  8. Lip service to peace should never be accepted as a substitute for genuine steps for peace. We are all too aware that the status quo is unsustainable, as we heard from Robert Serry, and that peace negotiations can never succeed under such conditions. The State of Palestine is ready to uphold its obligations and commitments to make peace a reality. However, a real partner for peace is missing. Israel, the occupying Power, must change its behaviour on the ground and in the negotiations and truly commit to the path of peace. Here, the role of the international community, including the Security Council, is vital; it must act collectively to demand and ensure Israel's respect for its legal obligations and to foster the appropriate conditions for credible negotiations to achieve Palestinian-Israeli peace.

  9. Regrettably, up until the present moment that has all been to no avail and our people continue to suffer gravely from the occupation, oppression and dispossession so unjustly inflicted on them. Yet we have not given up on peace. We call on the international community to shoulder its responsibilities at this crucial juncture to make it a reality. Israel, the occupying Power, must be required to comply with the law and must be held accountable should it persist with its blatant violations. The time is past due for Israel to be held to the same rules that all States are obliged to respect, without exception. Especially among the Palestine refugee population, which constitutes the majority of Gaza's residents, that unlawful situation is deepening hardships, with massive socioeconomic and humanitarian consequences. We again call for an end to the Israeli blockade and for the sustained, regular opening of Gaza's border crossings in line with the relevant resolutions. Time and again, we have come before the Security Council and called for action to compel Israel, the occupying Power, to respect its legal obligations, including under the Council's own resolutions. At this critical time, the long-standing international consensus on the parameters of the solution, enshrined in United Nations resolutions, must be reaffirmed, not set aside.

  12. Endangering their own lives, Palestinians held under administrative detention also continue to carry out hunger strikes to protest their imprisonment without charge or trial. We again draw attention to their plight and call on Israel to release the fourth group of Palestinian prisoners and to release all Palestinian prisoners and detainees. Added to all of this is the humanitarian crisis that persists in the Gaza Strip due to Israel's continuing illegal blockade and the gross collective punishment of that area's Palestinian civilian population, along with recurrent violent military attacks. United Nations agencies, including the United Nations Relief and Works Agency for Palestine Refugees in the Near East and the Office for the Coordination of Humanitarian Affairs, continue to highlight the severity of this crisis, but to no avail.

Also over the past months, Israeli settler violence and terrorism has persisted, including attacks on Palestinian school children, farmers and other villagers; the murder of an elderly Palestinian man, Saleh Malihat, who was run over by a settler in a car; and attacks on olive trees and other Palestinian properties by gangs of settlers who continue to act with impunity and with ero accountability for their crimes. Throughout this period, Israel has also continued its non-stop arrest ofPalestinian civilians. More than 4,000 Palestinians have been detained since the negotiations began in July. Human rights violations permeate the entire Israeli prison system, inflicting grave suffering, deplorable conditions and humiliation on the more than 5,000 Palestinians in Israeli captivity, including the 187 children being held in Israeli prisons.

This period also witnessed the continued use of lethal violence by the Israeli occupying forces against the Palestinian civilian population, a population entitled to protection under international law and which the occupying Power is obliged to ensure the well- being of, but instead purposely violates their right to life, targeting Palestinians for death, injury and other forms of harm. More than 60 Palestinians were killed by the occupying forces in the nine-month period of negotiations, most of them in refugee camps. That has included children, among them Wajih Al-Ramahi, 15, Saji Darwish, 18, and Yousef Al-Shawamreh, 15. It has also included violence against women, among them the killing of Amneh Qudeih, age 57, in Gaza.

In that regard, despite the clear global consensus on the matter, in recent months Israeli officials brazenly announced plans to build thousands more settlement units in the very same Palestinian territory from which Israel must withdraw if the illegitimate military occupation is ever to truly end. Israel's own Central Bureau of Statistics revealed a 123 per cent rise in settlement building this year relative to 2013. In just the nine months since negotiations resumed, Israel declared plans to construct more than 13,000 settlement units, in addition to the construction under way on thousands of other units, thereby underscoring its expansionist aims, making a mockery of its alleged commitment to the two-State solution and tarnishing the credibility of the peace process. That important step was followed by the advancement of long-overdue Palestinian reconciliation with the agreement of 23 April. The evolution of the situation has prompted the Palestinian leadership to undertake actions deemed necessary to assert and protect the rights of the State of Palestine and the Palestinian people under international law. All actions have been politically legitimate, non-violent and aimed at realizing the inalienable human rights of our people. In that regard, on 1 April, President Mahmoud Abbas signed 15 instruments of accession to multilateral treaties, affirming the State of Palestine's acceptance of the principles therein, its readiness to uphold legal obligations and its commitment to promoting the right of the Palestinian people in accordance with the law. Moreover, despite the Security Council's paralysis, we have never ceased appealing for collective action to uphold the law, while underscoring the urgency of confronting Israel's widespread violations and threats to the physical viability of the two-State solution. Despite all the difficulties, the Palestinian leadership has remained committed to negotiations and acted in consummate good faith. Regrettably, all of that has been to no avail. The convergence of Israel's bad faith in the negotiations, including reneging on the prisoner release agreement and its unlawful actions on the ground, particularly its intensification of settlement activities and incessant aggression in occupied East Jerusalem, seriously undermined the peace process - now totally suspended - due to Israel's unilateral decision to halt negotiations.

We appealed to the Council and the international community to uphold their responsibilities, stressing the criticality of the hour to salvage the two-State solution on the basis of the pre-1967 borders and the long-standing parameters enshrined in the relevant United Nations resolutions, the Madrid principles, the Arab Peace Initiative and the Quartet road map. In this regard, we welcome initiatives by the European Union and other States to deny any funding to Israeli entities in the occupied Arab territories, and those States, such as South Africa, that have begun labelling Israeli settlement products as such.   34. If we are to succeed in our endeavour of building and institutionalizing a culture of law, we must ensure that the Israeli occupation ends and that the conflict is resolved on the basis of law. In the case of the State of Palestine, the law has, at best, been sidelined and, at worst, transgressed in the most egregious manner. The rights of the Palestine refugees have been ignored. The human rights of the Palestinian people have been systematically violated. The humanitarian rights of the Palestinian people as protected persons continue to be trampled. Their rights under the Charter are perpetually denied, particularly the right to self-determination. It is accurate to say that this is an unprecedented case of lack of rule of law.

That is evident in that Israel, the occupying Power, continues to colonize Palestinian land, carry on with illegal practices and commit war crimes, setting back our development, curtailing our rights and sabotaging the possibility of peace and the credibility of the international legal system. In the case ofthe question of Palestine, the shelving of international law has led only to a chronic failure to achieve peace and the compounding of the conflict and the human suffering it is inflicting. Today's debate concerns a broader theme, and we welcome that; yet it is imperative to be realists, as there is a simple reality: without justice you cannot have peace, and without law you cannot have justice.   36. While we continue to make progress in promoting and strengthening the rule of law nationally, the rule of law internationally continues, regrettably, to founder. This is what the international community, specifically this Council, must address, based on the conviction that the rule of law at the international level is the key to the maintenance of international peace and security, its Charter mandate. We hold that the rule of law is also the key to ending Israel's nearly 47-year military occupation. The challenge for the State of Palestine is that the Council too often protects the powerful and deflects the weak.

  40. The message to Israel must be clear: illegal actions entail consequences, and Israel will be held responsible should its actions lead to the collapse ofpeace efforts and the two-State solution. Once again, before concluding, I must convey our grave concerns about the tragic situation of Palestinian refugees in Syria. As the conflict rages, our refugees, like other civilians in the country, continue to suffer death, injury, destruction and displacement, even including the starvation to death of children, women and men. The plight of thousands of Palestinian refugees trapped in the Yarmouk camp is shocking and inhumane. It is a humanitarian catastrophe.   41. The Palestinian leadership is acutely aware of this moment's significance and, despite the Israeli obstructions, is negotiating in good faith. If the opportunity for peace before us is lost, it will not be for a lack of effort by Palestine or by the international community, including the Arab States, whose historic Peace Initiative stands and is backed by intensive efforts, including the support of the 57 member countries of the Organization of Islamic Cooperation. That is imperative for creating trust and an appropriate environment for negotiating an end to the conflict, whereby the independent, sovereign and contiguous State of Palestine and the State of Israel can coexist in peace and security and just solutions can be reached on all outstanding core issues. A lasting solution must be founded on respect for international law and human rights. Peace and security cannot take root in the absence of those elements, as justice and rights are essential for peace to prevail anywhere. Therefore, in reaffirming Palestine's commitment to a peace based on two States, we reaffirm also our commitment to redressing the injustice borne by our people and fulfilling their national aspirations and rights, including the right to return and the right to self-determination.

But making peace also requires respect for international law and requires a change in mentality, behavior and discourse, consistent with the goals ofthe peace process and essential for preparing the public for new realities. The negotiations cannot be an objective in themselves or be used as cover to perpetuate the status quo. There must be an immediate halt to Israel's settlement activities and its attempts to assert control over more territory, whether in Jerusalem, the Jordan Valley or elsewhere, as well as a halt to the arrest of Palestinian civilians, the demolition of homes and the forced displacement of Palestinian families, and all policies of collective punishment against our people, including in Gaza.

And the Israeli blockade of the Gaza Strip continues to deepen the isolation, poverty and humanitarian hardships of our people, particularly our vulnerable refugees, whose subsistence has been almost totally reliant on the support of the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA). None of that engenders confidence in, or popular backing for, the negotiations. On the contrary, the continuation of Israel's illegal actions and provocative declarations further destabilize the situation and poison the atmosphere, obstructing progress and preventing peace from taking root on the ground and in the hearts and minds of our peoples. Of course, making peace requires negotiations.

  45. Israel is almost daily continuing military raids in Palestinian areas, perpetuating the violent, destructive face of the occupation. Palestinian civilians continue to be killed and injured by the occupying forces. Settler terrorism is rampant. Provocations against Christian and Muslim holy sites, including at Al-Haram Al-Sharif and Al-Aqsa Mosque, in occupied East Jerusalem, persist, inflaming religious sentiments and high tensions. Moreover, despite the welcomed release of long- term Palestinian prisoners, during 2013 alone at least 4,553 Palestinians, including children, were arrested or detained, adding to the ranks of the more than 5,000 Palestinians currently in Israeli jails. Also, Israel demolished at least 200 Palestinian homes in the past year, forcibly displacing hundreds of people.

Mistrust, cynicism and despair are rising among the Palestinian people, as they continue to witness and endure illegal Israeli practices, which, far from bringing an end to the occupation, are further entrenching it, deforming the two-State solution, impeding socioeconomic development, inflicting vast human suffering and diminishing the hopes that the current peace process will lead to the realization of their freedom and rights. Since the resumption of negotiations, Israel has announced plans to construct more than 7,600 settlement units, along with the construction under way on thousands more units throughout the occupied State of Palestine, including in and around East Jerusalem. Israel is also continuing the construction of its wall, destroying the contiguity of our land with such illegal colonization measures.

  47. And, in the immediate present, that is what will foster an environment conducive to credible negotiations, real progress and the ultimate achievement of our collective goals. On our part, the Palestinian Government and people are committed to peace and justice and are exhausting all efforts, conducting ourselves on the basis of international law, the relevant United Nations resolutions, including those of the Council, the well- known parameters of the peace process and the agreements reached from 1993 onwards. We have responsibly participated in all stages, rounds and initiatives of the peace process for more than 20 years, including the current negotiations. And we are doing so on the basis of historic compromise and great sacrifice. Yet the challenges we face on the ground are formidable.

  48. The Security Council has a duty to ensure respect for its resolutions, which form the backbone of a fair and sustainable solution. The welcomed international pledges to support and ensure the implementation of a future peace agreement are surely based on the premise that this will be a lasting peace, not one that does not survive as more than ink on paper. That requires respect for the principles of a just solution of all core issues - refugees, Jerusalem, borders, settlements, security, water and prisoners. It is vital that the international community stand by those principles and persuade Israel, the occupying Power, to respect them. That is what will facilitate a permanent agreement and guarantee its viability.

For decades, time, energy and resources have been heavily invested towards the realization of a two-State solution based on the relevant United Nations resolutions, the Madrid principles, the Arab Peace Initiative and the Quartet road map. Now is the time to follow-through on that investment with political will and courage. The long-standing consensus on the parameters of the solution must be reaffirmed, not set aside - completely ending the Israeli occupation that began in 1967; achieving the independence of the State of Palestine, with East Jerusalem as its capital, living side by side with Israel in peace and security based on the pre-l967 borders; and ensuring a just solution to the Palestine refugee problem based on the relevant resolutions, including General Assembly resolution 194 (III).

  50. It is a conflict that has implications with every leader I have met anywhere in the world as Secretary of State or a Senator. "And President Obama is determined that the United States of America and his Administration will do everything in our power to exhaust the possibilities of finding that peace." We recognize and commend that serious engagement by the international community, and we urge that this support be translated into intensified efforts for the achievement ofajust, lasting and comprehensive peace during this year. As negotiations are ongoing between Palestine and Israel, the international community and the Council have clear responsibilities and cannot remain on the sidelines.
