We note that the report includes improvements, including its recognition of the fact that the United Nations has managed to get humanitarian aid to thousands of people in need in Syria, thanks to the assistance of the Syrian Government and Syrian agencies. However, Syria believes that the current report requires yet further balance and objectivity. In both word and deed, the report should reiterate the commitment to the implementation of the United Nations resolutions, in particularly respect for Syrian sovereignty, and to providing humanitarian aid to those who are in need in Syria, without selectivity or politicization.

The Syrian Arab Republic also rejects the Secretary- General's call for cooperation with the so-called International, Impartial and Independent Mechanism to Assist in the Investigation and Prosecution of Persons Responsible for the Most Serious Crimes under International Law Committed in the Syrian Arab Republic since March 2011, and calls on Member States to read document A/71/799, which contains the text of a letter from our Permanent Mission to the Secretary- General, setting out the serious legal flaws of General Assembly resolution 71/248, which established an illegitimate mechanism that is not recognized by my country's Government or by the Governments of several other Member States.

Moreover, my country's Government calls on those who prepared the report to not simply take stock of the rate of funding but to express clearly and openly that some donors who made pledges are not fulfilling their financial commitments, and that some have imposed political conditions for the funding of international organizations operating in Syria and obstructed the Syrian Government's plans for the rehabilitation of infrastructure and the return of internally displaced persons to their homes once security and stability are restored. In conclusion, the Syrian Arab Republic rejects the call of the Secretary-General for the situation in the Syrian Arab Republic to be referred to the International Criminal Court (ICC). We affirm that the ICC has no jurisdiction over the situation in Syria.

My country's Government also calls on those who prepared the report to be transparent and credible by clear stressing in future reports the deeply negative impacts of the unilateral economic coercive measures imposed on Syria by the United States of America, members of the European Union and other States, which have affected even the activities of the United Nations agencies and foreign non-governmental organizations operating in the country. On the other hand, my country's Government calls on those who wrote the report to be transparent and clear in holding the so-called international coalition led by the United States responsible for the destruction of Raqqa city and the massacres perpetrated by the United States-led coalition in Raqqa city - which was completely destroyed - and other Syrian areas, killing hundreds and destroying many residential areas; and for using internationally prohibited weapons - especially white phosphorous - that constitute illegal war actions tantamount to war crimes, crimes against humanity and violations of international humanitarian law and international human rights law.

Civilians in eastern Ghouta are actually under an internal siege that is being imposed by the various armed organizations present there, which take advantage of civilians and use them as human shields. Those armed organizations seize, monopolize and distribute humanitarian aidto their supporters or sell it at inflated prices to those who need it, as was the case in the neighbourhoods of eastern Aleppo.

My country's Government confirms the need for United Nations personnel in Syria to refrain from dealing with any secessionist entities, illegal so-called local councils or unlicensed civil society organizations. We warn that most of those organizations have close ties, amounting to subservience, to the armed terrorist groups. Moreover, we call on the United Nations and its agencies to stop using the border crossing of Fish Khabur because it is an illegal crossing that is used by certain parties and organizations that enter Syrian territory illicitly. The Syrian Government continues to have grave concern over the persistent use of exaggeration and hyperbole by those writing the reports, their use of the expression "besieged areas" and their inclusion of misleading information about the situation in eastern Ghouta, in rural Damascus.

My country's Government further notes that the border crossings of Bab al-Hawa, Bab Salama and Ar- Ramtha are being used to smuggle arms and equipment to the very same armed terrorist organizations in Syria. We believe that the express desire of the Secretary- General and his aids in Syria to turn over a new leaf of professional work and cooperation with the Syrian Government runs counter to the continued inclusion by the report's writers of baseless claims promoting cross-border aid, tainting the image of the Syrian Government, or even ignoring its efforts, thereby effectively serving the political goals of some States that have a negative influence in the Security Council, including by promoting urgent claims for the renewal of resolution 2165 (2014).

We ask those preparing the report to inform the Member States of the real facts and figures that reflect the tangible progress made in ensuring the delivery of humanitarian access to its eligible beneficiaries, thanks to the efforts of the Syrian Government and its allies to liberate most Syrian territories from abominable terrorism. The Government of Syria regrets the continued insistence of those preparing the report on promoting cross-border aid delivery. We confirm that most of that aid continues to fall into the hands of armed terrorist groups present throughout the targeted areas. How else can we explain the continued suffering of civilians in those regions as a result of terrorists' controlling and seizing the nutritional material and aid that is delivered and then reselling it at exorbitant prices to those who need it?

  11. In that regard, I note the reference in the report to the fact that the United Nations has managed to deliver humanitarian aid to millions of people in need inside Syria. That could not have been achieved without the cooperation, coordination and support of the Syrian Arab Republic and its institutions. On this matter, I remind the members of the Council of the trilateral cooperation mechanism that was established in September, which includes the Syrian Government, the friendly Russian Federation and the United Nations. It has worked effectively and regularly to avoid any gaps and obstacles with a view to facilitating coordination and enhancing humanitarian access, and has achieved positive results of late.

  12. The current report, like its predecessors, continues to suffer from a major flaw. Those preparing it have relied on politicized and other open sources that lack credibility, while continuing to ignore trusted Syrian Government sources. The Syrian Government regrets that the report's writers refer to what they call "administrative impediments and deliberate restrictions" that they claim limit the delivery of humanitarian aid to unstable areas. Despite the fact that armed terrorist groups continue to shell cities in residential areas and to escalate and perpetrate violations in the de-escalation zones, my country's Government offers every possible facility to ensure the delivery of that aid when directed to eligible Syrian citizens and when the necessary and proper arrangements are made according to Syrian laws and regulations.

Furthermore, it should not submit to the pressure being imposed on it by some permanent States members of the Council to use humanitarian file as a tool to exert influence over the Syrian Government. While we note the improvements that it contains, we continue to hope that future reports will reflect the reality on the ground in an objective, transparent and professional manner. In the same vein, my country's Government looks forward to the announced visit by the Under-Secretary- General to Syria in January and will remain open to putting the relationship back on track and bridging the confidence gap resulting from some mistakes made recently by OCHA. We confirm the need for there to be no double standards or politicization in the work of OCHA.

I call on them to lift the economic blockade on the Syrian people and to end air strikes on cities, the destruction of infrastructure and the targeting of civilians under the pretext of combating Da'esh, and to stop making up fictitious stories that are similar to cheap Hollywood movies. I remind the United States representative and her colleague from France that the media in their two countries have questioned the fabricated evidence provided by the two countries on about the situation in Sednaya and Khan Shaykhun, yet no one has questioned the fact that the aircraft of the so-called international coalition kill hundreds of innocent civilians in Syria and Iraq.

The people of Syria continue to be the victims of the lies and hypocrisy within the Security Council espoused by the same group of States that do not wish to see an end to the crisis in Syria but want to continue to manage and invest in terrorism and in armed terrorist groups and impose an economic blockade on the Syrian people. I now address my comments to the representative of the United States, who claimed earlier today that she was speaking on behalf ofa Syrian refugee in Turkey. I speak here on behalf of millions of Syrians inside and outside Syria, who call on the Governments f France, the United States and the United Kingdom and on the Governments of regimes that support terrorism in Syria to stop exploiting the Syrian crisis to achieve their political schemes at the expense of the Syrians' interests.

Fifthly, the authors of the report cite the tragedy of civilians who fled Foah and Kafraya in a narrative way that it is far from describing the scale ofthat crime, despite the fact that the terrorist bombing of their buses in the Rashidin area in Aleppo city on 15 April claimed the lives of dozens of women and children and destroyed dozens of ambulances and buses that could not be replaced due to the economic siege imposed by Governments of certain Member States upon Syria. Sixthly, the report continues to promote cross- border aid, most of which falls into the hands of the terrorist groups that are rampant in the areas, where such aid arrives.

Fourthly, the authors of the report do not address the failures of the Office for the Coordination of Humanitarian Affairs in Syria, which deliberately delays the operations of the convoys, allows the delivery of aid to some zones on a monthly basis to the exclusion of others, and refuses humanitarian access to zones requested by the Syrian Government. Moreover, the Office does not provide accurate numbers of the convoys that are being organized every month in order to underplay the role and efforts of the Syrian Government. Additionally, the Office and the authors of the report purposefully avoid mentioning the joint International Committee of the Red Cross-Syrian Arab Red Crescent convoys, and they include neither the actual numbers of convoys being organised based on prior approvals, nor the number of people benefiting from them.

Thirdly, the Syrian Government rejects the allegations and accusations levelled against it by the authors of the report concerning procedural and logistical measures concerning the delivery of humanitarian aid to unstable zones. We reaffirm that we comply with all agreements on the provision of aid, including medical supplies, to civilians in need. Moreover, we want to ensure accuracy in determining the number of people who receive that aid, and that the supplies do not end up in terrorist hands. Additionally, the Syrian Government has facilitated the delivery of more than 15 humanitarian convoys in April and May, in keeping with the monthly humanitarian convey agreement. We will continue to make efforts to ensure that more convoys can reach those zones.

First of all, my Government again stresses the obligation of the United Nations to coordinate with it, in a spirit of partnership and cooperation, all aspects of the humanitarian efforts with Syria. We must not submit to the political agendas of certain Member States or to the demands and allegations of other actors, which the authors of the report erroneously identify as "local authorities". Secondly, the authors of the report must hold the Al-Nusrah Front terrorist group and its allied armed terrorist groups responsible for blocking humanitarian aid because those groups target peaceful residential areas, block vital roads, besiege several locations and use civilians as human shields.

It is therefore quite odd that the report states that Turkey's closing of the Nusaybin/Qamishli border crossing is but temporary and for security reasons, whereas in fact the closure began in December 2015 and only seeks to increase the suffering of the population of the Hasakah governorate. The Government of Syria has to date provided its people with around 75 per cent of its humanitarian needs. We reaffirm our steadfast policy to ensure the provision of humanitarian aid and to meet the needs of Syrian citizens everywhere, without any discrimination. Thus, we have welcomed the proposal put forward by the United Nations and the Government of Japan to facilitate regular monthly humanitarian convoys. I would also like to make certain observations on the humanitarian situation.

We also regret that the Secretariat continuously promotes the actions of that coalition and deliberately turns a blind eye to the illegal nature of the coalition and the fact that it is violating international law and the Charter of the United Nations. The coalition was not created at the request of the Syrian Government or pursuant to a Security Council resolution. The authors of the report continuously try to justify the aggression of the Turkish military regime - which backs some armed terrorist groups in Syria - against the sovereignty of the Syrian Arab Republic.

The incident in Khan Shaykhun was contrived by terrorist groups, led by the Al-Nusrah Front, with the guidance and support of the Governments of some States, in order for Syria to take the blame for the use of such weapons. The authors of the report insist on remaining silent on the catastrophic consequences of the illegal air strikes carried out by the self-styled international coalition. Those strikes have targeted infrastructure such as dams, bridges, hospitals, schools and oil facilities. Moreover, it is well known in the Council and to world public opinion, that such arbitrary strikes in northern and eastern Syria have claimed dozens of innocent civilian victims.

  25. That does not apply to civilians, of course, who can go back to their daily lives after the armed groups leave. We do not yet know why some senior officials of the Secretariat feel concerned about Syrians regaining their homes, security and normal lives. My Government regrets that the authors of the report have adopted, fully and in a biased way, the American version regarding the use of chemical weapons in Khan Shaykhun. The Government of the Syrian Arab Republic has repeatedly made clear its principled position rejecting the use of chemical weapons or toxic chemicals, which is considered to be a crime against humanity and an immoral, heinous act that cannot be justified in any circumstance for any reason or anywhere. We reiterate that we have not used chemical materials in our war against terrorism.

  26. Those groups sell humanitarian provisions at exorbitant prices in Aleppo, for example. The report uses the term "forced displacement" to describe national reconciliation measures being implemented in large swaths of Syria - a dangerous posture that reflects the positions of Governments that continue to insist on covering for and protecting armed terrorist groups in Syria. Those national reconciliation measures have restored security, stability and normalcy to many Syrian towns and cities. In that regard, we stress that the reconciliation efforts are transparent operations through which the Government offers armed groups the option to lay down their weapons and regularize their status without any legal charges brought against them or they can relocate to another area.

  27. The authors of the report insist on sending political messages adopted by the Governments of certain countries. They accuse the Syrian Government of laying siege to areas of Syria. The entire Syrian people is under siege and exhausted on both the living humanitarian levels, due to the unilateral economic measures imposed by the Governments of certain Member States - led by the United States and the European Union - that shed crocodile tears and bemoan the situation of the Syrian people. As for the areas that the United Nations has classified as under siege, the Organization is operating under erroneous information. Rather, armed terrorist groups that lay siege to those areas use civilians as human shields and deny them the humanitarian aid they are sent.

These Governments - some of which, unfortunately, are permanent members of the Security Council - impose unilateral economic measures against the Syrian people in order to bring pressure to bear on the people by denying them various basic resources necessary for a decent life. In this regard, I note that this morning the Government of my country has addressed two identical letters to the Secretary- General and the President of the Security Council containing its detailed response to the report. The Government of my country finds it strange that the authors of the report, who should focus on humanitarian issues, continue to include issues that have nothing to do with humanitarian affairs and do not reflect the reality on the ground. Allow me to share some key observations of the Syrian Government on some of this erroneous information.

It expresses its concern and regret over the approach of the report's authors, which in many aspects reflects the positions of certain States, parties and Governments that deliberately distort reality and deny the basic causes for the situation and humanitarian crisis in Syria, and the emergence and spread of armed terrorist groups with the support, financing and guidance of known Governments.

Here, I cannot but congratulate Liechtenstein's representative on his country's disgraceful participation in its establishment process, alongsidethe state of Qatar, which supports the terror unleashed in Syria by Jabhat al-Nusra, a group that is on the Security Council's list.

As I have mentioned, the Israeli authorities refuse the requests of the civilians of the Syrian Golan to build a hospital or allow the sick to receive treatment in the hospitals of their home country, Syria. Those whom the Israeli representative referred to as receiving treatment in Israeli hospitals are terrorists from Jabhat al-Nusra and other armed terrorist groups. We have informed the Council repeatedly about their treatment in the occupying Power's hospitals. Israel's role in the Syrian crisis is crystal clear; it provides logistic support to the terrorists in the area of separation, as confirmed in the reports of the United Nations Disengagement Observer Force. When the terrorists, are under increased military pressure, help comes from Israel through air and artillery bombing of the Syrian forces fighting terrorists.

I wish to emphasize the fact that we need to protect civilians, including those civilians who are suffering under the Israeli occupation in the occupied Syrian Golan and the other occupied Arab territories. We must build medical infrastructure for those citizens, owing to the refusal on the part of the occupying Israeli authorities to build a hospital for our citizens living in the occupied Syrian Golan, where they are being cruelly deprived of medical care. What can we call an occupying Power whose Prime Minister visits injured belonging to Jabhat aI-Nusra at Israeli hospitals? Of course, we call it occupying and terrorist Power. Today, the United Nations is in moral crisis and representatives of States are forced to listen to the lies of the representative of the worst occupying Power known to humankind - the Israeli occupation Power.

  34. The Al-Kindi Hospital and the Surgical Ophthalmology Hospital in Aleppo were both renowned institutions of the Middle East. We have heard the lies that have been spread and the manipulations of the truth, such as that some armed terrorists have represented themselves as members of humanitarian and health care organizations. The so-called White Helmets are nothing but a cover for individuals committing terrorist acts with impunity, supported by members of the Security Council. Numerous instances have underscored those lies. For example, I can refer to the medical material found in the warehouses of terrorist groups in east Aleppo. Those are the same terrorists that have come to possess medical materials by depriving civilians who are in great need of such resources.

We are committed to total respect for our citizens' lives and to providing them with basic services, including health, education and social protection, despite the tremendous challenges that we are dealing with. We will spare no effort in upholding and meeting our commitments under international humanitarian law. We have re-established the Syrian Commission for International Law and organized numerous international activities, including training sessions. Armed terrorist groups have invaded and occupied all of the hospitals and clinics in all of the areas of Syria where those groups are present. The hospitals have been turned into military bases and weapons depots or have been demolished. Modern infrastructure has also been destroyed.

How can Saudi Arabia be a member of the Human Rights Council when it is sending billions of dollars to help murder Syrians and destroy our health facilities, which is then being turned into warehouses for terrorists? It is spreading cholera in Yemen and attacking funeral processions, hospitals and other infrastructure mercilessly. How can Qatar preside over the Dialogue Among Civilizations initiative when it publicly supports the Al-Nusra Front, a terrorist organization that continues to commit crime after barbaric crime in Syria, including the destruction of clinics and health centres? The Government of the Syrian Arab Republic has a constitutional duty to protect its civilians.

It is strange to see them continue to take liberties as they accuse others of violating the rules of international law and international humanitarian law, forgetting their own crimes in many parts of the world . How can the United States, the United Kingdom and France claim to respect international law when, as members of illegitimate coalitions, they are attacking other countries and killing their citizens? They infringe on the sovereignty of other States and destroy their health infrastructure with no respect whatsoever for the Charter of the United Nations and the resolutions of the Security Council. They have thus lost all legitimacy and credibility when it comes to making statements on human rights - statements by their representatives that are nothing but lies.

We must avoid selectivity and double standards, and we should not exploit the issue of the protection of civilians in order to breach international law and the selfish agendas of certain States. Indeed, some of the ways in which some States have interfered in the affairs of others have had disastrous results for civilians that are very apparent to us all. The protection of civilians in conflict first requires addressing the underlying and genuine causes of those conflicts, and the growing threat posed by terrorism. Some international parties, however, have shown no willingness to attain that goal but have rather used their economic, political and military might to create new areas of tension around the world, instead of upholding their commitments regarding international peace and security and the eradication of terrorism.

  39. This has happened because these principles are used by some Governments to legitimize hegemonic policies and interfere in other States' internal affairs. I would like to make some remarks on behalf of my country, which for seven years has suffered the scourge international terrorism, which is supported by some of the members of the Security Council and other States. It is States that have the primary and exclusive responsibility to protect their civilians. We cannot deal with the issue of the protection of civilians as a whole without ensuring full respect for international law and the principles of the Charter of the United Nations, particularly those affirming the sovereignty and equality of States and the importance of non-interference in a State's internal affairs.

  40. Mr. Mounzer (Syrian Arab Republic) (spoke in Arabic): We would like to thank the Uruguayan presidency for convening today's important meeting. We have taken due note of the concept note on the protection of civilians and medical care in armed conflict (S/2017/365, annex), including on the implementation of resolution 2286 (2016). In that context, we recall the Preamble to the Charter of the United Nations, which states that the peoples of the United Nations are determined to save succeeding generations from the scourge of war and to reaffirm faith in fundamental human rights and human dignity. Today, however, our world remains incapable of translating those noble purposes and principles into a reality where peace, security and prosperity prevail.

The people responsible for violence directed against Syrian women and girls in Syria, Jordan and Turkey come from the same countries that announce in Security Council meetings that they want to do everything to protect Syrians while giving money, aid and support to terrorist groups and foreign terrorists who come to Syria in order to commit the worst possible acts of violence against Syrians.

We do not know why, but we hope that she will submit concrete proposals aimed at ending sexual violence against women and using her influence with the countries sponsoring armed terrorists, all of which we are familiar with, to put an end to the terrible crimes committed by these terrorist groups. We do not expect her to submit secret reports to the 1267 Committee that only expand her mandate in a way that interferes with countries' internal affairs. We are ready to cooperate with the Office of the Special Representative and to be informed of every name and incident that she has received in order to open investigations and punish the perpetrators of any crimes in a framework of cooperation and dialogue, so that she can fulfil her worthy mandate as effectively as possible.

The report ignores the suffering of the Syrian women and girls living in refugee camps in neighbouring countries, despite the fact that their situation has always been an issue discussed in the previous reports, since it involves violations that have been documented in United Nations resolutions and internationally. We had hoped that the report would mention the flagrant violations that Syrian women in camps in Jordan and Turkey have suffered, particularly the systematic rapes committed by Da'esh bandits who shelter behind a facade of legitimacy. All of this indicates structural gaps. The Government of Syria has already officially submitted and documented all of its structural gaps to the Office of the Special Representative, who has regrettably ignored all its requests.

That is why we once again urge the Office of the Special Representative to shine a light on the fate of hundreds of women and girls who have been abducted by elements of the terrorist group Jaysh Al-Islam to Adha in the suburbs of Damascus and exhibited in iron cages in Douma. We also call on the Special Representative to support the Syrian Government in seeing justice done for the women who have been abducted, enslaved or killed in Latakia, in the north, and those who have been killed in cold blood in Zara and Hama. All those crimes have been reported to the Office of the Special Representative and the Security Council, and we therefore call for more support in investigating what happened to these victims of takfiri terrorism.

  45. In fact, in some of the paragraphs of the report she mentions Syrian women's participation in political life. This leads one to ask why - if the Office of the Special Representative is unable to conduct investigations into sexual violence perpetrated by armed terrorist groups against Syrian women on Syrian territory, which do fall under her mandate - she is going beyond that mandate to discuss other topics, which increase her workload. She is also promoting the non-consensual resolution 71/248, which also goes beyond her remit. Syrians in areas controlled by terrorist armed groups are targets for the worst kinds of sexual violence and slavery. Women and girls have been abducted and forced into marriage with terrorists, including foreigners.

In her secret report submitted to the Committee pursuant to resolutions 1267 (1999), 1989 (2011) and 2253 (2015) concerning ISIL (Da'esh), Al-Qaida and associated individuals, groups, undertakings and entities, the Special Representative gave long, detailed descriptions of the flagrant acts of sexual violence committed by Da'esh, the Al-Nusra Front and their affiliates against Syrian and Iraqi women. In her current report, however, she says that none of those groups have committed flagrant crimes against Syrian women, whether of abduction, rape, violence, torture and the separation of mothers from their children. She confines herself to timid mentions of their restrictions on women's access to work and education. She has gone far outside her remit - identifying acts of sexual violence in conflict.

  47. The Special Representative of the Secretary-General indicated in her report that it was based on the reports of the Independent International Commission of Inquiry. I should reiterate that my country has rejected the work and reports of the Commission since its establishment. Its work has been exceedingly politicized and totally unprofessional. We are therefore concerned about the fact that the Special Representative is basing her points on reports and information from a body that has no credibility or humane principles. She should rather be basing her conclusions on investigations conducted by her own office.

  48. Mr. Mounzer (Syrian Arab Republic) (spoke in Arabic): We are pleased at Uruguay's assumption of the presidency of the Security Council for this month. We have taken note of the report of the Secretary- General under consideration (S/2017/249), which contains information submitted by the Special Representative of the Secretary-General on Sexual Violence in Conflict. While it is true that we support every effort to put an end to all forms of sexual violence in armed conflict and to bring the perpetrators and instigators to account, we believe that at the same time, we should be very cautious and objective in considering this very dangerous humanitarian issue, which has reached alarming levels in several parts of the world. The perpetrators of such crimes must be brought to justice.

  50. The representative of France spoke about exceptions. They are the ones who should not be the exception and should be held accountable for the July 2016 slaughter of more than 200 civilians by their warplanes in Toukhan Al-Kubra, in Rural Aleppo. They and their allies in what is called the "international coalition" should be held accountable for the killing of more than 800 civilians in Syria from late July 2016 to 22 March 2017. They must be held accountable for their support of armed terrorist groups and for providing them with political cover so as to continue their acts of terrorism against my own country.
