“As the destruction continues, 350 other Palestinians fear the same loss, in addition to the thousands more Palestinians, especially in occupied East Jerusalem, who are under the threat of pending demolition orders by Israel. For these families, the anguish is immense and the situation disastrous. Their homes have not been taken by an act of nature such as those we sadly witness around the world; rather they have been taken by a deliberate decision by the Israeli Government and its so-called Supreme Court of Justice, which have assumed rights and privileges that the people of Israel are not entitled to in order to strip another people of their legitimate rights, land and property. This is a blatant act of ethnic cleansing and forced transfer; it is tantamount to a war crime and it must be fully condemned and prosecuted as such.”

“Yet, ignoring its legal obligations and the appeals of the United Nations, States and Palestinian, Israeli and international human rights organizations, Israel began yesterday to demolish, as I have mentioned, the homes in Sur Baher. In the early hours of Monday, a large contingent of Israeli soldiers entered the homes of the families residing there and forced them to leave before proceeding to destroy the homes using military bulldozers and massive amounts of dynamite. As I have just shown Council members, the scenes have been shocking and heartbreaking. The families displaced and dispossessed of their properties and life's belongings yesterday include 17 persons, 11 of whom are children. Nine are Palestine refugees who have been traumatized by yet another displacement.”

“I can show Council members a few pictures of yesterday's reality; they depict some of the homes that were destroyed and demolished. In front of these homes, we see their owners watching the demolition by the Israeli occupying authorities, who show complete disregard for the suffering of children who are seeing the furniture of their homes being thrown outside while they are watching their family homes being destroyed and demolished. Such plans and actions, deliberate and systematic in nature, constitute gross violations of United Nations resolutions and the Charter prohibition on acquisition of territory by force, grave breaches of the Fourth Geneva Convention, disrespect for the 2004 International Court of Justice advisory opinion and war crimes pursuant to the Rome Statute of the International Criminal Court (ICC).”

“In clearing the way for a future devoid of values and principles, they not only expose the emptiness of their claims of seeking a peaceful, secure and better future for all, but do a disservice to humankind by setting dangerous precedents with far-reaching implications. All of the foregoing was starkly reflected in the scenes of destruction and injustice witnessed yesterday in occupied Palestine in the Sur Baher neighbourhood of the Wadi Al-Hummus area of Jerusalem, where Israel has issued military orders for the demolition of 10 residential buildings, comprising at least 70 apartments and affecting hundreds of families. Instead of demolishing the illegal wall, Israel is now using the wall as a pretext to demolish Palestinian homes.”

“This is a blatant situation of belligerent colonial foreign occupation, attested to by any measure ofthe law and by the Security Council, the General Assembly, the International Court of Justice, countless regional and global organizations, academia and the international community in its near entirety - and it must be brought to an end. Absent accountability, including for the gravest violations, this foreign occupation is rapidly mutating into apartheid, bringing shame to all who have pledged to never allow such denigration of human beings to occur again. “To Member States contemplating establishing missions in Israel, whether diplomatic, cultural or for trade, and to representatives of Member States undertaking official visits to Israel, that obligation, in accordance with resolution 478 (1980), includes Jerusalem. There are no exceptions. Decisions and declarations signed by others that depart from international law and United Nations resolutions cannot change facts and cannot legitimize what is illegitimate. The Security Council, in resolution 478 (1980), unequivocally deemed Israel's annexation of occupied East Jerusalem to be unlawful, null and void and without legal effect. Likewise, in resolution 497 (1981), it deemed Israel's annexation of the occupied Syrian Golan to be unlawful, null and void and without legal effect.”

“Only accountability can create the necessary pressure to break that toxic cycle in order to finally end the occupation and establish the rights of the Palestinian people - the cornerstone for a peaceful and secure Middle East. The Security Council has been patently clear in that regard. It was explicit in resolution 2334 (2016) in its determination not to recognize any changes to the 1967 borders, including with regard to Jerusalem, other than those agreed to by the parties through negotiations, and it directly called on States to differentiate, in their relevant dealings, between Israel and the territories it has occupied since 1967. “The international community must stop normalizing that occupation and treating it with any deference. It is in every way illegal and must be brought to an end. It is strange that, when it comes to Palestine, calls for action to uphold the law - whether to stop the colonization, provide protection to the occupied people or even do something as simple as ban illegal settlement products - are viewed as delusional rather than as legitimate tools to remedy injustice. That flawed approach has to change. After almost three decades of negotiations and appealing to the occupying Power - from the Madrid Peace Conference and the Oslo process to the Quartet efforts, the Annapolis Conference, the Paris Conference and every other attempt in between - Israel's violations, violence and intransigence have only become more flagrant.”

“The outlook has become even grimmer following Israeli elections that have further entrenched the extreme right to rule Israel as a racist apartheid State under Prime Minister Netanyahu. The absolute support given to Israel by a permanent member of the Security Council has only emboldened its flouting of the law, further fuelling its human rights violations against our people and the colonization of our land. Aided and abetted in its crimes, Israel's expansionist appetite is growing. If the Council is strong enough and powerful enough, it should see if the other side would accept such proposals. By the way, I accept having a discussion without statements, but I do not want it to be behind closed doors. I want the whole world to see the conduct of us all. It must be televised in all corners of the globe. If the idea is not to read statements, I accept it. If the idea is to have a very frank discussion in the Security Council, I accept it but let it be aired to all corners of the globe. Let the whole world see who is trying to work with the Council to open doors for peace and who is obstructionist and trying to block doors for peace.”

Members say that they want to have a special commission or a special body that the Council forms to see who is violating international law, including all the kinds of behaviour that members mentioned, such as rockets. Those are ideas. I hope that my colleagues in the Security Council will consider them seriously so that we do not continue with the eternal cycle of the Council asking us to do something and thinking that we are not doing it and it asking the other side to do something and it is not doing it. Step up to the plate. The Council is an objective party. Whatever decision it takes should be the most objective decision because the Council is responsible for the maintenance of international peace and security.”

At the same time, we must call on the Security Council, which today received the ninth report (S/2019/251) of the Secretary-General on the implementation of resolution 2334 (2016) - in writing, which we welcome - to remain vigilant in also demanding an end to all other illegal Israeli policies and practices in the occupied Palestinian territory, including East Jerusalem.”

“It must demand the occupying Power to respect its legal obligations without exception, including to ensure the safety and welfare of the civilian population under its occupation pursuant to the fourth Geneva Convention and ensure accountability in the case of continued breaches. This is matter of urgency to avert another onslaught and save innocent civilian lives. We urge that the warnings be heeded and call for serious action to prevent further brutality from raining down on our people. We recognize and pay tribute to Egypt and its efforts to secure a ceasefire. “Palestinian families - defenceless children, women and men - are bracing themselves for the prospect of yet another barbaric military aggression by Israel against Gaza, where the population has yet to recover from the lasting impact ofthe destruction and human loss caused by past Israeli wars, and coping capacities have been depleted by the collective punishment of the illegal Israeli blockade and the humanitarian catastrophe that it has deliberately inflicted on them. The Security Council must make its voice heard and act to deter further violence and the escalation of this dangerous situation. The Council is duty-bound to maintain international peace and security and must not turn a blind eye to Israel's violations and acts of aggression.”

“We must once again put on record - contrary to the blatant distortion and deception by Israel - the fact that the Palestinian leadership has repeatedly and unequivocally condemned acts of violence against civilians, including acts of terror. We reject any libellous claims otherwise. We have condemned rocket fire against civilian areas. That cannot be denied. We have stood firmly against terror and have committed to respect international law in that regard without exception, including the Council's demand in resolution 2334 (2016) for the cessation of all acts of violence against civilians, including all acts of terror, as well as provocation, incitement and inflammatory rhetoric.”

“What we are witnessing is pretext after pretext exploited by warmongering Israeli officials - once again in the context of an election campaign - to harm, kill, injure and maim defenceless Palestinians in order to prove their might and bravado and gain a few votes. Just listen to the words of Israeli Government and military leaders themselves as they boast of their intentions to annihilate, punish and devastate Gaza, threaten to bomb the Palestinian people back to the stone age and continue in vying with one another to spill more Palestinian blood. Yet that is met with silence. But one can just imagine the condemnation, shaming and calls for action were such threats and inflammatory rhetoric uttered by anyone else.”

“Nothing under international law - whether international humanitarian law or international human rights law - can ever justify the dehumanization, desperation and devastation imposed upon our people - even the need for security, which is neither mutually exclusive nor zero-sum. “As we approach the one-year anniversary of the Great March of Return, with deep worry about such continued savagery by the Israeli occupying forces, the Security Council cannot ignore the findings of the independent, international commission of inquiry of the Human Rights Council, which, with the exception of one incident on 14 May 2018 and another on 12 October 2018, found reasonable grounds to believe that in all other cases the use of live ammunition by the Israeli forces against demonstrators was unlawful and that demonstrators were shot in violation of their right to life or of the principle of distinction under international humanitarian law.”

Once again, the Israeli occupying forces have taken to the skies to drop bombs and missiles on our defenceless civilian population, terrorizing and traumatizing them in a blatant act of aggression and collective punishment in grave breach of international law. While perhaps the cyclical wars on Gaza have come to be seen by some as the norm, there is nothing normal about imprisoning, isolating and terrorizing 2 million people - more than half of them children and young people - for more than a decade.”

“Time after time, we have called on the Council to uphold its duties under the Charter of the United Nations in order to avert the outbreak of another deadly cycle of violence and to protect innocent civilian lives. We have appealed to the Council to implement its own resolutions with a view to ensuring accountability and salvaging the prospects for peace. Yet all that has been to no avail. The Council has been silenced by the obstruction ofa permanent member, which has, in turn, emboldened Israel, the occupying Power, to persist with total impunity in its systematic acts of violent aggression, incitement, provocation and collective punishment of the Palestinian people and rabid colonization and de facto annexation of our land.”
