“UNITAD was established to serve justice and provide reparations for the horrific crimes that were committed against the Iraqi people. It should be noted that the major challenge facing the Team in the coming period is to deliver justice and to submit all evidence to the Iraqi Government as soon as possible, whether obtained by the Team or provided by Iraq and developed using innovative technology, for use in Iraqi national courts. UNITAD’s mandate, in accordance with resolution 2379 (2017) and its terms of reference, is to collect, preserve and store evidence pertaining to the crimes that terrorist Da’esh committed in Iraq and to present that evidence to Iraq to enable it to conduct fair trials and to achieve justice and ensure redress for the victims.”

“Ritscher’s important briefing, we commend his report, which addressed several important points that ensured the progress that has been made in the Team’s work in Iraq. That was achieved by collaborating and cooperating with the Government of Iraq and by opening new investigation tracks for the crimes committed by the terrorist organization against all the people of Iraq so as to achieve accountability in cooperation with the Iraqi national authorities. Through the media and diplomatic and consular missions around the world, Iraq is continuing to extend a humanitarian appeal in Arabic and in English for Iraqi citizens or anyone else who has information in relation to missing Kuwaiti and third-country nationals or anyone who has information on Kuwaiti property, including Kuwaiti archives. Iraq is continuing its cooperation with Kuwait with respect to the information that was received by the Iraqi Embassy in Kuwait from a witness who claims to have information about two burial sites in Kuwait. In conclusion, I would like to thank the Secretary- General for his firm support for Iraq.”

“We are therefore asking UNAMI and the international community to provide us with assistance to fight desertification and to facilitate discussions on this issue with neighbouring countries, in which we could address the equitable distribution of water. As for Iraq’s relationship with the brotherly State of Kuwait, it has been getting stronger since the diplomatic relations between our two countries were resumed 18 years ago. Iraq’s foreign policy has managed to tighten this relationship. It has attached particular importance to the dossiers of missing people, maritime boundaries and property. Iraq has honoured its commitments, paid all compensation due and turned the page on these issues.”

“The Ministry continues to protect biodiversity and is working to achieve the Sustainable Development Goals, so that we can shift to a green and sustainable economy. The Ministry for the Environment is also facilitating the use of eco-friendly cars, specifically, electric vehicles and hybrid vehicles that use mixed types of energy. We have obtained the necessary permits to exempt these vehicles of customs duties and registration costs, which is in line with Iraq’s commitments to the provisions of the Paris Agreement on Climate Change. Iraq has suffered from sandstorms because of desertification and water scarcity.”

“In addition, we are continuing to raise awareness through the media and all public institutions while encouraging people to get vaccinated as early as possible at the nearest vaccination site. Pertaining to the fight against desertification and climate change, on 7 February, Baghdad hosted the meetings of the thirty-sixth session of the Near East Regional Conference of the Food and Agriculture Organization of the United Nations. Iraq raised the issues of water, agriculture and sustainable development. Furthermore, from 5 to 7 March, we hosted the second Baghdad Conference on Water, under the slogan “Water and Climate Change”. For its part, the Ministry for the Environment continues to support clean energy and nature-based solutions and ecosystem services.”

“We have also identified effective measures for managing prisons, strengthening and monitoring human rights in displaced persons camps and following up on social, familial, economic and electricity-related issues. Furthermore, a group of people injured during the October protests received foreign medical treatment in recognition of their sacrifice for reform. In terms of the fight against the coronavirus disease, the Government is following the most recent developments and measures undertaken to fight the pandemic. “In terms of the High Commissioner for Human Rights in Iraq, my Government is very eager to honour its international and national commitments to prevent violations against children during the fight against terrorism. A meeting between our national commission for monitoring and reporting and the United Nations country task force on monitoring and reporting was held on the subject of banning the recruitment and use of children. We have already agreed on a draft work plan waiting to be signed pending a final response from the United Nations. Through Iraqi media networks, we have also been discussing how to best disseminate human rights culture in such areas as women, children, people with special needs and minorities.”

“We have also modified our code of conduct for the internal security forces and the code of conduct for the information and communication office to meet gender requirements. We have also created a tribunal of inquiry and a criminal tribunal to address cases of domestic violence in each province. The process for divorced women to receive alimonies from the Ministry of Justice has been automated for facilitating follow-ups. Further, we have implemented gender- focused performance-assessment programmes in all Government institutions, and we have modernized the curricula related to human rights by adding university courses pertaining to women’s rights and peaceful coexistence. In addition, we launched a second national plan on women’s economic empowerment for the 2022-2023 period to promote capacity-building and provide loans.”

“Our Government is also continuing its efforts to establish a clear budget for a general transformation project in Iraq and for rehabilitating post offices to provide electronic services through a Government services portal. On women’s empowerment, the Government’s efforts are ongoing as part of the follow-up plan for resolution 1325 (2000). We are assessing what has been done in the context of our second national plan for the implementation of that resolution in Iraq as well as the results achieved with international support. We have also set up a female mediators for peace committee, which is working to implement a national strategy to strengthen women’s active participation in resolving conflict and peacemaking.”

“Iraq calls for solid relations and dialogue between the two countries in order to address pending issues by peaceful means and not through the use of force and unfounded allegations. Concerning support for the liberated areas, ongoing efforts and coordination with the international community have contributed to re-establishing stability in the liberated areas and enabled us to implement infrastructure, health-care, electricity and bridge and road construction projects, which has allowed many people to return to their regions and for the camps to be closed. “The Iraqi Government reiterated its appeal for the full withdrawal of Turkish forces from Iraqi territories, in a demonstration of binding respect for national sovereignty. Iraq also notes that the use of Article 51 of the Charter in the acts of aggression carried out by Turkish forces is without legal basis. That Article does not authorize undermining an independent country’s sovereignty. We would recall in that connection that the presence of the majority of the elements of the Kurdistan Workers’ Party (PKK) in the north of Iraq is the result of an agreement between the Turkish Government and the PKK, which Iraq opposed. The Iranian bombing of the city of Erbil with 12 ballistic missiles on 13 April led to great losses of civilian property.”

“Iraq attaches priority to repatriation efforts as well as to rehabilitation and accountability. We urge the Member States concerned to repatriate their nationals from Iraq and Syria. Iraq reiterates its commitment to continuing cooperation with the international community to fight terrorism. We reiterate our appeal to not use our territories for settling scores or for implementing political objectives under the pretext of fighting terrorism. We also underscore the importance of respecting the principles enshrined in the Charter of the United Nations. Concerning violations involving Turkey and Iran, the Iraqi Ministry of Foreign Affairs delivered to the Ambassador of Turkey to Iraq a note of protestation strongly condemning the ongoing violations by the Turkish army in the north of Iraq.”

“We asked for technical assistance and advice and support for the parliamentary elections planned for October in the Kurdistan Region. Allow me also to provide the Council with a brief overview of the most important developments in Iraq following the elections. On the security front, the Government and the people of Iraq would like to thank the Security Council for the solidarity and ongoing support that it has shown to Iraq in its fight against terrorism. In April, Iraqi forces launched a major offensive for hunting down the remnants of Da’esh in various provinces. Iraq is committed to repatriating Iraqi nationals detained in the Al-Hol camp in Syria. The Government has repatriated almost 1,900 foreign terrorist fighters and 550 families, that is, 2,249 people, mainly women and children.”

“The political parties in Iraq are continuing their efforts to reach understandings and solutions to address the political deadlock in order to form a new Government that meets the needs of the Iraqi people within the constitutional time frame and the relevant laws, one that reflects the interests of the Iraqi people and guarantees a balanced representation thereof. In addition, in line with resolution 2576 (2021) and following the successful holding of elections in October 2021 and the assistance provided to the Kurdistan Region during the parliamentary elections held in September 2018, Iraq, in its letter addressed to the President of the Security Council dated 23 March, asked UNAMI to provide assistance to the Kurdistan Region.”

“The Government is also strengthening the powers of judges in the areas of combating terrorism and promoting our judicial system in line with the Iraqi Constitution and Iraq’s international obligations. Iraq is prepared to receive the evidence that has been gathered by the United Nations Investigative Team to Promote Accountability for Crimes Committed by Da’esh/ Islamic State in Iraq and the Levant (UNITAD) in order to use it in a competent national court. The Council of Representatives of Iraq has finished its first reading of a draft law concerning the criminal court, which will address the crimes committed by elements of Da’esh. “With regard to the idea of appointing a special envoy, we believe that the United Nations is already broadly represented in Iraq by the United Nations Assistance Mission for Iraq, which provides political advice and humanitarian and development assistance. In addition, the Federal Government in Baghdad and the Kurdistan Regional Government hold high-level meetings to deal with all issues, including coordination between Iraqi security forces and Peshmerga forces to combat the remaining Da’esh cells. “The Council of Ministers, furthermore, has adopted legislation aimed at implementing the law of female survivors, taking into account their needs and hearing their views. It promotes peaceful coexistence and rejects violence. The Council of Ministers is planning to open medical centres to provide psychosocial and societal services to the survivors. Paragraph 6 of the law stipulates that applications presented by the survivors to the centres need to be confidential. In order to facilitate the process of submitting the applications, the Directorate is developing a mechanism for receiving and reviewing them and is establishing a database. The Directorate also plans to set up an online platform to receive applications in electronic format.”

“In March 2021, the Iraqi Parliament adopted a law on Yazidi female survivors, the first law to offer compensation and support to survivors, including women and girls who were sexually enslaved and sold in slave markets. They were forced to change their religion and get married. They were forced to become pregnant and to have abortions. That law also stipulates that a search will be undertaken for abducted persons. Pursuant to that law, a General Directorate for Female Survivors’ Affairs has been set up, which is the main body charged with implementing the law. This law explicitly states that the crimes perpetrated by the Da’esh terrorist organization constitute crimes of genocide and crimes against humanity. No general amnesty or specific amnesty can be granted to the perpetrators of crimes of abduction and captivity.”

“During the period 2014-2017, the entire world witnessed the perpetration of the most horrific crimes by the Da’esh terrorist organization against the Iraqi people, including decapitations, the sexual slavery of women and girls, forced marriage, the destruction of religious heritage and blatant disdain for the very principles of human rights and human dignity. “The Iraqi Ministry of Defence confirmed that it was following up on the burial site with the relevant authorities in the city of Salman Pak, based on the information available. There are two other sites in the city of Samawah believed to contain 151 human remains in one of them. Eighty-nine of them were exhumed while the other site contains 100 human remains. With regard to the Khamisiyah site, it could contain up to 180 human remains. A request was submitted to the International Committee of the Red Cross in order to obtain satellite imagery of that site. That request was also submitted to one of the members of the Technical Subcommittee in November 2021. However, searches for remains have not been decisive with one of the witnesses until now.”

“Iraq is launching a humanitarian appeal in Arabic and English to Iraqi citizens or any person who has any information to provide concerning the burial sites of Iraqi, Kuwaiti or third-country human remains during the second Gulf War or Kuwaiti property, including the Kuwaiti national archives. The Ministry of Defence continues to contact potential witnesses in that regard. On 1 November 2021, it met with a witness who claimed that he had information on a site in Babel governorate. On 17 November 2021, an exploratory mission took place in that region with the International Committee of the Red Cross and in the presence of the witness. On 24 November, the Ministry of Defence also received a call from another potential witness.”

“During the most recent period, we provided the Kuwaiti Embassy in Baghdad with information, books and microfilms. Concerning the missing-persons dossier, Kuwait recently identified the remains of a number of Kuwaiti citizens, which were exhumed in Samawah in Iraq and moved to the State of Kuwait in 2019 and 2020. The remains of 59 Kuwaiti and third-country nationals were identified. Iraq welcomed the return by the State of Kuwait of 6 unidentified remains to Iraq under the supervision of the International Committee of the Red Cross and with UNAMI’s support. The Technical Subcommittee and the Tripartite Commission recently held a meeting at which it was decided that the search for missing Iraqi and Kuwaiti persons would be expedited.”

“Fuad Hussein, listened to the briefing by the President of the United Nations Commission on Compensation for Damage Resulting from Iraq’s invasion of Kuwait in 1990. The Commission presented its final report and confirmed that Iraq has fulfilled all its obligations upon paying $52.4 billion in reparations for more than 1.5 million claims all over the world. Accordingly, resolution 2621 (2022) was adopted and confirmed that the Iraqi Government has met all its international commitments related to the losses caused by the invasion of Kuwait by Iraq in 1990. Iraq is firmly committed to turning the page on the past with our neighbour sisterly Kuwait, and we continue to give special priority to the missing-persons and missing property dossiers under Chapter VI of the Charter and in accordance with resolution 2107 (2013).”

“Concerning the fight against desertification and climate change, projects are under way in the governorate of Najaf to irrigate 100,000 acres and combat desertification, spearheaded by the Ministry of Water Resources. With regard to the relationship with the sisterly State of Kuwait, we are working to strengthen ties with the State of Kuwait, which is a priority for Iraq, in particular to ensure that the reparations dossier of $52.4 billion is closed. “With regard to the relationships between Baghdad and Erbil and between the Federal Government of Baghdad and the Kurdistan Regional Government, talks are being held at the highest levels, in particular to resolve the outstanding issues, including those related to the federal budget and coordination between the Iraqi security forces and the Peshmerga forces, in order to address security gaps and fight Da’esh. Moreover, the Ministry of Finance recently approved a transfer of 200 billion Iraqi dinars to the Kurdistan Regional Government. That is the fifth such transfer to pay the salaries of Kurdistan civil servants for November.”

“Concerning the fight against the coronavirus disease pandemic, the Ministry of Health has launched an awareness campaign on protection from and symptoms of the pandemic. We encourage citizens to take the vaccines. Those over the age of 65 and all those with health problems, in addition to health workers, are authorized to take the booster vaccine. Moreover, the Ministry of Health continues to undertake field surveys for early identification of pandemic patients by using rapid tests and vaccination campaigns at health institutions, governmental institutions and universities. So far, more than 8 million Iraqi citizens have received at least one vaccine dose.”

“The Iraqi authorities have adopted administrative regulations to facilitate cooperation with non-governmental organizations (NGOs) in Iraq in the area of providing humanitarian aid. We approved 419 out of 419 requests in December 2021 and January 2022. With regard to basic services, we have worked to provide such services in the areas of health, agriculture, housing and education, including projects pertaining to water, roads and bridges, in addition to Internet coverage. With regard to women’s empowerment, we continue to work towards empowering Iraqi women and to provide them with social support, including economic support for women by establishing a road map and identifying priorities and needs, taking into account federal budgets. We also identify expenses and make sure to organize training sessions on preparing the correct budgets.”

“It also helps displaced persons who are returning voluntarily to their liberated regions by implementing critical projects in the areas of education, health and infrastructure. The Iraqi Government is well known for not returning displaced persons coercively. The Government has statistics and an official database pertaining to the number of returned people. The Government has also been working on an e-governance programme and a digital exchange mechanism, in addition to a joint programme on combating violent extremism. We have given priority to societal reconciliation and organized training workshops to improve skills, especially after extending the UNDP programme in Iraq until 2023. We have also made the second payment designated by the Iraqi Government to support the programme with a view to rehabilitating the liberated regions.”

“The Turkish Parliament extended for two further years the mandate to deploy military troops to Iraq and Syria, as of 31 October 2021. This decision violates Iraq’s sovereignty and demonstrates Turkey’s indifference to Iraq’s efforts to foster dialogue on wise measures and alternative options to address the situation on the ground. In particular, Iraq stresses its rejection of the use of its territories for settling accounts or other political purposes under the pretext of fighting terrorism and jeopardizing its security and stability. With regard to the liberated areas, the secretariat of the Council of Ministers continues to cooperate with the United Nations Development Fund (UNDP) in Iraq in implementing programmes and projects in liberated areas and restoring stability there.”

Iraq therefore calls on the various regional and international bodies to strengthen cooperation and redouble efforts to more effectively combat the terrorist threat, in particular through the repatriation by Member States of their citizens who are currently in Iraq and Syria. While the international coalition’s combat role in Iraq has come to an end, we continue to cooperate with it in the context of providing support, advice and training for Iraqi forces, in particular the Iraqi army, in order to build capacity to protect our territories and democratic institutions. “We stress respect for the principles of the Charter of the United Nations, in particular for the sovereignty of Member States, good-neighbourly relations and the promotion of cooperation. Iraq calls on the Security Council to give serious consideration to those issues. All member States must be totally committed to respecting the aforementioned principles. Iraq has demonstrated that it honours its commitments, in particular the repatriation of Iraqis detained in the Al-Hol camp in Syria. Over the past three months, the Iraqi Government has repatriated approximately 1,000 civilians in two stages. They have returned to Jada’a-1 camp in Nineveh governorate and have been provided with psychosocial and social rehabilitation. Some 1,796 Iraqis have returned to Iraq since May 2021. Similarly, Iraq repatriated 1,900 terrorists from Syrian camps.”

“With regard to the security situation, the Iraqi Government would like to thank the Security Council for its significant solidarity and support to the Iraqi Government and people, demonstrated in two press statements (SC/14725 and SC/14774) in which the terrorist acts perpetrated in Iraq between November 2021 and February 2022 were condemned. We will never allow terrorism to remain a hindrance to the Government’s plans and efforts in various fields, foremost of which are development, strengthening security, stability and social peace. “The decision was declared to be in line with the Iraqi Constitution. The first session of the Iraqi Parliament took place on 9 January and resulted in the election of the Speaker of the House and his two deputies. The Federal Supreme Court is now assessing the eligibility of candidates for the presidency of the Republic of Iraq, in accordance with the provisions of the Iraqi Constitution. For its part, the Government is considering ways to implement the binding decisions issued recently by the Federal Supreme Court. Allow me to briefly mention the most important developments in the post-election situation in Iraq.”

“Iraq has also repatriated 1,900 terrorist fighters from detention camps in Syria under the control of the Syrian Democratic Forces (Kassad). Iraq calls on those supervising the camps to hand over all Iraqi terrorist fighters in order to prosecute them and bring them to justice, particularly since Kassad forces have not yet handed over to Iraq Da’esh leaders in its custody. The irresponsible behaviour of Kassad forces, including weak prison security and its reluctance to hand over terrorist fighters and Da’esh leaders to Iraq, undermines regional security. That is dangerous, especially given the increasing risk of prison breakouts. Such breakouts would help Da’esh to regroup and coordinate new attacks in Iraq and Syria, as well as the region in general.”

“We reiterate our commitment to cooperating with the international community to combat terrorism, whether through the Global Coalition to Counter Da’esh, strengthening long-term partnerships in different areas or multilateral cooperation with the United Nations and other specialized United Nations agencies. Iraq has shown its commitment to repatriating Iraqis stranded in the Al-Hol camp in Syria. The Iraqi Government repatriated two groups of civilians. The first group, on 8 December 2021, included 128 Iraqi families, comprising 507 individuals, and the second, on 8 January, included 111 Iraqi families, comprising 421 individuals. The groups were transported to Jed’ah 1 camp in Ninewa governorate for psychosocial rehabilitation. Since May 2021, Iraq has repatriated 450 families, comprising 1,796 individuals.”

Given its transnational nature, terrorism poses a significant, increasing and continuing threat to international peace and security. Iraq has been one of the country’s most affected by terrorist acts. Terrorist groups have repeatedly sought to undermine stability and security in my country by targeting Iraqi State institutions and killing, terrorizing and torturing civilians. Iraq values the briefing by the Under-Secretary- General and commends the efforts made by the Office of Counter-Terrorism.”
