We are also gravely concerned by the violations committed against educational establishments in armed conflicts and strongly condemn the repeated attacks against schools, such as the deliberate attack in Gaza in August against the schools of the United Nations Relief and Works Agency for Palestine Refugees in the Near East. The targeting of those schools, their transformation into part of the battlefield and their use by parties to the conflict for military purposes, such as for military barracks, operational bases and detention centres, is not only a violation of the civilian nature of those schools, but it also endangers children and denies them the right to education.

  2. As for Syria, the Secretary-General's report paints an indescribable picture of grave violations against children and the extreme danger they are in. More than 10,000 children have been killed since the beginning of the conflict, and the number of children killed increased significantly in 2013. Nevertheless, the Syrian Arab Armed Forces continue to indiscriminately shell areas inhabited by civilians, and the Islamic State in Iraq and the Sham continues to commit horrible acts, including kidnappings and other violations against children.

  3. The report of the Secretary-General on children and armed conflict (S/2014/339) paints a very painful picture. Many children suffer gravely from the effects of armed conflicts throughout the world. We are also aware that the suffering of children in the Arab region of the world is part of that painful picture. However, I would like to address two particular cases. Palestinian children are undoubtedly not immune to injustice, given the continued Israeli violations. In addition to the information contained in the report of the Secretary-General on the grave violations and the killing of Palestinian children in the Palestinian occupied territories, the recent Israeli aggression against the Gaza Strip has led to the death of more than 2,000 civilians, mostly women and children.

I would like to take the opportunity to underscore the importance of the Children, Not Soldiers campaign aimed at putting an end to the recruitment and use of children by Government armed forces in conflicts. That campaign comes at an opportune time, in view of the notable increase in violations against children in many conflict areas throughout the world and the severity of the Violations committed against them. We express our deep concern about the severity of the violations, which constitute a humanitarian crisis, and about the killing and recruitment of children and other violations, including sexual abuse and kidnapping, such as the action of Boko Haram, in which they kidnapped more than 200 students, who are still missing. All of those incidents are a source of grave concern.

  6. The situation in Syria has reached such a state as a result of the paralysis of the international community in regard to meeting the needs of the population. The Security Council's adoption of resolution 2165 (2014) clearly points to the international community's desire to promote the well-being of the Syrian people and to implement resolution 2139 (2014) so as to put a halt to the crisis, which will only deteriorate until a solution is found that will guarantee the rights of the Syrian people and condemn crimes against humanity. We congratulate Mr. de Mistura and the Deputy Special Envoy for Syria, Mr. Ramzy, on their appointments. We hope that that will make it possible to reach a settlement of the crisis.

We urge the international community to reach a just and lasting agreement, a ceasefire and respect for international law and human rights, thereby guaranteeing the security of the Palestinian people. The Security Council has a special responsibility to prevent any attempt to endanger the security of the Palestinian people. It needs to demand that Israel put an end to the assault so that humanitarian assistance can reach Gaza and so that a solution can be found. With regard to Syria, the Syrian authorities have continued to attack their own people by targeting civilians. The Secretary-General's report (S/2014/427) clearly points to the use of bombs against civilians, sieges, the infliction of famine on civilians and the refusal to allow access to humanitarian and medical assistance.

With regard to the daily tragedy for the people of Gaza and the siege against over 1.5 million Palestinians, there has been a violation of the November 2012 agreement between the Israeli and Gazan authorities. There also has been a violation of the agreements concerning the exchange of prisoners. Israel is responsible for all those violations. Qatar spares no effort to achieve a just and comprehensive peace, and we will continue to support our brethren, the Palestinian people. We are committed to stopping the violence. We also commend international efforts to reach a humanitarian truce and ceasefire. We have encouraged negotiations, including those in Cairo.

What has been taking place in Gaza is collective punishment and State terrorism that requires a clear response by the Security Council, given that the number of victims and the dead continues to grow after the land invasion and the air and sea assault. What is taking place in Gaza is not in response to terrorism, and the people of Gaza are not terrorists. They are a people who are strong and who seek to regain the rights that have been stripped from them over the past decades. For some time now, the international community has sought to broker peace between the Palestinians and the Israelis. Palestinian unity was considered a propitious environment for peace. However, the current Israeli actions are a real impediment to that peace.

  10. Such aggression will push everyone towards confrontation by all means and destroy any hope of peace in the region. Such actions will not lead to the security to which the people aspire. Those who consider that the assault against Gaza is justified by the killing of the three Israeli youths are wrong. The Israeli authorities should have conducted an investigation to find the culprits, given that the crime took place in territory under the control of Israel, which, as the occupying authority, must, according to international law, be held responsible for the crimes committed against unarmed Palestinians.

  11. Ms. Al-Thani (Qatar) (spoke in Arabic): In the past few days, we have witnessed horror and barbarous acts directed against the Palestinian people who have been besieged by Israel in Gaza. Those actions can be seen only as part of the continuous Israeli aggression that kills innocent people and commits atrocities, such as the massacre in Shujaiya, where most of the victims were children. We condemn all of the acts of aggression committed by Israel, which violate international humanitarian law and human rights. Israeli aggression against Gaza is not a way of defending Israel against the Palestinian people. How can one kill hundreds of women, the elderly and children in order to defend a population? Security cannot be achieved through military might or by targeting innocent civilians, as Israel is doing today.

  13. The continuing violence, systematic and large-scale killing and the use of heavy weaponry by the regime in urban areas, in particular the use of barrel bombs, is absolutely horrifying. We cannot remain silent in the face of the even more disturbing information that we have received regarding the use of toxic gases in populated areas. That is a very serious development, and we call for the setting up for a commission of inquiry on the issue. The international community's silence on that subject, in particular after the chemical weapons attacks in Ghouta, is simply unacceptable. In that respect, the Security Council must take swift and effective measures to deal with those blatant violations of the fundamental principles of international law and protect civilians in Syria.

  14. It is also preventing the delivery of humanitarian assistance and blocked the movement of humanitarian actors by flouting administrative processes. It has closed a number of medical and surgical centres and prevented non-governmental organizations from working with their partners on the ground, including blocking their movement. All that is quite clear from the second report of the Secretary-General (S/2014/295) on the implementation of resolution 2139 (2014), with which we agree. The time for negotiations on humanitarian access is over. Resolution 2139 (2014) was adopted two months ago and has still not been implemented. The humanitarian situation continues to deteriorate. The security situation is doing likewise, as clearly shown by the report of the Secretary-General.

The State of Qatar participated in the second Geneva Conference on Syria and has worked to convince the Syrian opposition to take part in that Conference, given the need for a political solution based on the Geneva communique of the Action Group for Syria (S/2012/522, annex) of 30 June 2012, which was accepted by the Security Council as the basis for any political solution. However, the failure by the regime to demonstrate its sincerity and its attempts to delay those negotiations clearly show that they do not want a political solution. The regime has gone even further and surprised the international community by undertaking measures aimed at scuttling the entire process. The Syrian regime has not limited itself to causing the exodus of millions of Syrians.

  16. Its disastrous impacts have reached horrendous proportions. Syria has since the beginning of the crisis been the theatre of war crimes, grave violations of human rights, violations of international law and violations of international humanitarian law. A great deal of evidence clearly demonstrates that such crimes and violations have taken place, including crimes against humanity perpetrated in the regime's prisons and elsewhere. We therefore doubt that it will be possible to achieve the political solution that the international community is calling for.

  17. The State of Qatar has called for the end of the split between the two parts of Palestine and for the unification of all of Palestine and its children. We therefore welcome the national reconciliation, which we view as a significant step forward. We call on the international community to support the reconciliation process, which will enable us to achieve the peace we all want to see. The proclamation of this year as the International Year of Solidarity with the Palestinian People was both important and a logical precondition for achieving a solution based on lasting, just and sustainable peace. We would like to take this opportunity to reaffirm the solidarity of Qatar with our Palestinian brothers in their rightful struggle. We urge the international community to do likewise. The Syrian crisis is entering its fourth year.

Any agreement must be clearly based on recognition of the rights of the Palestinian people, including the end of the occupation and the creation of an independent Palestinian State on Palestinian territories occupied since 1967, with East Jerusalem as its capital, a withdrawal from the occupied Syrian Golan, a recognition of the right of return of refugees and the inalienable rights of the Palestinian people. Israel's continued blockade of the Gaza Strip, its prohibition on the building of a port or rebuilding the airport, and its refusal to allow Gaza to import building materials to repair destruction for which Israel itself was responsible all create a situation of crisis. The blockade must therefore be lifted and border crossings reopened, pursuant to the agreement made in November 2005 by the various parties.

I reiterate our concerns regarding the impact of continuing Israeli policies that regrettably undermine any hope for peace, including continued settlement activities in the occupied Palestinian territories and East Jerusalem under the threat or the use of force, the exploitation of water and natural resources belonging to Palestine, the arrest of Palestinians, the destruction of entire villages and the demolition of buildings, and the continued aggression against the Holy Al-Aqsa Mosque. The State of Qatar has repeatedly stated its attachment to the principles of the Arab Peace Initiative to achieve a lasting and just peace in the region.

Those measurs include the attempts to undermine the integrity of Jerusalem, continued settlement activity in the occupied Palestinian territories, the refusal to release Palestinian prisoners and other arbitrary, illegal and immoral activities. Today's date coincides with the deadline for the signing of a framework agreement between the Palestinians and Israelis. Despite the support and the good offices of the United States of America, Israel has not responded to international and Arab efforts. That State is therefore responsible for the failure of the negotiations as a result of a number of measures undertaken by it and the fact that it has shown no genuine desire to reach a solution.

This is not only a violation of the civilian nature of such institutions, but it also endangers children and deprives them of their fundamental right to education, as mentioned in the Secretary-General's report as well as in those of other organizations, such as the latest report on attacks on education issued by the Global Alliance to Protect Education from Attacks. In that connection, we commend the efforts of the Global Alliance to formulate guidelines aimed at protecting schools and universities from military use.   24. Children, who are especially vulnerable to hunger and disease, are obviously the main victims of the regime's policy of starving Syrian towns and villages. They are also largely affected by the massive destruction inflicted upon the health-care sector in Syria. It is alarming, that as a result of the crisis, polio has re-emerged in Syria. In addition to all this, it is painful to consider that an entire generation of Syrian children may be lost because the lack of access to education, as indicated in a recent UNICEF report. More than 3,000 schools have been destroyed and more than 1,000 used as shelters. We are very concerned about the recurring attacks on schools and their use as military barracks, operations bases and detention centres.

The Syrian regime is primarily responsible for the tragic outcomes of its policies of oppression and use of force against the the Syrian people who rose up peacefully to demand their legitimate rights. The use of excessive and arbitrary military force by the regime's forces and militia have killed and maimed countless numbers of children, with long-term direct and indirect impacts, such as psychological effects. The regime's security and military forces do not spare children from arrest, arbitrary detention, ill treatment and fatal torture. The violations perpertrated by the regime include the use of children as human shields, sexual and physical violence, and massacres of civilians, including babies.

  26. Palestinian children, including minors, are subject to arbitrary arrest by the Israeli authorities on the pretext of being a security threat. According to the Secretary-General, more than 194 children were arrested by Israeli authorities. It is also alarming that a large number of attacks were made on schools and educational institutions in the Palestinian occupied territories, including East Jerusalem, where attacks on 321 schools were reported, representing a large proportion of schools in the Palestinian occupied territories. The Secretary-General's report on children and armed conflict in the Syrian Arab Republic (S/2014/31) describes horrendous situations, including grave violations against children in particular.

  27. The international community is determined to protect children in times of war and peace alike. The need for the international community to give priority to this issue is underscored by more than 25 articles of the Geneva Conventions and its two additional protocols that refer to children specifically, as well as the provisions of the Convention of the Rights of the Child as universally ratified. Palestinian children are suffering from injustice because of ongoing Israeli violations against the Palestinian people. As indicated by the Secretary- General in his latest report on children and armed conflict (S/2013/245), in one year alone 50 Palestinian children were killed and more than 665 injured by Israeli forces.

Since children are the most vulnerable group in societes, and given the continued suffering inflicted upon them in complex and diverse armed conflicts and the non-compliance of parties to conflicts with international humanitarian law, we look to the Security Council to further consider this issue and take more effective measures to protect children from violations. In this regard, we commend the concept paper on the subject submitted by the President today (S/2014/144, annex). While we reaffirm our commitment to the frameworks adopted by the United Nations in this respect, we believe that attention should not be limited to the conceptual level. Rather, the recommendations of the Secretary-General and the Working Group on Children and Armed Conflict must be applied to the individual cases considered by the Council.

  31. Finally, the State of Qatar supports what is underscored in the concept note regarding the integration of the rule of law at the national and international levels. Such integration should be given particular importance. Relations among the topics must be subject to the rule of law on the basis of equality, mutual respect and international cooperation, and the behaviour of States should be in line with the provisions of international law. The current crises and violations in the world reflect the disregard and disrespect by some regimes for international law and international humanitarian law, and their feeling that they can escape their responsibilities in the absence of robust implementation of international accountability. The violations being inflicted upon the brotherly Syrian people are clear proof thereof.

As an affirmation of the commitment of the State of Qatar to the responsibility of Member States to participate in promoting the principle of the rule of law on the basis of United Nations resolutions, and with a View to supporting the international community's efforts in this area, my country, in cooperation with the United Nations Development Programme, took the initiative of establishing in Doha a regional centre for the rule of law and combating corruption, which was inaugurated in 2011 under the sponsorship His Highness the Amir of Qatar. The centre plays an important role in promoting the principle of the rule of law in the region and in enabling relevant officials and civil society organizations to promote the rule of law and combat corruption.

International instruments have provided for the need to respect and to enforce the rule of law and equality before the law and to act accordingly That cannot be achieved without taking accountability measures, preventing grave violations of international law and international humanitarian law and other international crimes, and ensuring that perpertrators do not enjoy impunity and that subjective political interests are not allowed to undermine justice. If we look at the situations that threaten international peace and security, we conclude that the reasons behind them include the absence of the rule of law in some States.   36. Hence, the promotion of international peace and security, which we all seek, depends upon the ability of States to respect and follow up the implementation of those legal frameworks. The commitment by States to respect the rule of law and its entrenchment in all spheres of life is the cornerstone of the maintenance of international peace and security. Also, the protection of human rights and the achievement of development and social justice are at the very heart of the responsibilities of States at the national and international levels. The definition by the international community of the elements included in the concept of the rule of law affirms the interrelationship between the rule of law and the three pillars of the United Nations, that is, international peace and security, development and human rights. It is also a culmination of the international efforts in that regard. Therefore, the State of Qatar renews its support to what was stated by the Heads of States and Governments in the Declaration of the High-level Meeting of the General Assembly on the Rule of Law at the National and International Levels (General Assembly resolution 67/1) and in the other resolutions adopted in that connection, which stress the need for clear legal frameworks to mainstream the rule of law in all aspects of life and at all national, regional and international levels.

The events in Syria require the international community, including the Security Council, to shoulder its responsibilities in the face of this unprecedented humanitarian catastrophe, which has led to louder voices calling for further pressure and the adoption of a decisive resolution so as to stem the suffering of the Syrian people, put an end to the criminal actions and bring the perpetrators of such crimes to justice. The convening of the second Geneva Conference on Syria requires the international community to assume its responsibility in achieving the aspiration of the Syrian people for freedom and decent living conditions. We hope that the Geneva conference will find a solution. The Syrian regime must not be allowed to mark time and continue its war of genocide against the Syrian people.

  40. There is also the deadly blockade of the Palestinians in the Yarmouk camp. More than 40 children, women and elderly people are dying of starvation. Is that part of fighting terrorism or terrorism itself? Syrian refugees continue to flood into neighbouring States. We thank Jordan, Turkey and Lebanon and all neighbouring States for their efforts to alleviate the suffering of Syrian refugees. The international community must continue to provide assistance to those countries. I would also like to thank the Government of Kuwait and the Secretariat for having convened the second International Humanitarian Pledging Conference for Syria.

According to international organizations and human rights groups, the Syrian Government has used chemical weapons and taken the lives of tens of thousands of Syrian civilians at the hands of the regime and its loyal militia. Is it possible that some people still listen to the claims of that regime? We help to combat terrorism and must remember some facts. As the new year begins, the Syrian regime is continuing its indiscriminate bombing of civilians and its criminal bombardment of Aleppo, discharging barrel bombs on densely populated areas and schools. The number of victims of barrel bombs exceeds the total of chemical weapons victims. The Syrian regime continues to besiege hundreds of thousands of people and to pursue a policy of starvation to death. It impedes access to humanitarian assistance.

  42. We underscore the need for the Palestinian people to enjoy their inalienable rights and we continue to express our solidarity with the Palestinians. That people's acquisition of their national rights is a precondition for the settlement and peace to which we aspire. We would also like to emphasize the need for Palestinian national reconciliation on the basis of the Doha and Cairo agreements. The international community must pave the way for achieving such a reconciliation. The beginning ofa new year in the Syrian revolution doubtless provides the opportunity to pause and reflect on the grave human rights violations and war crimes perpetrated by the regime with impunity.

In that connection, we would like to state that, in order for any agreement to succeed, Israel must refrain from threatening the establishment of an independent, viable and sovereign Palestinian State. We would like to reiterate our warning with regard to the consequences of Israeli policies that are an obstacle to peace. Such policies include in particular its fait accompli strategy, its settlement activities in the occupied Palestinian territories, including East Jerusalem, the use or threat of use of force, the exploitation of Palestinian national resources, especially water, the continuing detention of Palestinians, the demolition of homes and villages, expulsions, the ongoing attacks on the Al-Aqsa Mosque and the blockade on Gaza.

  44. The peace process is the best way to achieve stability in the region. The question of Palestine is a critical issue for all Arabs. Qatar and all Arab States reiterate the Arab commitment and the basis and principles set out in the Arab Peace Initiative to achieve the comprehensive peace in the region to which they aspire. It is important that any agreement recognize Palestinian national rights and be based on putting an end to the occupation, the achievement of self-determination, the restoration of the Palestinian territories occupied since 1967, in accordance with the Arab Peace Initiative, and withdrawal from the occupied Arab territories. It must also underscore the inalienable rights of the Palestinian people.

  46. We recall the resolution issued by the League of Arab States and the Organization of Islamic Cooperation. The Security Council reached an agreement on adopting a resolution on the use of chemical weapons. But the Council is also called on to take rapid and immediate action to protect civilians on the basis of its own mandate and the Charter of the United Nations. On the humanitarian front, the Security Council, in its presidential statement (S/PRST/20l3/15), has taken the step of calling on the international community to take actions urgently, in a decisive manner, and to use all relevant mechanisms available to it. The human crisis faced by millions of Syrians and their children who are starving every day cannot be tolerated. The Council must adopt a resolution to put an end to their suffering.

  47. The status quo jeopardizes any prospects for peace. Any decisions taken by the State ofIsrael are null and void under international law. Israel is responsible for the escalation of the crisis in the entire region. We call upon the Security Council to shoulder its responsibilities to preserve the city of Jerusalem and the sacred Islamic and Christian monuments and sites there, to stop the aggression that religious people are subjected to in that sacred city and to take action to deter Israel in accordance with international law and the relevant Geneva Conventions. The situation in Syria has reached catastrophic levels because of the violations by the Syrian regime, which even include the use of weapons of mass destruction against its own people.

  48. We reaffirm today, as we have in the past, that the success of any initiative will be based on the sincere willingness of both parties to achieve the goals. We would refer to the unilateral settlement activities of the State of Israel, its efforts to change the demographic nature of the Palestinian territories, the Judaization of East Jerusalem and the blockade imposed on the Gaza Strip. Those actions do not create the conditions necessary for the desired development and progress. We urge the international community to find a solution that establishes an independent State of Palestine, with East Jerusalem as its capital, on the basis of the 1967 borders and a full withdrawal from all occupied territories, including the occupied Syrian Golan and the remaining occupied territories in Lebanon.

I also thank Mr. Feltman for his briefing this morning. The Palestinian question is the central question in the Middle East and will remain a source of concern for the region and the international community until the just solution that is desired by all is found. To that end, the State of Qatar has expressed support for and welcomed the international initiatives to relaunch the peace process on the basis of the well-known terms of reference, which were confirmed by the Arab Peace Initiative and expressed at the recent summit in Doha. Arab countries have taken practical steps to achieve those goals.

Under orders from the regime, acts of physical and psychological violence, rape, sexual violence, degradation and torture have been committed by members ofthe Syrian armed forces against their own families. Those are all war crimes and crimes against humanity. The Syrian regime bears full responsibility for sexual exploitation and trafficking in women; it is a regime that has killed thousands, making women into widows and children into orphans, and displacing people within the country and beyond its borders.
