“Mr. Wang Min (China) (spoke in Chinese): I would like to thank Ambassador Quinlan for his briefing and commend him for the enormous efforts he has made to push forward the work of the Security Council Committee established pursuant to resolution 1737 (2006) . China has always attached great importance to the work of the Committee and stands ready to work with the Chair in implementing the various activities of the Committee in a balanced, orderly and prudent manner. It has been China's consistent view that all parties are duty-bound to implement the Security Council's resolutions on sanctions against Iran in an accurate, comprehensive and faithful manner. But sanctions are not an end in themselves. The work of both the Committee and the Council is to serve the goal of achieving diplomatic solutions.”

“Efforts to strengthen the rule of law in such countries should take into account the reality and the needs on the ground, so that the building of the rule of law will accord with their national condintions and needs. Fifthly, it is important to properly handle the relationship between keeping peace and seeking judicial justice. Peace and justice are two worthy goals pursued by humankind. They complement and reinforce each other. Achieving judicial justice is not simply a legal issue; it is closely linked to political, economic and cultural factors. The pursuit of judicial justice should be conducive to achieving reconciliation and stability, rather than sacrificing the peace process and undermining national reconciliation in the countries concerned.”

Thirdly, the peaceful settlement of disputes is a necessary component of the rule of law. Resolving disputes through peaceful means represents the basic principle of international law. It is inseparable from building the rule of law at the international level. The peaceful settlement of disputes and the non-use of force are important components of the rule of law at the international level and both constitute core principles of the Charter of the United Nations and the foundation of contemporary international law. They represent international obligations that all countries should honour. Charter VI of the Charter provides for various means to resolve disputes peacefully.”

“Because of the differences in national conditions and levels of development, there is no single universal model for the rule of law for all. At the national level, countries are entitled to independently choose the paths towards the rule of law that suit their national conditions. Countries with different rule-of- law practices should learn from each other and seek common development. To strengthen the rule of law at the international level, it is necessary to strictly abide by the norms of international law. In the conduct of international affairs, it is critical to uphold the purposes and principles of the Charter of the United Nations, adhere to such important principles as the sovereign equality of nations and non-interference in internal affairs, reject power politics and aggression and honour international obligations in good faith.”

The current security situation in Kosovo is generally stable. The implementation of the First Agreement of Principles Governing the Normalization of Relations has made positive progress. “Some of these debates have even exceeded the mandate of the Council and eroded the scope of work of other United Nations bodies. The Security Council and other United Nations bodies have their respective functions and they should use their comparative advantages and expertise and avoid duplication of efforts. Secondly, broad consensus should be reached through full negotiations and patient consultations during the Council's decision-making process. It should be ensured that all members of the Council have sufficient time to study the relevant draft resolutions or draft presidential statements. The Council should avoid forcibly pushing for drafts on which there are major differences of opinion in order to preserve the unity of the Council.”

I would like to make the following points. First, in order to better fulfil its responsibility of maintaining international peace and security, the Council should focus its resources and efforts on dealing with major and pressing issues that are significant for international peace and security. China has always maintained that on the basis of the relevant United Nations resolutions, the principle of land for peace, the Arab Peace Initiative and the road map for peace, as well as through peace talks between Palestine and Israel, an independent State of Palestine must be established with complete sovereignty based on the pre- 1967 border, with East Jerusalem as its capital, whereby the two States, Palestine and Israel, can live side by side in peace and security.”

“In the recent past the international community has made enormous efforts to protect civilians from the scourge of such wars and conflicts, and the Council has adopted numerous resolutions and issued many presidential statements establishing mechanisms and frameworks aimed at effectively protecting civilians in conflicts, particularly women and children. China supports the Council's efforts to conduct in-depth and extensive discussions on the topic of the protection of civilians in armed conflict in order to respond comprehensively to the major challenges to that protection. The United Nations should provide greater assistance to such regional organizations as the AU in personnel training, institution-building, logistical assistance and financial support, so as to strengthen their capacity-building and thereby help them to play an important role in the maintenance of regional peace and stability. “In addition to existing dialogue and consultation mechanisms, flexible and practical collaboration mechanisms should be actively explored with regional organizations according to their institutional structure and functions, with a view to meeting the real needs inherent in a particular situation. Fourthly, the United Nations should strengthen its assistance and support to regional and subregional organizations. Enhancing the capacity of regional organizations to deal with security threats and challenges is an important means of effective conflict prevention. Many regional and subregional organizations, including the African Union (AU), have made major efforts, through good offices, to settle local hotspots, push forward peace processes and promote post-conflict reconstruction, with positive results.”

“Cooperation between the United Nations and regional organizations should help them to maximize their respective advantages, better complement and facilitate one another's work and avoid overlaps and conflict. Thirdly, cooperation between the United Nations and regional organizations should focus on effectiveness and be tailored to the local situation. The United Nations may engage in various forms of pragmatic cooperation with regional organizations, in accordance with their respective characters, in the field of confidence-building measures, good offices and crisis mediation, peacekeeping and peacebuilding.”

“At the same time, the actions taken by regional organizations should be in line with the purposes and principles of the Charter of the United Nations, and any actions taken should be in accordance with the provisions of Security Council resolutions and as mandated by the Council. Secondly, the United Nations and regional organizations can bring into play their respective advantages and complement each other's work in working jointly to meet security threats and challenges. “We support the efforts of the United Nations to deepen its cooperation with regional and subregional organization so as to better fulfil its responsibility for the maintenance of international peace and security. Here I wish to highlight four points. First, in strengthening cooperation between the United Nations and subregional and regional organizations, we must be guided by the Charter of the United Nations. The Council should encourage and support such organizations in the quest to achieve the peaceful resolution of a conflict through dialogue, consultation, good offices and mediation, so as to contribute to regional peace and security.”
