Their deployment has created the space for political progress, for humanitarian relief efforts and for Somalia's political and State institutions to grow. There is no doubt that without their support and sacrifices, we would not have accomplished what we did in such a short period of time. But we are now entering a new phase of transition. President Mohamed Farmajo is committed to Somalia's security forces, assuming responsibility for security in due course and gradually taking over tasks and posts from AMISOM. We also recently provided the Council with information on an investigation into crimes against peacekeepers of African Union-United Nations Mission in Darfur and aid workers, as well as information on all ongoing judicial proceedings. We will also transmit to the Council information about the sentences of the court. All that clearly shows the willingness and ability of the Sudanese justice system to deliverjustice. It also serves to highlight the fact that national legal measures are ongoing in Darfur - in contrast to the briefing and the report that was presented to the Council.

  7. We also recall the decision taken by African leaders that no African President should not be brought before the ICC or any foreign court while they are in office. A failure to respect Africa's will and its right to deal with its own cases would run counter to the right of people to democracy and freedom. Great strides have been made to implement all aspects of the the Doha Document for Peace, including justice and reconciliation. As I mentioned at the beginning of my statement, we have provided the Council with ample information on the measures taken by the prosecutor of the special court for Darfur. Those measures have resulted in sentences of capital punishment against six people on the Abu Zereiga incident.

  8. We have provided the Council with a great deal of information concerning the special court for Darfur and the trials of those who committed crimes. That serves to highlight the willingness of the Government of the Sudan to end impunity and the fact that the judicial system in my country is willing and able to do so. Perhaps the Council has taken note of the position of the African Union following its contact group to the region in November. I also wish to recall the emergency Summit held in Addis Ababa in October. Perhaps that will serve to remind us that the African Union has lost entire confidence in the ICC given the distortion of the Rome Statute owing to the politicization of international justice, which many had warned against.

  9. The briefing serves to underscore the fact that the ICC has taken on the role of a judge and become the political rival of the Sudan. The Prosecutor provided alleged information without citing the sources or without any member of her team having been given impartial information. The information came from biased sources. The briefing ignored all the positive developments in Darfur as a result of the implementation of the Doha Document for Peace by the Darfur transitional Authority, including all the steps taken by the special court to begin to bring to justice those alleged to have committed crimes in Darfur. The Prosecutor also did not mention the willingness ofthe Sudanese judicial system to combat impunity, nor its ability to do so.

What we have heard from the ICC Prosecutor reminds one of the statement made by the Minister for Foreign Affairs of a Member State of the Council to justify her country's failure to join the ICC: that the privileges conferred upon the Prosecutor amounted to powers greater than those of Governments. The briefing we have heard today is a perfect example of that. The Prosecutor has addressed the Council as if she were giving members orders. While serving to highlight that justification, the briefing also did not address the crux of the matter and strayed into addressing the relations between the Sudan and South Sudan, as well as the status of Abyei - almost as ifthe Prosecutor had become ajudge and had more power than Governments.

We strongly support the resolution just adopted, in which the Security Council expresses its concern with regard to the Ngok Dinka decision to hold a unilateral referendum, which would run counter to all signed agreements between the two countries and the two Presidents and has been rejected by the Security Council and the African Union. In conclusion, we need wisdom and self-restraint. We do not need to add fuel to the fire or to propagate a culture of war. What we need from the Security Council is support for the efforts of the two Presidents. Those efforts are making progress on a daily basis and upholding the interests of both countries. We do not need to take a path that undermines those agreements and could lead to war and conflict.

  13. It also sets back the normalization of relations that we seek, that is now at hand and that is being improved and developed on a daily basis. We support the provisions of resolution 2126 (2013) extending the UNISFA mandate because we believe that the continued delay in establishing and building the temporary administrative institutions and arrangements in Abyei is exacerbating tensions in the region. We are ready to agree immediately, today, to the formation of such temporary administrative mechanisms and arrangements. Those who are hesitant to set up those mechanisms must be encouraged to move forward towards their establishment so that they can pave the way for the two Presidents to agree on the final status. Those are the agreements that have been reached and signed between the two countries.

The terms "occupation" and "aggression" are incorrect because the Abyei region is part of the Republic of the Sudan, whereas occupation usually occurs when foreign forces invade and occupy a certain area that does not belong to them. We are completely committed to the provisions of the Abyei Protocol requiring the holding of a regional referendum to determine its fate as belonging either to the Sudan or to South Sudan. However, it would be unacceptable for the referendum to be held unilaterally - which the Council, the African Union and the Presidents of both countries have rejected - and even more so when it is called for from a singular, personal perspective. It undermines the security and stability of the region, the Sudan and South Sudan.

The answer is that we are here to defend our national interests - the interests of the Sudan in its entirety, from the far North to the far South, and the interests of South Sudan, from its far North to its far South. What we have heard today, however, speaks of narrow and, unfortunately, personal interests that are not in tune with the reality that exists between our two countries. We all know that the region of Abyei, as per the Comprehensive Peace Agreement and its clear and indisputable provisions, is part of the Sudan and will remain so until its final status is decided. Therefore, the use of such terminology as "aggression" and "occupation" is technically incorrect. I would therefore ask my colleague, the representative of the State of South Sudan, not to use them, especially since he is an experienced diplomat.

My brother representative speaks of a reality that is entirely removed from the spirit of cooperation and solidarity that exists between the Presidents of our two countries, the Sudan and South Sudan. The reality is that everyone is working constantly to normalize relations in order to open borders and facilitate the movement of citizens and trade. Unfortunately, what we have just heard rings with echoes of war and a culture of war that refers to events already far back in history. That leads me to wonder whether we are in the Council as representatives of our States, of our narrow regions according to our national affiliations, or of our wider affiliations, interests and demands?

I can confirm to the Council that such attacks and intercommunal fighting have now been contained and that, in that regard, we are cooperating with all parties of influence at the regional level in order to promote reconciliation between the tribes. The events of the past month have been contained, and fighting has now ceased between the tribes. Paragraphs 47, 48 and 49 of the report reflect a decrease in cases of violations of the right to life, of violations of the right to physical integrity, and of sexual and gender-based violence - all as a result of the implementation of the Doha Document for Peace in Darfur.

  20. I wish to confirm that we are going to continue along that path in order to convict all perpetrators of those crimes. The Government of the Sudan is also pursuing its efforts and investigations to bring to justice all those people involved in attacks against UNAMID. In conclusion, I would like to underscore that the report before us today states in paragraph 13 that intercommunal fighting over land and other natural resources poses a serious threat of physical violence to civilians. Furthermore, paragraph 41 of the report underscores that intercommunal fighting in East Darfur was responsible for the humanitarian situation.

The report befoe the Council today (S/2013/607) confirms in paragraph 7 that the Special Prosecutor for Darfur informed UNAMID that he had, since being appointed in June 2012, brought to trial nine cases of serious crimes resulting in 42 convictions, and that he was investigating another 57 cases. In that regard, we reaffirm his assertion that the Sudanese justice system is qualified and capable of meting out justice and make rulings in cases. I would like to underscore that during his visit to New York last month, the Sudanese Minister of Justice - who, as I said earlier, is from the Zaghawa tribe of Darfur - met with the Secretary-General. In that meeting, the Secretary-General praised the Minister's efforts to combat impunity and to lift the immunity enjoyed by certain indictees.

  22. Priority is currently being given to the implementation of the development strategy in Darfur that was approved at the donor conference that took place in Doha in April 2013. The report presented to us today (S/2013/607) discusses in great detail the measures taken in that regard in coordination with UNAMID and the United Nations Development Programme. Thus, and given the progress that has been made in terms of implementing the Doha Document, we strongly urge the international community, in particular, the Security Council, to support that progress. It is extremely important, as I have already said, to exert the necessary pressure on the rebel movements that refuse to join the peace process to do so swiftly and without any preconditions.

Ladsous acknowledged that fact when he met with the Sudanese Minister of the Interior during his visit to New York last month; he also mentioned it in his meeting with the Sudanese Minister for Justice, who is from Darfur, specifically from the Zaghawa tribe. Those two Sudanese leaders met with senior officials of the United Nations, including the Secretary-General, and confirmed the Sudan's cooperation and its determination to help UNAMID carry out its role in the most effective manner. I can confirm today that the Sudanese Government is absolutely determined to continue its work along the lines set forth heretofore, both here in New York, within the Secretariat, and in the Sudan as well, in order to facilitate UNAMID's mission. We have also heard the positive news regarding the Doha Document for Peace in Darfur and its implementation.

  25. We also expect the African Union-United Nations Hybrid Operation in Darfur (UNAMID) to fully shoulder its role, in particular because UNAMID is made up of peacekeepers and military personnel. The military personnel should carry out their duties and deal with the assailants, first and foremost to defend themselves, and then to carry out their mission to maintain peace in Darfur. In other words, the inability of the UNAMID military personnel to defend and protect themselves against attack, as well as the Mission's inability to shoulder other tasks, raises many questions. As I begin my statement, Iwould also like to reiterate the Government of the Sudan's condemnation of the incident in which one Zambian and three Senegalese peacekeepers died, and to once again express the condolences of the Government of the Sudan to the Governments of Zambia and Senegal. I would also like to underscore the fact that the Sudanese Armed Forces have clashed with the perpetrators of those incidents in which peacekeepers and two members of the militias were killed, and a vehicle was recovered after it had been intercepted by the assailants. In addition, a soldier from the Sudanese Armed Forces died and another was injured in that incident. The latter is currently in the hospital. The incident demonstrates with all certainty the commitment of the Sudanese Government to dealing with the acts perpetrated by the armed movements.

  27. Mr. Osman (Sudan) (spoke in Arabic): I would first like to congratulate you, Mr. President, on the way you have guided the Council this month. During your Security Council membership, which ends in a little more than two months, you have demonstrated your ability to contribute to the maintenance of international peace and security, thanks to your objective approach. The abductions and massacres committed by the rebel movements in Darfur against the civilian population and peacekeeping troops are a major concern for the Government of the Sudan, and far more so than for the other parties involved. We hope that all the efforts being made in this area can be coordinated to support those of the Sudan to end the conflict in Darfur, so as to re-establish peace and stability and, as a result, prosperity for the people of Darfur.

I thank the Council and would like to reiterate that we remain in contact with Mr. Mohamed Ibn Chambas, Joint Special Envoy for the African Union-United Nations Hybrid Operation in Darfur, who is today beginning negotiations in Arusha, United Republic of Tanzania, to convince the rebels to join the peace process. We have reiterated at all levels that the Sudan intends to continue to negotiate with them in order for them to join the peace process and move towards stability and peace in the Sudan. That will have a positive effect not only on the Sudan but also on our brothers in South Sudan and the region as a whole. We therefore appeal to all the members of the Council that could make a difference to try to influence the rebels to come to the negotiating table so that we can peacefully resolve the conflict. I would therefore have hoped that the Council would have been able to explain who the responsible party was for creating those obstacles, rather than putting the parties on an equal footing, which is not actually true in the case of the humanitarian situation in the regions of Southern Kordofan and Blue Nile. I had also hoped that, in that paragraph, the Council would have condemned the position of SPLA-North and referred to the other rebel groups that support it, as they have terrorized civilians and exposed them to killings and displacements in Southern Kordofan and Blue Nile. The fact that this was not explicitly mentioned could encourage the rebels to continue terrorizing civilians and exposing them to various types of violence, murder and displacement. I would have appreciated that.

  30. I reiterate that the Government of the Sudan has always cooperated and will continue to cooperate to ensure that urgent assistance is provided to those two regions. The Council is surely also aware of that the obstacles and the non-delivery of such assistance is due to the fact that the Sudan People's Liberation Army (SPLA)-North and some other parties have rejected the tripartite initiative of the African Union, the League of Arab States and the Organization of Islamic Cooperation, which we have accepted. I would like to repeat that when the Special Envoy of the Secretary-General is able to convince the other party to implement that initiative, we will also be prepared to do the same.

The regional mediation mechanism known as the African Union High- Level Implementation Panel on the Sudan, headed by Mr. Thabo Mbeki, plays a very important role in promoting peace within the Sudan and between the Sudan and South Sudan. That is a constructive example of cooperation that should be strengthened and promoted. Such mechanisms should be accorded sufficient time to finish settling all outstanding issues between the two countries. In conclusion, I would like to second and support the affirmation, made by a number of speakers before me, that regional and subregional organizations are more specifically qualified to achieve peace and security in their regions because of their knowledge of the culture, nature and specific characteristics of the areas of conflict within their respective regions.

  40. We support in particular its condemnation of the assassination of Mohamed Bashar, as well as the unfortunate incident in which seven Tanzanian soldiers lost their lives. We reiterate our condolences and our willingness to work with the Security Council to pursue our investigations and arrest those responsible. The attack was merely an attempt to undermine the Darfur peace process. We reiterate the principled position of the Government of the Sudan that a solution to the conflict cannot be found other than through negotiations and the peace process, which the rebel attacks on UNAMID are attempts to forestall. We hope that the Security Council will help the Government of the Sudan in its ongoing efforts to achieve peace, security and stability in my country.

We echo the Security Council's concern over the failure of certain parties to sign the peace agreement. All direct and indirect support for those movements must be halted. As for the crimes that have been committed in Darfur, we welcome the investigations undertaken by the Special Prosecutor, and commend the Security Council for encouraging that process. We also welcome the Council's support for the Doha Document for Peace in Darfur, and commend its refusal to accept the lack of support on the part of certain parties to the peace agreement and its insistence that those movements end their hostilities. The Security Council has condemned every act of violence in Darfur.

  42. Mr. Osman (Sudan) (spoke in Arabic): At the outset, I should like to thank all members of the Council for their cooperation in drafting resolution 2113 (2013). We welcome the renewal of the mandate of the African Union-United Nations Hybrid Operation in Darfur (UNAMID), in accordance with resolution 1769 (2007), under which it was established. We also reaffirm the importance of coordinating and discussing these issues with the Government of the Sudan in order to consider all measures undertaken towards the renewal of the mandate. In that regard, I refer in particular to the review provided for in paragraph 3 of the resolution, to be conducted in close consultation with the African Union and the Secretary-General, who is requested to present his recommendations in February 2014.

Last week, a leader of one of those groups, Mr. Abdul Wahid Mohamed Al-Nur, was bold enough to criticize the decisions on Darfur of the African Union Peace and Security Council, implying that he refuses to cooperate in seeing the peace process through to completion. In conclusion, I would like to emphasize my Government's firm resolve and willingness to achieve a comprehensive settlement of the Darfur conflict and a future of stability and peace, through the efforts of the African Union and the Joint Special Representative, working with the Doha Document for Peace in Darfur.

By the same token, we emphasize the need for the mission to be able to defend itself effectively, so that it will not be easily targeted by those rebel groups that wish to impede the peace process and send negative messages to the effect that there is instability in the region. We acknowledge the commendable efforts made by Mr. Mohamed Ibn Chambas in the political arena, as well as his endeavours to persuade those movements that have rejected peace to join the peace process. However, the international community's support for those efforts, through the clear messages conveyed to the movement leaders, has also been significant. We should also emphasize the importance of the role played by States of the region in achieving success in the peace process by ensuring that they give no support or shelter to any groups that reject peace.

  45. We emphasize the need to pursue the criminals and bring them to justice. Two hours ago I was speaking with the Special Prosecutor for Darfur Crimes, who told me that he is in contact with UNAMID authorities with a view to securing the arrest of those who carried out that barbaric attack. We emphasize the need for UNAMID to cooperate and coordinate with the local authorities in Darfur, with a view to guaranteeing the safety and movement of the mission's personnel. I should like, before the Council today, to emphasize the importance we place on coordination. That does not mean that we want to change the mandate of the mission. The intention is not to restrict the movement of the mission; on the contrary, we are more interested in safeguarding the safety and security of the mission's personnel.

In that connection, we would like to acknowledge the appreciable efforts deployed by the central Government, in coordination with the Darfur Regional Authority, to convene a conference on peaceful coexistence among the tribes as well to settle differences with no tribal discrimination. That is in addition to the considerable efforts made by local governments in Darfur. The report before the Council refers in paragraph 24 to the strenuous efforts made by Southern Darfur to settle the conflict between the Gimir and Beni Halba tribes. The Government of the Sudan condemns very strongly the attacks against UNAMID, the most recent of which was the barbaric attack that led to the assassination of seven peacekeepers from Tanzania. We reiterate our condolences to the sisterly Government of Tanzania as well as to the bereaved families.

The report before the Council notes that regarding the protection of civilians, a number of tribal clashes took place in north-east and central Darfur that led to an increase in the number of internally displaced persons compared with the past two years. In that connection, we would like to emphasize the key fact that all tribal clashes revolve around national resources, water, minerals and pastureland. As we have indicated in our previous statements, that is one of the fundamental raisons d'etre of the conflict in Darfur, which makes clear the region's need for development projects and their implementation.

  48. The report presented to the Council emphasized that progress has been made in the implementation of the Doha Document for Peace in Darfur, although it has been delayed. Yet the truth remains that the implementation of the Document is moving forward steadily. As is well known, while the funding requirements for the DDS, which were based on the needs assessment conducted by the Joint Assessment Mission, amounted to $7.2 billion, donors at the Doha Conference pledged a total of $3.6 billion. That is reflected in the implementation of the DDS, in accordance with the provisions of the Doha Document. We therefore appreciate the Secretary-General's appeal to donors contained in paragraph 73 of the report.

We therefore appeal to the Council to support all efforts to establish peace and security, as well as to call on the rebel groups that have to date refused to take that path to do so in order to enable us all to turn our efforts to reconstruction and development and the achievement of reconciliation, so as to restore peace, prosperity and stability for the Sudan in general and for Darfur in particular. I hope, Sir,that I have kept to the five-minute limit set for interventions.
