city of Jerusalem, and demand for themselves alone peace, prosperity and security. Since when is the peoples’ right to self-determination subject to the goodwill of the colonial Power? Did any country represented at the United Nations accept such logic?

Will the international community accept this apartheid in the twenty-first century, or will it convert to advocates of the one-State solution of freedom and equal rights for all between the river and the sea? These would be the only options available then. We recognize the efforts of the international community in defence of the international consensus, and we are grateful for the principled solidarity and support long extended to our people. This is the decisive moment where all these years, efforts and resources can bear fruit or be squandered. Nothing good will come from waiting. Leaving the parties alone means leaving the steering wheel in the hands of extremist Israeli settlers, as they are the ones controlling the agenda in Israel.

Beyond the need to repair the historical injustice endured by the Palestinian people and to end decades of occupation and oppression, there is urgency because this conflict has a solution that may still be available today and that will no longer be viable tomorrow. The two-State solution the international community has legislated and defended for so long does not need United Nations representatives by its bedside to share comforting words. It needs them to save it. Absent this sense of urgency, States Members should prepare themselves to attend the funeral of this solution with all the consequences of such a death for the lives of millions of people, Palestinians and others. The Palestinian people will survive, but the two- State solution may not. What happens then?

Their steadfastness has been tried and tested across decades and is unwavering.   7. The year 2021 was one of the deadliest for Palestinians in over a decade, including for Palestinian children, notably in the besieged Gaza Strip. It was one of the worst years in terms of home demolitions and of advancement of settlement units in the occupied Palestinian territory, including East Jerusalem. This year has barely started and yet its events offer a bleak picture of what awaits our people if resolute action is not undertaken. The first days of 2022 witnessed the killing of more Palestinians, even children and older persons, including Sheikh Suleiman Al-Hazaleen, the 80-year-old icon of popular peaceful resistance, as well as the announcement of plans for new settlement units in occupied East Jerusalem and continued dispossession and forced displacement of our people.

It is the bias shielding it from any form of accountability; the bias that has prevented the Security Council from ever acting under Chapter VII; the bias that has allowed Israel, instead of apologizing for its crimes and putting an end to them, to accuse even its closest partners of anti-Semitism for voting resolutions rooted in international law and human rights; the bias that has allowed it to attack the International Criminal Court, the International Court of Justice, the Human Rights Council, the General Assembly and the Security Council for performing their mandates and to insult and harass world leaders, Nobel Peace Prize Laureates, moral figures, celebrities and citizens for their stance regarding the question of Palestine; the bias that has allowed Israel to criminalize civil society and humanitarians and still be called a democracy; the bias that has allowed Israel to become a Member of the United Nations while, 75 years later, we have yet to become a <ember; the bias that recognizes a very widely interpreted right to security of an occupying Power, while the people under occupation are deprived of the most basic forms of protection.

  10. As we gather here to discuss how to advance peace, Israel pursues its relentless way against the Palestinian people on the ground. Today, before dawn, Israeli forces surrounded and raided the Salhiye family house in Sheikh Jarrah, violently uprooting them — including their children — from their home, throwing them out in the freezing cold and arresting several members of the family and supporters before demolishing their homes, leaving behind despair and destruction. That happened while United Nations representatives rushed to the scene, where some were present just a few hours before, and despite their repeated calls against such crimes. The Salhiye family, forcibly displaced in 1948, is displaced once again.

Impunity is the greatest obstacle to peace, as it allows the occupying Power to take advantage of its occupation instead of facing the consequences and promotes illegal actions instead of ensuring compliance with the law. A State that believes that it is beyond the law will be tempted to continue to act as an outlaw State. For the sake of peace, the benefit of all peoples of the region and the authority of international law, we must urgently and collectively act to change course, restore hope and achieve a just and lasting solution to the conflict. We seek justice, not vengeance, freedom, not conditional liberty, and peace, not apartheid.

Member States should do that, first, by supporting our rights, including to self- determination and their fulfilment, and by providing humanitarian and development assistance to the Palestinian people. Secondly, they should not recognize Israel's illegal activities, including those that seek to alter the character and status of Jerusalem. Thirdly, they should not support or assist illegal settlement activities. Fourthly, in their relations Member States should distinguish between the territory of the State of Israel and the territories occupied since 1967. Fifthly, they should ensure accountability, since impunity is the greatest obstacle to peace. We should make no mistake. At the United Nations the real bias towards Israel shields it from accountability.

I also take this opportunity to thank Jordan for its role in support of the rights of the Palestinian people and as custodian over the Christian and Islamic holy sites in East Jerusalem, including its role in protecting the historic status quo of Al-Haram Al-Sharif. In adopting its resolutions, including resolution 2334 (2016), the Security Council was motivated by the pursuit of international peace and security in fulfilment of its mandate. However, stating the law is not enough. We must find the channels to act so as to ensure its enforcement. Each country represented here at the United Nations can further contribute to peace by upholding its obligations, including pursuant to resolution 2334 (2016).

In that regard, allow me to commend the steady and consistent positions expressed by Security Council members and the international community at large by demonstrating how deeply rooted and constant the international consensus for just and lasting peace is. We also commend the strong response of the Arab world, the Organization of Islamic Cooperation and freedom- and peace-loving nations around the world to provocative statements regarding the annexation of Palestinian land.

  15. It is the settlement to which the entire world agreed. Today we reiterate our acceptance of that solution and our commitment to it. The reference to international law for negotiation is a requirement of common sense for any negotiation process and political initiative to resolve a conflict. The Palestinian question must not be an exception. It is not reasonable that international resolutions be selectively implemented based on narrow interests. We need to identify the means for plan A to prevail and to be aware of the alternative reality that Israel is creating on the ground. In order to be able to counter it, let us give it a name. Any serious negotiation process must be based on ending the occupation since 1967, including that of East Jerusalem, within a set time frame and with the aim of addressing all final-status issues in line with the internationally agreed parameters, the relevant United Nations resolutions and the Madrid terms of reference, including the principle ofland for peace, the Arab Peace Initiative and the Quartet road map, as well as the two- State solution and the establishment of an independent Palestinian State within the 1967 borders, with East Jerusalem as its capital under international sponsorship, in line with the statement of President Mahmoud Abbas to the Council in February 2018 (see S/PV.8183). It is not a Palestinian condition or argument, as some claim, to avoid dialogue, reject negotiations or obstruct peace.

Israel, the occupying Power, continues to create new realities on the ground with the purpose of changing the nature ofthe final status, while seeking to subjugate the Palestinian people, antagonize their leadership and blackmail their Government, while rejecting the implementation of all signed bilateral agreements. It imposes further absurd conditions requiring the Palestinian side to be content with that reality and accept the little offered to it, as though this were the only road that we can take in order to achieve a fair and lasting peace among the peoples of the region and ensure the safety of future generations. Is there anyone in the Council who would accept such a settlement? Our rights are not mere aspirations, and they are not to be compromised. We are a proud people, our land is precious, and our just cause is not for sale.

It establishes arbitrary military checkpoints extending from the far north to the far south of our occupied land. It storms Palestinian villages and refugee camps searching for anyone who rejects its injustice and suppression, and locks away in its prisons and detention centres anyone who seeks freedom and dignity. It pillages our money and natural resources and refuses to accept any criticism at the United Nations or any other international forum. Is that reasonable?

It deliberately murders a nurse and a journalist, kidnaps a child sleeping in his own bed at night and shoots him in the head or heart in a cowardly manner. It prevents a young girl from going to school in Khan Al-Ahmar; it demolishes a family home in Sur Baher; it stops a young man from Gaza from travelling abroad to pursue his studies or a woman from receiving urgent health care; it deprives a man of the right praying in Jerusalem; and it protects settlers who have seized a Palestinian house and forcibly taken up residence therein. Israel also carries out provocative activities at Al-Haram Al-Sharif and other holy sites.

  21. Netanyahu's declaration that he intends to annex occupied land in the valleys and the area north of the Dead Sea is merely a criminal's confession of the crime he has perpetrated. Will the criminal enjoy impunity? Israel's systematic attempts to change the demographic and geographic structure of the Palestinian land, including East Jerusalem, occupied since 1967 are illegal and rejected, and will not change the legal status of Palestinian territory as occupied. Nor will such attempts legitimize the Israeli occupation of our land. The intention of the occupation authorities has been revealed. It is to usurp the occupied land by force, annex it, forcibly displace Palestinians and transfer Israeli citizens to our lands, which is in stark violation of international humanitarian law and constitutes war crimes under the Rome Statute.

Israel is not committed to upholding the relevant resolutions or the Charter of the United Nations; it has never respected the rights of the Palestinian people or recognized the Palestinian people's natural right to self- determination and to establish their independent and free Palestinian State. Israel has arrogantly continued to violate international law and resolutions without any regard for either, believing that it enjoys an exceptional status that affords it the right to assault the rights and territories of others and shields it from criticism and accountability. Israel's disregard for the rights of the Palestinian people and for the security of the region as a whole has reached the point at which our precious national territories are presented as gifts to bribe extremist right- wing Israeli groups and win their votes.

At the next presentation of the report of the Secretary-General, we will not expect to hear any mention of positive steps towards the implementation of 2334 (2016), as long as there is no motivation or deterrence that would lead Israel to reconsider its military occupation of our Palestinian land, cease targeting Palestinians civilians and reverse its expansionist colonialist settlement activity, which preclude all hope of ending the illegal occupation of our territory and may render the two-State solution within the 1967 borders all but impossible.

As was the case with previous reports, its outlook is not at all promising in terms of progress in the implementation of the resolution's provisions. That leads us to wonder: In requesting the Secretary-General to submit these required reports, did the Security Council not intend to follow up on the implementation of the resolution on the ground, assess the parties' commitment to it and consequently take the necessary measures to ensure its implementation?

Not only do such actions have enormous potential to reignite the cycle of violence between the two sides, but, as we have repeatedly cautioned, every such illegal act of colonization and provocation further threatens the prospects for reviving the peace process and for achieving the two-State solution for peace on the basis of the 1967 borders. That could very well be one of Israel's aim today. History has shown that the prosecution of war crimes and the achievement of justice are, regrettably, not an immediate process.   31. Israel builds new settlement neighbourhoods, such as those in Al-Bustan, Silwan, Jabal Mukkabir and Al-Sheikh Jarrah. It also continues to carry out excavations, including around and beneath Al-Haram Al-Sharif, where it has also permitted extremists to perpetrate acts of provocation and incitement, inflaming religious sensitivities not only in the Holy City but far beyond, throughout the Arab and Islamic world. If such illegal actions and incitement remain unaddressed, the consequences at the political and security levels will surely be grave.

The entire international community has called for the full and immediate cessation of Israeli settlement activities, including so-called natural growth in the occupied Palestinian territory, including East Jerusalem. Yet Israel continues to blatantly flout these calls, international law and United Nations resolutions; to construct and expand settlements, settlement infrastructure and the separation wall; to confiscate more Palestinian land; to transfer more Israeli settlers, especially in and around East Jerusalem; and to take other illegal measures aimed at altering the demographic composition, character, nature and status of occupied East Jerusalem, including the ongoing demolition of Palestinian homes, the eviction of Palestinian families and their replacement by settlers, as well as the revocation of residency permits.

This gives the Israelis a excuse to justify their control of the Al-Aqsa mosque and to shirk the responsibilities of peace, resorting to the same bankrupt rhetoric and claiming that there is no Palestinian peace partner. Such conduct calls for just and firm action by the international community, including the Security Council. In recent months and weeks, we have drawn the Council's attention to the increasing and unprecedented levels of Israeli aggression in occupied East Jerusalem. The occupying Power's settler colonization measures and the lawless acts of terror, violence and provocation committed by its settlers in the city are inflaming tensions and threatening to ignite an already fragile, precarious situation on the ground.

  35. The credibility and foundations of international human rights law and humanitarian law, as well as of the United Nations as a whole, is at stake. The world has for too long witnessed Israel's impunity, knowing well that it has been repeatedly fuelled by the lack of punishment and accountability. The tragic consequences have been suffered by generations of innocents throughout sixty years of statelessness and diaspora and over 42 years of occupation. We must break that vicious cycle. There must be an outcry against the perpetrators of war crimes, not against those who seek justice for the victims. Israel must be stopped from committing the Violations and crimes it continues to carry out against the Palestinian people in the occupied Palestinian territories, including East Jerusalem.

We thus believe that the implementation of the recommendations contained in the Goldstone report must be seriously pursued. The Security Council must uphold its Charter duty to address matters crucial to the maintenance of international peace and security. We hope that the Human Rights Council will endorse the Goldstone report and will formally convey it to the pertinent United Nations bodies, in conformity with the report's recommendations. We firmly believe that in the long run the pursuit of accountability for war crimes will better serve the cause of peace, which cannot be attained without justice. In that connection, we recall sage words by eminent signatories of the 16 March 2009 open letter to the Secretary-General and the Security Council: "We have seen at first hand the importance of investigating the truth and delivering justice for the victims of conflict.

In this regard, while significant deterrent power is presented by this report, along with other pertinent investigations that preceded it - including the report of the Secretary-General's board of inquiry and investigations by the League of Arab States Independent Fact-Finding Committee on Gaza, the International Committee of the Red Cross, Amnesty International, Human Rights Watch and numerous other organizations - it is clear that serious and responsible follow-up at all levels is imperative. This is very important to prevent the recurrence of such Israeli crimes against our people. Tomorrow the Human Rights Council will convene a special session based on a Palestinian initiative at the call of His Excellency President Mahmoud Abbas to rectify the malfunction that occurred at the Council in Geneva two weeks earlier.

While we reject any equation of the occupying Power's aggression and crimes with actions committed in response by the Palestinian side, we wish to reaffirm that there is no symmetry or proportionality between the occupier and the occupied. We take very seriously the allegations contained in the Goldstone report regarding possible Palestinian violations. We once again affirm our respect for and conviction of the rule of law, including international humanitarian law. We reiterate the commitment, as publicly stated, to the pursuit of domestic legal investigations to address that crucial matter. Yet what the Goldstone report essentially constitutes is another damning record of the Israeli crimes committed against our people under occupation. Its recommendations represent a significant contribution to the pursuit of accountability and justice.

  40. All the Palestinians - men, women, the disabled - suffered much, and that affirms the veracity of those facts. The members of the United Nations Fact-Finding Mission on the Gaza Conflict - Justice Richard Goldstone, Professor Christine Chinkin, Ms.Hina Jilani and Colonel Desmond Travers - should be commended for the thorough investigation they carried out and for the comprehensive and serious report they compiled under difficult circumstances, including Israel's refusal to cooperate with the Mission. Those individuals are eminent jurists and experts of integrity and professionalism who cannot be challenged by anybody. In that context, we are aware that the Mission investigated all allegations of violations of international law in the course of the Gaza conflict, including the allegations against the Palestinian side.

The investigation concluded that Israel failed to take the precautions required by international law to avoid or minimize loss of civilian life, injury to civilians and damage to civilian property, flagrantly violating the principle of distinction. Moreover, it concluded that that Israeli military campaign was planned in all of its phases as a deliberately disproportionate and systematic attack aimed at punishing, humiliating and terrorizing the Palestinian civilian population, radically diminishing its domestic economic capacity to sustain itself and forcing upon it a heightened sense of dependency and vulnerability. That shocking finding is confirmed thousands of times over by the depth of the trauma and anguish suffered by the Palestinian people to this day.

The investigation conducted by Justice Goldstone and his team to follow up the request by the Human Rights Council led to findings that clearly confirm that Israel, the occupying Power, committed serious human rights violations and grave breaches of international humanitarian law, including the Fourth Geneva Convention, that amount to war crimes and even crimes against humanity against the Palestinian people. They include the wilful killing of civilians, torture and inhuman treatment wilfully causing great suffering, serious injury to body and soul and extensive destruction of property not justified by military necessity. All this was carried out unlawfully and wantonly and gives rise to Israeli criminal responsibility.

The widespread destruction deliberately wreaked by the occupying forces on the Gaza Strip remains shockingly in full view, as Israel continues to obstruct the reconstruction of thousands of homes, vital infrastructure, hospitals and schools, mosques, economic, industrial and agricultural facilities and even United Nations facilities damaged or destroyed in the Israeli onslaught. The continued imposition of this immoral, unlawful Israeli blockade and collective punishment of the population has insured that the Palestinian people in the Gaza Strip continue to live in misery amid the ruins of their homes, deepening their humanitarian hardship and stoking the raw feelings of injustice.

With respect to Gaza, we are all too aware of the tragic consequences of the savage Israeli military aggression launched on 27 December 2008 against the defenceless and besieged Palestinian civilian population. More than 1,400 of them, including hundreds of innocent women and children were killed, and more than 5,500 were injured, many permanently, as the occupying forces rampaged through Gaza, using all means of heavy and lethal weaponry and exhibiting a callous disregard for human life.

  45. Sensitivities are rising to all-time highs and the need and calls for responsible action, accountability and justice are intense and must be heeded. In this regard, the report of the United Nations Fact Finding Mission on the Gaza Conflict, also known as the Goldstone report (A/HRC/ 12/48), constitutes yet another wake-up call to the international community that must not be ignored. At the same time, the explosive situation in occupied East Jerusalem, the heart of the occupied Palestinian territory, with all the attendant consequences should it spiral further out of control, remind us of the centrality of this issue to regional peace and security and require urgent attention.

We regret that, despite the persistent efforts of the United States Administration, the members of the Quartet, countries of the region and other concerned parties, no real progress has been made towards peace. This is precisely because of the failure to address the major issues of concern, foremost among which is the ongoing Israeli settler colonization campaign in the West Bank, especially in and around East Jerusalem, and the raging humanitarian crisis in the Gaza Strip as a consequence of Israel's military aggression and ongoing blockade. Israel's intransigence and defiance of the international will continue to jeopardize the prospects for realizing a just, lasting and comprehensive peace in the Middle East. We are at a critical juncture.

Regrettably, all recent assessments of the situation in the occupied Palestinian territory attest to its severity on all fronts. The negative consequences of the continued failure to ensure Israel's compliance with international law and to promote appropriate conditions for the resumption of the peace process should give rise to concern in the international community.

The resolution calls for the lifting of the blockade and the opening of the crossings in accordance with the 2005 Agreement on Movement and Access, and calls for guarantees ensuring the sustained opening of those crossings. In that regard, we would like to express our thanks to all our Arab brethren in the Arab Ministerial Council, chaired by His Royal Highness Prince Saud Al-Faisal, for their principled and united position. This played a fundamental role in achieving, together with friendly countries, the adoption of the resolution. Now Israel, the occupying Power, must immediately implement this resolution. Aggression must cease so that we all may have the opportunity to work to heal our people's wounds and to rebuild what the brutal Israeli war machine has destroyed in Gaza.

Mr. Al-Malki (Palestine) (spoke in Arabic): The adoption of resolution 1860 (2009) was delayed several days despite the humanitarian crisis and the appalling loss of lives among civilians in Gaza. More than 760 Palestinian martyrs have fallen, 40 per cent of them women and children. More than 3,000 persons have been wounded, and vast damage has been done to the basic infrastructure in the district, including United Nations installations, in flagrant breach of international humanitarian law. After days-long consultations to reach this binding resolution calling for an immediate ceasefire, Israel must now put an end to its aggression against the Palestinian people and fully withdraw Israeli forces from the Gaza Strip.
