“With respect to the 1737 Committee, my greatest joy was to see it disappear in January. The signing of the nuclear agreement in 2015, thanks to the efforts of many, made it possible for diplomacy to triumph. I am confident that the full implementation of resolution 2231 (2015) will allow this matter to be definitively resolved. With respect to the 1718 Committee, it was always clear that the sanctions are directed exclusively against the military nuclear programme and ballistic missiles, not against the people of the Democratic People's Republic of Korea. It was this that led to the Council adopting resolutions 2270 (2016) and 2321 (2016), and we have always made sure that we do not affect the humanitarian situation. In the coming months, there remains much to do, and I am sure that the Italian presidency will do it brilliantly.”

“The third is unity. The Council must act united in both the adoption and implementation of the resolutions. Ambiguous clauses should be avoided, which create uncertainties and make implementation difficult. To those three I would add a fourth. I fully endorse the five proposals that the Ambassador of New Zealand put forward and which seem to me to be perfect, and of the five, I would emphasize one in particular: the way in which the need to get 15 votes in favour, which in the end turns the Committees into gatherings of 15 delegations each with a right of veto, makes decision-making in the Committees difficult. I shall now briefly refer to specific issues in the three Committees I have chaired: the Security Council Committee established pursuant to resolution 1737 (2006), the 1718 Committee and the 1540 Committee.”

“I believe that formalisms should be avoided in Security Council meetings, where there should be greater focus on discussion and analysis of relevant issues. I believe that briefings to the Council by the President should avoid the mechanical reading of a previously circulated text that is sometimes incomprehensible, not just for non-experts but also for the Chairs of the Committees themselves. The briefings should therefore be simple and allow for a substantive debate. The second is transparency. Transparency is essential in the actions of the Committees and in reflecting their decisions, particularly in the area of sanctions. States should be able to understand, with simple and complete clarity, the obligations they must fulfil. I therefore welcome the progress made by the Secretariat in the management of the Committees' websites.”

“I thank Ambassador Gaspar Martins for his briefing. I shall now make a statement as Chair of the Security Council Committee established pursuant to resolution 1540 (2004) and Chair of the Security Council Committee established pursuant to resolution 1718 (2006). In the exercise of the chairmanship of three committees on non-proliferation, Spain had always made clear that its main role was to search for consensus. As the main drivers in this task, we have acted responsibly and, above all, transparently. For that, we always counted on the cooperation of the members of the Council. I thank them for their support and the manner in which they helped us to solve problems. Now, there are three ideas that, in my opinion, would contribute to improving the effectiveness of the Committees. The first is relevance.”

“Over the past two years, at no time have we lost hope that the peace process could be unblocked, nor did we resign ourselves to seeing the Security Council fail to play a role in this process. Peace, as many have said, can be the only outcome of direct bilateral negotiations and the support of the international community can be a key factor. For that reason, we support the various initiatives currently under way, in particular the French initiative and the work of the Quartet. We also reiterate the importance of the Arab Peace Initiative. Any action in the Security Council must take this context into account. Like other representatives, we note that behind all the Security Council's initiatives there is a will to preserve the two States and that there is a clear feeling that the settlements are among the main threats.”

“Lastly, our understanding is that reconciliation at the intra-Palestinian level is essential if we are to reactivate the peace process. Our commitment - Spain's commitment i to peace in Palestine has no expiration date. It began with the Madrid Conference in 1991, and we have continued to work since then. The most recent example of this was the summit of religious leaders of the Middle East, which was held in Alicante on 15 and 16 November. I am pleased to say that this was a success and that a press release was adopted that represented an important step forward for tolerance and mutual respect. When we leave the Security Council, we will continue to take initiatives of this kind.”

He maintained innumerable contacts with the parties and we share his assessment. Spain too will be leaving the Security Council in two weeks. We are concerned that the Knesset is considering a draft law to legalize outposts in East Jerusalem and the West Bank. The stalemate in the situation in Libya is a threat to the security of Libya and of the broader region. I recall that the Political Agreement is the outcome of the work conducted by the United Nations with the Libyans themselves, and several urgent challenges must be met. The first is the establishment of a Government of National Accord, supported by the House of Representatives. The second is the smooth functioning of the country's financial institutions. And the third is the unification of armed forces under the authority of the executive.”

“We can achieve peace and stability in the region only when the Pyongyang regime shoulders its responsibility for that violation of the sovereignty of neighbouring States. The situation in the Democratic People's Republic of Korea is extremely complex and requires a multidimensional approach. It is our hope that this meeting will serve to ensure that the Democratic People's Republic of Korea responds to the cocnerns that have been expressed today and finally ends its internal human rights violations. “Secondly, we must provide necessary support to United Nations agencies working in the country. In that regard, I highlight the work that the Office of the High Commissioner for Human Rights, which was opened last year in Seoul, must undertake and is undertaking. Thirdly, we must offer the necessary support to civil society. Fourthly, there is a need to send a very clear message against impunity, but that cannot happen if there is only one participant in the dialogue. The first step must therefore be to enable to the long-blocked visit of the Special Rapporteur and other human rights mechanisms to the country. Moreover, we must insist that the Democratic People's Republic of Korea shed light on the hundreds of abductions, most of them of Japanese citizens, whose whereabouts have not yet been identified.”

“The Security Council has not remained indifferent to the suffering of the people of the Democratic People's Republic of Korea. In resolution 2321 (2016), which was adopted just a few weeks ago and is the latest to impose sanctions against the Democratic People's Republic of Korea, is a good example ofthat. But we must pursue our work and remain aware that condemning human rights violations is undoubtedly necessary but not sufficient. Pressure must also be accompanied by dialogue. In that spirit, I wish to highlight four elements that the Spanish Mission considered to be key. First, the Committee pursuant to resolution 1718 (2006), which has played a significant role as a pressuring mechanism, has also been able to adopt a banking channel to fund United Nations agencies operating in that country.”

“I am even more surprised that the State itself, which is responsible for the security and protection of its citizens, is the principal cause of their desperation. The citizens of North Korea want to flee their country. They seek liberty, dignity and respect and are willing to risk their own lives to that end. They are even prepared to risk summary execution. Some 80 per cent of those who manage to get out are women, and they are very often captured by human trafficking networks that force them into prostitution or to marry abroad. It is important to recall that progress has been made, such as the issuance of reports on the implementation of As we have seen in the report of the Convention on the Elimination of All Forms of Discrimination against Women and the Convention on the Rights of the Child. But much more needs to be done.”

Any gross and systematic violation of human rights is a threat to international peace and security. Regrettably, this type of situation has been occurring too often in too many places in the world, and the Democratic People's Republic of Korea is no exception. That is why Spain continues to support the ongoing examination of this matter by the Security Council. I will not dwell on the details, but naturally I am surprised that a Government that is capable of modernizing its arsenal at any cost should allow its people to suffer continuous famines.”

With today's veto of our draft resolution, the Spanish delegation has awoken from its dream, but we will not give up. I would like to conclude by expressing our gratitude to the delegations of Egypt and New Zealand, which have shared with us our frustrated attempt to tackle the conflict in Syria. “This time, however, we could no longer stay silent, considering that the General Assembly will be holding a meeting in three days in order to debate a draft resolution demanding that the Council take action on the grave situation in Syria. As my colleagues from Egypt and New Zealand have recalled, we convened an initial round of negotiations on today's draft resolution on 3 November. Despite the desperate situation of Syria's civilian population, we set aside enough time to help us work to reach a consensus. We have striven to find language that could bring together positions that were very different, included some that were fully opposed. We have incorporated suggestions from every delegation that wanted to contribute to drafting the text.”

“If peace cannot be maintained, we should at least be able to maintain respect for international humanitarian law, which prohibits attacks on civilians and requires the regular provision of humanitarian aid. Spain, Egypt and New Zealand share duties as rapporteurs on the humanitarian situation in Syria. Over the past two years, we have often been tempted to urge a response to the problems in Syria in the Security Council, but have refrained in order to avoid divisiveness and interference in the negotiations being conducted in other forums. We have crafted more than one draft resolution that has not seen the light of the day and have also participated in initiatives that ran the risk of creating conflict within the Security Council.”

“I shall now make a statement in my national capacity. We deeply regret the vetos of today's draft resolution (S/2016/1026), introduced by Spain, Egypt and New Zealand. Spain believes that its text, which is not perfect and undoubtedly comes too late for the thousands of lives that have been lost already, would have made it possible to protect the civilian population of Aleppo from the worst consequences of the war in Syria and to re-establish the cessation of hostilities throughout the country. As divided as the Council is with respect to how to respond to the conflict, it has continued to shoulder the responsibility conferred on it by the Charter of the United Nations.”
