Venezuela rejects in particular the construction of settlements and of the separation barrier; the use of lethal force against Palestinian civilians, including unarmed demonstrators; the detention and ill-treatment of political prisoners; the imposition of a blockade on the Gaza Strip; and the establishment of hundreds of checkpoints in the West Bank. Likewise, we object to the withholding of Palestinian revenues and the various other measures aimed at isolating East Jerusalem and modifying its historical character. The State of Israel has since 1947 systematically disregarded the relevant resolutions of the United Nations that advocate a two-State solution. If we look at the origin of the armed conflicts affecting some countries, we will discover that in most cases they stem from an underestimation of the social dimension of development and the plundering role played by international corporations that sack the riches of countries of the South. Venezuela believes that it is important to take into account social as well as political aspects in a holistic manner when addressing armed conflicts.

The Government of the Bolivarian Republic of Venezuela is concerned about the fanciful idea of incorporating, as a norm of the Charter of the United Nations, the notion of the responsibility to protect. Venezuela reiterates its firm opposition to that concept, which has served to undermine the sovereignty and independence of States and has been used to overthrow legitimate Governments by imposing interests that are expansionist, imperialist and colonialist. Ben Emmerson, United Nations Special Rapporteur on the promotion and protection of human rights and fundamental freedoms while countering terrorism, reported on an investigation into the impact of unmanned aerial vehicles, known as drones, on civilians and their human rights. He denounced the drones, due to the lack of transparency in their use. Venezuela applauds that initiative. The investigation, according to the Special Rapporteur, will focus on 25 attacks in which drones were used against civilian populations in Pakistan, Yemen, Somalia, Afghanistan and the occupied Palestinian territory. In Emerson's view, some of those attacks are particularly cruel and could be considered war crimes.

Their guiding principles ofimpartiality, the consent of the parties, and the non-use of force except in legitimate self-defence purposes must be strictly followed.   11. We disagree with those who claim to ignore or conceal the role of the sovereign State in the protection of civilians in armed conflict. Parties to conflict, whether Governments or armed groups, are responsible for preventing any harm to the civilian population during a violent conflict. In recent decades, we have witnessed with concern how technical military categories are manipulated to dilute responsibility for the disproportionate use of force through indiscriminate bombing that kills innocent civilians. The so-called collateral damage punishes defenceless civilians and is used as a war tactic. Venezuela condemns the use of indiscriminate and disproportionate force in armed conflict situations affecting civilians populations, especially vulnerable groups such as women, children and the elderly.

The epic of Atrahasis, the great sage, tells of a time expressed in Babylonian terms "when gods were in the ways of men" - a time when humans did not inhabit the Earth. The Earth was inhabited only by gods, who were divided into two classes: the Igigi, who worked the land and with their labour fed and eased the lives of the aristocracy of the gods, and the Annunaki, who lived off the work of others. Exhausted by their oppressive labours, the Igigi rebelled against the other gods and claimed luminous life in the sunlight. So it is that since time immemorial, gods and humans have risen up against oppression and injustice.

The blockade, the acts of aggression and military threats against Palestinians living in the Gaza Strip and the construction of settlements in the West Bank by the occupying Power are contrary not only to international law and resolutions adopted by the United Nations, but they are also a concrete expression of State terrorism. The Security Council's silence and inaction in the face of such practices are deplorable. The United Nations Global Counter-Terrorism Strategy calls upon States to discourage groups from engaging in terrorism, to deny terrorists the means to carry out their activities, to urge them not to support terrorist groups and to respect human rights within the context of combating terrorism.

  27. Terrorism is practiced not only by non-State actors behind the scenes, but also by States who act in the full light of day. Some imperial Powers are engaged in State terrorism, and they justify doing so with arguments related to national security. State terrorism should be condemned because it is contrary to the principle of the sovereign equality of all nations, denies the rule of international law and is a mass violation of human rights. The Palestinian case reveals the double standard of some countries in their so-called efforts to combat terrorism. Israel's military aggression as an occupying Power deprives the Palestinian people of their lives, their land, their freedom, their history, their identity and, most important, their dignity.

Consistent with the Charter of the United Nations and international treaties and agreements, that important political instrument recognizes that efforts to counter that serious scourge is the primary responsibility of Member States. The Strategy likewise states that combating terrorism should be undertaken in the context of cooperation and governed by existing international and regional instruments and the norms of international law, human rights and international humanitarian law. Venezuela endorses such a holistic approach. Terrorism takes on many forms and manifestations, with State terrorism being among the most reprehensible. Venezuela has been at the vanguard of efforts to counter that terrible scourge, as demonstrated by the countless treaties and conventions that our country has adhered to as well as the many successful policies adopted by our Government. Venezuela has approved a series of influential legal instruments that establish measures to control, prevent and oversee efforts to combat the financing of terrorism and money laundering. In May 2012 the Organic Law against Organized Crime and the Financing of Terrorism was enacted. Its objective is to prevent, investigate, prosecute, criminalize and punish crimes related to organized crime, with a particular emphasis on the financing terrorism. Venezuela has joined all the initiatives taken within the context of the United Nations Global Counter-Terrorism Strategy.

  32. The countries that arm and protect Israel speak of peace, human rights and international humanitarian law without any moral or political authority. Ironically, those who today speak of peace are the ones that have the greatest interest in the colonial expansionist war. Let us recall that Israel, the occupying Power, has refused to allow inspections of its nuclear installations or to sign the Treaty on the Non-Proliferation of Nuclear Weapons. That Power is the real threat to the region and to the world. The many detailed letters from the Permanent Observer of Palestine to the United Nations, Ambassador Riyad Mansour, addressed to the President of the Security Council and of the General Assembly pitifully describe the inhumane and illegal aggression of the State of Israel against the Palestinian people.

The imperialists and their allies try to establish a kind of beneficial terrorism and resort to it, including State terrorism, when they wish to appropriate or control territories and their natural resources or to overthrow leaders of the people - whatever they wish. The Bolivarian Government of Hugo Chavez Frias has warned against the serious consequences of arming mercenary terrorist groups in order to overthrow the Government of Syria. In that way, they seek to put Israel in a stronger position in the negotiations with Palestine, Lebanon and Syria. Regrettably, certain members of this body tend to remain silent in the face of the evident threat to international peace and security posed by the Government of Israel. On the other hand, they encourage conflicts that should be resolved solely through mediation and dialogue; that is the case with Syria. That bellicose attitude threatens the institutionality of the United Nations, the Charter of the United Nations and international law. Military interventionism is the method chosen by certain Powers in order to promote their expansionist, colonialist ambitions.   36. My country wishes to express its deep frustration at the inaction of the Security Council when faced with the expansionist policy of Israel, the occupying Power, in the Palestinian territories. Such inaction is, as the Council is aware, the result of the threat of veto by the United States and its closest allies. Those Governments are today promoting armed intervention in Syria; last year, they spearheaded resolution 1973 (2011) on the situation in Libya, which led to hundreds of civilian deaths and to chaos and violence in North Africa. The resulting collateral damage is euphemistically referred to "necessary costs". The absurd logic that they use to "protect civilians" and "promote democracy" encourages war and violence.

Attempts to undermine that facilitation and the peace efforts are causing grave concern. Warmongers do not want peace in Syria. Instead, they seek to bolster their geopolitical interests through regime change that, should it materialize, would destabilize the Middle East region. Historical experience has shown that resorting to sanctions and foreign military intervention in the internal affairs of a sovereign country does not settle, but instead aggravates, domestic conflict. Venezuela emphasizes the need to promote a negotiated solution among the Syrians themselves. In that context, a ceasefire is urgently needed.

  40. Israel's frequent violations ofLebanese sovereignty and occupation of the Golan are of great concern. We demand an end to its blockade of the Gaza Strip, which has been repudiated by the international community. We reiterate the urgent need for the Council to recommend to the General Assembly the admission of Palestine as a full Member State, in reaffirmation of the international recognition that the concert of nations has granted progressively and in greater numbers to Palestine over more than two decades, and which has been rightly reflected in forums such as UNESCO. We firmly support the establishment of an independent, viable and territorially contiguous Palestinian State, with East Jerusalem as its capital. The conflict affecting the peace-loving Syrian people is painful and regrettable.

  41. Those prisoners are kept in inhumane conditions under the policy of administrative detention. We stand in solidarity with them and demand their immediate release. Unfortunately, there are Powers that support these abuses, which, by all accounts, violate the principles of the Charter of the United Nations and international humanitarian law, particularly the Fourth Geneva Convention relative to the Protection of Civilian Persons in Times of War. Venezuela has repeatedly called on the Security Council to consider, by virtue of the competencies granted to it by the Charter of the United Nations, Israel's failure to comply with its resolutions on peace and security in the Middle East, which is causing a humanitarian tragedy with dire consequences.

In fact, the political and military elite of Israel have established a new apartheid in Palestine: roads for the exclusive use of the settlers, separate policies for Palestinian settlements and villages, endorsement of the aggression of the settlers against the Palestinian population and segregationist controls and checkpoints. The existing illegal settlements, which are promomoted by the occupying Power, are sabotaging the peace process. They constitute a grievous violation of international law and must cease immediately. Those inhuman practices are implemented by a State that, paradoxically, calls itself democratic. We express our deep concern at the tragic plight of thousands of Palestinian civilians, including children and teenagers, incarcerated by the Israeli Government without charges or a fair trial.

The protection of Palestinian, Syrian and Lebanese civilians suffering under the Israeli occupation must be a fundamental component of an international effort for the full and fair implementation of the mandate to protect civilians in armed conflict. While sanctions regimes are imposed on Governments and peoples of countries of the South, there is silence over the unpunished and massive human rights violations committed by the State of Israel. Why are Palestinian civilians not protected from those who systematically violate their human rights? The concept of the responsibility to protect re-establishes the former imperial political theories in new forms. Today, it is a lethal weapon of neoliberalism and brutal capitalism that seeks to violate the sovereignty of States.

Venezuela supports the initiative of the Russian Federation to convene an international conference on Syria, with the participation of key actors with influence in the Middle East, in order to help promote a political dialogue between the parties by way of achieving a peaceful and lasting solution to that conflict.   48. Why is civilian protection not invoked when American drones kill dozens ofcivilians in Afghanistan, Yemen and Pakistan? What about the war in Iraq, where hundreds of thousands of civilians have died. What about the sanctions imposed on Iraq before the invasion, which caused the deaths of at least 1 million people according to the press and international analysis? Where were the ardent advocates of civilian protection when those atrocities were being perpetrated? As some Security Council members have said, the report of the Secretary-General (S/2012/376) ignores the Middle East and African countries and alludes to the alleged lack of cooperation of the Syrian Government with regard to the protection of civilians, while it forgets the suffering of civilians subjected to the Israeli occupation. Nor does it address the situation in Libya.

Under the guise of protecting civilians, the Security Council adopted resolution 1973 (2011), which provided NATO with a pretext to destroy much of Libya's civilian infrastructure, causing the deaths of thousands of civilians, including women and children, and leading to regime change and the brutal assassination of the head of State. The International Criminal Court seems to be concerned only with alleged or actual crimes against civilians when they are committed by African leaders or individuals. The concept of civilian protection is therefore controversial. In its name, regime change and overthrowing sovereign Governments of countries of the South are promoted so as to set up puppet Governments that favour the interests of transnational corporations and imperialist Powers.

Some Member States of the Security Council promote resolutions seemingly to protect civilians, but what they seek is a hegemonic foothold over countries of the South. That practice undermines the noble principles of the Charter of the United Nations, including the Fourth Geneva Convention relative to the Protection of Civilian Persons in Time of War. In that way, such practices degrade the humanism and noble goals of civilian protection.
