3. “Mr. Araud (France) (spoke in French): I welcome the adoption of resolution 1984 (2011), which France, Germany and the United States co-sponsored. The measures adopted by the Security Council are aimed at convincing Iran to negotiate and slow the development of its nuclear and ballistic programme. In order to be effective, they must therefore be fully implemented by all States. The independent Panel of Experts established last year by resolution 1929 (2010) plays a crucial role in ensuring that the measures adopted by the Council are implemented, but also that they continue to be effective and are not violated. The Panel has done outstanding work in just a few months. It has carried out essential awareness-raising work with many Member States to explain the measures adopted by the Council.”

As the Secretary-General recalls in his most recent letters to the Security Council, the Council's priority task is to stabilize Cote d'Ivoire. Reinforcements to care d'Ivoire of military helicopters attached to the United Nations Mission in Liberia (UNMIL) play an essential role in this. The main threats of subregional destabilization are now in Cote d'Ivoire. It is not the Council's job to interfere in the management of logistical peacekeeping assets by the Department of Peacekeeping Operations. The Council has always supported UNMIL, which should continue to enjoy the resources it needs in the context of the democratic transition that began four years ago following the end of a 10-year crisis.”

17. “In that light, we take very seriously the allegations contained in the report of the Parliamentary Assembly of the Council of Europe, submitted in late 2010. They should be the subject of a methodical and dispassionate investigation. EULEX opened a preliminary investigation at the end of January to shed some light on the allegations. The investigating team held several meetings outside of Kosovo, in Albania and in Serbia. The Albanian authorities committed to providing their cooperation. EULEX has an operational team that is dedicated to witness protection, respects European standards and may be reinforced. An international, impartial investigation is thus under way. We call on all States concerned to cooperate with EULEX. France will continue to support the process of rapprochement for Kosovo and entire Western Balkans with Europe.”

18. “We express our full support for the European Union Rule of Law Mission in Kosovo (EULEX), which is doing outstanding work. Secondly, dialogue between Serbia and Kosovo, under the auspices of the European Union, is of crucial importance. Several meetings have already been held and concrete subjects have been discussed. We hope that those discussions, aside from their potential benefits for the population's daily life, will build confidence between the parties. I will highlight three points. First, a special effort should be made to strengthen institutions and the fight against corruption and organized crime. 24. “As we see routinely in our debates in the Council, the needs with regard to civilian capacity are numerous, varied and tend to increase with the complexity of the situations in which United Nations intervention is required. The United Nations must therefore be able to adapt, often in a short span of time. Effectiveness requires a certain level of flexibility in the use of civilian capacity. It also requires rigorous and responsible management of financial and human resources. Following up on these recommendations cannot be done without the participation of all Member States and on the basis of consensus. The recommendations to be made by the Secretary-General should be considered by the entire membership, in particular at the Fifth Committee.”

25. “It is not a matter of transferring the burden, but rather of taking advantage of more effective expertise by virtue of being closer to reality on the ground. The goal should be to strengthen the trilateral cooperation between donors, those that provide personnel and the host country. This is a concern for everyone. Lastly, we should encourage initiative on the ground. We therefore support the idea proposed by the Senior Advisory Group to provide a broader margin for decision-making to Special Representatives of the Secretary-General in the internal management of civilian resources. This is a productive proposal that could improve coordination with the funds, programmes and agencies in the use of their resources, thereby contributing to instilling a culture based on results in the management of resources.”

26. “In that regard, as rightly pointed out in the report, local human resources within civilian capacity support structures in post-conflict countries is of crucial importance. Secondly, partnerships must be expanded. The Senior Advisory Group has suggested establishing a civilian partnerships cell to facilitate matching needs with the capacities of different countries. That is exactly what France proposed in the context of the Group of Eight working group on peacekeeping and peacebuilding, which we currently chair. In that regard, countries of the South can provide more civilian capacity. That does not mean that the countries of the North can forego their responsibility in the areas of peacekeeping and development.”

27. “The report on civilian capacity in the aftermath of conflict is part of our efforts to improve the performance of the United Nations on the ground. We have a collective interest in ensuring that its goals are achieved. Moreover, we should avoid ideological debates and focus on the essential, namely, how to get the most benefit from the report that has been presented to us and how to help the Secretariat to implement it in the best way possible. I should like to focus on three issues that are at the heart of the reflection carried out by the experts that are of direct concern to the Security Council. First of all, the priority is national ownership. As we have said frequently in Security Council debates, there can be no lasting reconstruction without national ownership.”

The implementation of the report requires a joint effort by the entire United Nations, including the commitment of the Secretariat and the support of Member States, as was the case with the Brahimi report on peacekeeping operations and military capacities (S/2000/809).”

45. “Thirdly, the protection of civilians requires the victims to receive justice. The main responsibility in that respect falls to States, but the international community should support or supplement their efforts if they fall short. That is why the Government of Sri Lanka should undertake independent and impartial investigations into the alleged grave violations of international humanitarian and human rights law documented in the report of the Secretary-General's Panel of Experts, and those responsible should be tried. The Government of Sri Lanka must implement the other recommendations contained in the report and continue to cooperate with the United Nations. In Darfur, although the International Criminal Court issued arrest warrants for crimes against humanity and genocide, nothing has changed.”

46. “Secondly, France believes that the protection of civilians and human rights is a priority in all situations. We are determined to ensure that the Security Council shall continue to take measures tailored to individual situations. For instance, the Government of Syria is firing on and besieging its own people, and resorting to arbitrary arrests by the thousands, forced disappearances and torture. This must end. Demonstrators, human rights activists and journalists should be freed and freedom of expression respected. The Government should cooperate with the commission of inquiry of the Office of the High Commissioner for Human Rights and authorize humanitarian access, including for the assessment mission dispatched by the Office for the Coordination of Humanitarian Affairs.”

47. “By demining the port of Misrata, we enabled humanitarian assistance to be delivered and civilians to be evacuated. In C6te d'Ivoire, the Security Council gave the United Nations Operation in C6te d'Ivoire (UNOCI) the resources it needed to fulfil its protection mandate. By helping to neutralize heavy weapons being used against civilians, UNOCI prevented the commission of atrocities. We hope that the resolve UNOCI has demonstrated will serve as a point of reference for all United Nations peacekeeping operations. In the Democratic Republic of the Congo, the United Nations Organization Stabilization Mission should continue to intervene with equal resolve. We must support the Congolese authorities in building the capacity to ensure the effective, long-term protection of civilians.”

48. “I shall now make a statement in my national capacity. ll-33032 I thank Ms. Amos, Mr. Leroy and Mr. Simonovie for their briefings. I associate myself with the statement to be made by the Acting Head of the Delegation of the European Union. I wish to stress three points. First, when grave violations of international humanitarian and human rights law, war crimes and crimes against humanity are committed, it is the responsibility of the Security Council to intervene to end them. That is what we did in Libya. The Security Council authorized the forces of the coalition to protect civilians under bombardment ordered by their leaders. By striking Colonel Al-Qadhafi's forces before they entered Benghazi, France and its partners helped to prevent a massacre there.”
