“The only livestock that I have seen challenging pheasants have been pigs, who seemed to be intent on eating them. Amendment 105, in my name, removes damage to livestock from the list of situations in which a tenant is entitled to be compensated by the landlord for damage resulting from game or game management. Amendment 348 is a simple amendment that would change the definition of “game” in the bill to remove grouse. When I met the cabinet secretary, she kindly recommended to me a book called “Fair Game: The Law of Country Sports and the Protection of Wildlife” by Charlie Parkes and John Thornley. With a little bit of help, I managed to find it on Amazon and to buy it and read it. The cabinet secretary said to me that my amendment on the subject would be wrong, because grouse should be included in the definition of “game”.”

Amendment 105, in the name of Edward Mountain, is grouped with amendment 348. Edward Mountain: In 40 years of managing farmland and farming, and 15 years of managing upland estates, I have never yet been able to quantify in my mind what damage game can do to livestock. Sheep and deer seldom mix; and deer and cattle stay apart. I have yet to see a pheasant or a partridge chase a cow. If someone can tell me about their experience of that in the countryside I am happy to be corrected, but I have not seen it. I genuinely wonder what section 20 is trying to achieve. Perhaps at this stage I can say, tongue in cheek, that I do not believe that cows are frightened of pheasants.”

Amendment 228, in the name of the cabinet secretary, is the only amendment in the group. Mairi Gougeon: Amendment 228 makes a minor drafting change to clarify the procedure when a landlord notifies a tenant that they object to or are imposing conditions in relation to a proposed diversification by the tenant. The bill currently requires the landlord to explain to the tenant why the grounds for objecting to the diversification or the conditions imposed are reasonable. The amendment clarifies that such reasons are to be given in the same notification as the one that notifies the tenant of the objection or conditions imposed, and not separately.”

“At some stage, if notice has been served and the other side wishes to challenge it, it will be on the assumption that whoever posted the notice has to sign a bit of paper to swear that they have delivered the letter. That is not a way to go forward; the way to go forward is to have a form of recorded delivery, so that people can see that notices have been delivered, which each side would understand. For that simple reason, I do not accept the cabinet secretary’s comments. I agree with amendments 226 and 227, in the name of the cabinet secretary. They go a long way towards addressing some of the issues that I raised in relation to amendment 99. I might be in a position to reconsider moving that amendment, having heard what the cabinet secretary has said. I press amendment 220.”
“The amendment would turn guidance into a mandatory rule, which is not the purpose of paragraph 2. It creates a real risk that some modest changes would require consent that they would otherwise not need. With that, I urge members to support the amendments in my name and to oppose Edward Mountain’s amendments in the group. Edward Mountain: I have listened to the cabinet secretary ask members not to vote for my amendment 220 and those that relate to it. I do not yet understand why it is automatically assumed that, if you post a letter, you receive it. That does not always happen, and it does not stipulate whether the notice should be sent by letter, email, recorded delivery, special delivery or any other means.”
“Amendments 226 and 227 update the list of improvements that are presumed to facilitate and enhance sustainable or regenerative agricultural production for the purposes of the Scottish Land Court’s determination of whether to approve a relevant improvement. They remove from the list the creation of species-rich pasture and the conversion of a holding to organic farming, because their inclusion is now redundant, as the Land Court is no longer required to approve them since they were listed in part 3 of schedule 5. Edward Mountain’s amendments 220 to 223 and 225 remove and reverse various provisions in section 14 that are key for transparency. Amendment 99 would impose a blanket requirement for landlord consent, even when it might not be necessary or appropriate.”
“Such improvements include irrigating land, making or planting osier beds, making or planting short rotation coppice and so on. The amendment would clarify that consent must be required for those improvements, because they would result in a considerable change to the land usage. I move amendment 220. Mairi Gougeon: At stage 1, following evidence from tenant farming stakeholders, I promised to clarify the terms of new schedule 5 to the 1991 act, and I made good on that promise at stage 2. My amendments today provide further clarity where that is needed. Amendment 224 fixes a minor drafting error in schedule 5.”
“Amendment 221 would remove the requirement for a landlord to provide reasons in writing for the refusal of consent for a tenant’s improvement. Amendment 222 is related and would remove the 70-day period within which a landlord must give a tenant the reasons for refusal. Instead, a landlord would need to give the reasons for refusal within a “reasonable” timescale if a tenant asked for reasons to be given. Amendment 225 would require the bill to include a definition of “sustainable and regenerative agricultural production”, instead of ministers being obliged to define it in regulations. I am probably not the only farmer who is looking to understand what that means. Amendment 99 would provide that consent must be required for certain improvements listed in new schedule 5 to the 1991 act, on pages 61 and 62 of the bill.”
“I, along with probably many other people, have been caught out by not getting mail that was supposed to have been delivered. I get mail three days a week, but they are not always the same days every week, so people cannot rely on the mail. Through amendment 220, I am trying to introduce the assumption that—[Interruption.] I am sorry— does somebody want to intervene? The Presiding Officer: No. Please continue, Mr Mountain. Let us ensure that we can hear one another, colleagues. Edward Mountain: I am trying to ensure that, if a notice is served, both sides know that it has been served and it is responded to. Section 14—Compensation for improvements The Presiding Officer: Group 26 is on compensation for improvements. Amendment 220, in the name of Edward Mountain, is grouped with amendments 221 to 227 and 99. I point out that, if amendment 225 is agreed to, I cannot call amendments 226 and 227 due to a pre-emption. Edward Mountain: Amendment 220 would reverse the current assumption in the bill that a landlord has consented to a tenant’s request for an improvement to the land if they do not respond to a notice requesting consent. I have lodged the amendment for the same reason that I lodged a similar amendment to the Housing (Scotland) Bill: there is no stipulated way for serving notices.”

“There needs to be a co-ordinated approach across the wide range of policy areas and at different levels of government. That is something that we say in the chamber a lot, but we need to improve the delivery of that approach, so I would be interested to hear from the minister what plans she has to try to take it across policy areas. Many members have mentioned key recommendations that they hope that the minister will do further work on. We know that there are difficulties in accessing advice. Where is that advice? How easy is it for people to access it? What do we have in place to ensure that we get that trauma-informed training for members of staff? What would the introduction of a national roll-out of the fund to leave look like? It is important that we get some answers.”
“Sometimes, we forget how difficult it can be for people to give such evidence—for the victims, of course, but also for the staff who work in our policing, housing and social services. It is difficult for them to offer support again and again, because we are not always getting those solutions for people. The discussions with women with lived experience, the visit to Financially Included, which Bob Doris mentioned, as well as the evidence sessions on the wide range of relevant policy areas, such as housing, social security, legal aid, public debt, immigration status and policing, have paid dividends. The Government should methodically look through and respond to the recommendations. We have also heard from members across the chamber that the themes in the recommendations that we have all mentioned need to be co- ordinated.”
“15:33 Carol Mochan: In closing, I say again how significant the report is in contributing to the change that we all know needs to be made for women and girls who are fleeing domestic abuse. Jackie Dunbar’s example is still ringing in my ears. It is difficult for women to leave such situations, and we all need to try to fix that and find solutions. Scottish Labour fully supports the report and we want to work with the Government to ensure that we can deliver on its recommendations. Delivery is crucial. I commend the committee for holding the inquiry during the first half of 2025. Timeframes are tight for some of the committees, so it is important that it managed to hold the inquiry. “There are delays in the Scottish welfare fund, a five-week wait for universal credit that drives women into debt before they even leave and split payments that are still undelivered after eight years. This is a moral test for our Parliament. We cannot claim to stand against gender-based violence while tolerating systems that tie survivors to their abusers through poverty and bureaucracy. Financial independence is safety. Economic justice is freedom. Real justice means building a society in which no woman has to weigh her safety against her solvency. I look forward to the day when no one in Scotland is trapped in an abusive home for financial reasons and when our legal, social security and housing systems are not barriers but bridges to freedom and dignity. That day cannot come soon enough.”
“No woman should be chased for debts that were created through her abuse. No one should lose a home for trying to survive. The committee’s findings on public debt also make clear how the state can perpetuate economic abuse, from council tax collection to housing arrears. We must end the shaming of survivors through punitive debt recovery. On legal aid, as we have heard clearly this afternoon, the committee’s evidence was damning. Scarcity, bureaucracy and inadequate funding mean that survivors face impossible choices. Legal aid cannot be a postcode lottery or a privilege for the well-resourced—it is a human right. The Scottish Government’s commitment to reform is welcome, but reform must mean universal trauma-informed access, not further review and delay. The evidence on social security is just as stark.”
“Imagine the exhaustion and retraumatisation of retelling your story to strangers again and again, simply to survive. The report calls for trauma-informed training across all agencies. It should be mandatory. Every interaction, whether it be with a housing officer, benefits adviser or solicitor, can either empower a survivor to take the next step or drive them back into danger. The Scottish Greens have long argued that homelessness and abuse are inseparable issues. The report highlights that 5,000 people become homeless each year because of domestic abuse and many of them lose their homes while the perpetrators remain in place. That is why I am proud that Ross Greer’s amendment to the Housing (Scotland) Bill means that the Scottish Government is now required to review council tax arrears when domestic abuse is a factor.”
“I refer colleagues to my entry in the register of members’ interests. Prior to my election, I worked for a rape crisis centre. I apologise—I should have said that earlier. I begin my closing speech by thanking the Social Justice and Social Security Committee members, clerks and, most importantly, the women of the survivor reference group, whose experiences and insights make the report so powerful. Their testimony leaves us in no doubt. Financial barriers are among the most effective tools that abusers use to trap and punish. Too often, those barriers are reinforced, not dismantled, by our public systems. The committee found that women might have to contact 11 different services before finding the support that they need, or 17 if they are from a minority ethnic background.”
“The surviving economic abuse project reminds us that women who are unable to find even £100 at short notice are three and a half times more likely to experience domestic abuse. That is why a secure, unconditional income through universal basic income or genuinely fair social security is not a utopian dream but a life-saving necessity. The victims and survivors whose voices shaped this excellent committee report have survived unimaginable hardship. Our task now is not to admire their resilience but to ensure that no one else is forced to rely on it. 15:02”
“The committee heard from women whose applications were rejected because the fund had run low. Women were forced to go into debt just to heat their homes, which is not what a safety net should look like. Economic abuse is not simply a symptom of domestic abuse; it is a deliberate strategy of control. The committee heard how single household payments of universal credit allow perpetrators to dominate their partners financially. As Engender and Scottish Women’s Aid told the committee, “The single household payment is a gift to perpetrators of domestic abuse”. Next year will mark 10 years since the Parliament was empowered to introduce split payments and eight years since the Scottish Government was required to act. If it were a priority, it would have been done by now. We must look more broadly, too.”
“Legal services must be free for all women, children and young people who experience domestic abuse, with no means testing, clawback or arbitrary limits in place. I look forward to the Scottish Government’s response to Dr Marsha Scott’s principled proposal. The committee also recognised the Scottish Government’s fund to leave pilot, which was a scheme that helped more than 500 women to rebuild safety with grants of up to £1,000. It offered what Citizens Advice Scotland described as a “deep psychological reassurance”—a cushion that made leaving possible. However, as the report highlights, although around 5,000 people are registered as homeless due to domestic abuse, the support reaches only a fraction of those in need. It must be expanded and made permanent. The Scottish welfare fund can help, but it is stretched and inconsistent.”
“Indeed, as Karen Adam mentioned, the Equalities, Human Rights and Civil Justice Committee has also found that. We have heard that women who seek representation might have to approach between 30 and 50 solicitors in order to find one who is able and willing to take their case. That is not justice; that is abandonment. Legal aid is means tested, but survivors of abuse should never be subjected to a financial test to prove their right to safety or protection. Dr Marsha Scott of Scottish Women’s Aid put it perfectly when she asked: “How are you following Scottish policy in every other area connected to domestic abuse if you are means testing people who are subject to financial and economic abuse?”—[Official Report, Equalities, Human Rights and Civil Justice Committee, 20 May 2025; c 13.] She was absolutely right.”
“Poverty, inequality and unresponsive, sometimes heartless, benefits and justice systems trap people—overwhelmingly women—in abusive homes. The report from the Social Justice and Social Security Committee that is before us today lays bare the structural cruelty that allows economic abuse to flourish and the practical barriers that make it so desperately difficult for women to leave. The report tells us clearly that financial dependence is not accidental; it is a predictable consequence of unequal power, austerity and underfunded support. Equality before the law is a founding principle of our justice system, but that principle means little when survivors cannot access proper legal representation. The Law Society of Scotland has described domestic abuse as a legal aid desert, and the committee confirmed that reality.”

“The national collaborative’s charter of rights offers a strong foundation, and it includes the voices and experiences of the people it is meant to serve. It gives voice, agency and dignity to those who are most affected. We should strengthen that framework and not supplant it. With respect for the intention behind the bill, but with deep regret and concern about its consequences, we cannot support the bill today. However, our rejection of the bill is not a rejection of recovery. It is a call for better services, better understanding and better compassion, because everyone deserves the chance to recover, not through legal wording but through a society that truly cares. We reiterate our commitment to play our full part to ensure that we create that caring society.”
“The changes that are required to it would result in a very different piece of legislation. We know that we need legislative reform, some of which is not in our gift. It is clear that Westminster legislation hampers rather than supports the approach that we seek to take in Scotland. Annie Wells: [Made a request to intervene.] Graham Simpson: Will the member take an intervention? The Deputy Presiding Officer: The member is about to conclude. Maggie Chapman: Some members who are arguing in support of the bill today say that this is the last opportunity to do anything about addiction in the current session of Parliament. That is simply not true, and we know that legislation is never the whole solution.”
“None of us wants that. Addiction is not just a medical condition; it is a social justice issue. Poverty, trauma, inequality and isolation are its soil. We must nurture recovery not only through treatment but through housing, mental health support, community connection and dignity. That is why the Scottish Greens call for continued investment in holistic, community-based services; for trauma-informed care that recognises the person before the patient; for harm reduction measures that save lives today, such as safer drug consumption facilities, access to naloxone, and housing first; and for ending the stigma that too often drives people away from support. We do need legislation, but it must be constructed in ways that mean that it can actually achieve its aims. We do not have that in the bill.”
“People could end up in preparatory sessions that are counted as treatment, rather than getting the care that they need. That is not compassion; that is bureaucracy. The committee also heard that the bill’s language, which is centred on “addiction” and “diagnosis”, could deepen stigma. Emma Harper eloquently highlighted that. In addition to what she outlined, many people harmed by substance use would not fit the definition and might therefore be excluded, which would run directly counter to the inclusive, trauma-informed approach that Scottish Greens believe must underpin all public health work. There would be risks in creating legally enforceable rights that the NHS could not deliver on. If people turned to the courts because services were overstretched, we would spend precious resources and time on litigation rather than on care.”
“The committee’s report highlights deep concerns that that approach could undermine the progress that is already being made through the national mission on drugs, the medication assisted treatment standards and the charter of rights for people affected by substance use. Those frameworks are built on human rights, empowerment and lived experience. They aim to shift power towards people in recovery, while the bill risks shifting power back to institutions. I echo the concerns expressed by Patrick Harvie and Alex Cole-Hamilton about the bill’s three-week statutory deadline for treatment. It sounds good, but it would be unworkable in practice and could backfire, by pressuring services to tick boxes rather than provide meaningful support. As the SDF has warned, we have seen before how targets can distort behaviour instead of improving outcomes.”
“Why does she believe that she knows more than the front- line experts who tell us that the bill is required? Maggie Chapman: A lot of the front-line experts have told us the exact opposite and said that the bill threatens to cause real harm. As the committee found, and as Rona Mackay stressed earlier, the bill risks entrenching a narrow, medicalised model of treatment. It gives decision-making power solely to health professionals, when we know that real recovery depends on relationships, trust and communities and on support that meets people where they are. As the minister articulated earlier, by focusing so heavily on a clinical diagnosis and prescribed treatments, the bill ignores the wider psychological, social and economic roots of addiction.”
“What is perhaps more troubling for us is that, according to experts in the field, the bill risks doing real harm along the way. The question is not about whether people should have a right to recovery—of course they should. The question is about whether this particular bill would make that right real, and the evidence before us says that it would not. The Scottish Drugs Forum has been clear that the bill would not confer any meaningful new rights. People already have the right to assessment and treatment; what they often lack is access to good-quality, trauma-informed, person- centred support. That access is blocked not by law but by capacity, workforce pressures, stigma and a lack of properly funded services.
