In that context, additional steps should be taken to address the call of the Council for an impartial fact- finding effort to assess the losses and the economic and humanitarian damage, including to oil facilities and other key infrastructure, in and around Heglig. The Security Council stresses that there can be no military solution to the conflict in Southern Kordofan and Blue Nile states. That clear message, inter alia, discourages the activity of rebel groups in those states and any external support for them. Such measures and the increased attention supported by the Security Council under the resolution it has just adopted acquire particular significance with a view to ending the violence and preventing serious violations of the principles and purposes of the United Nations Charter.

By condemning the repeated incidents of cross- border violence between the two States, in particular the seizure and military occupation of Heglig in the Sudan and the support of proxy forces and armed groups, the Security Council reaffirmed, inter alia, the well-established principle of the inadmissibility of the use of force for the acquisition of territory and made it clear that such actions are illegal, unacceptable and cannot be justified under any circumstances. Azerbaijan welcomes the developments that resulted in putting an end to the occupation of Heglig and stressed the importance of addressing all of the consequences of that internationally wrongful act.

  11. It is essential that the resolution just adopted is mostly based on the decision of the African Union Peace and Security Council of 24 April 2012. It is important that the resolution reaffirms the strong commitment of the Security Council to the sovereignty, independence, unity and territorial integrity of the Sudan and South Sudan, and that it recalls the importance of the principles of the peaceful settlement of international disputes, good-neighbourliness, non-interference and regional cooperation.

  12. I shall now make a statement in my capacity as the representative of Azerbaijan. Azerbaijan voted in favour of resolution 2046 (2012), with the understanding that it would contribute to a ceasing of all hostilities, easing the current tension between the Sudan and South Sudan, facilitating the resumption of negotiations between the two States on the outstanding issues from the Comprehensive Peace Agreement and normalizing their relations. We take note of the Security Council's deep commitment to seeing the Sudan and South Sudan become two economically prosperous States living side by side in peace, security and stability. Azerbaijan supports the efforts of the African Union and its High-level Implementation Panel.

Needless to say, reports testifying to sporadic violations of the ceasefire are worrisome, but we still believe that such instances will remain isolated cases without further spillover to threaten the current fragile trust. The adoption of the resolutions authorizing the dispatch of the advance team to Syria (resolution 2042 (2012)) and, later, of the deployment of the full United Nations Supervision Mission in Syria (resolution 2043 (2012)) was an expression of a unified Security Council position on this highly crucial matter. Hopes are high that the security environment in Syria will be propitious enough for the Mission to carry out its task of monitoring and supporting the full implementation of the Special Envoy's six-point proposal.

It is also important to take full advantage of ethnic, religious and cultural diversity by promoting intercommunal dialogue and reconciliation while categorically rejecting and invalidating any manifestation of ethnic and religious intolerance. The situation in Syria still occupies the top position on the list of international security issues. We are encouraged by the fact that, as a result of the tireless efforts of the Joint Special Envoy of the United Nations and the League of Arab States on Syria, Mr. Kofi Annan, the sides concerned have committed to ending the bloodshed and observing a ceasefire after lasting violent clashes.

Needless to say, apart from their impact on the rights, freedoms and everyday lives of Palestinians, settlements cause serious damage to the peace process and, more dangerously, threaten a two-State solution and the emergence of a viable Palestinian State. The situation involving the serious violation of international humanitarian and human rights law cannot go unheeded by the Security Council. In performing its primary responsibility of maintaining international peace and security, the Council must react adequately in order to put an end to illegal practices and policies and ensure that human rights and fundamental freedoms are observed and respected.

  20. In this respect, Azerbaijan appreciates the consistent efforts of Jordan to revive the dialogue and resume the negotiations. We would also like to note the importance of the Quartet meeting held in Washington, DC, on 11 April, in keeping the Middle East peace process high on the international agenda, and express our hope that our collective efforts will finally lead to the resolution of this lingering conflict. Therefore, patience, diligence, resolve and political dexterity will be the best tools in making the democratic transformation process as smooth as possible and in excluding erroneous judgments and policies regarding the region's prospective development. Turning to more specific issues, we would like to note the progress in the Middle East peace process that was demonstrated by the recent interactions between the Israeli and Palestinian sides on 17 April in Jerusalem, after a prolonged hiatus in peace negotiations. The wave of changes that have swept the region since the spring of 2011 have become yet another potent factor that has absorbed international attention and portended the desire of Middle Eastern societies for political and societal transformation processes encapsulating the ideas of democracy, equal representation, greater freedom and wider political participation. We all agree on the potential benefits to be brought about by the process of democratic transition in the Middle Eastern countries. However, one should not dismiss the idea that every transition is accompanied by hardships and trials.

  26. Azerbaijan has been consistent in its support of the efforts aimed at ending the violence, overcoming the crisis in Syria and finding a solution by peaceful means and through dialogue. Like all Security Council members, we have also expressed our full support for the Joint Special Envoy of the United Nations and the League of Arab States, Mr. Kofi Annan, and his six-point proposal. As we all want a peaceful solution to the Syrian crisis, it should be emphasized once again that there is no alternative to the mission of the Joint Special Envoy. As contribution to international efforts on nuclear security and as a country committed to combating nuclear terrorism, Azerbaijan has become a party to key international instruments in the field of nuclear security, including the International Convention for the Suppression of Acts of Nuclear Terrorism and the Convention on the Physical Protection of Nuclear Material. According to international monitors, that nuclear power plant represents a danger to the entire region, and its reactor belongs to the oldest and least reliable category of all 66 Soviet reactors built in Eastern Europe and the former Soviet Union. Moreover, the plant in question is situated in a highly seismically active mountainous terrain and lacks suitable water resources for cooling its ageing reactor. We believe that the operation of the Metsamor nuclear power plant must cease without delay to prevent a tragic accident in future.

  29. At the same time, due to the continued occupation of the territories of Azerbaijan by neighbouring Armenia, we are unable to ensure proper control over a considerable part of our State border. We believe that nuclear security and safety needs should be directed primarily at the enhanced security and safety of civilian nuclear facilities, taking into account geographical peculiarities and transboundary environmental implications in the light of possible nuclear incidents. In that regard, we are seriously concerned about the nuclear safety situation in our region, which is affected by the presence of the outdated Metsamor nuclear power plant in neighbouring Armenia.

We believe that Azerbaijan's proposal on the creation of a nuclear-weapon-free zone in the South Caucasus will be supported by the neighbouring countries and the broader international community. Against the background of emerging proliferation threats and due to my country's geographic location, we attach the utmost importance to the prevention of the use of our territory as a transit route for illicit nuclear trafficking. In close cooperation with our international partners and in line with international standards, we have developed a comprehensive national export control system with a solid legislative basis. To date, the system has proved to be a reliable mechanism in the prevention of illicit nuclear trafficking.

In that regard, there is a need to further strengthen the concept of the generally accepted legally binding commitments concerning the non-use of nuclear weapons and nuclear technologies for military purposes. International cooperation has always been at the centre of Azerbaijan's efforts in the field of nuclear security and safety. Our activities have been target- oriented and conducted in a spirit of mutual respect and cooperation. Azerbaijan, which recognizes and commends the central role of the International Atomic Energy Agency in the development of nuclear security regulations and standards, has engaged in successful cooperation with the Agency on various aspects of nuclear security. Needless to say, nuclear security and non-proliferation issues are closely interconnected.

  32. First of all, I would like to thank the Secretary-General for his comprehensive briefing. Azerbaijan shares the position of the Non-Aligned Movement (NAM) on the issue, as reflected in the letter and the annexes thereto contained in document S/2012/223. Azerbaijan shares the common concern of the international community over the growing nuclear dangers and risks. Since the very first days of its independence, my country has attached great importance to nuclear security. We acknowledge the international efforts made to ensure the strict global implementation of the Treaty on the Non-Proliferation of Nuclear Weapons (NPT). At the same time, we see that the international mechanism and verification regime are not strong or effective enough to prevent the illegal proliferation of nuclear technologies.

Finally, I would also like to note that the requirements of resolution 1737 (2006) and international norms of non-proliferation, including combating illicit trafficking, cannot be applied to the almost 20 per cent of the internationally recognized territory of Azerbaijan that is currently occupied by neighbouring Armenia, as a consequence of which Azerbaijan does not control 132 kilometres of its southern border.

The Republic of Azerbaijan attaches the utmost importance to preventing the use of its territory as a transit route for the illicit trafficking of items and materials related to the proliferation of nuclear weapons and weapons technology. In our View, preventing the spread of nuclear weapons is the most important security challenge that the international community is currently confronting. But in pursuing that goal, we cannot deny the right of any country to develop its nuclear industry for exclusively peaceful purposes, under strict international control.

It is essential that the Committee continue to solicit national implementation reports from Member States and, with the support of the Panel of Experts working constructively with them, to increase the number of such reports. Azerbaijan welcomes the fourth quarterly assessment of Member States' implementation reports. We note the work done so far by the Panel of Experts in drafting the implementation assistance notices, and hope that that work can be finalized in a timely manner.

  37. Undoubtedly, stronger regional ties based on mutual confidence and common vision will also lead to an increase in foreign investment in Afghanistan from the region and beyond. Basing its approach on the principle of the indivisibility of security and its close relations with Afghanistan, Azerbaijan decided from the very outset to contribute to international efforts designed to enhance the security, stability and prosperity of the country. Azerbaijan joined the International Security Assistance Force almost from its beginning and has steadily increased its military contribution to it. Azerbaijan is expanding its engagement in non- military spheres by contributing to developing capacity-building in Afghanistan.

We look forward to the forthcoming Chicago conference on security matters and the Tokyo conference on development issues, which will give specific shape to the framework and parameters of the international engagement in Afghanistan after the transition period. We commend the strengthening of regional dialogue and cooperation, which are necessary in the broader context of stabilization efforts. In that regard, the positive momentum gained after the Istanbul Conference in November 2011 should be further developed, and we consider the follow-up ministerial conference to be held in Kabul in June 2012 to be an important step towards ensuring greater coherence among existing regional mechanisms.

As the transition period continues towards the eventual withdrawal of international military forces and the assumption of overall security responsibility by Afghan security forces by the end of 2014, it is becoming increasingly imperative that the international community maintain its active support of the Government of Afghanistan. Meanwhile, the timely implementation of mutual commitments assumed at the Bonn Conference is of paramount importance to ensure that the transition period will lay a solid foundation for the transformation decade of 2015-2024, during which Afghanistan will be able to consolidate its sovereignty by strengthening a fully functioning and sustainable State.

  40. We are encouraged by positive political developments in Afghanistan, in particular by the progress achieved so far in the implementation of the Afghanistan Peace and Reintegration Programme. We expect that the mandate of UNAMA, renewed on the basis of full recognition of Afghan sovereignty and the progress made in recent years, will ensure more coordinated, coherent and efficient work on the part of the United Nations in Afghanistan. Despite some decrease in security-related events during the reporting period, the precarious security situation continued to pose a serious threat to the overall peace and stabilization efforts in Afghanistan. Recent incidents demonstrate that additional resolute measures are needed to eliminate civilian casualties, which along with being a human tragedy also seriously undermine the national and international efforts towards peace and reconciliation.

I would also like to thank our colleague, Ambassador Tanin, for his statement. While presenting a record of positive developments during recent months in Afghanistan, the report and the briefing testify to the need for increased efforts, including through a continued United Nations presence, to tackle the existing security, economic, humanitarian and other challenges in the country. The United Nations Assistance Mission in Afghanistan (UNAMA) plays a critical role in supporting the Government of Afghanistan.

As a country that suffers from prolonged occupation of its territories and the resulting massive population displacement, Azerbaijan believes that the same understanding should apply equally to inter-State relations. The behaviour of Governments that resort to force to capture the territory of another sovereign State and authorize attacks on civilians and ethnic cleansing cannot be tolerated. It is of paramount importance that the international community unite its efforts and speak with one voice to reject repressive policies in inter-State relations, overcome mutual mistrust and double standards, and achieve the uniform application of international law and democratization of international relations.

We are of the strong view that the only solution to the crisis in Syria is through an all-inclusive and Syrian-led political process, where all national stakeholders demonstrate determination to solve the crisis peacefully. With respect to the occupied Palestinian territories and similar situations in other parts of the world, we proceed from the importance of reaffirming the continuing applicability of all relevant international legal norms, achieving the invalidation of activities aimed at the consolidation of military occupations, initiating urgent measures towards removing the adverse effects of such activities and discouraging any further practices of the same or a similar nature.

Apart from the impact on the rights, freedoms and everyday lives of the Palestinians, settlements cause serious damage to the peace process and, more dangerously, threaten a two-State solution and the emergence of a viable Palestinian State. In that regard, I would like to stress once again that, in contrast to some other well-known situations involving groundless and illegitimate territorial claims, including those under the concocted pretext of care for ethnic minority groups, the right to self-determination and statehood of the people of Palestine has been recognized.

Azerbaijan commends the reconciliation efforts of the national authorities in a number of countries of the Middle East to find negotiated and effective solutions, with the participation of all strata and political forces of their societies. We regret seeing the lack of progress in the Middle East peace process. At the same time, Azerbaijan commends and highly values the consistent efforts of Jordan to revive the dialogue and resume the negotiations towards the achievement of a comprehensive, just and lasting solution. Azerbaijan is deeply concerned about the continuing illegal settlement activities in the occupied Palestinian territories.

At the same time, in spite of the promises brought by the process of democratic transition, one should not forget that it is an extremely responsible stage in the history of the Middle East that demands the highest vigilance and laborious work in order to rule out miscalculations and unpredictability as to the region's future. The method of violence as a means of achieving political objectives is not itself a democracy, which cannot be propagated by the sword and imposed from outside. Any process within either an individual State or a region as a whole should be built on a sound legitimate basis, while progressive economic and democratic development should be an objective for all Governments.

  50. The upheavals that set some countries of the region on the path of transformation have fundamentally reshaped the typical set of features that once characterized the region. The changes reflect the natural aspirations of people for greater freedom and wider political participation. Against that backdrop, the will and tenacity of people to write their own future within democratic States, with functioning State institutions and respect for the rule of law and human rights, should be commended and supported. We believe that consistency and incessant efforts will lead to the achievement of targeted objectives.
