  1. In order to prevent armed conflict, developing social justice policies that make it possible to eliminate poverty and inequality among countries must be a priority. Such policies must be part of international cooperation and diplomacy based on solidarity. The issue of the protection of civilians in armed conflict cannot be addressed selectively or on a discretionary basis. We emphasize that the Security Council has acted in that manner on several occasions by choosing the civilians who merit or do not merit protection. In addressing the matter, it is not uncommon for imperialist Powers with neocolonial aims to resort to double standards. That is a strategy to reconquer and recolonize similar to that of past centuries that sought to topple the sovereign status of developing countries.

  2. All civilians on all continents require protection. International law on the protection of civilians, for example, as enshrined in the Fourth Geneva Convention and other international instruments, represents a milestone on the age-old path in pursuit of the dignity of the individual. Sovereign Governments bear the primary responsibility to protect their citizens. It is an exclusive responsibility, which cannot be replaced or manipulated by interventionist political agendas. The inequality, poverty, hunger, unemployment and inequities that arise as a result of the unjust global capitalist system and through foreign domination and occupation are the primary reasons for, or root causes of, armed conflict in countries around the world.

  3. The Security Council has been addressing the topic of the protection of civilians since 1999, with an emphasis on women, children and humanitarian workers. Those issues are inspired by noble goals. Diplomacy and dialogue are the most appropriate means for protecting civilians and the best guarantee for ensuring international peace and security. The protection of civilians in armed conflict must therefore be achieved peacefully. The use of military force is neither the best, nor the only, option for the protection of civilians. That alternative should be resorted to only in extreme cases, while always respecting the principle of proportionality. The protection of civilians in armed conflict is a commendable goal. There cannot be indifference to the violation of humanist principles and practices in times ofwar.

Mr. Valero Bricefio (Bolivarian Republic of Venezuela) (spoke in Spanish): We would like to thank you, Mr. President, for having chosen the protection of civilians in armed conflict for our consideration in this open debate. The Bolivarian Republic of Venezuela reaffirms its support for the importance of protecting civilians in armed conflicts. We wish to recall that such protection should always be based on international humanitarian law, particularly the Geneva Conventions and their Additional Protocols. Venezuela believes that the subject of the protection of civilians refers to those measures that are taken in order to protect civilians in time of war, and recognizes its ties to international humanitarian law, refugee law and international human rights law.

In that regard, we underscore the importance of effectively implementing the United Nations Programme of Action to Prevent, Combat and Eradicate the Illicit Trade in Small Arms and Light Weapons in All Its Aspects. My country is concerned about the transfer of weapons to non-State actors without the authorization of Governments. The illicit transfer to subversive elements and illegal armed groups, which threatens the legitimate peace and stability of Governments, has already led to the proliferation of illegal weapons in various regions and is destabilizing neighbouring countries.   8. My country has always taken a strong position against the illicit traffic in small arms and light weapons. Thousands such weapons have been confiscated in Venezuela, as never before in our nation's history. Venezuela acknowledges the problem posed by the manufacture and illicit trade in such weapons in all its aspects in many regions of the world. We agree with the need to establish controls, in particular by producer countries, so that the supply of such weapons is limited to Governments and their authorized bodies, in accordance with international law, in particular the right to self-defence, enshrined in Article 51 of the Charter of the United Nations.

Article 15 of the Constitution of the Bolivarian Republic of Venezuela stipulates that "The State is responsible for establishing an overall policy on land, island and maritime borders, to preserve territorial integrity, sovereignty, security, defence, national identity, diversity and the environment, in keeping with cultural, economic and social development and national integration." In Venezuela we have a constitutional and legislative framework, legitimated by the sovereign will of the people as expressed in referendums, which allows no means of decision-making other than approval or rejection by the people themselves through constitutional mechanisms.   11. Despite the grave economic and financial crisis, attempts are made to resuscitate the system through inhumane neoliberal policies that deepen the inequality gap in the world. The system and its drivers have no regard for democracy, nations, culture, ethical values or sovereignty. Illicit flows are part of the quest for financial gain without regard to fundamental human values. An automatic link is alleged between illicit flows and the proliferation of nuclear and conventional arms, terrorism, organized crime and other destabilizing factors. We challenge the attempt to merge various illicit flows with different and distinct illegal activities. There is no denying that the global consumerist and speculation-driven capitalist system - which punishes the world's poor and vulnerable while feeding the unbridled quest for short-term, immoral financial gain - is the root cause of illicit transborder flows. Some experts recognize that such crimes are the Achilles' heel of capitalism. The decadent capitalism of today - brutal, inhuman and nature-despoiling - is the systemic basis of transnational crime. A system that ever more concentrates wealth, without any regard to ethics, is a Petri dish for such crimes.

We caution that this is an attempt to continue to "securitize" the United Nations and usurp the competencies of other organs. We are concerned by the attempt to address the issue of illicit flows under such different and unrelated headings - which are handled in quite a variety of ways within United Nations bodies - as illicit drug trafficking, conventional arms, smuggling, terrorism and its funding, materials associated with weapons of mass destruction, conflict minerals and human trafficking.

  15. My country recognizes the efforts made by the Syrian Government to promote such reforms. We hope that resolution 2043 (2012), adopted on 21 April, establishing the United Nations Supervision Mission in Syria - which is to be composed of unarmed military observers and which has been welcomed by the Syrian Government - will contribute to overcoming the crisis. The quest for peace must never be abandoned. However, it is troubling that Kofi Annan's facilitation work and peace efforts by some countries are intentionally being undermined. The warmongers do not want peace in Syria; rather, they want regime change, which, if it were to materialize, would destabilize the Middle East and encourage the State of Israel's aggression against the Palestinian people.

  16. Syria's legitimate aspirations to regain control of the Golan Heights are eclipsed in favour of Israel's expansionist agenda in the Middle East. It is painful and regrettable to see the deplorable conflict afflicting the Syrian people - a people who love peace and nobly defend their sovereignty and right to self-determination. We are optimistic about the facilitating work of the Joint Special Envoy for the United Nations and the League of Arab States, Mr. Kofi Annan. The Council must contribute unambiguously to the implementation of the six-point plan he has proposed, which was welcomed by the Government of President Bashar Al-Assad. We support a ceasefire and a political and peaceful solution, through dialogue, to the conflict in Syria, in order to move towards democratic reforms without interventions imposed by imperialist interests.

Why such impunity? Why such inaction by the Council? We deplore the fact that, because of the complicity of one political and military Power, all resolutions on the Palestinian question are ignored. In that context, the urgent need is clear to move towards a new international order, genuinely based on the legal equality of States, and in which the fundamental principles of international law prevail. Communication channels reserved for the exclusive use of settlers, different rules for settlements on the one hand and Palestinian villages on the other, deliberate policies to abandon the Palestinian people to violent attacks by settlers, segregationist controls and checkpoints and arbitrary arrests of children, the elderly and women - all of those are inhuman practices on the part of a State that, paradoxically, calls itself a democracy. There is no democracy when laws, policies and the use of force privilege one group over another, enforcing religious and ethnic separatism, and when a people is subjected to oppression, exploitation and discrimination, as is the heroic Palestinian people. It is imperative to put an end to the Palestinian tragedy by effectuating a peace that is comprehensive, lasting and, above all, fair.

Political, cultural or religious differences must be overcome by means of dialogue and understanding. Those who promote interventionist unilateral action against the Government and people in Syria are violating international law and flouting the fundamental principles of the United Nations Charter. The valuable information submitted to the Security Council by the representative of the Syrian Government must be taken constructively. The people are the only owners of their own destinies, and therefore cannot countenance continuing foreign interventions by imperialist Powers in the internal affairs of the countries of the South, carried out on the pretext of protecting civilians. It also supports compensation and the consequent return to their homeland of 50 per cent of the Palestinian population who find themselves dispersed throughout the entire world, in line with General Assembly resolution 194 (III). We pay tribute to the tireless efforts being made by the Government of President Bashar Al-Assad to preserve the unity, integrity and stability of his country, besieged by imperialism. The stability of Syria is fundamental to peace in the Middle East. Venezuela reiterates the need for Israel to withdraw from the occupied Syrian Golan, pursuant to resolution 498 (1981) and in respect of resolutions 242 (1968) and 348 (1974). We renew our call to the State of Israel to respect the sovereignty of Lebanon and to avoid further conflict such as took place in July 2006.

Such actions, aimed at changing the demographic composition, the nature and the configuration of the Palestinian territories, are in violation of international humanitarian law and the relevant resolutions of the Council and the United Nations. The Government of Israel has long undermined the principles of the United Nations. International law prevents Israel from invoking conquest and colonization, calling it natural expansion. Therefore, Venezuela once again calls on the Security Council to take the necessary steps to ensure that the State of Israel respects all relevant resolutions and its obligations under international law. Venezuela reiterates its full support for the recognition of the Palestinian State by the United Nations on the basis of the pre-1967 borders, with East Jerusalem as its capital.

  44. Palestine has all the international legal, political and moral criteria to qualify as a sovereign State, in line with international law. After so many decades of delay, Palestine has established itself as a subject automatically by law in the international community. Through the building of an unjustifiable and racist wall, the imposition of neocolonial settlements, the brutal and ongoing blockade of the Gaza Strip and institutionalized violence, Israel is blocking the paths towards a negotiated settlement between the parties. The Government of Israel currently has in its prisons more than 6,000 prisoners, including more than 280 children, some less than 12 years old. We are dismayed that there are children among those deprived of liberty. That makes clear the inhuman nature of the Government of Israel and those who defend such practices.

The historic decision of the Palestinian authorities to request the Security Council to support its international recognition as a State with full rights in the United Nations is a claim for justice and reaffirmation of the Palestinian people's right to self- determination. The Government of the United States has launched a campaign to frustrate recognition of the Palestinian State, making it conditional on the relaunching of direct talks between Israel and Palestine, facilitated by the Quartet. In that way, it seeks to delay or to block the international historic demand calling for the establishment of that State. The Bolivarian Republic of Venezuela diplomatically recognized the Palestinian State on 27 April 2009.

Resolution 1973 (2011) established that the sovereignty and territorial unity and integrity of Libya must be respected. Who authorized the killing of thousands of civilians in Libya in the name of defending civilians? Who authorized the destruction of civilian facilities, such as schools, hospitals and universities, in that country?
