France therefore calls upon those local players to do their all to ensure that elections can be held this year, in respect for the principles reaffirmed by the Peace Implementation Council's communique of 2 December 2015. We note with satisfaction the statements issued by the Republika Srpska authorities on the indefinite postponement of the referendum project, which could have challenged the competence of the central State in the judicial field. Whether it refers to the functioning of judicial institutions or public holidays, compromise solutions must be found. That is in the interest of everyone. Today, the situation in Bosnia and Herzegovina, despite its weaknesses, seems to be moving in the right direction of normalization.

  4. Local campaigns should not pit one side against the other on the basis of hatred and rancour, but should lead to constructive discussion of political projects. Faced with mass unemployment, Bosnians deserve that priority be given to the economic development of the territories. All Bosnians deserve the right to express themselves democratically in free and fair elections. As such, we remain concerned about the situation of the city of Mostar. Indeed, due to the lack of consensus between political forces, its inhabitants have been deprived of their most basic civil rights at the local level for nearly eight years. To accept such a status quo would be irresponsible. However, the only viable solution will be one that creates a consensus among local players.

It is especially important that a fully operational European coordination mechanism be set up as soon as possible, that significant progress be achieved in the implementation of the reform agenda and the Stabilization and Association Agreement, and that the country advance towards a judicial system that is fully independent, impartial and effective. More than 20 years after their signing, the Dayton-Paris Peace Accords remain the cornerstone of stability in Bosnia and Herzegovina. It will be up to the Bosnians themselves to ensure that, when the time is right, their institutions evolve. At a time when the country is facing elections, we call on all political forces to set aside divisive rhetoric that is as outdated as it is dangerous in favour of the construction of the future.

In that context, the European Union will continue now more than ever to support the Bosnian and Herzegovina authorities in the implementation of reforms that meet the economic and social aspirations of the population. The reform agenda adopted last year is crucial to that end. We welcome the fact that it has already produced initial concrete results, such as the adoption of new labour legislation at the entity level. Nonetheless, the Bosnia and Herzegovina authorities must bear in mind that their candidacy is only the beginning of a long and demanding process that will require efforts at the central State and entity levels.

  7. Mr. Bertoux (France) (spoke in French): I thank the High Representative for Bosnia and Herzegovina for his comprehensive briefing on the situation and for his work. France aligns itself with the statement to be made by the observer of the European Union. France welcomes the fact that the European perspective today serves as the main engine for the development and consolidation of Bosnia and Herzegovina. Its recent application to join the European Union reflects the overwhelming support of that perspective within the Bosnian population, as well as the unanimity that exists around this topic within the collegial Presidency of the country. The Council noted these developments that in resolution 2247 (2015), the most recent resolution on the situation in Bosnia and Herzegovina, which was adopted unanimously on 10 November.

  9. Upholding human rights and the rule of law, as well as education, inclusion and social harmony, will be key factors in the long term in any strategy to prevent or of fight violent extremism. It is our shared responsibility to ensure that combating terrorism, which is so crucial to the safety of our fellow citizens, necessarily goes hand in hand with upholding human rights. Given a threat of this scope, we have no other choice but to strengthen international cooperation. Specific progress is possible, as was demonstrated by the adoption today of the passenger name registry by the European Parliament. In each of these areas, the United Nations has a great added value to provide, be it in the creation of standards, strategic guidelines or mobilizing the international community.

The President of the Republic announced at UNESCO the introduction by France of a customs control of the importation of cultural property and the creation of safe havens in France to hold endangered cultural property. These provisions have been included in a bill currently being debated in Parliament. Finally, the third area of work, combating terrorist propaganda, which is undertaken pursuant to resolution 2253 (2015), is another fundamental area where mobilization of the international community is indispensable. The ease with which terrorists use the Internet and social networks so as to spread their messages of hate is particularly worrisome. We stress that any initiative in this area should respect the freedom of expression.

France is also fully mobilized in the fight against the trafficking in works of art and antiques. We have drawn the attention of antique dealer associations to the trafficking of works of art from Syria and Iraq and to the fact that such trafficking may contribute to the financing of Da'esh. We call on all our partners to implement the United Nations resolutions and to adopt robust measures. I welcome the holding, at this very moment, ofajoint meeting ofthe Committee established pursuant to resolution 1373 (2001) concerning counter- terrorism and the Committee established pursuant to resolution 1267 (1999) concerning Al-Qaida and the Taliban and associated individuals and entities, on terrorist financing, with the presence of the President of the Financial Action Task Force on Money-Laundering. I take the opportunity provided by this debate to announce that in September, France will co-organize with UNESCO a seminar in Paris on the prevention of violent extremism through education. Preventing the radicalization of youth will also be one of the topics discussed at the sixteenth Summit of la Francophonie, in Madagascar in November 2016. The second priority for us all is the fight against terrorist financing and the full implementation of resolutions 2199 (2015) and 2253 (2015). The funding of Da'esh was greatly affected by the strikes of the coalition, forcing the group to decrease the salary that it pays its fighters.

It instituted a ban on leaving the territory and a prohibition on entry into and residence in national territory for foreigners not residing in France that constitute a danger to national security. At the international level, it is essential that the United Nations remain committed to stemming the flow of foreign terrorist fighters and to preventing violent extremism. The full implementation of resolution 2178 (2014) and following up the Secretary-General's Plan of Action to Prevent Violent Extremism are the two primary axes of that action. The Secretary-General's Plan in particular aims to unite and better coordinate efforts that we all undertake, Member States and United Nations, at the national, regional and international levels to prevent radicalization, which is an essential aspect of the fight against terrorism.

  15. They are young people, with varied profiles - men, women, converts, minors, and so on, from more than 100 countries. In France, this phenomenon has reached extremely alarming proportions, with 600 individuals present in the area, including 217 women and 18 minors. To adapt to this new face of the threat, we have taken some important steps. In April 2014, the French Government adopted a plan to combat terrorist networks and violent radicalization. An interministerial committee is responsible for coordinating the strategy to prevent and treat radicalization. The Government has also established a territorial mechanism to monitor persons that have been reported and to assist families in order to respond appropriately to each case. Finally, the law of 13 November 2014 introduced into our law several major innovations.

Today I would like to focus on three main themes that should, from my country's Viewpoint, be priorities for the international community and our Organization. The first is violent extremism, which feeds the foreign terrorist fighter phenomenon. I would like to begin by thanking the United Nations and Switzerland for having organized a high-level conference on this subject in Geneva on 7 and 8 April.   18. We are firmly committed to that, particularly in terms of securing high-intensity radioactive sources, as any theft could have extremely serious consequences. The second International Conference on Nuclear Security of the International Atomic Energy Agency (IAEA), scheduled for December 2016, will help to define the IAEA's upcoming nuclear security plan of action for the period 2018-2021. It will also strengthen the security of radioactive sources. We must emphasize the broadest possible participation at the ministerial level to ensure the success of that important conference. Again, the risk is real. Mobilizing all of energy of the international community is necessary to combat the proliferation of weapons of mass destruction and prevent them from falling into the hands of terrorists.

On the issue of assistance, I want to assure the Council of the commitment of my delegation, which coordinates the working group on the subject, with the aim of improving the efficiency of the assistance mechanism. Given the emerging technologies that terrorists may be able to exploit, all Member States must further strengthen their export and border controls, prevent and suppress the financing and proliferation of weapons of mass destruction and ensure that sensitive goods and materials are as secure as possible within their territory. The comprehensive review of the implementation of the resolution, which the 1540 Committee has just launched in accordance with resolution 1977 (2011), must meet those challenges. As I already mentioned, the preliminary analysis by the Group of Experts on the measures taken by States Members pursuant to resolution 1540 (2004) shows improved implementation of the resolution, which is very positive. However, the implementation is uneven, depending on the region and the type of action.

  21. I commend the Group of Experts for analyses and outreach efforts, which are essential to the Committee's work. Secondly, today we see that an increasing number of international, regional and subregional organizations have adopted strategies to implement and promote the provisions of the resolution. The European Union, for example, has promoted the implementation of the resolution since 2004; and that commitment was renewed in July 2013 by the Foreign Affairs Council, which adopted a decision on resolution 1540 (2004) allocating €1.5 million towards regional efforts to implement its provisions. Despite the undeniable success of the past 11 years, much work remains.

The adoption of resolution 1540 (2004), 11 years ago, marked a decisive step in preventing those dangers by requiring, via a resolution under Chapter VII of the Charter of the United Nations, that States take specific measures to prevent such weapons from falling into the hands of terrorists. The setting up of the 1540 Committee has since ensured the ongoing monitoring of the implementation of the resolution, and encouraged cooperation among Member States in that fight. We have seen undeniable progress in implementing the resolution over the course of the past 11 years. First, the vast majority of Member States have adopted measures to translate the provisions of the resolution into their national legislation, including informing the Committee of such measures via implementation reports.

The proliferation of radiological, biological, chemical and nuclear weapons and the risk that they may fall into the hands of terrorists are very real dangers, as the Ambassador has very aptly reminded us. The crimes committed by Daesh in Syria and Iraq, which seem to know no bounds, means that we cannot rule out such a possibility.

  25. Its support to the Government remains crucial, particularly in enabling the people to benefit from Government programmes and international assistance. In that regard, we emphasize the importance of the joint discussions on the changes to be desired in the support that the United Nations Assistance Mission in Afghanistan (UNAMA) and the United Nations can give the country. We hope they will be a useful guide in the renewal of UNAMA's mandate in March. In that context, France would like to emphasize its support for the proposals made in the final report of the Tripartite Review Commission regarding the establishment of a narrow mandate that confers on UNAMA strengthened powers in the areas of good offices, protecting human rights, coordinating humanitarian activities and combating the production and trafficking of narcotics.

We welcome Afghanistan's adoption on 15 October of a national action plan against drugs for 2015 to 2019, reflecting its determination to pursue a comprehensive approach to fighting this scourge in close cooperation with the United Nations Office on Drugs and Crime. France is committed to ensuring that the United Nations plays a greater role in addressing this major challenge, particularly in coordinating the United Nations agencies and programmes involved in the drug war. In this difficult context, the international community should not cease its efforts to support Afghanistan in achieving greater stability, prosperity and democracy. As Afghanistan continues its political and security transition, it is more important than ever that the United Nations adapt the role it plays.

  27. The international community should also continue to support the Afghan authorities in implementing their commitments regarding the protection of children in armed conflict. The fight against narcotics and the illicit economy is also among these challenges and of great concern to France. The large-scale production and export of narcotics in Afghanistan are extremely damaging to the country's security, stability and development, since they help to finance the insurgency, destabilize the economy and weaken the Government. They create a threat to public health that affects Afghanistan first and foremost but that also extends well beyond it to affect the region and many other countries worldwide.

However, the Afghan Government and its international partners should not relax their efforts to strengthen the security forces' capacity, because the situation remains fragile in many provinces. The Taliban's temporary occupation of the city of Kunduz in October revealed the Afghan forces" vulnerabilities as well as the new capacities that the insurgency has acquired. In the area of human rights, the situation of women and children remains precarious, as was shown recently by the recent tragic stoning of the young woman named Rokhshana who had been accused of adultery. It is essential that Afghan civil society and the authorities continue to act to fully implement their national action plan on women and peace and security adopted in follow up to resolution 1325 (2000).

  29. I wish to underscore my country's support for the Afghan Government and encourage it to continue the efforts it has been making for more than a year and a half now. France also welcomes the announcement made at the Heart of Asia-Istanbul Process Conference in Islamabad on 7 and 8 December on the resumption of the peace and reconciliation initiatives, a process critical to the country's national reconciliation and lasting stabilization. On the security front, the conflict has continued to spread and the level of violence unfortunately remains high, with numerous casualties, including growing numbers of civilians. The Afghan security forces have made notable progress and have kept control over Afghanistan's main urban centres.

For Afghanistan, 2015 was a year of progress and many challenges. First, from a political perspective, the transition started in September 2014 and the gradual consolidation of the National Unity Government have raised the expectations of the Afghan population, neighbouring countries and the international community. The Afghan Government has shown its willingness to move forward in circumstances that are, at times, difficult.

  31. If the transfer had been successful, it would also have constituted a violation of resolution 1737 (2006). Such violations, coming so soon after the July agreement, do not augur well. They demonstrate just how vigilant we must continue to be. The Vienna agreement on the Iranian nuclear programme will be a victory for international diplomacy only to the extent that it is fully and rigorously applied. In that regard, we will remain engaged in its implementation in good faith but in a spirit of watchfulness that can ensure the credibility of the agreement and that the solution to the Iranian nuclear issue will be a lasting one.

  32. In that context, we were disturbed to learn the conclusions of the latest incident report from the Panel of Experts concerning the ballistic missile launched by Iran on 10 October. According to the report, the Panel's rigorous independent inquiry concluded quite unambiguously that the missile launch constituted a violation of resolution 1929 (2010). That violation must receive an appropriate response from the Committee established pursuant to resolution 1737 (2006). The Panel of Experts also mentions a possible ballistic missile launch on 21 November. That information should receive our full attention, and if it is confirmed we should also respond to it. In a second report concerning an attempt to transfer titanium bars under embargo, the conclusions in the Panel of Experts are no more reassuring.

On 18 October, following the completion of the national investigation process, the Vienna agreement went into effect, and just today the Board of Governors of the International Atomic Energy Agency took important decisions aimed at re-establishing the relationship between the Agency and Iran on new foundations. Having endorsed the Vienna agreement through the adoption of resolution 2231 (2015), the Council must now shoulder the responsibility of implementing it. I would like to recall in that regard that both the agreement and the resolution establish that until the start of implementation, all existing Security Council measures, including sanctions, remain in full effect.

  34. The July agreement between Iran and the E3+3 meets the traditional and essential requirements for non-proliferation that we outlined during the negotiations. In order to ensure Iran's compliance with its commitments, we have established a robust and detailed verification regime. The Vienna agreement is now our collective road map. We will monitor it to ensure that the timetable and measures defined in the agreement and in resolution 2231 (2015) are rigorously and comprehensively implemented. Positive progress has been made since July.

The Vienna agreement of 14 July and the Council's adoption of resolution 2231 (2015) marked a historic step on the road to establishing confidence in the exclusively peaceful nature of the Iranian nuclear programme. For 12 years, the international community worried about Iran's alarming expansion of its nuclear programme. Today, after long and difficult negotiations, a path has opened towards a lasting solution to the issue.

  37. The measures for their implementation should be put in place at once. Matters relating to the rule of law, justice and internal affairs will be under particular scrutiny within that framework. In recent years, Serbia, for its part, has undertaken important efforts to draw closer to Europe, whether through internal reforms or by improving relations with its neighbours. I would also like to take this opportunity to reiterate our support for the European Union Rule of Law Mission in Kosovo, which is working day by day to support the rule of law and security in Kosovo. I should also like to recall the European position, which recognizes all the Balkan States as a whole. The signing on 27 October, in Strasbourg, of the Stabilization and Association Agreement between the European Union and Kosovo signals an important step that confirms the European Union's full commitment to supporting Kosovo in its implementation of the reforms that are an indispensable part of its pursuit of rapprochement with Europe. The Agreement will be an essential tool for strengthening our cooperation in a great number of domains, particularly in the economic, commercial and political spheres.

  39. The consolidation of the rule of law also entails the fight against impunity. After the Kosovo Assembly's adoption in August of a series of constitutional amendments that authorized the establishment of the specialist court to follow up allegations of war crimes contained in the Marty report, it is important that the specialist court be put in place as soon as possible. The consolidation of the rule of law also ultimately requires the fight against radicalization in all its forms. France commends the actions taken by the Kosovar authorities in support of the fight against violent extremism. Their mobilization on that front is critically important in our collective fight to combat terrorism. We intend to pursue our bilateral coordination efforts in that realm.

  40. Kosovo's authorities must pursue their efforts to reconcile with Serbia on this score, all the while stepping up outreach to the population. The efforts to consolidate the rule of law in Kosovo must remain more than ever a priority. That entails, first and foremost, unconditional respect for the functioning of its institutions. Recent months have been marked by a series of particularly serious incidents in the form of attacks against members of the Government or even physical attempts to impede the work of the Parliament, as we saw yesterday. Such acts of violence are quite simply unacceptable. They endanger the advances so patiently built up by Kosovo for more than 10 years on its path to constructing an independent, modern and democratic State. We therefore call on all Kosovar political actors to abstain from all forms of violence.

  41. We are pleased that the first concrete steps have already been taken, such as the launching of the construction work on the Mitrovica bridge. However, it is crucial that the parties continue to mobilize without reserve their efforts to fully implement the agreement. We will, in that regard, be attentive to the developments following the decision of the Kosovo Constitutional Court to postpone until next January the possibility of adopting the agreement on the association of Serb-majority municipalities. In our view, that agreement is a key mechanism that enables the Serb population to fully embrace their Kosovar citizenship and to stop viewing themselves, wrongly, as foreigners. Its creation will not call into question the unitary status of the country.

Mr. Bertoux (France) (spoke in French): I thank the Special Representative of the Secretary-General for his briefing and assure him of my country's full support in his new role and wish him every success. I also thank the Minister for Foreign Affairs of Serbia and the Ambassador of Kosovo for their statements. I take this opportunity to express to them France's gratitude for the messages of solidarity of the Kosovar and Serbian authorities following the heinous attacks on our country on 13 November. France welcomes and supports the political dialogue between Serbia and Kosovo under the auspices of the European Union. As the Special Representative noted, the signing, on 25 August in Brussels, of four bilateral agreements is a significant step forward.

That means that the Security Council Committee established pursuant to resolution 1737 (2006) and the Panel of Experts supporting it must continue their activities, including as pertains to incidents already reported as well as those that may be reported by Member States. Furthermore, I hope, as indicated by the Ambassador of Spain, that the Committee, with the Panel's support, can provide Member States with all the necessary support for the implementation of Security Council resolutions on Iran. The Vienna agreement is the best demonstration of what diplomacy is capable of today. While there was an accumulation of uncertainties, the agreement today provides a lasting foundation for a resolution of the Iranian nuclear issue.

  45. We will take part in this exercise in good faith, of course, but also with necessary vigilance - and for the entire duration of the agreement. We will particularly ensure that the timetable set forth by the Vienna agreement and the resolution will be scrupulously upheld. In that respect, I think it would probably be useful to recall that just until implementation day - that is, until the IAEA confirms to us that Iran has implemented all the initial measures of the agreement - all existing measures of Security Council resolutions remain fully in force. The Vienna agreement and resolution 2231 (2015) explicitly state this.

  46. This agreement is based on a thorough verification on the ground of the commitments made by Iran. We have also taken requisite steps to restore sanctions should it be necessary ifthere are significant violations. Everything has been done to deter any violation of the agreement by the Iranian side. We shall judge based on evidence: the success of the agreement depends in large part on Iran, which will have to implement all measures provided for. In exchange, the nuclear-related sanctions will be progressively eased as Iran concretely honours its commitments and the IAEA is able to verify it. The Security Council, having endorsed it, is today the guarantor of the implementation of the Vienna agreement.

We support the Vienna agreement, as it attained all the objectives that my country had set for itself during the negotiations, namely, a 98 per cent reduction in Iranian uranium stocks, a two-thirds reduction in the number of centrifuges, a limit to the rate of uranium enrichment and a ban on enrichment activities in the underground site of Fordow. All of those things have significantly lengthened the time necessary for Iran's swift access to nuclear weapons. By obliging Iran to modify the Arak reactor, we blocked access to a plutonium-based nuclear bomb. Finally, by guaranteeing International Atomic Energy Agency (IAEA) oversight not only over Iranian nuclear facilities and over the integrity of the fuel cycle, but also, where appropriate, to non-declared sites, we are ensuring that the agreement will be strictly verified in the field.

Mr. Bertoux (France) (spoke in French): I, too, would like to the Spanish Ambassador for his briefing on the quarterly activities of the Security Council Committee established pursuant to resolution 1737 (2006). The Vienna agreement of 14 July between Iran and the E3+3, and the adoption a week later of resolution 2231 (2015) by the Council were historic steps in re-establishing confidence with regard to the exclusively peaceful nature of Iran's nuclear programme. For 12 years, this question has occupied and worried the international community. The alarming expansion of Iran's nuclear programme for over a decade led us to establish a significant sanctions regime, while keeping the door open to dialogue for starting serious negotiations.

An overwhelming majority of Member States have already translated the provisions of the resolution into their domestic legislation and have taken measures to decrease the risks of proliferation. We also commend the efforts made by the Committee and the Group of Experts to put States requiring technical assistance in contact with those able to provide that assistance - a matter that France considers particularly important. Much remains to be done. After more than 10 years of implementation of resolution 1540 (2004), there are many lessons still to be learned in order to improve our collective work. We have confidence in the comprehensive review process that began a short while ago, and today we mark that with the issuance of a press statement.
