“During the general debate of the General Assembly this year, both Prime Minister Netanyahu and President Abbas reaffirmed their support for a two-State solution and their willingness to reach it through negotiations (see A/67/PV.12). Negotiations are the only way to get the process back on track. We strongly encourage the Middle East Quartet to expand its efforts to frame and support the process. We strongly believe that progress on the Middle East peace process would contribute to regional stability and offer new opportunities for the region as a whole. Ten years ago, the League of Arab States showed foresight and courage in adopting the Arab Peace Initiative. In this time of transformation in the region, Israelis and Palestinians must now prove their will to shape their national destinies.”

“The very achievements of a successful State-building process under the leadership of President Abbas and Prime Minister Fayyad are at risk. We therefore call on all donors to come through on their commitments of support. For its part, Germany will continue its significant level of assistance to the Palestinian Authority. Beyond that immediate need, however, the financial crisis can only be overcome through economic development. Such development will not be possible without a political perspective. Above all, Palestinians must be able to move freely on their land and have access to Area C. We need to see increased control by the Palestinian authorities over those areas, in line with the Oslo Agreements and the road map. We call on Israel to work with the Palestinian Authority towards realizing that objective.”

“Feltman highlighted that in clear words in his briefing. The security and stability risks posed by the status quo should instil in everybody a sense of urgency. Since the beginning ofthis month, dozens ofrockets have been launched from Gaza against residential areas of southern Israel. Those are terror attacks which we condemn in the strongest terms. At the same time, we urge Israel to exercise its self-defence with utmost restraint. On 20 October, Palestinians in the West Bank, except for East Jerusalem, will vote in local elections. That will be another step towards the consolidation of good governance and democracy in the future Palestinian State. Under current conditions however, the Palestinian authority has no resources to pay salaries or services for the rest of the year. What is at stake here is more than a mere budget problem.”

“The findings of the commission will provide a solid basis, including possible action by the International Criminal Court. The Syrian people deserve our support. The crisis of internally displaced persons and refugee will worsen with the winter approaching, putting further strain on neighbouring countries. We welcome the efforts of the relevant United Nations agencies in neighbouring States in providing support to Syrian families in need. Germany will continue to be a reliable partner in providing humanitarian aid to alleviate the suffering. These days, the Middle East process makes fewer headlines than most other events in the region. That is because the process is stalled, not because it is in any way less urgent. On the contrary, with every day that goes by, the concerns over the viability of a two-State solution become more acute. Mr.”

“No matter how many letters the Syrian delegation sends to the Security Council, and no matter how much Damascus portrays itself as the innocent victim of external aggression and terrorism, its deadly action on the ground speaks for itself. We also encourage the opposition in Syria and beyond to work towards a unified political platform. On Friday, the Council met with the independent international commission of inquiry the Syrian Arab Republic. Its findings show a clear pattern of gross and systematic human rights violations committed by the Syrian authorities and orchestrated at the highest level. Abuses are also being committed by the anti-Government groups, although not comparably in scale and organization. It is my Government's firm conviction that accountability for such grave violations of human rights has to be ensured.”

“That was not the first time that Damascus has taken violence beyond its borders. But this time, the bombs not only killed an innocent Turkish woman and her four children, but they also violated the sovereignty and territorial integrity of our NATO partner. The Security Council unequivocally condemned the shelling in the strongest terms. Despite all divisions, the Council has sent a clear message that it will not tolerate Damascus threatening regional peace and security. We continue to hope that the Council will also soon find unity in supporting a political transition process to a new post-Al-Assad Syria. Let me be clear.”

“Allow me to thank Under- Secretary-General Jeffrey Feltman for his insightful briefing. Last month, the Council met for a high-level debate on peace and security in the Middle East. The Secretaries-General of the United Nations and of the League of Arab States both called for a fresh and united approach by the international community to a changing Middle East. In that spirit, we adopted a presidential statement encouraging closer cooperation between the United Nations and the Arab League (S/PRST/2012/20) - ajoint commitment that must now be brought to life. Above all else, we must together address two pressing issues: the crisis in Syria and the Israeli- Palestinian conflict. Let me start with a few points on Syria. With the shelling of Akcakale, Turkey last week, the crisis there has reached yet another nadir.”

“The Secretary- General's proposal that MINUSTAH further concentrate its efforts on mentoring and developing the Haitian National Police, and gradually phase out operational policing activities, goes in the right direction. A corresponding reduction of MINUSTAH'S troops, as proposed by the Secretary-General, seems feasible but requires a further build-up of the Haitain police. That is why clear benchmarks will be required as foreseen in MINUSTAH's reconfiguration and consolidation plan. Finally, I would like once again to thank the troop - and police-contributing countries for all their efforts. We will continue to give our full support to the Mission and to the Government and people of Haiti.”

“Security and stability should increasingly be provided by an effective Haitian National Police. We welcome President Martelly's stated intention to focus on the continued strengthening of that institution, so that it can provide security throughout the entire territory of Haiti. We are encouraged by recent steps undertaken by the Government to increase the number of police recruits, in particular female ones. The United Nations Stabilization Mission in Haiti should not be in charge of long-term reconstruction efforts. The Mission needs to continue to draw down its post-earthquake surge in activities. In that sense, I welcome the suggestions contained in the Secretary- General's report (S/2012/678) about MINUSTAH's reconfiguration and consolidation plan.”

“At the same time, we are concerned about the refusal by the Haitian Senate and Parliament to name their representatives to the Permanent Electoral Council and about the recent withdrawal of the three members nominated by the Superior Council of the Judiciary. A functioning Electoral Council is indispensable for the elections mandated by Haiti's Constitution. All parties need to make a renewed and speedy effort towards a credible Permanent Electoral Council with all members on board. Preparations for the elections must begin without further delay. We are encouraged by the progress reported on the security front, including Government measures to contain elements of the former armed forces who had been illegally occupying sites throughout the country.”

“Agreement on seven concrete confidence-building measures has been achieved, which will contribute to fostering cooperation in the region and thus to stability and prosperity. We look forward to supporting this process. We are offering our specific expertise in the areas of regional infrastructure and chambers of commerce. We welcome the initiative taken by the Government of Afghanistan to hold a meeting for senior officials here in New York in the coming week to take this process a step further. Thirdly, the number of civilian casualties has been reduced. “The Tokyo Mutual Accountability Framework is of paramount importance in achieving Afghanistan's governance and development objectives. Germany looks forward to sustained progress in the five key areas agreed on in Tokyo. We encourage the Afghan Government to finalize its national priority programmes and to transform them into "vehicles for tangible development results", to quote the Secretary- General's report (S/2012/703). My country has pledged $560 million annually in contributions to the implementation of Afghan Government priorities. “They were working closely with their colleagues from the German police project team in Afghanistan. Today I would like to focus on three key issues. The first is that the Tokyo Conference has complemented a series of international conferences on Afghanistan. At those conferences - Bonn, Chicago, Kabul and Tokyo - the Government of Afghanistan and the international community agreed on a long-term partnership and a framework for Afghanistan to assume full responsibility for its security and development. The challenge ahead is now achieving a swift and comprehensive implementation of the decisions taken at those conferences. Germany remains committed to supporting Afghanistan in its efforts to do so and to achieve stability, economic growth and development.”

“In the same context, Ambassador Osorio's 90-day report underscores the pressing relevance of that issue. Therefore, the consistent implementation of sanctions by all Member States is crucial to maintaining the pressure on Iran. We encourage the Committee to take swift action. Based on the recommendations contained in the final report of the Experts, first measures should aim at operationalizing new designations and updating the existing listings of sanctions violators as soon as possible. There is no alternative except to continue to work towards a diplomatic solution. But we cannot hold talks for the sake of talks. If Iran does not engage in serious negotiations, we will have to increase pressure by further strengthening the sanctions regime. It is now high time for Iran to live up to its international obligations.”

“Moreover, Iran's continued refusal to cooperate with the IAEA increases concerns about a possible military dimension of Iran's nuclear programme. In a first reaction to the IAEA report, the European Union's three plus three group co-sponsored a resolution urging Iran once more to comply fully and without delay with all its obligations. Likewise, we remain deeply worried about Iran's renewed ballistic missile launches of early July 2012, using missile technology that is in clear violation of paragraph 9 of resolution 1929 (2010). We reiterate our deep concern over the continued weapons exports from Iran to other countries, especially to Syria. Those concerns are aggravated by unsettling recent reports indicating that Iran is shipping arms to Syria under a humanitarian pretext.”

We are grateful for his able leadership, which has contributed so much to ensure that the Committee established pursuant to resolution 1737 (2006) remains focused on implementing its important mandate. More than two years ago, the Security Council adopted resolution 1929 (2010), in response to Iran's continued non-compliance with its international obligations. To this date, Iran has not engaged seriously, and without preconditions, in talks aimed at restoring confidence in the peaceful nature of its nuclear programme. The latest report of the International Atomic Energy Agency (IAEA) of 30 August (GOV/2012/37) is alarming. It shows a massive increase in the 20 per cent enrichment capacity.”

“We walked the extra mile, but we could not do one thing - compromise on the integrity of existing and, so far, accepted mechanisms of the United Nations. That would have been irresponsible. I hope that the wish to strengthen the existing United Nations system to protect children in armed conflicts will unite us all, although a few members might have different opinions on the way forward. In closing, 1 would like to reiterate Germany's hope that the Security Council will keep up its good work on this important issue. Our ambitions for this agenda must remain high. We owe it to the children. We owe it to them as the most vulnerable group of our society. We owe it to them to spare no effort in enhancing the protection of their rights in armed conflict. “Germany is gratified that the Security Council today once again adopted a resolution (resolution 2068 (2012)) that underlines the importance of the work of the Special Representative of the Secretary-General for Children and Armed Conflict, that reiterates the Council's readiness to adopt targeted and graduated measures against persistent perpetrators, and that authorizes annual reports of the Secretary-General. It goes without saying that we would have preferred a consensus decision on the resolution we adopted today. We regret that some members chose not to support that resolution. We had one week of extensive discussion, and we, as penholder, made an extra effort to accommodate all delegation's concerns.”

“Perpetrators of crimes against children need to be held accountable. This goes especially for the alarming number of so-called persistent perpetrators. The Security Council needs to look at new ways to address the issue. The report of former French Ambassador De la Sabliere provides a good overview of possible options. Let me mention just two. One option that Germany favours is that the Security Council increase its political engagement, for example, through sessions dedicated to the issue. The second option we should pursue is that the Security Council make more use of targeted measures against individual perpetrators through sanctions committees, starting with the expansion of existing sanctions committee mandates. We should take those suggestions forward in our future discussions.”

“New parties have been listed for the recruitment and use of children and for the killing and maiming of children. There have also been first listings for attacks on schools and hospitals. What can we do better? First, we should explore ways to improve the existing protection framework. Child protection and child protection training should be an integral part of all peacekeeping and special political missions. In that regard, we strongly commend the efforts of the Department of Peacekeeping Operations and Department of Political Affairs to develop a joint Child Protection Policy. Child protection issues and, in particular, the release and reintegration of children, need to be systematically included in peace negotiations and agreements. Secondly, we need to address the issue of accountability.”

“We have to increase our joint efforts to stop and prevent heinous crimes committed against children. It has to be said that, since 2005, encouraging progress has been made. Twenty action plans have been signed by parties to conflict. Consequently, tens of thousands of child soldiers have been released. This is a remarkable achievement of which the United Nations and the Security Council can be proud. The recent convictions of Thomas Lubanga and Charles Taylor have made clear that accountability for the recruitment and abuse of children is advancing. But we must not be complacent. There is still reason for concern. The listings of new parties in the Secretary-General's report (S/2012/261) are proof of the seriousness of the problem.”

I wish to draw the attention of Council members to document S/2012/643, which contains the report of the Secretary-General on Somalia. Members of the Council have before them document S/2012/708, which contains the text ofa draft resolution submitted by France, Germany, Italy, Morocco, Portugal, South Africa and the United Kingdom of Great Britain and Northern Ireland. It is my understanding that the Council is ready to proceed to the vote on the draft resolution before it. I shall put the draft resolution to the vote now. A vote was taken by Show ofhands.”
