It is an unusual and immoral practice that is out of touch with reality and does not contribute to the climate of respect, dialogue and cooperation we need in order to make headway in combating and preventing this critical global challenge. Instead, it increases confrontation, which benefits criminal mafias. Furthermore, given the increase in the use of information and communications technologies for criminal purposes, we believe it should be a priority for the United Nations to formulate a universal legally binding instrument to combat this modern manifestation of crime, which has permeated every area of life and even poses a threat to the security of critical infrastructure and other key social and economic elements.

Considering all of that, Venezuela would again like to take this opportunity to denounce a genuine and sophisticated manifestation of transnational crime that is a cause of poverty and exclusion and threatens effective cooperation in every area. By that we mean the illegal imposition of unilateral coercive measures on sovereign States, which affect more than a third of humankind in more than 30 countries around the world. The immediate and full lifting of those measures would help lead to an environment conducive to progress in effectively combating criminal mafias, in efforts that should always be based on dialogue and cooperation. We also categorically reject the publication of unilateral lists that claim to assess the efforts of other States to combat transnational organized crime and its various manifestations.

Before we persecute migrants, we must denounce the main intellectual authors of migration crises, who on a pretext of defending human rights — which the authors never respect and do not really uphold — have created instability all over the world and throughout history to advance their own geopolitical and geoeconomic goals, destabilizing Governments with false rhetoric about peace and democracy. If they were genuinely interested in human rights, sustainable development and the peace and security they are always talking about, they would refrain from actions that threaten those values, such as the criminal imposition of so-called sanctions, which are themselves a push factor in migration flows.

  6. In that regard, for example, our country has underscored that the issue of international migration cannot be addressed from a perspective of securitization. We cannot criminalize migrants. We must stress that combating mafias involved in trafficking in persons and in migrant smuggling is a collective task that requires urgent cooperation on our part. We are also opposed to all crimes that may be committed by criminal networks against migrants and denounce the various kinds of exploitation that many are often subjected to. We therefore urge everyone to put aside ideologies and begin a global dialogue on migrants, without exception and in the sole interest of migrants.

The ability of States to move forward collectively with international institutions and other nations in activities and programmes aimed at preventing and combating organized transnational crime is a sovereign right. Claiming that it is a threat to international peace and security could go beyond the Council’s mandate and has the potential to result in political, legal and social nonsense by seeking to point fingers at individual countries in the face of global tragedies that no nation can escape. Attempting to criminalize States or citizens per se, or failing to clearly define distinctions within the concept of terrorism, can have serious implications that go beyond the spirit of the founding Charter of our Organization.

As part of this important commitment, it is Venezuela’s duty to state clearly and categorically that the Security Council must make a clear differentiation in its capacity to take action with respect to issues linked to transnational organized crime in its various manifestations, limiting itself strictly to the mandate conferred on it by the Charter and its own relevant resolutions. It cannot allow the notion of its involvement in such issues to create an imbalance in the multilateral institutional structure related to this issue, including United Nations conventions and the many successful and effective bilateral and regional projects around the world.

Such instruments contain not just the legal framework but the spirit and essence that should guide this shared struggle — cooperation and dialogue, based on the purposes and principles of the Charter of the United Nations, including those referring to national sovereignty, non-intervention in internal affairs and the sovereign equality of States. In that regard, we want to emphasize that a politicized focus on combating transnational organized crime can never help to eradicate transnational criminal mafias. Quite the contrary — it will create only conditions that prevent cooperation, which is the sole sustainable way to combat them, and will actually aid their expansion and scope, ultimately jeopardizing economic development and harming the victims of a despicable scourge.

That is all part of a comprehensive commitment by the Venezuelan Government as a whole to ensuring public security, which has also been recognized by the international bodies with which we work closely and actively. In that regard, we consider the institutional cooperation frameworks in this area, both multilateral and bilateral, to be the ideal way to advance global collective action to combat transnational crime. They must be based on the principles of transparency, respect and sovereign equality, and in line with international law. Special mention should be made of agreements under the umbrella of the United Nations, such as the United Nations Convention against Transnational Organized Crime and its protocols and the United Nations Convention against Corruption, as well as other multilateral instruments.

We based that complex effort on our national Constitution and progressive laws and on proactive and timely measures taken by our public authorities, including the Comptroller General, the Office of the Public Prosecutor, the Office of the Ombudsman and the power of the people — in other words, an organized nation. The participation of the police and security services has also been key in this unrelenting fight. With a high level of professionalism, they have been implementing various initiatives to prevent and combat crime throughout the country, which has led to a significant reduction and elimination of mafias of all kinds in recent years, and has resulted in a robust investigative network aimed at preventing impunity.

A truly peaceful and prosperous world will continue to elude humankind until we put a complete and unconditional end to the imposition and implementation of the so-called sanctions, which are creating a veritable systemic crisis in a world that is not only more interconnected, but also more polarized and turbulent.   16. Development with social justice should, therefore, be part of any process that would seek to truly guarantee peace in the short, medium and long term. To that end, it is therefore necessary to put an end to all forms of interventionism or supposed neocolonial dominance. However, this is a sine qua non for sustainable development — a task that involves more than 30 countries around the world, including Venezuela, which suffer on a daily basis from the hardships imposed by criminal regimes of unilateral coercive measures that are illegally imposed and in open violation of all norms of international law. Such measures are deliberately and cruelly calculated to affect the right to development of more than a third of humankind.

Countries with their own development plans, many of which are also on this organ’s agenda, have often suffered the effects of interference, political destabilization or even military intervention for the simple reason that their sovereign decisions were at odds with the economic or geopolitical interests of third parties. There are too many examples of that in Africa, the Middle East and even in our own region of Latin America and the Caribbean. In that connection, Venezuela believes that it is of paramount importance not only to strictly respect the purposes and principles of the Charter of the United Nations but also to ensure that people have the necessary means for their survival and to create the foundation for inclusive, sustainable, fair and equitable development.

Likewise, in the economic sphere, they must respect the principle of common but differentiated responsibilities; give special and differential treatment to developing countries; promote fair trade; cooperate in sovereign debt restructuring; and help countries in the global South achieve internationally agreed development goals, including those derived from the 2030 Agenda for Sustainable Development, without conditionality. Recent history has shown us that imposing a single model or a vision, interfering in affairs that are essentially the domestic jurisdiction of States, and socioeconomic imbalances, including exclusion, inequality and social injustice, are often part of the structural causes of conflicts.

It is then evident that, in order to reverse the negative trends derived from colonialism, as well as the plundering of natural resources and an unjust global economic, financial and social structure, it is urgent to join forces within the framework of a truly inclusive multilateralism that allows, without further delay, the reform, among other things, of the social and economic policies and norms linked to a production system and consumption patterns that are unsustainable for the planet. The international community must therefore place greater emphasis on promoting the sustainable development agenda. Similarly, developed countries must comply with their commitments, including with respect to official development assistance, technology transfer and climate change.

The Palestinian case is a clear example of that because, despite it being evident that colonialism and foreign occupation are part of the root causes of that prolonged and painful conflict, the Security Council remains paralysed as a result of the decision of the United States Government — the main partner and accomplice of the occupying Power in the commission of war crimes, crimes against humanity, extermination and genocide against the Palestinian people — regardless of the result that that deliberate and premeditated decision has brought to the lives of hundreds of thousands of innocent people who have been murdered over more than 75 years and who have been prevented from realizing their right to development.

  22. Venezuela has reinvested national income to promote the eradication of poverty, social exclusion, illiteracy, hunger and disease. The Venezuelan Government therefore includes each and every member of our society as the final objective of development, which we view as a universal, indivisible and inalienable human right of all our people. This open debate gives us a special opportunity to highlight the importance of inclusive development in the building of just, equitable and peaceful societies as a fundamental condition to prevent, address and overcome conflicts and violence, given that nothing is truer, albeit trite, than the phrase that there is no peace without development or development without peace. We also understand that there is no single development model, and that each nation is free and sovereign in deciding its own destiny and vision of development. For our country, for example, inclusive and equitable development has been a core policy of the Bolivarian revolution for almost 25 years within the framework of its social programmes and great undertakings.

  27. It must end its indiscriminate attacks on the population and on essential civilian infrastructure. It must allow the unimpeded entry of humanitarian assistance and the safe evacuation of the civilians who need emergency medical care. It must also allow the United Nations Relief and Works Agency for Palestine Refugees in the Near East to fully carry out the mandate entrusted to it. Finally, we emphasize that the time has come for the promise of peace, justice and freedom enshrined in the Charter to become a reality for the Palestinian people, who are demanding their right to self-determination and the realization of their legitimate national aspirations. Meanwhile, we once again renew our unwavering solidarity with our brother Palestinian people, as well as our firm support for their just cause and that of their martyrs.

  28. We will continue to decisively support all international efforts that will bring us closer to achieving a just, comprehensive and lasting peace and resolving the question of Palestine. Now, in the absence of a credible political horizon, it is imperative to advance with a sense of urgency towards the adoption of concrete measures that will enable us to guarantee the welfare of the civilian population and provide international protection to the Palestinian people. Amid the current international situation and the gravity of the situation on the ground, we also demand that Israel, the occupying Power, return to a path of international legality. They are attempting to give carte blanche to the aggressor not only to continue its policy of extermination but also its vendetta against an entire people, who are simply demanding their right to a free homeland. That is exactly what the United States is seeking with its unacceptable draft resolution. Today, as we celebrate the anniversary of the entry into force of the Charter of the United Nations, the Bolivarian Republic of Venezuela reaffirms its historic and principled position in support of the just Palestinian cause. We will not tire of defending the inalienable right of our brother Palestinian people to exist, and not merely survive, in a free, independent and sovereign State of Palestine, with East Jerusalem as its capital, along the pre-1967 borders.

Unfortunately for the United States, however, its manipulation of the facts and gaslighting techniques no longer have the effect they once had, because the world we live in today is widely connected, thanks to technology and social networks. The evidence is therefore right before the world’s eyes. The responsibility of the Israeli regime is incontrovertible and irrefutable. It is regrettable to see how a number of Governments refuse to categorically condemn indiscriminate violence against innocent civilians and, on the contrary, prefer to encourage the commission of war crimes and crimes against humanity, as well as the prolongation of this conflict. Today they have once again opted for indifference, and what is even worse, for complicity.

In the past two weeks, entire shelters have been bombed; food warehouses have been destroyed; thousands of innocent civilians — including women and children, as well as United Nations and Red Cross personnel and members of the international press — have been murdered; and air strikes have been carried out on homes and hospitals. We have all watched in shock as those events have unfolded. They are not mere statistics, but facts in the public domain and human lives that have been lost. Even so, Washington insists that according to its supposed assessments, Israel is not responsible and that the occupying Power is using proportionate force in the exercise of its right to self-defence.

That has been demonstrated by the facts and confirmed by reports from bodies and agencies within the United Nations system, the International Committee of the Red Cross and other humanitarian actors on the ground, who have not been exempt from the barbaric violence and in some cases have even lost their lives. We can see that from the images that have gone viral around the world since 7 October. It is a reality that can no longer be minimized or concealed and that will live on in the memory of generations who will never be able to forget the massacres that are still happening right now.

Nevertheless, we call for careful note to be taken of the conduct and positions today of the countries seeking to justify the unjustifiable, including through the submission of draft resolutions that only make a mockery of the world. Despite the fact that it is ethically and morally wrong, history has shown us that their hypocrisy knows no bounds and that tomorrow they will have no shame in putting themselves forward once again as supposed leaders on other important issues. The situation on the ground is truly tragic. The humanitarian situation continues to deteriorate by the minute, day after day, while this organ continues to be paralysed.

We wonder where is the so-called international community — the Government of the United States of America, its Western partners and satellites — which, in any other case, would be pretending to give us lessons on human rights, calling for the protection of civilians and demanding unimpeded and unhindered access to the humanitarian aid which is needed now on the ground. We wonder whether those are the rules that the United States Government is referring to when it promotes the consolidation of a so-called rules-based world order — the rules of exceptionalism, unilateralism, supremacy, double standards and subjective interpretations of international obligations. We are in no way surprised by the United States’ deafening silence, which constitutes a clear example of its complicity in this and so many other painful conflicts around the world.

Against that backdrop, it is clear that the Israeli regime is not only openly, flagrantly, deliberately, systematically and with impunity violating each and every relevant General Assembly and Security Council resolution, but also the purposes and principles enshrined in the Charter of the United Nations, the norms of international law, international humanitarian law, international human rights law, international refugee law, as well as the Geneva Conventions and their Protocols, which, among other things, regulate the savagery of war. It is clear therefore that the occupying Power believes it is above the law and is in no way committed to the realization of the two-State solution, with two peoples living side by side in peace and security.

The escalation of violence and military aggression beyond the Gaza Strip, including against the Palestinian civilian population in the West Bank, ranging from unjustifiable bombings against civilian infrastructure in the city of Damascus, to the accumulation of destructive power in the region, with aircraft carriers and troops of Powers from outside the region, demonstrates the clear intention of the occupying Power and its main accomplice and protector, the Government of the United States of America, to escalate the conflict and geopolitical tensions, to maintain dominance in the region, including by launching operations on other fronts, with the aim of completely altering the Middle East and taking advantage of this situation not only to annex the Gaza Strip, but also to deploy an operation aimed at the ethnic cleansing of the Palestinian civilian population surviving in the so-called world’s largest open-air prison.

For years we have been warning about the need to put an end to the inflammatory discourse that foment fanatical groups and encourage, among others acts, the commission of hate crimes and attacks against religious sites. For years we have demanded that the Security Council assume its responsibilities under the mandate conferred upon it by the founding Charter of our Organization. For years we have demanded that the Security Council ensure compliance with its resolutions, which are legally binding on all United Nations Member States without exception of any kind. We call for the cessation of any unilateral measures or actions that could escalate tensions, destroy a political horizon and further prolong the conflict, and for progress, without further delay, particularly in the Security Council, towards changing the status of the State of Palestine, so that it becomes a full-fledged member of our United Nations once and for all. The time has come for the promise of peace, justice and freedom contained in the Charter of the United Nations to become a reality for the heroic Palestinian people, who demand their inalienable right to self-determination and the realization of their legitimate national aspirations.

  43. From this podium, we call for an end to the prevailing cycle of impunity that, for years, has only emboldened Israel to continue its war crimes and crimes against humanity. We ask that those responsible for so much pain and suffering be brought to justice and that the noble Palestinian people be provided with international protection. That is particularly necessary in view of the cruelty of the most recent episodes of violence against the Palestinian civilian population by the occupying Power, and of attempts to minimize the consequences of that violence, as happened recently in Jenin, despite the fact that the Office for the Coordination of Humanitarian Affairs confirmed that it was the most lethal operation, with the highest number of Palestinians killed in the West Bank, of the last 20 years or so.

The panorama is certainly not encouraging and, although there are those who prefer not to denounce it publicly, this is a reality based on probable facts and constitutes a flagrant, systematic and grotesque violation of the precepts contained in the Charter of the United Nations and all norms of international law. Perhaps this is the best example that we need to dismantle the so-called rules-based order that the United States and its satellite countries so ardently tout and pretend to impose — an order based on presumed exceptionalism, unilateralism, supremacy, double standards and interpretations that accommodate their international obligations. None of those notions has any place in the United Nations, which operates according to the rules accepted by the entire international community in its actions and relations.

  45. This is nothing more than the result of the framework of impunity with which the United States of America, its main partner within the Security Council, protects it. The Israeli-Palestinian conflict is one of the most painful conflicts facing humankind for more than 75 years, when the Palestinian catastrophe, or Nakba, began. We cannot continue to procrastinate in taking concrete steps to put an end to the prolonged suffering of an entire people who cannot and will not tire of demanding what is rightfully theirs — the inalienable right to exist; the inalienable right to return to their homes and the inalienable right to live in a free, independent and sovereign State of Palestine.

It is clear that the occupying Power has no intention whatsoever of ending either the occupation or its criminal aggression and that its policies are, in fact, aimed at seizing total control of the occupied Palestinian territory, even insisting on altering its demographic status, as evidenced by the recent announcement by the Israeli regime of the construction of thousands of new settlements, which will undoubtedly result, in turn, in further evictions, destruction of homes and transfer of settlers, a matter that was condemned on 12 July by at least six independent experts of the United Nations, as well as by Assistant Secretary-General Khiari. We categorically reject that conduct, which flouts international law, on the part of the occupying Power.

We agree that the situation on the ground continues only to deteriorate, which is a matter of great concern, especially in the absence of a clear political horizon and the continuation of policies of racial domination, oppression, colonial occupation and apartheid that are being systematically and deliberately pursued by the occupying Power — not only to prolong the conflict, but, even worse, to destroy the viability of a two- State solution.

My delegation also endorses the recent statement delivered by the representative of the Republic of Azerbaijan on behalf of the Movement of Non-Aligned Countries. The Bolivarian Republic of Venezuela reaffirms its historic principled position in support of the just Palestinian cause. Lastly, we would like to conclude our statement by acknowledging the most recent developments in Middle East dynamics, from the normalization of diplomatic relations between the Islamic Republic of Iran and the Kingdom of Saudi Arabia to those between the Syrian Arab Republic and several countries of the region.
