Despite the serious humanitarian implications of the military confrontations in the fraternal Sudan and despite the Arab League’s efforts to bring about an immediate ceasefire between the Rapid Support Forces and the Sudanese Armed Forces and reach an internal consensus among all military and civilian Sudanese stakeholders on a political settlement for re-establishing civil rule in the country, the Arab League reiterates the position expressed by the Group of Arab States in New York in a letter sent to the President of the Security Council and the Secretary-General dated 3 February, in support of the Sudanese Government’s request for the sanctions imposed by resolution 1591 (2005) and other relevant resolutions to be lifted without any preconditions, as the Council did in relation to lifting the arms embargo on Eritrea in resolution 2444 (2018).

  3. The Arab League welcomes the recent exchange of prisoners in Yemen. Furthermore, we would also like to express our appreciation for the constructive role played by the United Nations in offloading the FSO SAFER oil tanker so as to avoid any environmental or security disaster in the Red Sea. We support all efforts made to provide the necessary funding for a comprehensive political settlement in Yemen as well as the intensive political efforts made to reach such a settlement.

The League of Arab States expresses its concern that the Security Council does not have sufficient unity with regard to cross-line and cross-border mechanism for delivery of humanitarian assistance in Syria, despite the Security Council co-penholders’ constructive solutions and Syria’s unilateral sovereign decision to open the Bab Al-Hawa crossing for the United Nations humanitarian support to reach north-west Syria for six months. The Arab League calls on the Council to intensify its joint work with the Syrian Government to overcome the acute humanitarian crisis faced by the Syrian people. All parties should come together on this matter, while ensuring the independence and objectivity of the delivery of humanitarian aid, respecting the territorial integrity and sovereignty of Syria and providing adequate funding.

The thirty-second Arab summit, which was held in the Kingdom of Saudi Arabia, took a pivotal decision to reinstate Syria’s suspended membership in the Arab League and to give further attention to the Syrian issue in order to reach a peaceful comprehensive settlement that helps Syria regain its standing. That can be achieved by respecting Syria’s sovereignty over its territories and eliminating any unauthorized foreign presence therein, including by ending the Israeli occupation of the Arab Syrian Golan. The increased activities by terrorist organizations on Syrian territory must also end. The Arab League appreciates the support of the international community to those ends, despite some having reservations.

To ensure that the Council is capable of doing that, the principles of international accountability that are applied in other countries need to be upheld, especially with regard to any Israeli who commits violations on the Palestinian occupied territories. This week, many countries and organizations submitted their legal views to the International Court of Justice on the illegitimacy of the Israeli occupation of Palestinian territories. The Arab League was one of the organizations to express its views. We are looking forward to the advisory opinion of the Court requested by the General Assembly in its resolution 77/247, which will lay a new solid legal foundation in support of international legitimacy.

Despite false accusations and continuous attacks by the Permanent Representative of Israel against the United Nations and the Security Council, the Arab League emphasizes that it is the responsibility of the Security Council and the Secretary-General to implement the proposals set forth in his 2018 report on the protection of the Palestinian civilian population (A/ES-10/794), prevent any further deterioration of the Palestinian people’s security and set up a mechanism for ensuring international protection for this defenceless people and their holy sites, in particular Al-Aqsa Mosque, but also other Muslim and Christian holy sites. Israel must respect the Hashemite Jordanian custodianship of those holy sites.

Despite the apparent similarity among those issues, particularly those involving to the occupation of lands of others by force, the Council has chosen to apply a double standard in dealing with the Ukrainian issue, providing it with all kinds of support — institutional, logistical and financial — while minimizing the international community’s support for Palestine amid the current deteriorating conditions. The Israeli Government intends to deploy special security forces in support of settlers who are illegitimately attacking the defenceless Palestinian people, all of which is in violation to all Israel’s obligations as the occupying Power. The current situation is exacerbated by the absence of any prospects for a settlement by the Middle East Quartet or the Security Council itself. The Council has not convened a meeting of the Quartet in a very long time. The well- known reasons stem from the ongoing confrontations and tensions in the Security Council relating to other issues that are strongly preoccupying its members and the international community.

It is no secret that one of the most important and malicious goals of the extremist right-wing Israeli Government is to do away with the two-State solution and any chance to build an independent Palestinian State with Jerusalem as its capital. It is doing that by continuing its expansionist settlements and construction policies that violate resolution 2334 (2016), including displacement, confiscation and demolition measures and support for Israeli settlers while intensifying its attacks in order to change historical reality on the Palestinian territory, particularly in East Jerusalem, the capital of the independent Palestinian State.

I would like to thank Assistant Secretary-General Khaled Khiari for his comprehensive briefing today, and I align myself with the statement to be delivered by the representative of Yemen on behalf of the Group of Arab States. We gather today to discuss a very complex and sensitive regional situation in the Middle East that has resulted from the challenges that Israel, the occupying Power, is continuing to pose to the will of the international community and the United Nations. It continues to violate international law, international humanitarian law and international human rights law in the occupied Palestinian territory, without being held internationally or criminally accountable.

We underscore the importance of reviving the role of the Middle East Quartet in order to prepare for convening the international peace conference that has long been called for by Palestinian President Mahmoud Abbas before the Council and the General Assembly. It is necessary to launch an integrated negotiations process between the Palestinian and Israeli parties on all five final-status issues while maintaining the full commitment not to seek to alter the status quo on the ground in any way until a final political settlement is reached. I also reiterate the citment of the League of Arab States to ending the Israeli occupation of the occupied Syrian Arab Golan, in accordance with the relevant international terms of reference, and to maintaining regional peace and territorial integrity in Syria and Lebanon.

Respecting the rule of law when addressing the Palestinian question at the United Nations is inevitable, as is ensuring respect for the international legitimacy established in this Organization; justly and honestly implementing the two-State solution; and refraining from altering the situation on the ground through unilateral measures. Only negotiations between the Palestinian and Israeli sides can lead to a solution. From that standpoint, the League of Arab States calls on the Security Council to assume its full responsibilities in defending international legitimacy and the rule of law and confronting the grave violations of the new Israeli Government in Al-Aqsa Mosque, while ensuring that they do not reoccur.

In Tel Aviv on 15 January, 80,000 Israelis protested against the plans of the extreme right-wing Government to introduce legal amendments that make it easier for the Parliament to cancel rulings issued by the Supreme Court, thereby undermining the independence of the judiciary and supporting corruption. It is clear that such amendments contradict the most basic values of democracy and accountability. The League of Arab States aligns itself with the call made by the Secretary-General during the high- level open debate of the Security Council on the subject of the rule of law (see S/PV.9241).

It is shameful and deplorable that Israel has committed all of those violations despite receiving repeated warnings, including the open letter from more than 300 American rabbis stating that the new Israeli Government’s practices have caused irreparable damage to Israeli relations with the Jews in the diaspora, and the open letter from 100 Israeli ambassadors and former officials in the Israeli Foreign Ministry to Prime Minister Netanyahu in Le Monde newspaper on 9 January expressing their grave concern about the new Government’s practices, which constitute a flagrant violation of the democratic identity claimed by Israel. Those violations have proved that the Israeli Government is not, unfortunately, sincere in their claims.

Israel’s deliberate actions and wilful violation of the sanctity of the Al-Aqsa Mosque, as well as its frantic endeavour to alter the historic status quo in Jerusalem and its persistent arbitrary punishment of the Palestinian Authority, is considered by the League of Arab States as a punishment aimed against the entire United Nations system, including the Security Council, the General Assembly and the International Court of Justice itself. The League of Arab States also considers all of those actions as a sign of disrespect of the United Nations Charter, the international rules and values which underpin the multilateral international community and the democratic decision-making approach. Meanwhile, Israel claims falsely to be the biggest democracy in the region.

There was no response after the emergency meeting convened by the Japanese presidency at the request of the Arab League with a number of Council members on 5 January (see S/PV.9236), at which we witnessed a feverish attempt by the Israeli representative to distort the steadfast historical and legal facts. All of that has encouraged the extremist Israeli Government to adopt, the day after that meeting, further unjust punitive and provocative measures against the Palestinian people and their leadership, including by confiscating millions of dollars due to the Palestinian Authority, placing a ban on granting travel permits to senior officials of the Palestinian Authority and even prohibiting the raising of the Palestinian flag.

Despite the international calls addressed to the entire international community, particularly the Security Council, to deal with those violations through effective measures that would oblige the new Israeli Government, as the occupying Power, to adjust its course, reverse its aggressive policies and cease its attacks on the Palestinian people and its violations of international law and international humanitarian law — as well as to ensure that it does not take any additional provocative steps in Al-Quds Al-Sharif that would cause great distress to millions of Muslims around the world and threaten security and stability in the region — the Security Council has failed to respond in any way to those violations.

  23. The Arab Ministerial Committee mandated to address the illegal Israeli policies and measures in the occupied city of Jerusalem condemned those violations in the strongest terms. Such acts will effectively eliminate the prospects for a two-State solution and the establishment of an independent Palestinian State with East Jerusalem as its capital within the borders of 4 June 1967. The League of Arab States, along with the rest of the world, was shocked by the recent grave Israeli violations in the occupied city of Jerusalem, in particular the storming of the Al-Aqsa Mosque/ Al-Haram Al-Sharif by a minister in the new Israeli Government on the morning of 3 January under the guard and protection of the occupying Power’s military and police forces. That provocative step constituted a flagrant violation of international law, as well as of the historic and legal status quo in Jerusalem and its holy sites. It also demonstrates blatant disrespect for the Hashemite Kingdom of Jordan’s custodianship of the holy sites.

It has destroyed all prospects for achieving a just and comprehensive solution to the situation in the Middle East, at the heart of which lies the Palestinian question, which is a central issue for the League of Arab States and the entire Arab world. The new Israeli Government has dashed all hopes for peace by asserting its intention to expand settlement activities in stark violation of resolution 2334 (2016), which will include forced displacement and the demolition of homes and communities and expulsion of refugees, in an effort to alter the historic and actual status quo on the ground and tighten Israeli control over all the occupied Palestinian territories.

  27. Allow me to begin, Mr. President, by congratulating you and Japan on your election as a new non-permanent member of the Security Council and on presiding over the Council this month. I also thank Mr. Tor Wennesland for his briefing today. There is no doubt that the Palestinian situation is currently experiencing one of its worst phases, at the same time as international liquidity is constrained by multiple international crises and sudden changes in the political inclinations of the world’s major Powers for reasons unrelated to our region. The time has come for the Council to realize that its credibility is at stake; that the international move towards the establishment of a Palestinian State with Jerusalem as its capital will not stop, but will continue and increase, with the full support of the Arab countries and the Arab League; and that the Council’s failure to deal effectively with the Palestinian question will only lead to a greater orientation towards the General Assembly, the Human Rights Council, the International Court of Justice and the International Criminal Court in order to enhance the strength of democracy, the strength of human rights and the force of law, which transcends the strength of geopolitical conflicts.

Israel must also be stopped from preventing Jerusalem residents from participating in local elections, especially following the international and regional support for the declaration adopted in Algeria this month and the signing of the agreement for the reunification and national reconciliation of the Palestinian people, which will pave the way for holding the delayed Palestinian elections, with the support of Egypt, Qatar, other Arab countries and other parties working to achieve Palestinian reconciliation. The international multilateral system has suffered and continues to suffer from double standards and their consequences in the work of the United Nations organs, especially the Security Council.

That would lead to the protection of the defenceless Palestinian people, while supporting the efforts of the Hashemite Kingdom of Jordan and the Kingdom of Morocco to protect Islamic holy sites from the oppression of the Israeli forces and settlers. That would also ensure that Israel does not enact laws perpetuating the apartheid regime against the Palestinian people or Jewish State law, which has been rejected by the Arab world and the international community, and that Israel does not repeat the unaccountable assassination of Palestinian journalists for exposing Israeli violations.

Until that happens, and to ensure that the Palestinian leadership and people do not lose hope or that matters do not reach the brink of explosion or spin out of control — and after we all heard the statement delivered by President Mahmoud Abbas at the general debate of the seventy-seventh session of the General Assembly and the bitter appeals it contained in that regard (see A/77/PV.10) — urgent international decisions and steps are required to ensure the expansion of the circle of international recognition of the State of Palestine and to ensure that the State of Palestine is granted full membership of the United Nations.

It is not enough for the Israeli leaders and their supporters in the General Assembly to express their support for the two-State solution; they must work to translate words into practical deeds by engaging in serious negotiations with the Palestinian partner based on that important principle and in compliance with the terms of reference of international legitimacy. The Security Council, and specifically the international Quartet, play a very pivotal role in lighting the first spark of those negotiations, leading to the international conference repeatedly called for by Palestinian President Abu Mazen before the Council and before the General Assembly.

The Arab countries have also voted and will vote in favour of all resolutions calling for an end to the Israeli occupation of the Palestinian territories and for the start of serious peace negotiations between the Israeli and Palestinian parties on the basis of the two-State solution, the principle of land for peace, the Arab Peace Initiative and the relevant resolutions of the Council. They will also vote in favour of other political, economic and social decisions and resolutions adopted on the Palestinian question by the main United Nations organs, especially those extending the mandate of the United Nations Relief and Works Agency for Palestine Refugees in the Near East for three years. That is the credibility that Israel and other countries that support it unfortunately lack.

After I heard the statement by His Excellency the Minister for Foreign Affairs of Hungary in the Council today, and to demonstrate the credibility of the Arab countries and their observance of the required balance in dealing with the binding rules of international legitimacy, the Arab countries have voted in favour of the two General Assembly resolutions on Ukraine, sending a clear message to the international community that Arab countries reject the occupation of others’ lands by force.

Nor is it logical to interpret Israel’s indication in its statement today that normalizing its relations with some Arab countries means abandoning the centrality of the Palestinian question in the Arab world or giving up the principle of the two-State solution, which has been and will continue to govern the peace process in the region, or even as a transformation of the principle of land for peace to the principle of peace for peace. The Palestinian territory is precious to all Arabs, regardless of their political orientation. We must always remember that the Palestinian State and territory were and will remain the basis for the Arab Peace Initiative, launched by the Arab summit, under the auspices of the Kingdom of Saudi Arabia, in Beirut in 2002. That initiative was inaugurated 20 years ago today.

It is equally illogical that Israel practices crude opportunism by condemning the Russian Federation’s occupation of parts of the territory of Ukraine while it arrogantly occupies the entire territory of the State of Palestine, in violation of General Assembly resolution 181 (II) of 1947, which established and adopted the two-State solution. It is also in blatant defiance of the numerous resolutions of the Council seeking to launch direct negotiations for the establishment of an independent Palestinian State, with Al-Quds Al-Sharif as its capital. Israel is also seeking to impose its sovereignty over Al-Quds Al-Sharif and the rest of the occupied Palestinian territories, where it is continuing its massacres in clear violation of the successive resolutions of the Council over the years, without the slightest measure of accountability.

Following today’s briefing on the implementation of resolution 2334 (2016), which indicated an escalation in the severity of the situation in the occupied territories in a way that portends imminent danger, the League of Arab States believes that the Council must re-evaluate the way to address the Palestinian question. It is illogical, or contravenes the rules of international multilateral legitimacy, to read United Nations report after report that Israel is continuing to implement its fierce settlement policies, in flagrant violation of resolution 2334 (2016) since its adoption in 2016, and to kill and repress the defenceless Palestinian people. The Council has taken no punitive measure to compel Israel to respect its resolutions.

I am pleased to begin my statement by congratulating you, Madam President, on your assumption of the presidency of the Security Council for the month of October, and to thank Mr. Tor Wennesland for his outstanding briefing to the Council today. We endorse the statement of the Group of Arab States to be made by the representative of the Republic of Iraq. The Palestinian question is central to the work of the League of Arab States, as it is the primary Arab issue based on the decisions, statements and initiatives of the Arab summits, as well as the meetings and ministerial committees of the Arab League since its establishment in 1945, in addition to the relevant United Nations resolutions.

  40. In conclusion, the Palestinian question has suffered in the past from unfair and irresponsible decisions. In recent times, the question has been deliberately neglected for no reason and has fallen victim to the conflicts between super-Powers. However, the League of Arab States insists that we restore the Middle East peace process in its entirety. We need to use the hope and positive momentum we have achieved recently to overcome all the obstacles in the way of the realization of the peace desired.   41. The League of Arab States appreciates the valuable financial support provided to the Palestinian Authority to help it address that devastating economic crisis.   43. An entire generation of Palestinians is being wiped out under occupation, giving them no hope for the future. On several occasions, President Mahmoud Abbas has proposed an initiative to the Council and the General Assembly to convene an international conference under the aegis of the Secretary-General for the purpose of holding direct and serious negotiations between the Palestinian and Israeli sides under the auspices and supervision of the international Quartet. The League of Arab States strongly supports that initiative.

Besides those accountability measures, the Council should lead an independent international investigation into Israel’s assassination of the martyred Palestinian journalists Shireen Abu Akleh and Ghufran Harun Hamid Warasneh, whose murders are a flagrant violation of freedom of opinion and the press and of the most basic human rights of defenceless journalists, simply because they are reporting on the practices of the Israeli army and the settlers who are violating the rights of the Palestinian people. The Council must also address Israel’s systematic violations of the rights of young Palestinians, which are preventing them from achieving the Sustainable Development Goals and from establishing and fulfilling their political, economic and social aspirations.

It is now more important than ever for the Council to take decisive measures to ensure that Israel complies with the provisions of international law, international humanitarian law and international human rights law and respects the Council’s resolutions.   46. The report mentions the very concerning cases of violations in Palestine against children due to flagrant Israeli violations. In that context, given the positive momentum of recent meetings, the Security Council should not feel it has done its job by merely listening to report after report from the Special Rapporteur on the implementation of resolution 2334 (2016), while in every report that Israel is still continuing to build settlements, and as of yesterday, 25 July, Israel continues to pursue its fierce settlement policy, preventing the implementation both of a two- State solution on the ground and of the principle of land for peace.

In parallel, the Council must take measures to ensure that the defenceless Palestinian people are protected from Israel’s repeated violations of their inalienable rights throughout the occupied Palestinian territories. Grave violations, inflicted on the Palestinian people by Israeli forces and settlers, have occurred recently in Masafer Yatta, Sheikh Jarrah, Silwan and Hebron, as well as Jerusalem itself. In Jerusalem they have violated holy Islamic sites, particularly the Al-Aqsa Mosque, preventing Palestinian Muslims from visiting the sites and practicing their rites, a stark violation of their freedom of religion. The League of Arab States welcomed the Secretary- General’s recent report on children and armed conflict (S/2022/493), discussed last week in the Council (see S/PV.9096).

That positive momentum should enable the Middle East Quartet to start meeting at the ministerial level without delay, with the goal of preparing for direct negotiations between the Palestinians and Israelis on the five final-status issues, particularly the issue of land, which is critical to establishing the Palestinian State and implementing a two-State solution. The other four are security, water, refugees and lastly Jerusalem, an issue that has great significance not just for the Palestinian people but for all followers of the three major monotheistic religions worldwide. East Jerusalem is and will remain the capital of the independent Palestinian State.

  49. In that regard, the Council should block any attempts to transform the principle of land for peace into a principle of peace for peace. It should block Israel’s attempts to defer or postpone the realization of a two-State solution and prevent the establishment of an independent Palestinian State, or to expand its circle of peace with other Arab countries without making simultaneous progress towards establishing a Palestinian State on the occupied territory. It is crucial that we build on the positive momentum of the Jeddah Security and Development Summit between the Arab countries and the United States, held in mid-July with the effective participation of the United States. The Summit emphasized the pivotal link among those countries, with the security aspect of that link connected to the work of the Council.

The increased attention to the Middle East on the political, security and economic fronts should be reflected in the various international and multilateral forums, especially here in the Council. That will help support the consideration of Arab issues at the United Nations with the aim of achieving a lasting and comprehensive peace in our region, based on a two-State solution and the principle of land for peace, which the United Nations and the international community have adopted as a basis for reaching a peaceful settlement of the Palestinian question that ensures the establishment of an independent Palestinian State, with East Jerusalem as its capital, along the June 1967 borders, in accordance with the resolutions of international legitimacy law and the Arab Peace Initiative.
