  2. We recall that the Lima Group, as early as October 2017, asked the Secretary-General to contribute to resolving that serious crisis and the ongoing human rights violations in Venezuela. We reiterate that call on this occasion. It should also be recalled that, in September 2018, the Human Rights Council adopted resolution 39/1 on the promotion and protection of human rights in Venezuela, sponsored by Argentina and other countries, which expresses deep concern about human rights violations in that country and urges the Government of Venezuela to accept humanitarian aid to alleviate the shortage of food and medicine.

For all these reasons, Argentina and the other countries of the Lima Group have come to the unanimous and resounding conclusion that the continuity of Maduro and his illegitimate regime in power represents an unprecedented threat to the security and peace of the whole region. That grave situation has created a regional and global migration and refugee crisis. More than 3 million Venezuelans have had to seek refuge in other countries, particularly in Latin America and the Caribbean. Argentina has received more than 130,000 Venezuelan migrants and refugees, while continuing to provide humanitarian assistance to the Venezuelan people through various missions carried out by the White Helmets Commission of Argentina. The United Nations cannot remain indifferent to the crisis in Venezuela, given its gravity, depth and manifold impacts.

Argentina strongly condemns the fact that the Maduro regime has prevented the entry of humanitarian aid into Venezuela and firmly repudiates once again the repressive and violent actions of the regime against the Venezuelan people. In view of the recent serious and deplorable events of 23 February, on the understanding that indiscriminate violence against civilian populations and the denial of access to humanitarian aid constitute crimes against humanity, the Lima Group, of which Argentina is a member, decided on 25 February to ask the International Criminal Court to open an investigation into those events, within the framework of the proceedings brought by Argentina and other countries before the Court in September 2018.

  5. The crisis in Venezuela has deteriorated at an alarming rate, as evidence by the recent events beginning on 23 February on the border with Colombia. Maduro's dictatorial regime used force to block the multilateral, peaceful humanitarian initiative to deliver food and medicine to alleviate the desperate situation in which millions of Venezuelans find themselves. It did so by stifling with unacceptable violence the innocent and unarmed civilian population that was trying to help the entry and distribution of such assistance. That deliberate action taken by the Maduro regime, which violated human rights and international law, left at least four dead and hundreds injured.

Mr. Garcia Moritan (Argentina) (spoke in Spanish): I am grateful for the convening of this meeting to address the tragic situation in Venezuela, which is of particular interest to my country, the Latin American and Caribbean region and the rest of the international community. I would also like to thank Under-Secretary-General for Political Affairs and Peacebuilding Rosemary DiCarlo. Argentina believes that the serious political, economic and humanitarian crisis in Venezuela requires urgent and concerted international action and that the Council has an important role to play, in accordance with the Charter of the United Nations, in order to prevent the further deterioration of the situation and an increase in the terrible suffering of the Venezuelan population.

  8. The Argentine Republic will continue to denounce the human rights violations perpetrated by the regime, as it has been doing since our President, Mauricio Macri, took office. In line with this position, the Government of Argentina joined other countries in requesting that the Office of the Prosecutor of the International Criminal Court initiate an investigation into allegations of the commission of crimes against humanity in that country, and promoted the suspension of Venezuela's membership in the Southern Common Market (MERCOSUR), pursuant to the Ushuaia Protocol on the Democratic Commitment in MERCOSUR, the Republic of Bolivia and the Republic of Chile. In conclusion, Argentina believes that the Security Council should reaffirm its role as a guarantor of international peace and security.

By October 2017, the Lima Group, of which Argentina is a member, had already requested that the Secretary-General and the United Nations system contribute to addressing this crisis and the continuing violations of human rights taking place in Venezuela. Indeed, the crisis is regional and global in scope. According to the Office of the United Nations High Commissioner for Refugees and the International Organization for Migration, 3 million Venezuelan migrants and refugees have been forced to leave their country because of a political, economic and humanitarian crisis that seriously impacts their human rights. Of those, 2.4 million are now in Latin America and the Caribbean. Argentina once again strongly condemns the repressive actions of the Maduro regime against the Venezuelan people.

  10. Accordingly, Argentina would like to recall that the Santo Domingo dialogue process failed, owing to Maduro's lack of real willingness to engage in dialogue. Therefore, Argentina warns of the risk that dialogue initiatives promoted in good faith by various international actors could be manipulated by Maduro's regime, turning them into delaying tactics. Argentina believes that the United Nations and its States Members should provide support to facilitate a peaceful transition to free, democratic and transparent elections as soon as possible. That is the only way to deal with the serious political, economic and humanitarian crisis that has plagued Venezuela for too long.

  11. The Government of the Argentine Republic recognized Juan Guaido as Interim President of Venezuela, as did many other States. On 24 January, at the behest of Argentina and other countries, the Permanent Council of the Organization of American States met in extraordinary session to consider recent developments in Venezuela. As a result of these deliberations, 16 countries signed a declaration ratifying the constitutional authority of the National Assembly and recognizing Juan Guaido as Interim President of Venezuela. In recent days, several international actors have again proposed dialogue initiatives to overcome this crisis. Argentina always bets on dialogue, but to be conducive to positive results, dialogue requires the good faith of the parties involved.

On 10 January, Argentina announced concrete measures against the Maduro regime, including, inter alia, a ban on the entry of high officials of the regime, suspension of the application of the visa exemption agreement in diplomatic and official passports, and alerts to banking and financial institutions about the risks of working with the Venezuelan Government or with companies that are owned or controlled by the Venezuelan State. As is well known, Juan Guaido, President of the Venezuelan National Assembly, took office as Interim President in accordance with the Venezuelan Constitution, in the context of the massive demonstrations by the Venezuelan people on 23 January, whose clamour for democracy and freedom has been clear and forceful.

  17. On the other hand, attacks against Israeli citizens are inadmissible and must cease immediately. My country vehemently condemns all terrorist acts, as well as the violent actions of Hamas and other Palestinian organizations, including the launching of missiles from the Gaza Strip and the construction of tunnels to infiltrate Israel. In that context, we recognize the right of Israel to exercise legitimate self-defence. Without prejudice to that, however, we recall the need for Israel's actions to be compatible with international humanitarian law and take into account, inter alia, the principles of distinction between civilians and combatants, proportionality and military necessity in terms of the use of force. Argentina reaffirms its support for the inalienable right of the Palestinian people to self-determination and the establishment of a viable and independent State that is recognized by all countries, as well as the right of the State ofIsrael to live in peace with its neighbours within secure and internationally recognized borders. Argentina reiterates its concern about the growth of illegal Israeli settlements in the occupied Palestinian territories and urges Israel to cease such expansionist activities. We congratulate you, Mr. President, on your excellent job in conducting the work of the Security Council this month. The peace process between Palestinians and Israelis is experiencing its most fraught moment since the Oslo Accords in 1993. The seriousness of the situation on the ground requires a collective effort to keep alive the prospect of a two-State solution, based on the 1967 borders, and to move forward in resolving all final-status issues identified in those agreements, namely, the issues of Jerusalem, refugees, settlements, borders and security measures. Argentina resolutely supports all efforts aimed at achieving peace and stability in the region.

  21. The security of peacekeeping operations staff continues to be a major concern, as missions increasingly deploy in highly unstable scenarios and where there is no peace to keep. In that regard, we condemn in the strongest terms all attacks and acts of violence against peacekeeping personnel, and we call for all the necessary measures to be taken to bring those responsible to justice and ensure adequate accountabililty. Finally, I would like to conclude by expressing my sincere appreciation for the courageous personnel of field missions and to pay tribute to the personnel who have lost their lives over the past year in the discharge of their duty in maintaining peace and in pursuit of the ideal ofa more just and peaceful world.

In that regard, with regard to the prevention of conflicts and the maintenance of peace and security in Africa, it is essential to highlight the role of regional and subregional bodies in promoting political solutions based on dialogue through their mediation efforts, as well as the action of African Union peace support operations authorized by the Council under Chapter VIII of the Charter of the United Nations. Argentina agrees on the need for all stakeholders to renew our commitment to peacekeeping operations.   24. We also see a growing tendency to require peacekeeping operations to perform better in performing a greater number of tasks in increasingly risky and complex operational environments. In that context, there is a need for more effective and flexible missions, based on clear mandates and benchmarks for both staff and host States, with adequate advance planning and resources. Argentina has supported from the outset the conception of peacekeeping operations as policy tools to be designed and implemented as part of a broader strategy in support of viable political processes and the peaceful resolution of disputes. We believe that peacekeeping operations must be part of a holistic strategy that includes conflict prevention, peacekeeping and sustainable peacebuilding that integrates the perspective of sustainable development and human rights and addresses the root causes of conflicts. Against that backdrop, Argentina has been participating in peacekeeping operations in Africa for 58 years and is currently present in the United Nations Mission for the Referendum in Western Sahara, the United Nations Mission in South Sudan, the United Nations Organization Stabilization Mission in the Democratic Republic of the Congo and the United Nations Multidimensional Integrated Stabilization Mission in the Central African Republic. We believe that the mandates of peacekeeping operations should be tailored to specific contexts.

  29. Likewise, we would like to highlight the value of regional organizations in the maintenance of international peace and security. The development of multilateralism at the regional level has also proven to be highly effective in the prevention and peaceful resolution of conflicts. In the framework of the Charter, the International Court of Justice plays a central role as the principal judicial organ of the United Nations. In that regard, at the international level the Rome Statute of the International Criminal Court is one of the most significant achievements of multilateralism and plays a central role in the fight against impunity.

In that regard, my country deems it relevant to stress that the ability of any mediation effort, mission of good offices or other means of peaceful settlement to achieve its goal and purpose depends on compliance in good faith with the obligations incumbent on the parties to those procedures. When called on to negotiate by the organs of the United Nations, the parties involved must do so in good faith, refraining from acts that could hinder their obligation to settle the dispute by peaceful means. Likewise, States that are not parties to a dispute must contribute to its peaceful resolution and abstain from any conduct that could frustrate the settlement of the dispute. All of that is also part of a genuine commitment to multilateralism.

Protecting the rules-based international order was and is a shared responsibility, and the maintenance of international peace and security is increasingly threatened by serious new challenges such as organized crime, cybercrime and terrorism, which require effective and efficient responses based on dialogue, consensus, cooperation and multilateralism, which no individual State in the international community is able to provide on its own. In that regard, today more than ever the role of leadership is fundamental to protecting and maintaining the international order that we have been able to build over the past decades, in order to achieve peaceful, inclusive, equitable and sustainable societies. Similarly, the Ministry of Foreign Affairs, in coordination with the Embassy of Canada in Buenos Aires and the non-governmental organization Latin American Security and Defence Network, has begun to develop an assessment project about the status quo of the inclusion of the gender perspective in the 10 ministries involved in the implementation of the resolution 1325 (2000) national action plan. In that regard, it is expected that the results of that mapping will be ready by March 2019. With regard to concrete actions to implement resolution 1325 (2000), on women's participation in conflict resolution and sustainable peacebuilding, in August the Ministry of Foreign Affairs of Argentina and the Ministry of Justice and Human Rights launched the creation of a federal network of mediators, with a gender perspective. The network is made up of more than 50 professionals from all the provinces of our country and promotes the substantive involvement of women in peacebuilding processes and in the handling of crisis situations and everyday community conflicts.

Education is an essential factor in promoting the comprehensive empowerment of women of all ages and their effective participation in decision-making processes at all levels, with a view to promoting peace, security, development and the full enjoyment of human rights. In that regard, protecting education and guaranteeing continuous access to safe education during conflicts is a fundamental objective that would help to protect women and girls from the risks of armed conflict. In that framework, in 2017 Argentina and Norway organized the second Conference on Safe Schools to disseminate the Safe Schools Declaration and Guidelines for Protecting Schools and Universities from Military Use during Armed Conflict. In that regard, we encourage all Members of the United Nations, and especially the members of the Council, to endorse the Declaration.

  40. States not party to a dispute must also contribute to its peaceful resolution and refrain from engaging in behaviour that could hamper the settlement of the dispute. The use of the various dispute-resolution mechanisms is subject to the requisite consent of the parties to engage in a peaceful dispute-settlement process. Nonetheless, it is clear that the higher obligation of all Member States to settle disputes by peaceful means can never be subject only to the consent of the parties. We would like to highlight in particular the contribution of regional and subregional organizations to mediation processes and stress the importance of women's participation in all stages of the conflict resolution cycle, including in mediation processes. The possibility that mediation, a mission of good offices or any other means of peaceful settlement could achieve its objective and purpose depends on the fulfilment in good faith of the obligations of the parties involved. When the organs of the United Nations call upon parties to a dispute to negotiate, they should do so in good faith and refrain from actions that could obstruct the obligation of both parties to resolve the dispute by peaceful means.

In that regard, I would like to underscore the support provided by the Secretariat both through advice on specific technical issues and in enhancing the capacities of regional partners and national and local actors. The complexity of contemporary conflicts requires multidisciplinary approaches that allow for broad and inclusive agreements that can withstand the post-conflict test. Mediators should always take into account the unique features of each case without attempting to determine pre-established formulas or exploit possible positive synergies with other equally useful dispute-resolution mechanisms.

  43. In that regard, we would like to reaffirm our commitment to the principle of the peaceful settlement of international disputes. We believe that every method of peaceful dispute settlement is equally valid for conflict resolution; only through such methods can just and lasting solutions be reached. We underscore the obligation of all Member States to agree to peaceably settle their disputes, as stipulated by the Charter of the United Nations, as well as the particular role the Charter entrusts to the Secretary- General in the area of good offices and mediation. Mediation and mediation support are very important to the broader objectives of conflict prevention and resolution. That is why we support the Secretary- General's strategy to place preventive diplomacy at the centre of his management efforts.

  47. Argentina believes that the holy city must be a place of meeting and peace and that it must guarantee Jews, Muslims and Christians free access to holy sites. Any attempt to deny or diminish the profound meaning of those sites or their historical ties to the three great monotheistic religions would be totally unacceptable and only stand in the way of finding a solution to the conflict. Concerning the situation in the Syrian Arab Republic, Argentina supports the reaching of a political solution through dialogue and diplomacy, in compliance with international law and with full respect for the sovereignty, independence and territorial integrity of the Syrian Arab Republic. Argentina attaches particular importance to the Geneva talks held under the auspices of Staffan de Mistura, Special Envoy of the Secretary- General for Syria.

Palestinian leaders must address Israeli security concerns in a spirit of sincerity, and we urge Israel, in cases where it exercises its inalienable right to legitimate defence, to take into account its obligations under international humanitarian law and international human rights law, refraining from any actions that would make resumption of dialogue more difficult. In this regard, Argentina notes with concern the continuing excessive use of force by the military and condemns acts of settler violence. Argentina reaffirms the special status of Jerusalem pursuant to the relevant General Assembly and Security Council resolutions and in this regard rejects any unilateral attempt to modify it.

  49. Argentina also reiterates its concern at the persistent and continued growth of illegal Israeli settlements in occupied Palestinian territory and urges that their expansion be halted. The settlements run counter to international law, are an obstacle to peace and undermine prospects for the solution of two States living in peace and security, thus perpetuating an unsustainable status quo. At the same time, we strongly condemn the actions carried out by Hamas against Israel, including the launching of rockets and incendiary devices from the Gaza Strip, which must end immediately.

With regard to the question of Palestine, Argentina wishes to reaffirm its support for a peaceful, definitive and comprehensive settlement on the basis of the two- State solution and the 1967 borders as well as the decisions reached by the parties during the negotiation process, as set out in the relevant General Assembly and Security Council resolutions, the road map and the Arab Peace Initiative. Argentina reaffirms the inalienable right of the Palestinian people to self-determination and to an independent, viable State recognized by all nations, as well as the right of the State of Israel to live in peace alongside its neighbours within secure and internationally recognized borders.
