Despite those incidents, which hindered the transition process again, fortunately it was possible to achieve a parliamentary agreement that enabled the establishment of a provisional Government after the end of the mandate of President Martelly. Like other countries in the region worried about the future of Haiti, Argentina is closely following the process and hopes that the Haitian people can achieve the normalization of the political situation by concluding the electoral process and installing a legitimate Government that can consolidate greater stability.

We acknowledge her work and the results achieved, which are contributing to strengthening dialogue and Haiti's institutions. Let me also acknowledge the presence of the Permanent Representative of Haiti, Ambassador Denis Regis, and his active delegation. We also thank the new Force Commander, Lieutenant General Ajax Porto Pinheiro, and Commissioner Serge Therriault. When the Security Council considered the situation in Haiti in October (see S/PV.7530), the electoral process was under way and the presidential elections were still on the horizon.

In that regard, in the Americas, consideration should be given to the role that could be played by the Organization of American States or other subregional organizations such as the Community of Latin American and Caribbean States, the Union of South American Nations and the South American Common Market. The 2030 Agenda for Sustainable Development (General Assembly resolution 70/1), which we approved in September 2015, proposes the promotion of fair, peaceful and inclusive societies, thereby linking the sustainment of peace and development. Peacebuilding architecture that aspires to sustain a stable international order cannot neglect these three interrelated dimensions: development challenges, financing and time frames consistent with the objectives to be achieved. Lastly, I would like to emphasize that regional and subregional organizations are also essential to partnerships that are conducive to peacebuilding processes.

And in that vein, we agree with the recommendation by the Advisory Group to allocate $100 million to the Peacebuilding Fund annually or, if the figure were greater, an amount equivalent to 1 per cent of the total budget of the United Nations for peacekeeping operations and special political missions, in the framework of contributions established for the budget of the Organization. Another important point raised both in the report of the Advisory Group and in your concept note (S/2016/104, annex), Mr. President, is the need to review the time frames on which the processes and programmes towards the achievement of sustainable peace are structured.   6. Peacebuilding activities are carried out in the field, not at agency headquarters, given that domestic realities must take precedence. For this, it is necessary to have flexible approaches, since there is no single approach that will work in every case. (spoke in English) There is no "one size fits all" in peacebuilding. The aforementioned preventive approach includes, in a necessary and decisive manner, inclusive national ownership in the peacebuilding process, that is, a fundamental involvement of Governments and of the various political and social stakeholders in the Member States involved in these processes. As the report notes, such inclusive national ownership should be encouraged, since the United Nations and international actors can support and facilitate this process, but not lead it. The Commission has the potential to be a bridge between the Security Council, the General Assembly and the Economic and Social Council, as well as between Headquarters in New York and field activities, bringing together all other relevant stakeholders in peacebuilding, including at the national, subregional and regional levels. Reaching systemic coherence in peacebuilding strategies should be our main objective. The review of the peacebuilding architecture and the parallel reviews of United Nations peace operations and of resolution 1325 (2000), on women and peace and security, are focused on prevention.

My country welcomes the report of the Advisory Group of Experts (see S/2015/490) in that it has highlighted a number of the outstanding challenges we see for peacebuilding today, more than a decade after the establishment of the Peacebuilding Commission. Ten years after its establishment, we have a unique opportunity to make a difference. We must not waste it. In these 10 years we have learned various lessons and found excessive fragmentation in the actions of the Organization, dispersion of efforts and some inconsistency in the strategies. Coordination among the principal organs of the United Nations that proposed establishing the Commission is today far from being effective, which is why we must analyse the deficiencies of the system and bring about its repair through concrete measures that bolster integration.

Our country is also prepared to contribute to official assistance, in particular by providing personnel from our White Helmets initiative and placing specialized teams of trained volunteers able to act as reserves at the disposal of the United Nations humanitarian system. The Government of Argentina strongly emphasizes that this is the time for diplomacy. The inclination towards bellicose action should be abandoned. A negotiated way out of the crisis should be supported, including the urgent establishment of an unconditional ceasefire that allows the international community to immediately set up a humanitarian truce to make it possible to help people at risk.

  13. Humanitarian conditions in the occupied Palestinian territories are also cause for special concern for our countries. The international community should take urgent steps to alleviate the suffering of the Palestinian population. Israel must also contribute to that end by allowing humanitarian personnel immediate and secure access. The humanitarian crisis in the Gaza Strip is alarming. In the current circumstances, international assistance cannot reach the affected population. If we do not act urgently, a major humanitarian crisis could ensue, potentially affecting more than 1.5 million Palestinians. We know that various coordination efforts are being considered to provide assistance in the area. Argentina is preparing a significant package of humanitarian assistance for Gaza.

We are particularly sensitive to the suffering of civilian populations, and we are of the view that the State apparatus is responsible for protecting citizens living in territories under its control. In this context, the Republic of Argentina expresses its profound concern with regard to the deterioration of the situation in the Middle East. We condemn the excessive use of force by Israel in Gaza and the launching of rockets towards Israel from the Gaza Strip. Full respect should be ensured for obligations in the context of international humanitarian law and all measures should be taken to protect the civilian population. The United Nations reports are eloquent: the number of civilians who have died as a result of bombings and land operations is horrific. This must stop.

This Council has also repeatedly required compliance with obligations under international law, in particular the provisions of the Hague Conventions, the Geneva Conventions and their Protocols, and the decisions of this Council. The Council has repeatedly condemned, in the most energetic terms, all acts of violence or abuse committed against civilians in situations of armed conflict in breach of the applicable international obligations, be it in Afghanistan, the Democratic Republic of the Congo, Somalia, Darfur or the Middle East. The recent political history of my country and its commitment to international law, international humanitarian law and respect for human rights prompt us to speak up on matters that occur in other places.

Mr. Garcia Moritan (Argentina) (spoke in Spanish): I thank you, Sir, for convening this open debate on a matter that my delegation believes to be of particular importance, given its topical and sensitive nature. We are also grateful for the report by Mr. Holmes this morning. The Security Council has provided the legal framework for the protection of civilians in armed conflict through its resolutions 1265 (1999), 1296 (2000) and 1674 (2006). This legal framework should be used to protect victims. The Security Council, in its resolution 1674 (2006), established that attacks deliberately targeting civilians or other protected individuals in situations of armed conflict represented a flagrant breach of international humanitarian law and condemned such practices most energetically.

The approaches proposed by the facilitators and the task force on Security Council reform established by the President of the General Assembly could lead to a reformed Council that is more democratic and efficient. For this, transparent and effective working methods are also required. The Council must also become more dynamic and incorporate more regional decision-making. The successive failures of the Council show that the permanent members have not kept their part of the bargain struck in 1945: permanent seats and a veto in exchange for responsibility to the broader membership. Indeed, they are clearly making any attempt at reform in terms of composition or working methods impossible. It is time for them reconsider and to make possible true change that will revitalize the Organization and enable it to fulfil its purposes and principles.

Despite that, we believe it is necessary to mention it in this open debate, since its use and the threat of its use operate as a procedural device when permanent members pursue their national interests, a process that affects both the working methods and the effectiveness of the Council in achieving its objective of enforcing international peace and security. In that respect, we note our regret and concern over the more frequent use of the veto this year. Finally, we once again call upon the Members of the Organization to reach an agreement on Council reform, based on a transitional approach, without winners or losers, that would make it possible to resolve the current impasse that has lasted a long time, 14 years to be precise.

Another point is that we must produce an annual report that is more analytical and substantive, and at the same time avoid lengthy negotiation over its contents.   20. In that regard, the Secretary- General or the Special Representatives should place more emphasis on the necessity to receive advice or guidance from the Council. It is also necessary to establish more frequent contact between the principal organs of the United Nations, so as to mitigate negative perceptions of the Council and to achieve more coordinated joint action. Meetings between the Presidents of the General Assembly and the Economic and Social Council with the Security Council president of the coming month could be organized in relation to the Council's agenda. We believe that regional groups could play an important role here, increasing the legitimacy and accountability of the Council. Allow me to recall the role of Argentina, together with the delegation of New Zealand, in the establishment of meetings to exchange information with troop-contributing countries during the 1990s. We believe that the agreements reached in 2006 are positive but also insufficient. It is necessary to continue the progress towards greater democracy in the Council and greater openness to the membership, which will greatly contribute to a more effective organization. Here, I should like to recall some of the proposals we have made regarding the Council's working methods. First, we must undertake an annual or biannual revision of mandates and recommendations in the case of conflicts that we all know will last a long time. Council members should make the greatest effort to focus the debate on specific action-oriented proposals and decisions.

Our country was a member of the Council when the reforms contained in presidential note S/2006/507 were adopted in July 2006. In the Informal Working Group on Documentation and Other Procedural Questions, under the presidency of Japan, we witnessed how difficult is to change the practices and procedures that were not very transparent, established by the permanent members over the past years. The effort to improve the working methods of the Council had started in earlier years.

Systematic cooperation between the United Nations and regional organizations that includes a clear distribution of functions and adequate capacities will increase the effectiveness of the international community to prevent conflicts. It would make possible a speedier response when a conflict arises and provide solutions for building lasting peace. Given the existing link between security, peace and development, we believe that the specialized knowledge of regional organizations, whose original mandates were to foment economic and commercial integration, may also be of value in ensuring the success of strategies aimed at economic growth and long-term stability.

In conclusion, we believe that greater decentralization in, and delegation of, peacekeeping operations to regional organizations, along with greater cooperation and coordination among those organizations and the Security Council, will not only alleviate the actual burden on United Nations peacekeeping, whose resources are at their limit, but, in accordance with the principle of subsidiarity, it could also enhance the effectiveness of peacekeeping missions authorized by the Security Council. Cooperation under Chapter VIII of the Charter of the United Nations provides enormous possibilities to optimize resources and stimulate the political will of the international community to achieve peace and security through an effective operational association between the United Nations and regional and subregional organizations. It is therefore desirable to promote formal and informal consultation mechanisms that will allow the United Nations and regional organizations to mutually enrich that interaction. We believe that when the universal Organization studies a specific conflict, prior to taking action on the ground, it should ideally have available to it the opinion and advice of the relevant regional organization and give that organization's point of view adequate consideration.

We can say that the OAS has established a strategic association with the United Nations, facilitating the fulfilment of the mandate of the United Nations Stabilization Mission in Haiti through the leadership and accumulated experience of the organization. The OAS has contributed its specific technical knowledge and has actively collaborated in the political dimension and, specifically, in the continuity of the electoral process. That has been fundamental for the organization of free and clean elections, from which the current democratic Haitian Government has sprung.

In this context, we are pleased with the initiative to give assistance to the African Union to increase its peacekeeping capacity with the objective of establishing a permanent African reserve force by 2010, as well as the initiatives of the Economic Community of West African States and the Economic Community of Central African States or the Southern African Development Community to create reserve brigades for peacekeeping in their respective subregions. In the American region, the case of Haiti deserves mention as a model for cooperation between the United Nations and the Organization of American States (OAS).

Nevertheless, the situation would be different if the Council were to determine that preventive intervention were necessary due to a potential risk that exploitation of a given country's natural resources could in the future lead to a conflict that could pose a threat to international peace and security. That would violate the principle of non- intervention in the internal affairs of States that is set out in the Charter of the United Nations, because the basis for intervention would then be the remote consequences that the sovereign actions of a country could possibly have for international peace and security.

With regard to peacekeeping operations in countries where illegal exploitation of natural resources is taking place, we believe that these integrated operational groups could also include experts in the area of natural resources, so that the Secretariat's recommendations could also serve to adjust the mandates of peacekeeping operations in that regard. With regard to the mandates of peacekeeping operations, the Secretary-General's recent comprehensive report on strengthening the capacity of the Organization to administer and support peacekeeping operations underscores the fact that the complexity of mandates has resulted in an increase in the number of integrated missions. The report proposes the establishment of integrated operational groups comprising officers from various United Nations departments. The groups would be responsible for day- to-day support for all aspects of peacekeeping operations, including the coordination and preparation of recommendations for the planning and implementation of policy strategies and the achievement of integrated operational objectives.

However, with regard to other natural resources, in order to make the transition from sanctions imposed on a country to the lifting of sanctions during the peacebuilding stage, there is a need for greater cooperation and coordination among the Security Council, regional organizations and the Peacebuilding Commission so that the Commission's assistance to countries in conflict can make it possible not only for the Council to lift sanctions in connection with the exploitation of natural resources but also for natural resources to become a source of sustainable development for the Governments in question.

During its membership of the Security Council, Argentina therefore supported the imposition or continuation of embargoes on diamonds and timber from certain countries on the agenda of the Council in which resources were being used by armed groups to finance their activities. Argentina has also supported the Kimberley Process to establish an international system of certification of the origin of raw diamonds that would make it possible to lift embargoes from States once they could guarantee the source of diamonds, so that the income generated from that resource could help those countries attain sustainable development, which would help them to avert a relapse into conflict during the peacebuilding phase. An objective mechanism is in place for diamonds, namely, the Kimberley Process.

  37. Paradoxically, the exploitation of those sources of wealth has contributed to fuelling or prolonging conflicts. Especially in some regions of Africa, armed groups often use those resources to finance their activities and defend the territories where those resources are located from State control. Likewise, a country's entire dependence on its natural resources generally results in great vulnerability, given that an economy centred on a single element has a higher risk of experiencing ongoing economic crises once international conditions for that commodity worsen. The result of that is an increased chance that conflict will break out.

Mr. Garcia Moritan (Argentina) (spoke in Spanish): 1 thank the delegation of Belgium for having chosen the subject the maintenance of international peace and security for today's open debate of the Security Council. I would also like to thank Mr. Pascoe, the President of the General Assembly and the President of the Economic and Social Council for their statements. There is an undeniable link between development and international stability, or, to put it another way, between poverty, instability and conflict in the context of domestic and international relations. It is noteworthy that many of the countries that have experienced conflict in recent years are rich in such natural resources as diamonds, gold, timber, oil and copper, to name but a few.

  39. Finally, we would like to say that we regret the way in which the 1540 Committee recently proceeded to renew the contracts of the groups of experts. Within this framework of action, the adoption of measures for accounting, physical protection, border and police control and national control of trans-shipment and export, including monitoring the provision of financial and other services, is of particular importance. Argentina's commitment to disarmament and non-proliferation is reflected in our adoption of all existing export control regimes and their national implementation through a commission established for that purpose as early as 1992. In that context, our work and the experience we have gained enable us to offer any support that other countries of the region may request to help with national implementation in the technical, judicial and customs fields. My delegation would like to reaffirm its support for the work of the Committee and recalls that resolution 1673 (2006) requested that it intensify its efforts through a work programme to include the compilation of information, outreach, dialogue, assistance and cooperation.

  42. It is because we believe that in this area regional cooperation is fundamental that we are meeting the challenge of implementing these extremely important resolutions. That is why cooperation with regional and subregional organizations should also be encouraged. We submitted in a timely manner our national report, prepared by our Ministry of Foreign Affairs, which is our focal point on this issue, with the support of an inter-ministerial commission created for this purpose. The report has since been updated. Those actions mesh with national criminal and administrative legislation to implement at the national level our international obligations. In this context, I would like to note that Argentine legislation is under constant review and revision so that we can make the necessary changes.

  43. In June 2005, together with the Government of Spain, we organized a first regional seminar on the implementation of resolution 1540 (2004), held in Guatemala. Its objective was to address the specific difficulties of the countries of Central America and the Caribbean. Subsequently, in September of the same year, we organized another seminar, this time together with the United Kingdom, in Buenos Aires, Argentina. That seminar was the first time since its establishment that the 1540 Committee had the opportunity to be in contact with the entire region. Argentina also actively participated in the seminar held in Peru last November under the auspices of Spain and the European Union.

International cooperation in the non-proliferation of nuclear, chemical and biological weapons and their means of delivery and related materials is of crucial importance in achieving the Security Council's objective of prevailing in the fight against the threat to international peace and security posed by the proliferation of weapons of mass destruction and by international terrorism. We believe also that specific actions in the field of non-proliferation must go hand in hand with a clear and specific commitment that can be translated into a plan of action in the field of disarmament by all members of the international community. My country has offered its support to those countries that may need assistance in the implementation of obligations arising out of resolutions 1540 (2004) and 1673 (2006), especially countries in our region.

Mr. Garcia Moritan (Argentina) (spoke in Spanish): First of all, Mr. President, allow me to express my delegation's gratitude for your organization of this open Security Council debate on cooperation between the Council and relevant international organizations in the implementation of resolutions 1540 (2004) and 1673 (2006). This debate has given us the opportunity to be in direct contact with organizations such as the International Atomic Energy Agency (IAEA), the Organisation for the Prohibition of Chemical Weapons (OPCW) and the World Customs Organization (WCO), whose work in this field is of fundamental importance and should enjoy the firm support of all Member States.

  46. We know from experience that it is not possible to resolve conflicts by means of military operations alone. Finally, I would like to say that while security is the first pillar upon which peace can be achieved in any conflict, the role of the United Nations must be directed towards fostering development and ensuring respect for and defending human rights. We therefore believe that the work of the Peacebuilding Commission must also be directed towards those goals.

  47. Before concluding, my country would like to congratulate the two new States members of the Peacebuilding Commission, elected by the Council: Panama and South Africa. Argentina particularly welcomes the inclusion of Panama in the Commission, as that allows for the correction of the imbalance in terms of regional representation, which is an underlying principle of this Organization and one on which my country, together with other Latin American nations, has put great stress. I would also like to note that my country continues to be convinced of the wisdom of establishing the Commission, which will allow for the completion of the final phase of post-conflict situations and the reconstruction and the strengthening of institutions, so that conflict can be left behind for good.

At the same time, we believe that the report to be produced by the Commission, with recommendations, should also include mechanisms for achieving goals and implementing plans, as well as provisions for supervision so as to prevent the funds from being diverted. To those two elements to which we have just referred - clear and precise rules and supervision - we would like to add another, which we believe is vital for the orderly and predictable functioning of any organization: the establishment of rules of procedure. We know that such rules have been outlined by the Commission, and we trust that their prompt definition will help to improve its functioning, leading to a fruitful outcome.

  49. Presentations by Governments or local representatives to the Commission make detailed analysis possible and allow for a more complete picture to be painted. Such information will make it possible to identify priorities with greater precision, taking into account requirements and resources. In that connection, a calendar of short-, medium- and long-term objectives could be set out, on the basis of what we believe must be clear and precise rules, established by the Commission, which must be in keeping with the spirit of the Organization and respond to the wishes of the international community.

Likewise, the subsequent establishment of the Peacebuilding Fund must be considered as the ideal way for the international community to obtain foreseeable financing for initial recovery activities and to extend the period for post-conflict recovery. Thanks to the Fund, we will be able to set out emergency plans on the basis of predictable funding. Responding to the appeal of the Security Council, the Peacebuilding Commission has already held its first formal meetings to consider the situations of Burundi and Sierra Leone, with the Governments of both countries participating. In this regard, we would like to underline the significance of the participation of those countries in the assessment of their own situations.
