We fully subscribe to the Secretary-General's call for implementing the decisions adopted at the Yaounde Summit of Heads of State and Government on Maritime Safety and Security on 24 and 25 June, which will pave the way for strengthening subregional and interregional cooperation in order to enhance maritime security in the region. We note with concern the growing menace that poaching and illicit trading in ivory pose to sustainable peace and stability in Central African States. Such cross-border criminal activities, which have reached alarming levels, are among the major sources of financing for various transnational criminal networks and armed groups, including the LRA.

  2. The multifaceted challenges destabilizing the Sahel region require a comprehensive and multidimensional response at the national, regional and international levels. The United Nations Integrated Strategy for the Sahel creates a solid framework for addressing the drivers of chronic instability in the region. Special emphasis must be placed on enhancing coordination and mobilizing resources to promote inclusive economic growth in the Sahel. We therefore welcome the Secretary-General's continuing engagement, including through his recent mission to the region, aimed at galvanizing international support for the affected countries. Piracy and armed robbery in the Gulf of Guinea represent another serious threat to the security and economic development of the Central African subregion.

The negative impact of the crisis on the region and various regional processes, including efforts to address the threat posed by the Lord's Resistance Army, require the swift implementation of all transitional arrangements and the urgent restoration of the rule of law and the reinstatement of constitutional order in the country. We commend the mediation efforts ofthe Economic Community of Central African States (ECCAS) aimed at solving the crisis, and the support that other regional institutions have provided to ECCAS. Azerbaijan welcomes the decision of the African Union Peace and Security Council to authorize the deployment of an African-led international support mission in the Central African Republic, as well as resolution 2121 (2013), adopted by the Security Council last month.

I thank Special Representative of the Secretary-General Abou Moussa for his comprehensive briefing and for presenting the Secretary-General's report (S/2013/67l) on the activities of the United Nations Regional Office for Central Africa (UNOCA) and on the areas affected by the Lord's Resistance Army (LRA). The complex political, security and humanitarian crisis in the Central African Republic continues to have an adverse impact on the stability and security of the entire Central African subregion. We note with serious concern the deteriorating situation in the country due to increasing violence, widespread criminality, the circulation of weapons and rising numbers of refugees and internally displaced persons.

In that connection, we commend the efforts of the Office ofthe United Nations High Commissioner for Refugees, the International Organization for Migration and UNMIK in monitoring the process and implementing the necessary policies towards the facilitation of returns. The question of security should be of high priority, among others. We also commend the efforts of UNMIK and contributions by other international partners to facilitate UNESCO's activities in Kosovo for the purposes of the restoration of the culture and religious heritage. In conclusion, I would like to commend UNMIK, under the leadership of Special Representative Zarif, for its sustained efforts towards the maintenance of peace and stability in Kosovo and overcoming multiple challenges to make that objective possible.

  6. Except for sporadic violence in northern Kosovo, it is a positive sign that the overall security situation in Kosovo remained generally calm during the reporting period. However, it is clear that much work is yet anticipated for the maintenance of permanent stability. The unresolved legacies of the conflict should remain among key priorities so as to ensure that all those responsible for war crimes and other criminal acts are brought to justice. More efforts are also needed to resolve the fate of persons who are still missing as a result of the conflict. The voluntary return of internally displaced persons to Kosovo, although not significant, nonetheless improved during the reporting period.

We take positive note of the fact that the sides met on a regular basis during the reporting period and commend both Belgrade and Pristina for their efforts towards consolidating their important achievements. Recent agreements in the fields of telecommunications and energy, as well as the police and the judiciary, can be seen as a good starting point that can be replicated for securing agreements in other relevant areas. We take note of the efforts towards the seamless conduct of the Kosovo municipal elections. We encourage the sides to continue to remain committed to reaching an agreement on the contentious issues through mutually acceptable solutions. That is indispensable to greater stability and well-being in the region.

It is noteworthy that the Mission continues to work closely with the communities on the ground and to collaborate with all other mandated international presences to enhance the prospect of success in the political dialogue. UNMIK should maintain and further develop its key role in ensuring the coordination of all international efforts on the status-neutral framework as envisaged in resolution 1244 (1999). Azerbaijan welcomes the commitment of the parties to the European Union-facilitated dialogue and the progress achieved so far in the implementation of the agreement on principles governing the normalization of relations of 19 April and the subsequent implementation plan of 22 May.

  9. I thank the Special Representative of the Secretary-General Farid Zarif for his briefing. We welcome the participation in today's meeting of the Prime Minister of Serbia, His Excellency Mr. Ivica Dacic', and thank him and Mr. Thaci for their statements. I would like to reaffirm the position of Azerbaijan, which is based on respect for the sovereignty and territorial integrity of the Republic of Serbia and non-recognition of Kosovo's unilateral declaration of independence. Resolution 1244 (1999) remains the binding international legal framework for a comprehensive settlement through a political process and negotiations. Once again, we want to underline the important role of the United Nations Interim Administration Mission in Kosovo (UNMIK).

  10. Fifthly, the concept of complementarity is the cornerstone of the operation of the International Criminal Court. We believe that Kenya is capable of investigating the alleged post-election crimes, and we take note of its ongoing efforts and measures in that regard. Azerbaijan voted in favour of the draft resolution before us today to express its support for the deferral of the investigation and prosecution against the President and Deputy President of the Republic of Kenya for a period of 12 months, in accordance with article 16 of the Rome Statute of the International Criminal Court.

Thirdly, the Government of Kenya has demonstrated a strong commitment to fighting impunity and to complying with its international obligations, including those deriving from the Rome Statute of the International Criminal Court, to which Kenya has been a party since 1 June 2005. It should be particularly noted that both the President and the Deputy President of the Republic of Kenya have extended full cooperation to the ICC process. Fourthly, the Government of Kenya has made considerable efforts to restore the stability and security in the country since the 2007 post-election political crisis. The peaceful and democratic conduct of the general elections in March is illustrative of the country's progress and determination to move forward.

In that connection, the judicial proceedings against the country's senior officials would undoubtedly create serious obstacles to the normal functioning of State institutions in Kenya and thereby pose a threat to the ongoing efforts to ensure and promote peace and stability in the region. Azerbaijan understands the concerns of Kenya and the African Union, and deems them legitimate and reasonable. Secondly, the request for deferral cannot be considered a measure of impunity. It is important that the draft resolution recalls the need to fight impunity and to hold accountable all perpetrators of the 2007- 2008 post-election violence in Kenya.

  13. Azerbaijan is not a party to the Rome Statute of the International Criminal Court (ICC). Nevertheless, we strongly believe that the protection and vindication ofrights, as well as insistence on accountability, contribute to the maintenance of international peace and security. Our decision to vote in favour of the draft resolution before us today is based on the following understanding. First, Kenya and the region in which it is situated are facing complex security challenges. Kenya is a front-line State in and one of the key regional contributors to the fight against international terrorism.

Another issue of concern requiring attention is non-enforcement of the decisions of the Constitutional Court of Bosnia and Herzegovina. That constitutes a violation of the General Framework Agreement, undermines the rule of law and erodes respect for the authority of the highest judicial body in the country. In conclusion, we reiterate our call on all stakeholders in Bosnia and Herzegovina to engage in constructive dialogue with a view to addressing the pressing challenges, overcoming the political stalemate and strengthening the stability and unity of the country.

We once again express our concern about the continuation of direct and open challenges to the fundamentals of the Dayton Peace Agreement, including in particular the sovereignty and territorial integrity of Bosnia and Herzegovina. Azerbaijan condemns divisive rhetoric advocating the dissolution of the State and any action or attempt to challenge the functionality of the State, its constitutional responsibilities and the core provisions of the General Framework Agreement. We would like to emphasize in that regard that neither the General Framework Agreement nor general international law contains any provision invoking the claimed right to self-determination for the purpose of unilateral secession from or dissolution of the State.

  17. During the reporting period, important progress was made towards unblocking the long-delayed appointments to the Federation Constitutional Court and its Vital National Interest Panel. We commend the High Representative for his efforts in that regard. There were also some positive developments on the economic front during the reporting period, although the overall economic situation remains complex, with a high number of persons unemployed and a difficult fiscal situation. We agree with the High Representative that much more should be done to realize the country's full potential for significant growth. Despite the aforementioned positive developments, Bosnia and Herzegovina continues to face a number of challenges.

It is particularly encouraging that the Bosnia and Herzegovina authorities have continued their path towards completing the "5+2" agenda, which is necessary for the closure of the Office of the High Representative. In that regard, we note the regular meetings of the ministerial working group established earlier this year with the purpose of solving the State- and defense-property issue and the drafting of legislation on the matter. We encourage the Government to continue its efforts to that end. Among the achievements registered were also regular meetings of the Federation institutions, the adoption of a number of new laws and amendments to existing laws by the Government and the Federation Parliament, and the holding of the first post-war census of population and households in Bosnia and Herzegovina.

  19. Let me start by congratulating you, Mr. President, and your delegation on your assumption of the presidency of the Council for this month. I wish you and your team every success. I would like to thank Mr. Valentin Inzko, High Representative for Bosnia and Herzegovina, for presenting the forty-fourth report on the implementation of the Peace Agreement on Bosnia and Herzegovina (S/2013/646, annex). We welcome the adoption earlier today (see S/PV.7055) of resolution 2123 (2013), authorizing the renewal of mandate of the European Union-led force Operation Althea. We note that the security situation in the country continued to remain stable during the reporting period. According to the report of the High Representative, the intensity of the political crisis in the Federation entity diminished.

  34. However, three months into the set time frame, and in spite of many rounds of talks, Israeli authorities continue settlement expansion. The Peace Now movement, along with other Israeli commentators and human rights organizations, could see in that only a lack on the part of their Government to a "genuine intention to negotiate seriously". Moreover, empowered with a sense of impunity, Israeli settlers multiply their assaults on Palestinian civilians and their properties, attacking elementary schools and terrorizing children, robbing farmers of their livelihood by uprooting their olive trees, and vandalizing churches and mosques. Clearly, such actions threaten to undermine the prospects for the Palestinian-Israeli negotiations. The Council must condemn them in the strongest terms.

We welcome the adoption of resolution 2118 (2013), regarding the chemical weapons in Syria, and the presidential statement of 2 October of this year on the humanitarian situation there (S/PRST/2013/ 15). Lebanon considers that those united actions by the international community should lead to putting an end to violence, provide for a safe and dignified gradual return of Syrian refugees to their country and pave the way to a political process that will fulfil the aspirations of the Syrian people. On 31 July, Palestinian-Israeli negotiations resumed, owing to the efforts of the United States Administration and with an initial time frame of nine months to achieve progress. Like many other countries, we commended the United States efforts in that regard and were ready to see signs of hope in them.

  36. More than 170,000 Lebanese will be pushed into poverty by 2014." In his address to the General Assembly last month, the President of the Republic of Lebanon, General Michel Sleiman, warned that this grave situation has begun to have an "existential dimension" for my country. In his meeting in Beirut last week with representatives of the members of the International Support Group, he stressed that the financial burden- sharing is still insufficient. He said the relocation of refugees remains symbolic - 17 countries have hosted only a few thousand refugees, while the international community faces difficulties in providing them shelter within Syria, notwithstanding that Syria is 18 times larger than Lebanon.

  37. With the ongoing Syrian crisis, the number of refugees from Syria has come to represent the equivalent of one fourth of the population of my country. Over and above the obvious humanitarian challenges, a recent World Bank report has underlined the severe negative socioeconomic impact of the Syrian crisis on Lebanon. The report notes that "the Lebanese growth is estimated to be down by 2.9% this year Government expenditures will increase by an estimated $1.1 billion over the 2012 to 2014 period while its revenues will drop by $1.5 billion. Unemployment could reach 20 per cent over the same period.

  38. Again, let me reiterate my country's deep appreciation for that message of political solidarity. Capitalizing on the consensus articulated in the aforementionedpresidential statement, on 25 September the Secretary-General launched the International Support Group for Lebanon, stressing the need for "strong, coordinated international support for Lebanon to help it continue to withstand the multiple current challenges to its security and stability" (S/PRST/2013/9, p. 3). Lebanon looks forward to the enlargement of that group, and the convening of follow-up meetings to address its specific needs for coping with the humanitarian crisis resulting from the influx of refugees from Syria, to enhance the Lebanese army's capabilities and to provide for Lebanon's economic and financial needs.

Thus, we believe that this is an opportune moment for the Council to translate its support into a strong message urging Israel to completely withdraw from the remaining Lebanese occupied territory, to end its violations of Lebanese sovereignty by land, air and sea and to refrain from taking unilateral action that violates its obligations under international law. Convinced of the importance of a stable Lebanon for the maintenance of peace and security in the region, the Council adopted a presidential statement (S/PRST/2013/9) on 11 July, renewing its support for Lebanon's sovereignty, territorial integrity and independence, and endorsing Lebanon's disassociation policy vis-a-vis the situation in Syria, as well as the Baabda Declaration of 11 June 2012.

  40. I would also like to commend the Permanent Representative of Australia and his team for their excellent work during their presidency last month. When faced with challenges threatening the core of their stability and security, countries explore all ways and means to build partnerships, strengthen them, and establish safety nets. In that context, Lebanon reiterates its commitment to the full implementation of resolution 1701 (2006), unanimously adopted by this organ on 11 August 2006. Likewise, over the past seven years, everyone present here has been expressing their unwavering support for the full implementation of the above-mentioned resolution.

With regard to Syria, we welcome the efforts carried out so far towards the fulfilment of the objectives laid down in resolution 2118 (2013) and the relevant decision of the Organization for the Prohibition of Chemical Weapons Executive Council. It is imperative that all parties cease armed violence, engage constructively in the political process and commit to the implementation of the Geneva communique (S/2012/523, annex). The convening ofthe "Geneva II" conference in the coming weeks is necessary to bring about the parties' engagement in dialogue and negotiation. In conclusion, we would like once again to express our firm conviction that peace and security in the Middle East is possible through the dedication and hard work of all involved, and with the indispensable support of the international community.

  43. The Council must take all necessary measures to ensure that international law, human rights and fundamental freedoms are observed and respected at all times and without preconditions. The economic, financial and humanitarian situation in the occupied Palestinian territory requires the constant attention of the international community. Further easing of restrictions on the Palestinians' movement, the providing of access, and the easing of financial restrictions are necessary. The continued support of the international community for a socioeconomic revival of the State of Palestine is very important. We are convinced that there is no room for religious or ethnic intolerance in the Middle East. People must live together, hence they must seek ways ofbuilding peace and good-neighbourly relations in the region.

  44. Such practices are illegal under international law, and they must be stopped immediately and unconditionally, regardless of the course of negotiations and their outcome. Pursuant to article 49 of the Fourth Geneva Convention, of 12 August 1949, "[t]he Occupying Power shall not deport or transfer parts of its own civilian population into the territory it occupies." That both constitutes the basis of and explains the rule of law prohibiting the establishment of settlements in the occupied territories consisting of the population of the occupying Power, or of persons encouraged by that Power to settle in those territories with the intention, expressed or otherwise, of changing the demographic balance.

Among the necessary prerequisites for success is the need to ensure that the process and all efforts are guided by normative standards set by the Charter of the United Nations, as well as by the objective of a comprehensive settlement based on international law. We have repeatedly stated that the lack of agreement on political issues in situations of armed conflict and military occupation cannot be used as a pretext for failing to uphold international law and human rights. Settlement activity in the occupied Palestinian territory remains a matter of serious concern. No doubt, the increase in new settlements in the West Bank and East Jerusalem may adversely affect the delicate situation on the ground. They constitute a serious threat to the peace process and infringe upon the rights and freedoms of the Palestinians.

  46. I shall now make a statement in my capacity as the representative of Azerbaijan. We thank Under-Secretary- General Jeffrey Feltman for his comprehensive briefing. The past couple of weeks have been remarkable in terms of the revitalization of the Middle East peace process, and the continuation of the direct talks between the parties. We welcome the recent meeting of the Middle East Quartet, which was held on the margins of the United Nations General Assembly in New York on 27 September. We hope that the parties will demonstrate continued dedication and good faith to the quest for a lasting solution.
